Abstract

BMT services that are still manual cause customers difficulties in transactions, information services and consultations as a result of ineffective services. The development of BMT has succeeded in becoming a reliable microfinance institution, expected to be a substitute for loan sharking practices that are considered detrimental to MSMEs in prolonged debt. The problem in this service is that BMT services are still manual, causing customers difficulty to transact and the lack of information obtained. The service method carried out is training which aims to provide training to Gampong apparatus and Gampong Panggoi BMT administrators in terms of online-based BMT management to make it easier to transact and get wide information. As a result of this training, Gampong Panggoi has been able to manage BMT Babul Huda Panggoi online. This online management has been able to run information systems and services using technology by not ruling out sharia aspects and safeguarding customer data and applying the precautionary principle.

Abstract

The government is working on Indonesian Sustainable Palm Oil Plantations by issuing various regulations, both through the Presidential Regulation of the Republic of Indonesia Number 44 of 2020 concerning the Certification System for Indonesian Sustainable Palm Oil Plantations, as well as through the Regulation of the Minister of Agriculture Number 38 of 2020 concerning Implementation of Plantation Certification Indonesian Sustainable Palm Oil so that the oil palm plantation business obtains results that are economically feasible, socio-culturally feasible and environmentally friendly and increase the competitiveness of industrial palm oil products for the international market. The study method is normative juridical. In this study, an approach is used by identifying research objects and a statute approach. Based on the results of the study, the Government of Indonesia continues to make efforts for oil palm plantation companies to carry out ISPO certification. The government also issued various regulations to accelerate ISPO certification. It is suggested to the government continue to make efforts and be serious about accelerating ISPO certification by implementing various regulations that have been issued, including the Regulation of the Minister of Agriculture of the Republic of Indonesia Number 18 of 2021 concerning the Facilitation of Development of Community Gardens in Surroundings, in addition to issuing the Regulation of the Minister of Agriculture of the Republic of Indonesia Number 03 of the Year 2022 concerning Development of Human Resources, Research, and Development, Rejuvenation, as well as Facilities and Infrastructure for Oil Palm Plantations and several regions a Team for the Acceleration and Supervision of ISPO certification has been formed so that it has an impact on the country's economic growth.

Abstract

This study examines the existence and effectiveness of the Sharia Court of Lhokseumawe’s rulings on post-divorce child support obligations through a normative-empirical legal research approach. Normatively, the analysis draws on Law No. 1 of 1974 on Marriage, the Compilation of Islamic Law (KHI), and Law No. 35 of 2014 on Child Protection, while empirically it relies on case studies of court decisions and interviews with judges. The findings reveal that the court consistently upholds the father’s responsibility to provide child support after divorce, reflecting alignment with statutory provisions, Islamic principles, and the doctrine of the best interests of the child. However, variations in the determination of support amounts and weak enforcement mechanisms demonstrate a gap between “law in the books” and “law in action.” Sociological analysis further shows that ineffective enforcement disproportionately burdens women and children, exacerbating economic vulnerability and the feminization of poverty. The study concludes that while the normative foundation of child support rulings is strong, their practical effectiveness requires improvements in drafting quality, standardized guidelines, and enforcement mechanisms, alongside greater collaboration between the judiciary, government, and society to ensure substantive justice and child welfare.

Abstract

General background: Peatland ecosystems such as Paya Nie hold strategic ecological and socio-economic value as carbon sinks, biodiversity habitats, and community livelihood sources. Specific background: Despite these roles, Paya Nie faces degradation due to land conversion and weak enforcement of conservation norms. Customary law historically guided sustainable use, but its oral nature and reliance on social sanctions reduce its effectiveness in the face of modernization. Knowledge gap: Previous studies have emphasized either the ecological or legal dimensions but have rarely examined the synergy of customary law, social capital, and national law in peatland governance. Aims: This study employs a normative juridical method enriched with a socio-legal perspective to analyze the position of customary law in Indonesia’s legal system and its integration with social capital for ecological sustainability. Results: Findings confirm that while customary law is constitutionally recognized, its enforcement is limited, requiring revitalization through codification, strengthened social capital, and harmonization with national regulations. Novelty: The study introduces a governance model that integrates customary law, social capital, and state law as a synergistic framework for sustainable peatland management. Implications: This model contributes theoretically to socio-legal discourse and practically to policymaking, offering adaptive, participatory, and sustainable solutions for environmental conservation and community empowerment. Highlights: Integration of customary law, social capital, and national law strengthens peatland management. Codification and formal recognition enhance the enforcement of customary norms. Abstract

This study examines the professional liability of notaries for drafting Sale and Purchase Binding Agreements (PPJB) in Indonesia, which serve as preliminary contracts when a Sale and Purchase Deed (AJB) cannot yet be executed, but often give rise to legal disputes. Such disputes commonly stem from negligence in verifying the object's legality, weak application of the precautionary principle, and partiality toward one party. Using normative legal research, this study analyses primary, secondary, and tertiary legal materials using descriptive and analytical methods, drawing on statutory, conceptual, and case approaches. The findings show that notaries' professional liability in PPJB transactions rests on five core elements: compliance with positive law, application of the precautionary principle, neutrality, protection of the parties' interests, and observance of professional ethics. Establishing a causal link between notarial acts or omissions and parties' losses requires an integrated evidentiary approach that combines factual and juridical causation, particularly the doctrines of conditio sine qua non and adequate cause. Sanctions must be imposed proportionately, taking into account the degree of fault, the nature of the violation, and its impact, ranging from administrative and ethical sanctions to civil and criminal liability. The novelty of this research lies in formulating an integrative and systematic framework that connects notarial professional standards, causation doctrines, and proportional sanctions within PPJB disputes. This framework clarifies notarial accountability and strengthens preventive legal practice nationwide.

Abstract

Pendidikan Khusus Profesi Advokat (PKPA) merupakan amanat dari Undang-undang Nomor 18 Tahun 2003 tentang Advokat (UU Advokat). Pendidikan khusus ini merupakan suatu bentuk pendidikan yang harus diikuti oleh seseorang yang berijazah sarjana berlatar belakang pendidikan tinggi hukum. Pendidikan PKPA ini mempunyai relefansi dengan Undang-undang Sistem Pendidikan Nasional (Sisdiknas) yang didalamnya dinyatakan bahwa jenis Pendidikan terdiri dari pendidikan umum, kejuruan, profesi, vokasi, kegamaan dan khusus. Kegiatan pengabdian ini bertujuan melahirkan para profesi advokat yang handal, madiri, dan bertanggung jawab sehingga mampu tampil sebagai penegak keadilan dalam penyelenggaraan peradilan yang jujur, adil dan sesuai dengan tujuan hukum yakni, keadilan hukum, kemanfaatan hukum dan kepastian hukum bagi semua dengan pemberlakuan kesamaan di depan hukum. Kegiatan ini diikuti oleh 20 peserta yang dilaksanakan sejak tanggal 15 Oktober sampai 05 November 2022 di Kota Lhokseumawe. Metode yang dilakukan Service Learning (SL), dimaksudkan untuk mengintegrasikan pembelajaran ke dalam kegiatan PKPA atau Kemitraan Fakultas Hukum dengan PERADI-SAI. Selain itu, pendekatan Participatory Action Research (PAR) berorientasi pada pemberdayaan para peserta PKPA. Hal ini dikarenakan kebutuhan dan penyelesaian permasalahan hukum di masyarakat. Para pengabdi dari perguruan tinggi harus menempatkan masyarakat sebagai pemeran utama pembangunan dan perubahan. Hasil kegiatan ini adalah melahirkan para profesi advokat dan memberikan pemahaman Advokat merupakan profesi yang mulia, bebas, mandiri, dan bertanggung jawab dalam menegakkan hukum, serta kegiatan profesi tersebut dijamin dan dilindungi oleh undang-undang demi terselenggaranya supremasi hukum.

Abstract

PT PNM Mekaar Syariah is an institution engaged in sharia financial services that provides financing in the form of capital to support business actors in developing their businesses. Even if the business fails, customers are still required to repay their loans. This study aims to determine the implementation, obstacles, and efforts in applying sharia principles to micro, small, and medium enterprise financing at PT PNM Mekaar Syariah Blang Mangat. This research is a qualitative study using a legal-empirical approach with a descriptive nature. The research data used are sourced from primary and secondary data. Primary data were obtained from observations and interviews, while secondary data were obtained from books, articles, and relevant scientific publications. The research data was systematically organized, beginning with data reduction, data presentation, and conclusion drawing. The research findings revealed that the implementation of Sharia principles and contracts by PT PNM Mekaar Syariah Blang Mangat Branch has not fully adopted Sharia principles, as evidenced by its operational practices not fully adhering to the murabahah system. The obstacles encountered by customers are that they often choose financing not for business purposes but for personal needs. This can lead to various challenges such as late payments, increased personal expenses, and difficulties in managing customer business operations. Efforts made include actively monitoring customers to detect potential late payments or defaults early on.

Abstract

Law No. 11/2006 on the Government of Aceh (Aceh Government Law) has mandated Aceh Qanun No. 11/2018 on ShariaFinancial Institutions. A thorough and integrated regulatory infrastructure must support the Qanun on Sharia Financial Institutions. The Qanun on Sharia Financial Institutions regulates that all Sharia Financial Institutions operating in Aceh must transition from the conventional to the Sharia system. However, in reality, many norms still need to be synchronised with national rules so that Sharia Financial Institutions do not run optimally. This study aims to map and harmonise legal issues and purification of Qanun on Sharia Financial Institutions in the future. The method used is normative juridical with a qualitative approach and uses secondary data. The study found that first, the mapping of Qanun on Sharia Financial Institutions still has articles that overlap and need to be more technical with the inclusion of the year that has passed. In addition, an article includes administrative sanctions that are not implemented. Then, there are ambiguous norms that cause multiple interpretations. Second, Qanun on Sharia Financial Institutions needs harmonisation with higher laws and regulations. In addition, several Governor and Regent Regulations and other technical rules are required to maximise the implementation. Third, purification is needed by revising articles that overlap with the rules above and harmonising them with national regulations in Islamic finance.
