Abstract

This study aims to identify and analyze criminal responsibility for administering drugs that cause acute kidney problems in children. As well as knowing and analyzing law enforcement against Pharmaceutical Companies Regarding Contamination of Syrup Drugs. This research is a type of normative research. So that it can be seen that criminal responsibility for administering drugs that result in acute kidney disorders in children must be fully responsible. Especially companies that produce drugs that ultimately cause acute kidney problems in children. In addition, the Food and Drug Supervisory Agency (BPOM) as the drug and food supervisory agency has the right to recommend that law enforcement be carried out against pharmaceutical companies related to drug syrup contamination, strict action must be taken.

Abstract

This study aims to find out and analyze the position of the buzzer who spreads hoaxes in the perspective of positive law. As well as knowing and analyzing criminal responsibility for spreading fake news by buzzers. This research is a type of normative research. So it can be seen that the threat of punishment that haunted the buzzers spreading hoaxes in the 2019 elections in the Criminal Code is regulated in several articles. The articles in question are Articles 137, 207, 208 paragraph 1, and Article 310 paragraphs 1 and 2. And for stakeholders who order such action from the buzzers, they are threatened with punishment as stipulated in Article 55 paragraph 1 and Article 56 paragraph 1 and 2.

Abstract

Kemampuuan berpikir kritis adalah keterampilan untuk menyelesaikan secara sistematis, logis sehingga dalam mengambil kesimpulan di dasari oleh data yang ada. Keterampilan menganalisis informasi, mengevaluasi argument, dan membuat keputusan berdasarkan fakta yang ada. Penelitian ini bertujuan untuk mendeskripsikan kesulitan kemampuan berpikir kritis siswa. Metode penelitian yang digunakan adalah deskriptif kualitatif dengan Teknik pengumpulan data melalui tes tertulis dan wawancara. Tes tertulis digunakan untuk mengetahui kesulitan siswa dalam menyelesaikan permasalahan sedangkan wawancara digunakan untuk menggali informasi secara mendalam untuk mengetahui informasi berkaitan dengan penyelesaian permasalahan. Subjek penelitian ini adalah siswa kelas VIII SMP Muhammadiyah Larangan. Materi yang digunakan adalah persamaan garis lurus. Analisis data dilakukan dengan triangulasi yaitu membandingkan data dari sumber (tes tertulis dan wawancara). Hasil penelitian menunjukan bahwa: 1) siswa kategori tinggi tidak mengalami kesulitan dalam menyelesaikan permasalahan yaitu menginterpretasi, menganalisis, melakukan pemecahan masalah, dan melakukan evaluasi akan tetapi siswa mengalami kesulitan dalam melakukan inferensi atau menarik kesimpulan; 2) siswa kategori sedang tidak mengalami kesulitan dalam melakukan interpretasi, analisis, pemecahan masalah akan tetapi siswa mengalami kesulitan dalam mengalukan evaluasi dan inferensi. 3) siswa kategori rendah mengalami kesulitan dalam menyelesaikan permasalahan karena siswa mengalami kesulitan dalam menginterpretasi, menganalisis, memecahkan masalah, melakukan evaluasi dan menarik kesimpulan dalam menyelesaikan permasalahan. Berdasarkan hasil penelitian menunjukan bahwa siswa belum terbiasa menyelesaikan soal kontekstual sehingga siswa perlu dibiasakan untuk mengerjakan soal soal kontekstual agar tidak mengalami kesulitan dalam berpikir kritis.

Abstract

Critical thinking skills are very important and closely related to how students manage their learning process independently. The purpose of this study is to analyze the ability to think critically on opportunity materials reviewed from self-regulated learning in junior high school students in grade IX. The method used is qualitative with a descriptive approach. The research was carried out at Putra Harapan Boarding School Purwokerto with the research subject grade IX students. The research instruments used were in the form of essay questions designed based on indicators of critical thinking ability and self-regulated learning (SRL) questionnaires. Based on the students, they are grouped into high, medium, and low categories. Respondents were taken one student from each category by purposive sampling. Data analysis includes reduction, data presentation, and Conclusions. The results of the study were that students in the high SRL category met the achievement of correct and complete critical thinking skills. Students in the SRL category are meeting the critical thinking indicators appropriately but need to emphasize the aspect of argument analysis. In contrast, low SRL students cannot achieve complete critical thinking skills.

Abstract

Penelitian ini bertujuan untuk mengkaji berbagai publikasi yang membahas pengembangan instrumen penilaian berbasis Pendidikan Matematika Realistik (PMR) dalam rangka mengukur kemampuan siswa dalam menyelesaikan masalah. Latar belakang penelitian ini menekankan pentingnya menghubungkan permasalahan matematika dengan situasi dunia nyata agar siswa dapat memahami nilai dan relevansi konsep yang dipelajari. Metode yang digunakan berupa tinjauan literatur, dengan menganalisis berbagai sumber seperti jurnal, buku, dan laporan penelitian yang diterbitkan antara tahun 2020 hingga 2024, yang relevan dengan pengembangan perangkat tes berbasis PMR. Penelitian ini merangkum berbagai komponen penting yang perlu dipertimbangkan dalam penyusunan instrumen tes PMR, serta mendiskusikan manfaat dan tantangan penerapannya dalam pembelajaran matematika. Hasil penelitian mengungkapkan bahwa instrumen penilaian berbasis PMR mampu mengevaluasi keterampilan pemecahan masalah siswa secara lebih kontekstual dan aplikatif, sehingga membantu siswa mengaitkan matematika dengan situasi dalam kehidupan nyata. Secara praktis, kajian ini memberikan wawasan yang dapat digunakan untuk penyusunan instrumen tes berbasis PMR di masa mendatang, serta penerapan pendekatan ini dalam evaluasi pembelajaran matematika. Rekomendasi dari hasil kajian ini berfokus pada pentingnya penyusunan instrumen tes yang relevan dan kontekstual, serta tantangan yang perlu diperhatikan dalam penerapannya.

Abstract

The integration of Cobb's social constructivism, Polya's problem-solving strategy, and Zahorik's contextual learning is a mathematics learning approach that emphasizes student activity, social interaction, and the connection between abstract concepts and real-life experiences. Through discussion, group work, and negotiation of meaning, students collaboratively build mathematical understanding so that they not only memorize procedures but also understand the reasoning behind problem solving. Polya's stages help students think systematically in understanding problems, planning strategies, implementing solutions, and reviewing results, which trains reflective and critical thinking skills. Contextual learning makes mathematics more meaningful and relevant to everyday life, increases motivation to learn, and facilitates the transfer of knowledge to new situations. This integrated approach has the potential to develop problem-solving and higher-level mathematical thinking skills, while creating a collaborative and supportive classroom atmosphere, which requires teachers to be adaptive, reflective, and flexible in their application of the curriculum.

Abstract

This study analyzes Decision Number 257/Pid.B/2023/PN Rhl as a case study to unveil the law enforcement paradox regarding illegal lottery schemes. This case employed a hybrid modus operandi combining conventional methods and electronic means. This research employs a normative-empirical juridical method, drawing on statutory, conceptual, and case study approaches. The objective is to dissect the inconsistency in the application of legal instruments and the sociological impact of the verdict. The findings reveal that the Public Prosecutor and the Panel of Judges tended to be pragmatic by applying Article 303 section (1) point 1 of the Penal Code. They disregarded the fact of electronic means usage, which should have been subject to the principle of lex specialis derogat legi generali under Law Number 11 of 2008. This reduces the potential for the impoverishment of perpetrators through maximum fines. Furthermore, the 8 (eight) month prison sentence without a fine against a Defendant who made gambling his livelihood proved ineffective as a deterrent. Such punishment did not address the perpetrator’s root economic motives. Sociologically, this decision reflects structural inequality in law enforcement, with a sharp downward bias against small retailers and a blunt upward bias against major bookies. This condition implies the normalization of gambling as a community economic alternative. This study recommends integrating a more progressive criminal policy, utilizing digital forensics, and revitalizing customary law to comprehensively eradicate the gambling ecosystem.

Abstract

Criminal law enforcement in cases of collective violence frequently encounters challenges in determining the proportionality of punishment. This challenge arises primarily when Public Prosecutors submit uniform sentencing demands for all defendants without dissecting their respective gradations of culpability. This research aims to analyze the urgency of applying the principle of individualized punishment to correct uniform demands in participation (deelneming) cases. Furthermore, this study evaluates the judicial ratio decidendi in imposing sentencing disparities to achieve substantive justice. This study is a normative-juridical legal research employing a case approach toward Decision Number 103/Pid.Sus/2020/PN Sbh. The results indicate a significant asymmetry in factual roles among the defendants. The initiator of the violence possessed a more dominant causal contribution toward the death of the child victim compared to other participating perpetrators. The Judges performed a judicial correction by handing down a verdict exceeding the demand (ultra petita) in favor of the initiator and a conforming verdict in favor of the follower. This sentencing disparity is not assessed as a form of inconsistency; rather, it constitutes a manifestation of proportional justice oriented toward child victim protection (victim-oriented justice). This research concludes that, in participation offenses resulting in fatalities, justice does not lie in equal sentencing, but in the precision of imposing sanctions commensurate with the gravity of the perpetrator’s role and fault.

Abstract

The striking disparity between the Defendant’s resistance and the judge’s mitigating considerations in an oral defamation case constitutes a juridical anomaly. This condition fundamentally undermines legal certainty and the victim’s sense of justice. This research conducts a juridical review of Decision Number 64/Pid.B/2020/PN Amp. In said decision, the judge imposed a conditional sentence (probation) on a Defendant who, based on the evidence, was found to have refused to apologize to the victim. This research aims to analyze the evidentiary legal aspects in the fulfillment of the objective and subjective elements of the offense, as well as to test the validity of applying the conditional criminal sanction based on trial facts. The research method applied is normative legal research with a case approach and a statute approach to dissect the coherence between facts and norms. The results reveal a dualism in the quality of law enforcement. At the stage of proving guilt, the Panel of Judges successfully proved all elements of Article 310 section (1) of the Penal Code precisely based on valid evidence under Article 184 of the Criminal Procedure Code. However, at the sentencing stage, the application of Article 14a of the Penal Code involves a serious internal logical defect (an internal contradiction). The material requirement of “behavioral prognosis” was based on assumptions of imaginary remorse and is opposed to the trial facts demonstrating a high degree of defiance. In conclusion, this decision contains an inconsistency in proving the subjective requirement, implying a high risk of supervision execution failure as stipulated in Article 276 of the Criminal Procedure Code. The research recommends the necessity for objectivity in remorse indicators within sentencing guidelines to prevent veiled impunity and maintain judicial authority.

Abstract

This study aims to critically examine the relationship between mathematics and tawhid (Islamic monotheism) and to explore how fundamental mathematical concepts can serve as a means of internalizing aqidah within the framework of Islamic education. This research employs a qualitative descriptive approach through a systematic literature review. Data sources consist of relevant journal articles, academic books, and conference proceedings published within the last ten years that discuss the integration of mathematics, Islamic values, and tawhid. The collected literature was analyzed thematically to identify patterns, concepts, and theoretical perspectives regarding the relationship between mathematical structures and monotheistic principles. The findings indicate that mathematical concepts such as numbers, patterns, logical consistency, order, and symmetry reflect the principles of divine unity, harmony, and precision inherent in tawhid. These concepts can be interpreted as manifestations of Allah’s order (sunnatullah), thereby positioning mathematics as not merely a computational tool but also a medium for strengthening students’ spiritual awareness and religious character, including honesty, discipline, and accuracy.
