Abstract

This essay examines the role of the constitution as a fundamental element in forming a democratic and just state based on law. In the philosophical dimension, the constitution is seen not only as a legal document but also as a reflection of fundamental values that reflect the identity of a nation, such as justice, freedom, and respect for human rights. This essay explains that a state based on law prioritises the supremacy of law, where all government actions must be based on the law, not the power of specific individuals or groups. According to legal philosophy, an ideal constitution must regulate the separation of powers, checks and balances mechanisms, and protection of citizens' rights. This essay also discusses the challenges that arise if a country does not have a strong constitution, which has the potential to cause legal uncertainty and political instability, and provides recommendations for strengthening the constitution in building a just state based on law.

Abstract

This essay discusses how the constitution manifests the values of political philosophy that underlie a country. The constitution functions as the highest legal document and reflects the ideals of politics, justice, and ideal governance. However, in its implementation, the country often faces a dilemma between the perfect norms of the constitution and the existing social, political, and economic realities. This essay examines various foundations—philosophical, sociological, and legal—that strengthen the constitution as a reflection of the values of political philosophy. In addition, it also discusses the debate on the flexibility of the constitution and the challenges in balancing local and universal values. Finally, this essay offers ideal recommendations so that the constitution remains relevant, can accommodate the dynamics of society, and functions as the central pillar of a democratic state.

Abstract

This essay discusses the nature of justice in constitutional philosophy as an effort to achieve a balance between individual rights and collective interests. Justice is not a static concept, but continues to evolve along with social and political changes. This essay explains several strategic steps to uphold constitutional justice, including equitable legal reform, strengthening judicial institutions, increasing access to justice, and implementing a multidisciplinary approach in public policy. The state can create a more inclusive and bias-free legal system by understanding justice from a philosophical, sociological, and legal perspective. The active involvement of various stakeholders is key to realising real justice. Thus, this essay emphasises that justice must be realised in normative concepts and sustainable policy practices.

Abstract

This essay discusses the close relationship between the constitution, democracy, and law in realising a sovereign state based on the rule of law. This essay highlights the role of the constitution as the primary foundation that regulates the division of power, individual rights, and governance mechanisms in a democratic system. In this context, popular sovereignty is a fundamental principle that requires the people to actively form and supervise legal policies. This essay explains that the law must reflect the people's will, guarantee justice, and ensure social welfare through a transparent and accountable process. In addition, enforcing the law based on the people's sovereignty requires a fair and participatory system, which allows every individual to participate in legal decision-making. This essay concludes by emphasising that a healthy relationship between the constitution, democracy, and law is the key to creating a just and sovereign state, where the law serves social justice for all people.

Abstract

This essay discusses constitutional change from the perspective of legal philosophy, focusing on philosophical, sociological, and legal aspects. Constitutional change is considered essential to maintain the relevance of a country's fundamental law. This essay reviews the debate between rigid and living constitutions, reflecting the tension between legal stability and flexibility. From the perspective of legal philosophy, constitutional change is analysed through the concepts of justice, utilitarianism, and social contract theory, which emphasise that change must create justice and reflect social consensus. Sociologically, this essay highlights factors such as demographic changes, developments in social values, and interest group pressures that drive constitutional change. From a legal perspective, this essay emphasises the importance of a legitimate amendment procedure to maintain legitimacy. Overall, this essay suggests that constitutional change should be carried out carefully to remain relevant to the dynamics of society without damaging the legal order.

Abstract

The constitution is the highest fundamental law and is the main instrument in protecting human rights (HAM). This essay discusses the importance of the constitution in guaranteeing individual freedom and balancing state interests with citizen rights. However, implementing human rights in the constitution often faces a dilemma, especially when national interests clash with personal liberty. With a strong philosophical, sociological, and legal foundation, the constitution can effectively ensure justice and freedom for all. In addition, strengthening legal mechanisms, socialising human rights, harmonising with international standards, and increasing community participation are strategic steps to make the constitution the main pillar in enforcing human rights. Thus, the constitution is not only a legal text, but also a dynamic and adaptive tool for protecting rights to the development of the times.

Abstract

Industrial relations disputes (Perselisihan Hubungan Industrial (PHI)) are essential to examine because these disputes represent unbalanced bargaining positions between workers and corporations. On the other hand, there are many PHI documents, so they need to be classified and distinguished from other types of other decisions for other types of civil cases. PHI decisions document can be accessed openly from a special directory of civil courts. This ruling has similarities with other decisions regarding consumer protection or bankruptcy. This study used 450 documents consisting of 255 PHI court decisions and 255 non-PHI court decisions. This study takes the case as a classified part. We use several feature extractions and three methods: Support Vector Machine (SVM), Extreme Gradient Boosting (XGBoost), and Bidirectional Long Short-Term Memory (Bi-LSTM). For SVM and XGBoost classifier, we utilize Frequency-inverse document frequency (TF-IDF). Another classifier needs word embedding Glove Wikipedia Indonesian with a dimension size of 50. Various experiments conducted found that the best classification results used Bi-LSTM with Gloves. This classification has 100% accuracy without overfitting. We found the second result using XGBoost with parameters optimized using random search, while the lowest accuracy results were obtained using the SVM method. The accuracy of the classification results in this study can impact the availability and quality of open legal knowledge that can be utilized by society and for future research.

Abstract

In the financial sectors, fraud has become a world phenomenon, ranging from fraudulent financial reports, assets misappropriation and corruption. These three types of fraud are practices carried out deliberately against the law which harm many parties. This study aims to analyze fraudulent financial reporting, where the presentation of misstatements is presented to mislead financial reports. These are against the ethical perspective of Islamic law as stated in the Quran and Hadith. This research uses secondary data based on the principles of sharia accounting concepts and Islamic ethics. The analytical method used is a qualitative description method with literary and normative approaches by examining fraudulent financial reporting from the perspective of Islamic law. The results of this study strengthen the theory of fraud pentagon with the symptoms and red flags of fraud, namely pressure, opportunity, rationalization, competence, and arrogance of the perpetrators of fraud. The Quran as well as the hadith emphasize the values of honesty, justice, truth, responsibility, and belief in reporting. This research also overlooks the weak ethics of the accounting profession and also the value of religiosity held by weak accountants from the perspectives of Islam. AbstrakPada sektor keuangan, fraud (kecurangan) menjadi salah satu fenomena global, dengan kasus kecurangan laporan keuangan, penyelewengan aset dan korupsi. Ketiga bentuk kecurangan tersebut merupakan praktek yang dilakukan secara sengaja melawan hukum dan merugikan banyak pihak. Penelitian ini bertujuan untuk menganalisis kecurangan pelaporan keuangan, dimana informasi yang disajikan dalam laporan adalah hal yang tidak sesuai dengan kenyataan. Hal ini bertentangan dengan etika hukum Islam dalam Al-Qur'an dan Hadits. Penelitian ini adalah menggunakan data sekunder dengan mendasarkan pada prinsip-prinsip akuntansi syariah dan etika Islam. Metode analisis yang digunakan adalah metode deskripsikualitatif dengan pendekatan literatur dan kajian normatif. Hal ini dilakukan dengan memeriksa kecurangan pelaporan keuangan dari perspektif hukum Islam. Hasil dari penelitian ini memperkuat teori Fraud Pentagon tentang gejala dan Red Flag Fraud, yang terdiri dari tekanan, peluang, rasionalisasi, kompetensi, dan arogansi para pelaku penipuan. Hal ini bertentangan dengan prinsip hukum Islam yang menekankan pada nilai-nilai kejujuran, keadilan, kebenaran, tanggung jawab, dan kepercayaan dalam pelaporan. Penelitian ini juga menunjukkan lemahnya prinsip etis dalam profesi akuntansi dan jugai religiusitas yang dimiliki oleh akuntan.

Abstract

Damage will hit the people of a country when corruption has become a culture. However, religion as a way of life for the people is able to contribute to dampening this culture of corruption, so that it can save people from the destruction of their culture of life. The method used in this study is a qualitative method with a literate approach. The results of the study stated that religion greatly contributed to reducing the culture of corruption. However, there are still challenges for religion to be able to contribute to reducing the culture of corruption, including the limited involvement of religious leaders in political issues, religious differences, lack of coordination between religious institutions and the government, cultural and social environmental factors, lack of supervision and strict law enforcement. In addition, there are limitations of religious leaders in their mastery of general science and technology.Keywords: Corruption Culture; Religion; Contribution

Abstract

The election of regional heads (Pilkada) in Indonesia, which is regulated in Article 18 Paragraph (4) of the 1945 Constitution, has important implications in realizing the principles of democracy and regional autonomy. This article emphasizes that regional heads are elected directly by the people. This study aims to analyze the legal politics contained in Article 18 Paragraph (4) of the 1945 Constitution related to the election of democratic regional heads. Using a normative analysis approach, this study explores the relationship between the principles of democracy, decentralization, and the implementation of regional autonomy in the context of the Regional Elections. The results of the study show that although Article 18 Paragraph (4) provides a constitutional basis for direct regional elections, it also does not rule out the possibility that the election of regional heads through the Regional Representative Council (DPRD) both at the provincial and city district levels, its implementation still faces challenges in terms of the quality of democracy, local political influence, and imbalance between the central and regional governments. The study also identifies the importance of reforms to realize effective decentralization and better quality democracy at the regional level.
