Abstract

This study analyzed a reflection on a bibliometric approach to evaluate the importance and impact of the manuscripts that have been published with the title “Law of Maritime Transportation” during the period 1998-2024. It also reveals that the area of Law of maritime documents has received increased attention and interest from academicians, researchers, and research funding institutions. The paper aims to provide a wide range of maritime fields and to offer a representation of various areas and interdisciplinarity research. Furthermore, to find out how they are connected. Bibliometric analyses were used in this study to examine dominant subfields of maritime Law, mapping and clustering the keyword. The tool provided the authors' data, year of publication, country of origin, Journal of publication, and affiliated institutions. The findings show that the manuscripts regarding the legal framework of maritime transportation documents are divided into 6 clusters. The most prominent focus is the Law of the Sea, International Law, and Law of Legislation. The legal framework was an umbrella that covered shipping, maritime transportation, documentary framework, maritime policy, and sustainable development.

Abstract

This study investigates the role of community legal assistance, focusing on free legal clinics and legal socialization initiatives, in supporting the recovery and restoration of rights for women victims of violence in Indonesia’s coastal regions. Employing a qualitative research methodology, the research analyzes field data, organizational reports, statutory frameworks, and direct interviews with stakeholders involved in legal advocacy. Results reveal that socio-legal interventions—especially targeted legal empowerment actions integrating psychosocial support with accessible legal services—have significantly improved women’s legal knowledge and helped many to secure protection orders, initiate police reports, and access community-based support networks. Nonetheless, cultural barriers, limited funding, and geographical constraints remain major challenges. The findings support policy recommendations for sustainable legal outreach in marginalized communities and underscore the importance of multi-sectoral partnerships to ensure effective rights restoration in coastal zones of Indonesia.

Abstract

Personal Data Protection Outreach for Vulnerable Groups in Kampung Inspirasi through a Clinical Legal Approach The rapid advancement of digital technology has significantly increased the risk of personal data misuse, particularly among vulnerable groups such as housewives, children, and the elderly. Limited legal and digital literacy in Desa Cijambe, Bandung Regency, underscores the urgent need for public legal education on personal data protection, especially in the context of Indonesia’s Law Number 27 of 2022 on Personal Data Protection (PDP Law). This community service program aimed to enhance public awareness and understanding of the importance of safeguarding personal data during everyday digital interactions. The program employed a Clinical Legal Education (CLE) approach through student-based learning, interactive workshops, roleplay simulations, and live legal clinics. Evaluation results showed a significant improvement in participants’ comprehension, with average scores increasing from 67.5 (pre-test) to 81.5 (post-test), and learning completion rising from 72.5% to 92.5%. Participants demonstrated active engagement and enthusiasm during discussions and practical sessions. These findings indicate that the CLE method is effective in delivering legal material in a practical and accessible manner. The program not only strengthened participants’ legal literacy but also laid a foundation for the replication of similar outreach activities in other communities.

Abstract

Penelitian ini membahas pembangunan dan perkembangan hukum di Indonesia melalui perspektif teori hukum integratif. Teori ini menekankan pentingnya penggabungan berbagai sumber hukum, yaitu hukum adat, hukum nasional, dan hukum internasional, agar tercipta sistem hukum yang harmonis dan responsif terhadap dinamika sosial budaya masyarakat Indonesia. Fokus kajian diarahkan pada perkembangan hukum sejak era 1970-an hingga periode reformasi dan globalisasi, dengan tujuan menganalisis sejauh mana teori hukum integratif mampu menjelaskan keterkaitan antara hukum formal, nilai sosial, dan budaya masyarakat dalam proses pembangunan hukum nasional. Metode yang digunakan adalah penelitian hukum normatif dengan sifat deskriptif analitis, menggunakan pendekatan yuridis normatif. Teknik pengumpulan data dilakukan melalui studi kepustakaan (library research), sementara analisis data menggunakan metode yuridis kualitatif yang menekankan pada penafsiran hukum dan relevansinya dengan konteks sosial budaya. Hasil kajian menunjukkan bahwa perkembangan hukum Indonesia sejak 1970-an dapat dipahami melalui teori hukum integratif yang menggabungkan aspek hukum formal dengan nilai sosial dan budaya. Meskipun hukum bertujuan untuk mencapai keadilan sosial, masih terdapat permasalahan berupa ketimpangan penegakan hukum, kriminalisasi kebijakan, serta fenomena “no viral, no justice” yang mencerminkan belum optimalnya perlindungan keadilan bagi seluruh warga. Oleh karena itu, diperlukan reformasi struktural, peningkatan kapasitas aparat, dan penerapan prinsip-prinsip hak asasi manusia sebagai fondasi agar pembangunan hukum Indonesia benar-benar mampu mewujudkan keadilan, kepastian, dan kemanfaatan bagi Masyarakat.

Abstract

Maritime law enforcement is an important aspect in maintaining security and sustainability of maritime activities at sea. However, complex challenges such as territorial expansion, increasing illegal activities, and cross-border presence demand the adoption of new technologies in maritime law enforcement. This research examines the importance of digital transformation as an effective solution in increasing the efficiency and effectiveness of maritime law enforcement at sea. This research uses a normative legal approach based on applicable regulations. The research results show that digital transformation has a positive impact on maritime law enforcement at sea. Information system integration enables data exchange between law enforcement agencies, strengthens cross-agency collaboration, and increases operational efficiency. The use of digital technology also makes it possible to detect and deal with illegal activities at sea, such as illegal fishing and smuggling, more effectively. In addition, digital transformation provides a solid foundation for holistic and sustainable maritime policymaking, supporting more effective and sustainable management of marine resources in the long term.

Abstract

The escalating climate crisis has become one of the greatest challenges of this century, having far-reaching negative impacts on the environment, human health, food security, and the global economy. The response to this crisis requires a deep understanding of the dynamics of climate change, as well as comprehensive and collaborative policies and actions at the global level. Therefore, it is important to evaluate and identify effective strategies to mitigate the impacts of climate change and move towards a sustainable future. This research aims to explore comprehensive policy responses and collaborative global action to navigate the climate crisis toward a sustainable future. The research method used is qualitative, by collecting and analyzing data from relevant research results and previous studies. The results of this research found that efforts to overcome the climate crisis require a comprehensive approach, involving strong international cooperation and synergy between development policies. Transitioning to clean energy, sustainable management of natural resources, and increasing community resilience to the impacts of climate change were identified as key strategies. Education and increasing public awareness are also important elements in supporting behavior change and community participation. Technology and innovation play a vital role in creating efficient and sustainable solutions. Finally, adequate funding and innovative funding mechanisms are needed to support the effective implementation of climate policies and initiatives.

Abstract

Sea transportation is inherently exposed to various risks, including vessel damage and marine pollution caused by collisions and accidents. These risks pose significant challenges to carriers, particularly when they fall outside the scope of traditional insurance coverage. To address such gaps, shipowners have established Protection and Indemnity (P&I) Clubs, mutual associations that provide comprehensive coverage for liabilities not covered by conventional underwriters. This study explores the critical role of P&I Clubs in protecting Indonesian carriers, focusing on their rules and operational impact. It also examines the distinctions between P&I Clubs and traditional marine insurance, highlighting their complementary roles. Employing a library research method with a dogmatic legal approach, the study utilizes diverse sources, including international conventions, domestic legislation, case law, legal literature, P&I Club rules, and reputable online resources. The findings reveal that P&I Clubs offer broader and more specialized coverage than standard marine insurance, particularly in addressing pollution-related accidents. For example, P&I Clubs cover the full scope of pollution impacts, providing a level of protection unavailable through other means. The novelty of this research lies in its focused analysis of P&I Club practices in the Indonesian context, offering insights into their unique contributions to maritime risk management. By bridging the gap between legal theory and practical application, this study underscores the urgency of integrating P&I Club mechanisms into Indonesia's maritime industry, contributing to enhanced carrier protection and risk mitigation strategies.

Abstract

This article analyzes the inheritance rights of extramarital children under the post-Constitutional Court decision of Balinese customary law. Any child born of unmarried parents or out of adultery is stigmatized as an extramarital child (walad al zina) for his entire life and forbidden from inheriting an estate from his biological father. This legal issue is chosen as the main subject of this study is because of the legal circumstance in which the Balinese community does not grant status to extramarital children in matters of inheritance from the Purusa line. Hindu-Balinese religious leaders such as Parisada and the Traditional Village Council have never upheld the Constitutional Court’s ruling that states that children born out of wedlock have civil relations with their biological fathers. Islamic religious leaders have followed up on the Constitutional Court’s decision by issuing a fatwa of the Indonesian Ulema Council (MUI). The fatwa imposes an obligation on biological fathers to separate their wealth for a guarantee of life to children. Applying the statutory approach, conceptual approach, sociological approach, and case approach, it can be understood that children born out of wedlock (the Balinese call it begin at children) have no status as heirs in the Purusa line but have inheritance rights from their mother and their mother’s family.

Abstract

Donation-based crowdfunding is now common in many countries in the world. It has been increasingly important, particularly during Covid-19, and is viewed as one of the strategies for addressing financial challenges in some segments of society. Government and non-governmental organizations. However, the scammer activities via crowdfunding are increasing and Malaysian laws are only regulated the Equity Crowdfunding (ECF) and Peer to Peer Financing (P2P) This paper will focus the discussion of Malaysia's legal framework for crowdfunding. The paper investigates the issues surrounding donation-based crowdfunding in Malaysia. This paper employs qualitative methodology and phenomenology as a case design. Data will be gathered from statues, journals, and other written materials. Thematic and content analysis will be used to analyse the data. This paper discovered that there are issues with donation-based crowdfunding conducted by individuals or non-governmental organizations. This paper concludes thatthere is a pressing need to regulate donation-based crowdfunding in Malaysia in order for it to achieve the donor goals and Maqasid Syariah.

Abstract

Malaysia has a dual financial system that includes both conventional banking and Islamic banking. Over time, Islamic banking has evolved to the point where it has enticed traditional banks to offer Shariah-compliant products as well. However, even though conventional banks have provided Shariah-compliant products, the Islamic bank's obligation to provide Islamic banking services remains. The goal of this article is to look at the measures in the Islamic Financial Services Act 2013 that assure Shariah-compliance security for Islamic banks. This paper also investigates the current approach of civil courts in resolving disputes. The qualitative research methodology was used in this paper. The phenomenology method was used in the research design. Data will be gathered from journals, statutes, and case law. The data will be analyzed using the content analysis method. This paper concludes that it is a heavy-duty of every Islamic bank to ensure Shariah compliance security, and the current civil court approach is that the Islamic banking agreement is still enforceable even if it does not comply with Shariah law. Islamic banking agreements that are in accordance with Shariah law or are not perfectly in accordance with Shariah law are both valid and legal
