Abstract

The amendment to the Criminal Code  is a significant phenomenon in the dynamics of criminal law in Indonesia. The amendment to the law has led to updates and even created new articles for various criminal acts in Indonesia. One of the new articles that emerged in the amendment is the emergence of an article prohibiting the spread of Communism/Marxism-Leninism in Indonesia in articles 188-189, but on the other hand, Article 188 paragraph 6 contains an exception (Criminal Exception) to study these ideologies for scientific purposes. From this, this study aims to discuss the legal limitations of the study of these ideologies in the scientific sphere so that they are not misused by related parties. This study concludes that the limitation on the permissibility of studying Communism/Marxism-Leninism for scientific purposes is as long as the activity does not include the dissemination or propaganda of these ideologies.

Abstract

Modernity has brought significant changes in social, cultural, and legal structures in various parts of the world, including in multicultural societies. One of the main challenges that arise is the conflict of values in the application of customary criminal law. Customary criminal law, which has long been an integral part of traditional people's lives, now faces pressure from a modern legal system that tends to be universal and based on human rights. This study aims to analyze the dilemmas arising from the tension between the two legal systems, focusing on how customary criminal law is applied in a multicultural society, where diverse cultural and religious values often clash. In this context, the application of customary criminal law often faces challenges in maintaining a balance between maintaining local values and accommodating the principles of modernity, such as gender equality, individual rights, and social justice. This research suggests the need for a more inclusive and dialogical approach between customary law and state law in order to create a legal system that is responsive to cultural diversity, without neglecting the basic principles of human rights.

Abstract

The election of regional heads (Pilkada) in Indonesia, which is regulated in Article 18 Paragraph (4) of the 1945 Constitution, has important implications in realizing the principles of democracy and regional autonomy. This article emphasizes that regional heads are elected directly by the people. This study aims to analyze the legal politics contained in Article 18 Paragraph (4) of the 1945 Constitution related to the election of democratic regional heads. Using a normative analysis approach, this study explores the relationship between the principles of democracy, decentralization, and the implementation of regional autonomy in the context of the Regional Elections. The results of the study show that although Article 18 Paragraph (4) provides a constitutional basis for direct regional elections, it also does not rule out the possibility that the election of regional heads through the Regional Representative Council (DPRD) both at the provincial and city district levels, its implementation still faces challenges in terms of the quality of democracy, local political influence, and imbalance between the central and regional governments. The study also identifies the importance of reforms to realize effective decentralization and better quality democracy at the regional level.

Abstract

The solution household crisis provided by the wife and accepted by the husband is known as a khulu' in Islamic law. This study examines the legal protection for a wife if the surrender of khulu' is determined and investigated. As well as the relationship between the provisions and the concept of khulu' with the position of women in marriage law which is sourced from the Compilation of Islamic Law related to Marriage Law.. It was decided to apply the research method of normative juridical research in conjunction with a statutory approach. The findings of this study indicate surrender of khulu' to the husband to divorce himself from the marriage bond is accompanied by the payment of 'iwadh', namely the payment of money or goods to the husband from the wife's side as a reward, divorce as a form of legal protection for the wife. The text states that 'iwadh is a system of legal protection given by the state to the wife who proposes khulu'.

Abstract

This article objective to examine the monikah indigenous traditions for Kasimbar Tajio ethnic communities in Central Sulawesi. Qualitative method used in this research, data collection techniques of observation, interviews and document tracking non-structure. Technical analysis of data through data reduction, display data, verification data to generate conclusions and findings of the research results. Conclusion The study found that first; monikah custom comes from acculturation Mandar and Tajio ethnic culture in the tradition of marriage, second; monikah custom implementation of social value that affects personality Tajio ethnic communities in maintaining the values of brotherhood, family, respect for elders, unity and cooperation, maintain the pattern of interpersonal communication that is based on mutual respect in maintaining a harmonious relationship between human beings. third; monikah indigenous religious value that affects Islamic personality in performing worship to Allah (God), tawadhu’ attitude, moral education, purity and purification of the soul, ta’aruf and silaturrahmi.
