Abstract

In this postmodern era, when the boundaries between local and global are increasingly blurred, efforts to build a contextual, ethical, and responsive criminal justice system have become an urgent necessity. This study aims to propose a model of criminal law reform based on maqaṣid al-shari'ah that is more humane and just, emphasizing not only the imposition of sanctions or punishments but also the rehabilitation and restoration of offenders. This study is normative-juridical, employing a doctrinal analysis approach and reinforced by various relevant legal theories to provide a philosophical foundation for evaluating the application of maqaṣid al-shari'ah in contemporary criminal law needs. The results state that the integration of maqaṣid al-shari'ah in criminal law reform in Muslim-majority countries, including Indonesia, should not be viewed merely as a symbolic moderation between religious law and human rights, but as a transformative project that requires epistemological courage to overhaul the classical view of legal authority and the meaning of justice. Amidst the wave of globalization that challenges the supremacy of religious law and demands stronger protection of human dignity, maqaṣid is present not merely as passive theological values, but as active principles that require that law protect life, reason, freedom, and social welfare in concrete and measurable ways. The path toward integrating maqasid-based criminal law principles into the modern criminal legal systems of majority-Muslim countries is not a short-term project, as it requires a paradigm shift from a textualist approach to a contextual approach, from legalism to humanism, and from conservatism to intellectual courage.

Abstract

This study aims to trace the development and characteristics of various shīʿa literature in Indonesia from a historical perspective. This study uses library research, which allows for integrative and connective tracing of various literature as the primary source of data, which is analyzed through a descriptive approach considering historical dimensions. The findings reveal that the existence and development of shīʿa literature in Indonesia are not merely a historical reflection of the diversity of Islamic sects, but also a manifestation of intellectual dynamics that continue to transform within local and global contexts. The shīʿa tradition, which the majority has long overshadowed, has played a vital role in shaping Islamic discourse in Indonesia through institutional contributions, such as educational foundations, publishing, and academic networks spread across various Islamic universities. Amidst stereotypes and narrative challenges, this development reflects an epistemological openness among Indonesian Muslims who are slowly beginning to recognize the importance of inter-sectarian interaction in building a more comprehensive Islamic intellectual horizon. However, limited access to shīʿa literary archives, the dominance of publishing biases, and the lack of representation in mainstream academic discourse serve as reminders that the process of scholarly integration still requires sustainable and inclusive strategies.

Abstract

This study aims to comprehensively explore and understand the role of Islamic philanthropy in handling natural and humanitarian disasters by exploring how Islamic philanthropy, through its instruments such as zakat, infaq, sadaqah, and waqf, can serve as a tool to strengthen community resilience and build social solidarity. This study uses library research with literature analysis techniques carried out integratively and comprehensively to identify and categorize data assisted by various relevant theories. The results state that Islamic philanthropy reflects the values of justice, solidarity, and social care, playing a vital role in disaster management and community recovery through zakat, infaq, sadaqah, and waqf. In the digital era, this philanthropy has the opportunity to pioneer global social empowerment by utilizing technologies such as Islamic crowdfunding and crypto waqf innovations, enabling rapid, widespread, and accountable distribution. However, this great potential must be accompanied by a commitment to ethics, security, and transparency to ensure Islamic philanthropy remains relevant and contributes progressively to sustainable socio-economic resilience.

Abstract

Purpose - This study explores the important role of music in practical implications for the modern Islamic da'wah context. Method - This study uses library research, with integrative and connective literature analysis as the main method, to connect various perspectives from various previous studies. Result  -  Music in Islamic da'wah is not just a means of conveying messages but a transformative force capable of stirring emotions, building deep spiritual bonds, and challenging the traditional boundaries of da'wah. With its ability to trigger emotional feelings, compassion, and spiritual reflection, music can make religious messages more alive and relevant amidst the dynamics of the modern world. Implication – The use of music in conveying Islamic messages through da'wah must consider ethics, content regulations, and understanding of different cultures. In facing this challenge, intercultural collaboration, education, and awareness of the impact of music in a religious context are needed. Originality/Value - Music is not just a medium but a tool capable of helping individuals internalize religious values, facilitating more profound understanding, and stimulating deep spiritual reflection in humans. *** Tujuan - Penelitian ini mengeksplorasi peran penting musik dalam implikasi praktis untuk konteks dakwah Islam modern. Metode - Penelitian ini menggunakan penelitian kepustakaan, dengan analisis literatur integratif dan konektif sebagai metode utama, untuk menghubungkan berbagai perspektif dari berbagai penelitian sebelumnya. Hasil - Musik dalam dakwah Islam bukan hanya sekedar alat penyampai pesan, melainkan sebuah kekuatan transformatif yang mampu menggugah emosi, membangun ikatan spiritual yang mendalam, dan menantang batas-batas tradisional dakwah. Dengan kemampuannya untuk memicu perasaan emosional, kasih sayang, dan refleksi spiritual, musik dapat membuat pesan-pesan agama menjadi lebih hidup dan relevan di tengah dinamika dunia modern. Implikasi - Penggunaan musik dalam menyampaikan pesan-pesan Islam melalui dakwah harus memperhatikan etika, regulasi konten, dan pemahaman terhadap budaya yang berbeda. Dalam menghadapi tantangan ini, kolaborasi antar budaya, pendidikan, dan kesadaran akan dampak musik dalam konteks agama sangat dibutuhkan. Orisinalitas/ Nilai - Musik bukan hanya sekedar media, melainkan alat yang mampu membantu individu untuk menginternalisasi nilai-nilai agama, memfasilitasi pemahaman yang lebih mendalam, dan menstimulasi refleksi spiritual yang dalam pada diri manusia.

Abstract

The modern paradigm of science and technology with various metaphysical and ethically neutral approaches has dragged the millennial generation to the aridity and need for dimensions of thinking, so it is urgent if Pancasila is used as an integrative paradigm in the formation of imagination and creativity to increase self-awareness that the guideline of life in the nation and state in Indonesia is Pancasila. This research uses a qualitative method with a content analysis approach to gathering relevant information related to the topic or problem of this study. The results of this study state the importance of actualizing the values of Pancasila in praxis life because there is constantly changing and renewal in transforming the values of Pancasila into norms and practices of life while maintaining consistency, relevance and contextualization. Pancasila, as an integrative paradigm in the formation of imagination and creativity among the millennial generation in the development of Science and Technology, especially for the life of society, nation and state, is expected to be the basis and roots of scientific development that is adjusted to the cultural values of the Indonesian people so that the development of science and technology does not get out of the values that the Indonesian people have. However, this must also be supported by various competencies that must be honed and cultivated, such as critical thinking, creativity, innovation, communication, and collaboration among the millennial generation.

Abstract

The relationship between religion and the state has always been an actual problem in the discourse of Islamic political thought. This paper aims to describe the relationship between religion and the state in Indonesia with a focus on studying the Islamic political paradigm in the view of Prof. Kamsi, who is one of the professors in the study of Islamic law politics at UIN Sunan Kalijaga Yogyakarta. Then, library research with analytical descriptive nature is used in this research by conducting a descriptive study that aims to provide answers to various problems regarding the state of a particular subject or object in detail. Then, various data that have been obtained are analyzed and interpreted to get an adequate explanatory meaning. Furthermore, this study states that in the view of Prof. Kamsi. In general, the pattern of relations between religion and the state is not just a pattern of dichotomous relations that cancel each other out. However, the relationship between religion and the state must be harmoniously and proportionally established. This is intended so that the thinking process of Muslims will not be disturbed by the development of a country that is pioneering and building a better and functioning state order for the long term.

Abstract

The study investigates the significant impact of identity politics in contemporary Islam on political and social stability, considering the crucial role of media and communication in such dynamics. This study uses a literature study method that involves an integrative and comprehensive analysis of literature to collect, review, and analyze various sources of relevant information. The study results stated that identity politics in contemporary Islam is central to shaping political and social dynamics worldwide. By influencing the perceptions and actions of individuals and groups, identity politics in Islam can significantly impact political and social stability within a country, especially in intergroup tensions. In addition, the role of media and communication has also proved crucial in shaping the image and narrative of Islamic identity politics, both positively and negatively. Therefore, a deep understanding of the complexities of identity politics in Islam and concerted efforts to promote mutual understanding, dialogue, and peace are key to confronting the challenges of identity politics in contemporary Islam.

Abstract

If the arrival of Islam equitably regulates the polygamy procedure, this is the same as the presence of marriage regulations in Indonesia. Law of the Republic of Indonesia Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage is a marriage regulation in Indonesia, one of which aims to provide legal certainty for polygamy in Indonesia. This article examines the Islamic reform in the family sector, especially on the issue of polygamy before Islam, after Islam came, and the rules of polygamy in Indonesia and how they are relevant between Islamic reform in the family sector and the rules of polygamy in Indonesia. Then, the library research is a data collection method used in writing this article with an analytical descriptive nature. Meanwhile, making it as additional knowledge and further reference in studying polygamy and its legal regulations in Indonesia is the goal expected in the preparation of this article. This article concludes that polygamy in Islam and marriage regulations in Indonesia are strictly regulated so that there is no mistreatment of women and try to provide protection and cover discrimination perpetrated by men against women in family life.

Abstract

This study investigates how the concept of nafaqah is interpreted and applied in Muslim societies and how women's financial rights have been recognized and protected within the framework of Islamic law. The study utilizes the library research method as one of the main approaches to collecting relevant data and information from various perspectives and viewpoints. The analysis shows that although the concept of nafaqah is regulated in Islamic teachings, its implementation often does not reflect the principles of gender equality and economic justice. In addition, women's right to financial support is also an integral part of creating gender equality in society. These rights include women's inheritance rights, property ownership, and equal access to economic opportunities. As such, there is a need for concrete measures to strengthen the protection of women's financial rights in Muslim societies. This includes legal reforms recognizing women's economic rights equally, raising public awareness about the importance of gender equality in nafaqah, and promoting harmonization between the concept of nafaqah and women's economic rights.

Abstract

This study aims to illuminate the gap between the idealism of Islamic law and its practical implementation by providing a deep insight into the associated challenges and potential solutions. The focus is on detailing the obstacles and strategies for realizing a dynamic Islamic law that aligns with the demands of contemporary Muslim societies. Employing library research methods, this study conducts an integrative and comprehensive analysis of the literature, summarizes significant information, traces ongoing debates, and formulates well-rounded conclusions. The findings reveal that the pragmatic application of Islamic law requires an inclusive and open approach to universal values and social contexts. Contextual interpretation and an in-depth understanding of Islamic legal texts are crucial for developing implementation strategies relevant to everyday life, considering social, cultural, political, and technological dynamics. Flexibility and responsiveness in interpreting Islamic law are essential to maintaining its relevance and benefits for the Muslim community. Therefore, Muslim countries must adopt a dynamic approach, remain open to change, and focus on the needs of modern Muslim societies. By integrating universal values that correspond with contemporary times, the implementation of Islamic law transcends legal aspects and becomes a vehicle to promote justice and welfare within Muslim communities today.
