Abstract

Human rights which are the natural rights of humans that come from God, have one important part, namely the right to a sense of security. This right is an important part of human rights; therefore this right is regulated in Law No. 39 of 1999, Article 33. In addition to being regulated in law, the right to a sense of security is also considered important in Islam, this can be seen in the hadith qudsi narrated by Imam Muslim no. 467. Departing from the importance of the right to a sense of security, this study was conducted with the aim of the right to a sense of security in the perspective of positive law and hadith, using the literature study method and information collected from various journal articles then studied with a normative-descriptive approach. The results of this study are the harmony between positive law and hadith in viewing the right to a sense of security, where both positive law and hadith consider that the right to a sense of security is an important right to be maintained and respected by all parties.

Abstract

Artikel ini menganalisis konflik antara ojek pangkalan (opang) dan ojek online (ojol) di Bandung melalui pendekatan sosio-legal dan etika hukum Islam, khususnya kaidah hadis la dharara wa la dhirar (“tidak boleh membahayakan diri dan orang lain”). Konflik ini mencerminkan ketimpangan akses terhadap ruang kota serta ketidakhadiran negara dalam menjamin keadilan mobilitas. Penelitian ini menggunakan pendekatan kualitatif melalui studi literatur, observasi, dan penguatan dengan data empiris dari studi sebelumnya. Temuan menunjukkan bahwa konflik tidak hanya berbasis ekonomi, tetapi juga melibatkan perebutan legitimasi ruang dan kuasa sosial informal. Di sisi lain, keberadaan ojol belum diakui sepenuhnya dalam kerangka hukum positif sebagai moda transportasi publik. Dalam konteks ini, kaidah hadis la dharara wa la dhirar Ibnu Majah (2341) dapat menjadi fondasi etik untuk menilai kebijakan dan merumuskan tata kelola transportasi yang berkeadilan. Artikel ini merekomendasikan integrasi prinsip maqāṣid al-sharīʿah dalam perumusan regulasi transportasi berbasis aplikasi sebagai upaya menuju transformasi kebijakan yang adil dan inklusif.

Abstract

Penyerobotan tanah merupakan suatu bentuk pelanggaran hak kepemilikan atas tanah  yang sering terjadi dalam praktik kehidupan bermasyarakat. Artikel ini bertujuan untuk memberikan edukasi dan informasi mengenai aspek hukum perdata dan perspektif syariah berdasarkan hadist riwayat Bukhari terkait dengan penyerobotan tanah. Dengan menggunakan metode deskriptif analisis, penelitian ini mengkaji ketentuan hukum positif Indonesia yang mengatur tentang hak kepemilikan tanah serta prinsip-prinsip keadilan dalam hukum Islam yang melarang keras tindakan penyerobotan. Hasil kajian menunjukkan bahwa dalam hukum perdata, penyerobotan tanah melanggar hak kebendaan dan dapat menimbulkan sanksi ganti rugi maupun pengembalian hak kepada pemilik sah. Sementara dalam perspektif hadist riwayat Bukhari, penyerobotan tanah dikutuk keras dan dijanjikan hukuman berat di akhirat. Nilai penting dari artikel ini terletak pada upaya mengintegrasikan pemahaman hukum positif dengan nilai-nilai keadilan syariah, sehingga memberikan panduan komprehensif bagi masyarakat dalam memahami dan menyikapi kasus penyerobotan tanah secara adil dan bertanggung jawab.

Abstract

This study examines the growing phenomenon of online loans (pinjol) in Indonesia from two different legal perspectives: positive law through Article 1320 of the Civil Code concerning the valid conditions of an agreement, and Islamic law based on the Hadith Narrated by Imam Bukhori No.2085 and Imam Muslim No.1598 concerning the prohibition of usury. Analysis of the validity of online loans according to Article 1320 of the Civil Code shows that many pinjol services fulfill the elements of agreement, ability, and certain things, but often have problems with the elements of a lawful cause, especially related to very high interest. Meanwhile, from the perspective of the hadith narrated by Imam Bukhori and Imam Muslim, the practice of online loans with excessive interest is clearly included in the category of usury which is prohibited in Islam. This study concludes the importance of stricter regulation of online loans to ensure compliance with the legal aspects according to the Civil Code while paying attention to the principles of sharia economics, so that it can protect society from exploitative financial practices that are contrary to legal and religious norms.

Abstract

The principle of justice is a fundamental foundation in legal systems, both in positive law and Islamic law. This article aims to examine the principle of justice as regulated in Law Number 48 of 2009 concerning Judicial Power and the hadith of the Prophet Muhammad (peace be upon him) narrated by Abu Dawud No. 3573. This study uses a normative-comparative approach with qualitative analysis of the legal text and the hadith. The findings show that both legal sources place justice as the central goal of judicial practice. In positive law, justice is supported by legal systems and procedures, while in Islamic law, it is upheld by the moral and spiritual responsibility of the judge. Integrating both perspectives may strengthen the integrity of the Indonesian judicial system

Abstract

This study aims to analyze the role of zakat from an Islamic perspective, with an emphasis on the teachings of the Hadith and applicable legal regulations. The methodology used in this study is a normative legal approach based on religious texts, especially the Hadith of Bukhari Muslim No. 1407, as well as regulations governing the management of zakat, namely Law No. 23 Article 3 of 2011. In addition, this study also examines how zakat can function as a tool to improve community welfare. The results of the study indicate that zakat can have a significant social impact if managed properly, and not simply considered an obligation. This study concludes by emphasizing the importance of collaboration between religious teachings and legal regulations in the management of zakat to achieve broader welfare goals.

Abstract

This study aims to analyze the relevance between Article 8 of the Universal Declaration of Human Rights (UDHR) and the principles of Islamic law in ensuring legal protection for economic actors, as well as to identify points of convergence that can strengthen the national economic legal system to make it more just and humanistic. This article is categorized as library research using a qualitative approach. The methodology applied is a normative-juridical study. Primary data were obtained from the official texts of the UDHR, the Qur’an, Hadith, and literature on fiqh muamalah, while secondary data were derived from books, scholarly journals, and relevant legislation. The findings indicate a substantial alignment between the principle of effective remedy in Article 8 of the UDHR and the values of justice in Islamic law. Both emphasize the state’s responsibility to ensure effective, transparent, and equitable legal protection for every economic actor. Therefore, harmonizing international human rights norms with Islamic law becomes an essential step in realizing a legal protection system that is not merely legalistic but also grounded in universal morality and humanity.

Abstract

This study explores the contribution of Muhammad Mustafa Azami in responding to Orientalist critiques of the authenticity of hadith as a primary source of Islamic teachings. In contemporary Islamic studies, hadith has often been the target of criticism, particularly by Western Orientalists such as Joseph Schacht, who argued that hadith was a fabrication by later Muslim scholars rather than originating from the Prophet Muhammad himself. Such views have undermined the authority of hadith and shifted its central role in Islamic epistemology. Azami, a renowned hadith scholar and academic, systematically refuted these claims through his seminal works, including Studies in Early Hadith Literature and On Schacht’s Origins of Muhammadan Jurisprudence. He challenged the Orientalist methodology and demonstrated that both the isnad (chain of transmission) and matn (content) of hadith were preserved and codified with rigorous scholarly discipline since the earliest generations of Islam. This research employs a qualitative approach using literature review methods to analyze Azami’s arguments. The findings reveal that Azami not only reaffirmed the authenticity of hadith but also strengthened its standing in global academic discourse. His contributions significantly defend the integrity of Islamic scholarly tradition and foster a more balanced dialogue between classical Islamic and contemporary Western approaches.

Abstract

The study of hadith in the Islamic scientific tradition often focuses on the authenticity of sanad and matan, but does not pay attention to the historical context and ethical values contained behind the words and actions of the Prophet Muhammad PBUH. Fazlur Rahman's approach through the concept of Double Movement offers an interpretive framework that combines the understanding of the context of the emergence of the hadith with the withdrawal of universal moral principles that can be applied to contemporary reality. This study aims to analyze the relevance and contribution of this approach in developing a more responsive interpretation of hadith to modern social dynamics. This research uses a qualitative-hermeneutic method with literature study techniques, involving an in-depth analysis of Rahman's primary works as well as relevant hadith literature and contemporary studies. The data was analyzed by tracing the relationship between the hadith texts, their historical context, and the rationalization of moral values produced through the double movement of interpretation. The results of the study show that this approach is effective in bridging the gap between normative texts and the ethical needs of today's society. The double movement approach allows for a more substantive reconstruction of the meaning of the hadith, resulting in an understanding that does not stop at the literal level, but moves towards applicable moral principles. These findings confirm that Rahman's hermeneutic methodology has contributed significantly to the development of contemporary hadith studies, particularly in the context of ethical ijtihad and the renewal of Islamic thought.

Abstract

The development of the Islamic capital market in Indonesia reflects the transformation of Islamic economic practices in response to social, cultural, and modern economic system dynamics. This transformation is not merely related to normative compliance with Sharia principles but also involves social and cultural processes that shape how Muslim communities interpret and engage with contemporary economic activities. This study aims to analyze the transformation of Islamic economic practices within the Indonesian Islamic capital market from sociological and anthropological perspectives. The research employs a qualitative method using a literature review approach, involving an analysis of Islamic economics literature, economic sociology, economic anthropology, as well as regulations and practices governing the Islamic capital market. The findings indicate that the Islamic capital market in Indonesia has evolved as a social institution that internalizes Islamic ethical values within modern market mechanisms, particularly through regulatory frameworks, Sharia-compliant stock screening mechanisms, and financial instrument innovation. From a sociological perspective, the Islamic capital market contributes to the formation of new social norms and social legitimacy in the investment activities of Muslim communities. Meanwhile, from an anthropological perspective, this transformation reflects processes of cultural adaptation and the construction of contextual Islamic economic symbols without detaching from religious identity. This study concludes that the Islamic capital market in Indonesia represents an adaptive and multidimensional transformation of Islamic economics, affirming the continued relevance of Islamic values within modern economic systems.
