Abstract

A foundation as a non-profit legal entity has a vital role in organising social, religious, and humanitarian activities. However, in practice, many foundations are involved in business activities directly and commercially, thus giving rise to legal issues related to violations of the non-profit principle, which is the basis for establishing the foundation. This study aims to analyse the limitations of business activities permitted for foundations according to Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations, and to explain the legal implications for foundations that exceed these provisions. This study uses a qualitative approach with a normative legal research type. The methods used include a statute and conceptual approach, with data sources from laws and regulations, scientific literature, legal documents, and related jurisprudence. The study results indicate that business activities can only be carried out by foundations through capital participation in business entities that are under the intent and purpose of the foundation. Foundations are prohibited from running a business directly and distributing profits to patrons, administrators, and supervisors. Violating these provisions can have legal implications in the form of administrative sanctions up to the foundation's dissolution. Therefore, compliance with legal restrictions is crucial in maintaining the legitimacy and sustainability of the foundation's social function.Keywords: Foundation; Business Activities; Limitations

Abstract

This study discusses the problem of the special inheritance section for heirs with disabilities as a form of legal progressiveness based on affirmative action. The distribution of inheritance based on needs provides a greater sense of justice because it is in line with the principle of proportionality. The purpose of this study is to determine and analyze the distribution of special inheritance for heirs with disabilities as a form of legal progressiveness based on affirmative action. The type of research used is normative juridical with a statute approach and a conceptual approach. The results of this study indicate that legal guarantees for heirs with disabilities are still very weak. However, the absence of the phrase heirs with disabilities and the inheritance section, in particular, indicates that the state does not provide a guarantee for the right to receive an inheritance and inherit. This study provides a solution in the form of regulating a special section for heirs with disabilities as a form of progressive Indonesian law based on affirmative action. The existence of special treatment for vulnerable groups is in line with the mandate of the constitution and the principle of justice of John Rawls in the theory of Justice as Fairness. The government, as a duty bearer, must continue to pay attention to heirs with disabilities by fully guaranteeing constitutional rights.Keywords: Disabled Heirs; Legal Progressiveness; Affirmative Action

Abstract

This study analyzes the executive power of Constitutional Court Decision No. 135/PUU-XXII/2024 in the Indonesian general election system and the legal implications of the lack of legislative follow-up. The study focuses on the decision's final and binding nature, its non-self-executing character, and the role of legislators. This qualitative, normative-juridical research uses legislative, conceptual, and case-based approaches. Data collection was conducted through library research of relevant books, journals, and regulations, analyzed using content analysis. The results show that, despite its final and binding nature, the executive power of the decision does not always take effect immediately when it requires changes to statutory norms. The lack of legislative follow-up to Constitutional Court Decision No. 135/PUU-XXII/2024 creates legal uncertainty, weakens the effectiveness of constitutional supremacy, and has the potential to trigger constitutional issues in the implementation of elections. Therefore, it is necessary to strengthen the design of Constitutional Court decisions to make them more implementable and provide a clear legislative follow-up mechanism to ensure the effective enforcement of decisions within the Indonesian constitutional system.

Abstract

Indonesia's foreign policy remains consistent, adhering to free and active diplomacy principles grounded in Pancasila and the 1945 Constitution. The Indonesian foreign policy is characterized by its autonomy and proactivity, maintaining a neutral stance while consistently adapting to the ever-changing dynamics of world politics. Independently shape perspectives on global issues without being bound by military might or alliances, and actively promote peace, justice, camaraderie, and mutually advantageous collaboration among states. Indonesia continues to regard ASEAN as the primary foundation of its foreign strategy. Hence, this article seeks to elucidate Indonesia's foreign policy towards ASEAN, the collaborative relations between Indonesia and ASEAN member states, and the outcomes of their cooperation in fostering political stability in Southeast Asia. The conclusion asserts that Indonesia's foreign policy remains committed to the principle of free and active engagement with ASEAN and endeavours to uphold the stability of multilateral relations among ASEAN member nations.

Abstract

Indonesia's proactive foreign policy has dramatically impacted the Asia-Pacific Economic Cooperation (APEC) group's (APEC) worldwide relationship. Due to its active foreign policy, Indonesia can make judgments and formulate plans that are in line with its national interests, free from the influence of political blocs that are driven by dominance. Indonesia's aggressive foreign policy has contributed to the country's growing importance outside of APEC. With 21 member nations cooperating to support steady economic growth in Asia-Pacific, APEC has become a prominent participant in the world economy. In addition to its active participation in international financial institutions like the World Bank and Asian Development Bank, Indonesia's active foreign policy has contributed to its status as a significant participant in global monetary and fiscal affairs.

Abstract

Indonesia's foreign policy at the United Nations (UN) General Assembly reflects the complexity of the country's problems and opportunities in global diplomacy. Indonesia, as the world's largest democratic country and with the largest Muslim population, plays a vital role in advocating for peace, justice and sustainable development on the global stage. However, amidst changing geopolitical dynamics, Indonesia faces many obstacles that hamper its capacity to shape international policy. This article will explore sovereignty, territorial integrity, human rights, peace and security, and sustainable development to understand how Indonesia can take advantage of existing opportunities and overcome the obstacles it faces to take a more prominent position in this global forum. This article will comprehensively study the dynamics of Indonesia's foreign policy at the UN.

Abstract

The G20 has emerged as the primary platform for global economic diplomacy, addressing matters about both developed and developing nations. Despite its goal of achieving consensus to foster inclusive and sustainable economic growth, the forum is frequently marked by discord and strain among its participants. This study examines the fluctuating patterns of agreement and disagreement in international economic negotiations within the G20. This article discusses the impact of the G20 in creating global economic policy by analyzing topics such as international trade, global finance, sustainable development, and poverty reduction. It also discusses the obstacles to establishing a consensus acceptable to all G20 members. This study offers a comprehensive analysis of the intricate dynamics inside the G20 conference and their potential impact on the future trajectory of the global economy.

Abstract

Indonesia's Foreign Policy has played an essential role in determining the direction of this country's international relations. One example is the termination of Indonesia's participation in the Inter-Governmental Group on Indonesia (IGGI) in 1992. This study analyses the factors underlying Indonesia's foreign policy decision to terminate the IGGI. Using a historical approach and foreign policy analysis, this research highlights the political, economic and strategic factors influencing these policies. The results show that Indonesia's termination of the IGGI was a response to regional and global political dynamics at the time and shifts in Indonesia's foreign policy priorities. The implications of terminating the IGGI on Indonesia's bilateral relations with donor countries and Indonesia's domestic political dynamics are also debated in this analysis. This study provides important insights into the relationship between Indonesian foreign policy and regional political dynamics in the past and its relevance in the current context of Indonesian foreign policy.

Abstract

Indonesia is a significant producer and exporter of oil, a commodity that plays a vital role in the economy of the entire world. Within the scope of this study, the dynamics of Indonesia's oil exports and imports, as well as its membership status in OPEC, are investigated. To have a better understanding of the influence that Indonesia's membership in OPEC has had on the country's economy and the role that Indonesia plays in the global oil market, a detailed examination of Indonesia's oil trade data is utilised. The findings of this study have the potential to offer significant insights that Indonesia can use in its economic strategy and its connection with international oil organisations.

The Quran offers a thorough and inclusive explanation of justice language, encompassing individual and social dimensions. This essay seeks to examine the terminology of justice found in the Quran and its potential application within constitutional Law. Amidst the growing trend of globalization, it is crucial to comprehensively comprehend how the principles of justice outlined in the Quran can be effectively incorporated into constitutional legislation. This essay emphasizes the significance of incorporating Islamic principles into constitutional Law to establish a fair and enduring society.
