Abstract

Many groups are calling to apply the Islamic values. Both in social issues, economy, country and politics. But they are not able to create a balancing of the values of Islam itself. Because in general, they actually limit the scope of women's movement. They do not give chance to women to participate in the world holding the reins of supreme leadership.If the excuse put forward is that Islamic values can be applied in general, why not give the right to limit even to women? In fact Islam devoted to men and women.However, when the raging spirit has been created, the power has been awakened, when the women had to roll up his sleeves to participate in social, political and matters relating to life, why the sudden sheet of voiced speech with a loud "O woman returned to the house each of you ", an appeal which it seems so unfair to discredit. Therefore, re-examine the traditions that are considered to discredit the woman, for Hadith Prophet Muhammad saw. ill only textually but also interpreted in context is the right thing to do.

Abstract

Abortion is not just a medical problem or public health, but also the social problems that arise because people follow the Western civilization. But the solution must be comprehensive, fundamental, radical, which is essentially the attitude” taqlid” to revoke the West with all the values and institutions of the West in conflict with Islam, and then replaced with the Islamic civilization is humane and fair. For women, abortion is a very frightening because it related to someone living dead. However, under certain conditions, women in a dilemma, love or grief? Continue to maintain trust God, or must be prepared to suffer? Islam is a religion of peace. He attended a reference to human safety. For that reason, Islam Syariat also very flexible and supple. Syariat Islam does not necessarily proscribe something that God has forbidden on certain conditions, but will still refer to the social conditions that encompass these problems.

Abstract

The analysis of wording (lafaz) in Islamic legal texts occupies a central position in the methodology of Islamic jurisprudence, particularly in the process of legal derivation (istinbāṭ al-ḥukm). Explicit textual meaning (dalālat al-manṭūq) represents the most direct form of legal indication and functions as a primary reference before engaging implicit meanings or analogical reasoning. However, contemporary legal discussions often reveal inconsistencies in understanding the scope and authority of explicit meaning, leading to divergent legal conclusions. This article examines the forms and classifications of dalālat al-manṭūq and analyzes their implications for legal reasoning within the framework of uṣūl al-fiqh. Employing a qualitative descriptive-analytical approach, the discussion is grounded in a critical review of classical and contemporary uṣūl al-fiqh literature. The findings demonstrate that dalālat al-manṭūq al-ṣarīḥ holds strong legal authority due to its clarity and minimal interpretative ambiguity, while dalālat al-manṭūq ghayr al-ṣarīḥ, although still authoritative, requires careful contextual and linguistic analysis. The study highlights the continuing relevance of precise textual interpretation in responding to modern legal challenges and emphasizes that methodological rigor in understanding explicit meaning is essential to ensure legal rulings remain aligned with the objectives of Islamic law (maqāṣid al-sharīʿah).
