Abstract

Although marriage dispensation has been widely examined in Islamic family law research, studies specifically analysing judges’ considerations in marriage dispensation cases involving pregnancy outside marriage from the perspective of maṣlaḥah mursalah remain limited, particularly regarding Sawahlunto Religious Court Decision Number 25/Pdt.P/2025/PA.SWL. This study aimed to analyse the judge’s considerations in granting a marriage dispensation application due to pregnancy outside marriage as an urgent reason and to assess the conformity of these considerations with the principle of maṣlaḥah mursalah. This study employed a qualitative approach with a case study design and field research. The research informant was a judge of the Sawahlunto Religious Court selected using purposive sampling. Data were collected through observations, semi-structured interviews, and a documentation study of the court decision and were subsequently analysed through the stages of data reduction, data presentation, and conclusion drawing. The results showed that the judge’s considerations were based on positive law provisions, facts presented during the proceedings, evidence, and the circumstances of the applicants. Pregnancy outside marriage was regarded as an urgent reason to prevent greater harm. From the perspective of maṣlaḥah mursalah, the decision was oriented towards protecting lineage and honour and ensuring legal certainty for the parties. This study confirms that the application of maṣlaḥah mursalah can serve as a substantive basis for considering benefits and preventing harm in marriage dispensation cases. These findings provide a theoretical contribution to the development of Islamic Family Law studies and practical implications for Religious Court judges in formulating legal considerations oriented towards protecting the parties. Future research may conduct comparative studies of marriage dispensation decisions across different Religious Courts.

Abstract

Students in the Cosmetology and Beauty Study Program receive practical makeup training, including traditional West Sumatran bridal makeup, which is presumed to be associated with their confidence in promoting makeup services through social media. This study aimed to analyze the contribution of traditional West Sumatran bridal makeup skills to students’ confidence in promoting makeup services on social media. The study employed a quantitative approach with an ex post facto design. The sample comprised all 80 students from the 2022 cohort, selected using total sampling. Data were collected using a Likert-scale questionnaire and documentation of practical makeup scores. The research instrument was declared valid based on the calculated r-values, which exceeded the critical r-value of 0.361, and reliable, with a Cronbach’s alpha value of 0.928. The descriptive analysis showed that the students’ makeup skills were in the very good category, with a respondent achievement level of 89.62%, while their self-confidence was also in the very good category, with a respondent achievement level of 90.24%. Because the normality test indicated that the data were not normally distributed (p < 0.05), the hypothesis was tested using the nonparametric Spearman’s rho correlation. The results showed a positive, very strong, and significant relationship between makeup skills and students’ self-confidence (ρ = 0.923; p < 0.001); therefore, H0 was rejected and H1 was accepted. The coefficient of determination was 85.2%, while the remaining 14.8% was associated with other variables, such as self-concept, self-esteem, experience, and educational background. These findings confirm that mastery of makeup skills is closely associated with students’ confidence in promoting makeup services on social media and reinforce Bandura’s self-efficacy theory regarding mastery experience as the primary source of self-belief.

Abstract

Although the badantam tradition has become part of the social and cultural life of the community of Korong Pautan Kabau, Nagari Sunua, studies specifically analyzing its implementation and status from the perspective of ‘urf remain limited. This study aimed to analyze the implementation of the badantam tradition in alek perkawinan and to determine its status from the perspective of ‘urf. This study employed a qualitative approach through field research with a descriptive design. Informants were selected purposively and included the Wali Nagari Sunua, the Kepala Mudo or niniak mamak, the Chair of Bamus Nagari Sunua, and customary leaders familiar with the badantam tradition. Data were collected through interviews, observation, and documentation and were subsequently analyzed descriptively using deductive and inductive reasoning and the perspective of ‘urf. The findings showed that badantam was performed after the marriage contract by involving families, relatives, and community members through contributions of money, gold, goods, and labor. This tradition functions to help finance alek perkawinan while strengthening community solidarity and mutual cooperation. From the perspective of ‘urf, the badantam tradition constitutes ‘urf khāṣṣ based on its scope and is categorized as ‘urf ṣaḥīḥ because it has been accepted and practiced repeatedly and promotes public benefit. This study concludes that the badantam tradition can be maintained as a social mechanism for supporting wedding celebrations and strengthening community solidarity. These findings broaden Islamic law scholarship on local customary practices and affirm the importance of preserving the value of mutual cooperation within this tradition while avoiding social pressure that may harm the community.
