Abstract

This research is a qualitative research with a descriptive approach, namely describing the position of Online Petitions in the legal order in Indonesia and also describing its position in the legal order in European countries. The data used in this research is secondary data that researchers obtained from scientific articles, books, statutory regulations, magazines and credible websites that are commonly used and become references in each research. The data used was analyzed using descriptive and comparative legal analysis techniques, namely first describing the position of online petitions in Indonesian legal matters and then comparing them with various European countries. The result in this research show that that the regulation of online petitions in Indonesia is not very detailed and roams freely. This means that online petitions that have been filled in in large numbers exceeding the threshold in countries such as the UK and the United States which must be answered by the government, do not have to be answered in Indonesia. Online petitions are a form of product of freedom of expression from democracy. On the one hand, researchers believe that more specific arrangements for handling online petitions such as the United States and England also need to be implemented in Indonesia. However, on the other hand, this is not really necessary due to the responsive nature of the Indonesian government in answering the big questions on the minds of the public. Apart from that, these big questions are more often discussed through various talk shows, whether via digital television, print media, Instagram, YouTube and other platforms. For these various reasons, researchers believe that further regulation regarding online petitions is not really necessary in Indonesia. In fact, researchers are of the opinion that making a case go viral on social media without packaging it in the form of a petition is more effective than organizing the online petition itself.

Abstract

Abstract Legal disputes must still be resolved, even though there is a void in legal institutions, this is intended to guarantee a person's legal rights, including in this case Military Administrative Disputes. This study aims to find out and analyze: (1) How is the current settlement of military administrative disputes (2) How is the legal certainty of military administrative dispute cases (3) How is the legal protection of the rights of soldiers in military administrative dispute.The approach method used is normative juridical, namely discussing the doctrines or principles in the science of law, especially laws and regulations with positive regulations as a touchstone. The data source uses secondary data from library materials in the form of primary legal materials, collected through literature studies, document studies and interviews. Empirical qualitative data analysis and problems were analyzed with Legal Protection Theory and Legal Certainty Theory.Based on the results of the research, it was concluded: (1) Military Administrative Dispute Settlement cannot currently be carried out due to the absence of a legal institution governing the Military Administrative Procedure Law as stipulated in Article 353 of Law Number 31 of 1997 concerning Military Justice. (2) As a result of the existence of a void in the legal framework governing the military administrative procedure law, the parties, especially soldiers whose rights have been harmed as a result of the issuance of a military administration decision, do not have legal certainty. (3) Legal Protection of Soldiers' Rights in Military Administrative Disputes during a period of legal vacuum is carried out through a restorative justice mechanism or settlement outside the Court (non-litigation) by filing a lawsuit against a superior who is higher than the superior who issued the Military Administrative Decree, in addition also by encouraging the Government to immediately issue a regulation on the Military Administrative Court Procedure Law.Keywords : Soldier’s Rights, Military Administrative Disputes, Legal Vacuum AbstrakSengketa hukum tetap harus diselesaikan, meskipun terdapat kekosongan pranata hukum hal ini dimaksudkan  untuk menjamin hak hukum seseorang, termasuk  dalam hal ini  adalah  Sengketa Tata Usaha Militer. Penelitian ini bertujuan untuk mengetahui dan menganalisis : (1) Bagaimana Penyelesaian Sengketa Tata Usaha Militer saat ini (2) Bagaimana Kepastian Hukum Perkara Sengketa Tata Usaha Militer (3) Bagaimana Perlindungan Hukum Hak Prajurit Dalam Sengketa Tata Usaha Militer.Metode pendekatan yang digunakan yuridis normatif, yaitu membahas doktrin-doktrin atau asas-asas dalam ilmu hukum khususnya peraturan perundang undangan dengan peraturan positif sebagai batu ujinya. Sumber data menggunakan data sekunder dari bahan pustaka berupa bahan hukum primer,  dikumpulkan melalui studi pustaka, studi dokumen dan wawancara.  Analisis data secara kualitatif empiris dan permasalahan dianalisis dengan Teori Perlindungan Hukum dan Teori Kepastian Hukum.Berdasarkan hasil penelitian disimpulkan : (1) Penyelesaian Sengketa Tata Usaha Militer saat ini tidak dapat dilaksanakan akibat belum adanya pranata hukum yang mengatur tentang Hukum Acara Tata Usaha Militer sebagaimana diatur dalam Pasal 353 Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer. (2) Akibat Terjadinya Kekosongan Pranata Hukum yang mengatur Hukum Acara Tata Usaha Militer maka Para Pihak khususnya para prajurit yang haknya dirugikan akibat dikeluarkannya Keputusan Tata Usaha Militer tidak mendapatkan kepastian hukum. (3)  Perlindungan Hukum Hak Prajurit Dalam Sengketa Tata Usaha Militer selama masa kekosongan hukum dilakukan melalui mekanisme restorative justice atau penyelesaian di luar Pengadilan (non litigasi) dengan  mengajukan gugatan kepada Atasan yang lebih tinggi dari Atasan yang mengeluarkan Keputusan Tata Usaha Militer tersebut, selain itu juga dengan mendorong kepada Pemerintah untuk segera mengeluarkan regulasi tentang Hukum Acara Peradilan Tata Usaha Militer.Kata Kunci : Hak Prajurit, Sengketa Tata Usaha Militer, Kekosongan Hukum

Abstract

This study examines the ambiguity of legal norms related to industrial relations in the context of force majeure during the Covid-19 pandemic. The main focus is on the provisions of Law Number 13 of 2003 concerning Manpower and Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation, which regulates termination of employment (PHK) and force majeure conditions. It was found that force majeure provisions that have not undergone changes or revisions in the latest law have caused legal uncertainty, allowing employers to carry out unilateral layoffs without the obligation to pay severance pay. This ambiguity of norms results in violations of the principles of legality, legal certainty, and utility, and has a negative impact on labor protection, especially in crisis situations such as the pandemic.

Abstract

This research aims to increase the accuracy of vote predictions in the Quick Count process in the 2024 Governor Election using the XGBoost algorithm. Quick Count is a fast method for obtaining estimates of election results based on some of the data that has been calculated. The XGBoost algorithm was chosen because it has proven effective in various applications, including predictive modeling. This research analyzes the implementation of the XGBoost algorithm in modeling vote predictions for Quick Count, especially in the context of the 2024 gubernatorial election. By using various evaluation metrics such as accuracy, precision, recall, and F1-score, this research provides a comprehensive understanding of the performance of the XGBoost model. The research results show that the XGBoost algorithm achieves high accuracy, precision, recall, and F1 score, demonstrating its ability to classify sounds accurately. The practical implications of this research are significant in improving the integrity of the democratic process by providing more reliable and transparent election results. Additionally, this research paves the way for developing more sophisticated Quick Count methods by leveraging insights from previous research on machine learning techniques and data security.

Abstract

Bankruptcy is a legal process in which the assets of an insolvent debtor are managed and settled by a curator under the supervision of a judge. This research discusses the legal certainty for workers when the company goes bankrupt, as well as the legal protection for their rights. It employs normative legal research methods and qualitative analysis of secondary data, which includes primary, secondary, and tertiary legal materials. The results of this study indicate that workers' rights must be prioritized in cases of company bankruptcy, in accordance with Constitutional Court Decision No. 67/PUU-XI/2013. In such instances, unpaid workers' wages must take precedence over other creditors, including the state and government agencies. Curators play an important role in protecting workers' rights during the insolvency process, and workers have the right to sue if their rights are not met.

Abstract

Community empowerment assistance is an important strategy in developing a sustainable and inclusive village economy, where village communities can obtain greater economic benefits and improve their quality of life. This assistance aims to help rural communities develop their area's economic potential to increase the community's income and welfare. The method used in this community service is Community Based Research (CBR) using the Forum Group Discussion (FGD) approach in training and mentoring. The result of this service is that community empowerment assistance can be an effective strategy for improving the village economy. Assistance can be obtained by applying various relevant theories, such as community empowerment, local economic development, social entrepreneurship, and sustainable development. In practice, community empowerment assistance must be carried out in a participatory manner by involving village communities in planning and developing businesses that benefit them.

Abstract

General elections in Indonesia are a democratic mechanism to determine leaders who are expected to have legitimacy, namely recognition and support from the voting public at large. To achieve this, Indonesia needs an electoral system that is effective and in accordance with the country's conditions. Elections in this country have been regulated through the 1945 Constitution and are conducted through direct and representative election methods. There were variations in the electoral system before and after the 1945 constitutional amendment was made. This electoral system is set up to ensure that the voting process is conducted directly, publicly, freely, confidentially, honestly, and fairly. However, the implementation of the current electoral system shows some shortcomings that require improvement to ensure better elections in the future.

Abstract

Prinsip Umum Good Governance dapat menjadi suatu gugatan dalam Pengadilan Tata Usaha Negara, walaupun dapat dikatakan masih bersifat yuridis dan belum formal. Berdasarkan pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009 tentang Peradilan Tata Usaha Negara, PUGG dapat dijadikan dasar untuk mencari keadilan bagi masyarakat yang dirugikan dengan Keputusan Hakim PTUN yang sama sekali tidak mengacu pada PUGG dalam membuat keputusan atau peraturan yang diterapkan dalam kehidupan bermasyarakat. Bagaimana penerapan dan fungsi yang seharusnya diperankan PUGG dalam putusan dan bentuk logika hukum dari sisi hakim PTUN? Surat Keputusan Direktur Jendral AHU Kementerian Hukum dan Asasi Manusia Republik Indonesia No.AHU-001313.AH,01.04 Tahun 2020 tentang Pengesahan Pendirian Badan Hukum Masjid Agung Sunan Ampel Soerabaja yang menjadi sengketa antara Pengurus Yayasan Masjid Agung Sunan Ampel Soerabaja dan Pengurus Yayasan Makam Sunan Ampel di PUTN,d an telah diputus oleh hakim PTUN dengan Putusan No 06/ G/ 2017/ PTUN.DPS dapat disimpulkan bahwa : 1). Penerapan atau fungsi PUGG sudah berjalan melihat dari sisi logika majelis hakim dalam menerapkan PUGG untuk memutus suatu sengketa, 2) Hakim sudah bertindak aktif dalam mencari sebab dan apa yang menjadi perkara dengan menerapkan PUGG dalam suatu pertimbangan untuk memutus sengketa yang terjadi, tanpa melupakan freies emerssen yang dapat digunakan oleh pemerintah dalam membuat suatu keputusan yang berlaku bagi masyarakat.

Abstract

This study employs a normative legal research approach focusing on conceptual and legislative analysis. Its aim is to examine the dynamics of the enforcement of the electoral organizers’ code of ethics by the Indonesian Election Supervisory Agency (DKPP) and to formulate a reconstruction of this enforcement aimed at achieving substantive justice. The findings assert that the enforcement dynamics of the electoral organizers’ code of ethics by DKPP inherently pose two main issues. Internally, the enforcement requires oversight and public participation to ensure DKPP’s credibility and integrity in upholding the code of ethics. Externally, issues arise regarding the final and binding nature of DKPP decisions, which have been undermined by Constitutional Court rulings, allowing for their annulment by judicial bodies such as the Administrative Court (PTUN). Reconstruction or reform efforts concerning the enforcement of the electoral code of ethics for electoral administrators, based on substantive justice, necessitate a clear affirmation of the independence of ethical norms, particularly those related to the conduct of electoral administrators. This includes ensuring that the enforcement of these ethical norms is immune from legal norms and external intervention. Additionally, there is a need for a revision of the electoral laws in Indonesia to enhance the appeal process for ethical judgments rendered by the Election Supervisory Board (DKPP), which are final and binding and cannot be overturned by the courts, especially the Administrative Court (PTUN).

This scholarly exploration navigates the intricate terrain of autonomous vehicles, tracing their evolution from a technological marvel to a catalyst for profound changes in legal frameworks, regulations, and societal dynamics. Our journey begins by delving into the technological foundations and significant achievements that underpin autonomous vehicle development. This illuminates the complex algorithms, sensor arrays, and machine-learning capabilities driving these self-driving vehicles. Transitioning from technology, we delve into the intricate realm of law and regulation, where established norms of road safety, liability, and privacy intersect with autonomy's transformative potential. This paper scrutinizes the intricate network of legal frameworks and ethical considerations governing the testing, deployment, and daily operation of autonomous cars. With their integration into transportation systems gaining prominence, balancing innovation with regulation assumes critical importance. This study embraces technology, law, and regulation, aiming to understand the multifaceted dimensions arising when autonomous cars intersect with legal and ethical frameworks. We explore the dynamic nature of global regulatory paradigms, analyzing obstacles, achievements, and ethical dilemmas shaping progress.
