Abstract

Abstrak Penelitian ini bertujuan untuk merumuskan pendekatan integratif antara Ushul Fiqh, hukum adat, dan prinsip hukum internasional lingkungan dalam upaya perlindungan ekologis yang berkelanjutan di Indonesia. Latar belakang penelitian ini adalah krisis lingkungan hidup yang kompleks dan multidimensi, yang memerlukan pendekatan hukum yang tidak hanya sektoral dan legal-formal, tetapi juga berbasis nilai dan partisipatif. Metode penelitian yang digunakan adalah pendekatan normatif dan konseptual, dengan teknik studi pustaka terhadap sumber hukum Islam, hukum adat, dan instrumen hukum internasional lingkungan seperti Paris Agreement dan Rio Declaration. Pembahasan difokuskan pada dua aspek utama: pertama, sinergi antara konsep maslahah dalam Ushul Fiqh dan nilai-nilai kearifan lokal dalam hukum adat yang terbukti efektif secara empiris dalam menjaga lingkungan; kedua, korespondensi antara prinsip-prinsip hukum internasional lingkungan dengan maqāṣid al-sharī‘ah dan norma hukum adat dalam mewujudkan keadilan ekologis. Hasil penelitian menunjukkan bahwa ketiga sistem hukum tersebut dapat saling menguatkan dalam membangun model hukum lingkungan yang partisipatif, etis, dan kontekstual. Sebagai saran, perlu adanya penguatan regulasi berbasis nilai lokal dan maqāṣid, forum dialog lintas sistem hukum, serta reformasi kurikulum pendidikan hukum yang mengintegrasikan nilai Islam, adat, dan prinsip global dalam perlindungan lingkungan. Kata Kunci: Ushul Fiqh, Hukum Adat, Hukum Internasional Lingkungan   Abstract This study aims to formulate an integrative approach between Ushul Fiqh, customary law, and international environmental legal principles in achieving sustainable ecological protection in Indonesia. The background of this research lies in the multidimensional environmental crisis, which demands a legal approach that goes beyond sectoral and formal structures, embracing value-based and participatory frameworks. This research employs a normative and conceptual method, using library research to examine sources of Islamic law, Indonesian customary norms, and international legal instruments such as the Paris Agreement and the Rio Declaration. The discussion focuses on two main aspects: first, the synergy between the concept of maslahah in Ushul Fiqh and the ecological values embedded in local customary practices, which have proven effective in environmental conservation; second, the alignment between international environmental law principles and maqāṣid al-sharī‘ah as well as customary norms in promoting ecological justice. The findings indicate that these three legal systems can mutually reinforce each other in constructing a participatory, ethical, and contextual environmental legal framework. The study recommends strengthening legal regulations rooted in local values and maqāṣid, facilitating cross-system dialogues, and reforming legal education curricula to integrate Islamic, customary, and global environmental perspectives. Abstract

The subject of this paper is how the freedom of women in choosing a potential husband. In general, ideas can be put forward in a society where the pattern of relationship is traditional, marriage is perceived as a social necessity which is part of the inherited social tradition. This study aims to find out how the views of the Shafi'i School and the Hanafi School of Women in choosing a husband. Whether choosing a husband candidate is a woman's absolute right or is there interference from parents. Where cases of matchmaking and the practice of forced marriage by parents of girls are still found in Indonesian society. Mazhab Syafi'i and the Hanafi School have different opinions about women's freedom to choose a husband. The Shafi'i school is of the opinion that a girl who is not yet an adult, in this case, according to him, he can marry the girl even without his permission. According to him, for a widow there must be clear consent from the person concerned. Meanwhile, according to the Hanafi School, the consent of a woman, either a widow or a girl, must be in the marriage and vice versa, if they refuse the marriage contract, it cannot be carried out

Abstract

Barzanji recitations in Bugis pesantrens in Makassar have traditionally relegated women to passive roles, reflecting entrenched gender norms. This study aims to empower women to participate actively in Barzanji rituals at the Multidimensional Alfakhriyah Islamic Boarding School by implementing a gender‑sensitive Participatory Action Research (PAR) framework. Data collection included in‑depth interviews, focus group discussions, and field observations. The intervention comprised Barzanji sessions co‑designed with female santri and community leaders, featuring flexible timing and culturally adapted formats. Findings reveal that women’s participation increased from 12 % to 68 %, accompanied by enhanced spiritual understanding and a strengthened sense of ownership over the ritual. Participatory monitoring further reinforced women’s agency within religious spaces. These results demonstrate that gender‑responsive programs can effectively shift traditional norms and position women as active agents of change within Islamic ritual practice. This study contributes to gender and Islamic scholarship by presenting a scalable model suitable for other pesantrens. Future applications may include broader implementation across Sulawesi and longitudinal research to assess cultural transformation.

Abstract

The worship-related problems of modern workers indicate the need for an understanding of fiqh that is flexible, proportional, and still grounded in sharia provisions, especially when work demands create limitations in time, place, and physical condition in performing worship. This study aims to examine the concept of the maxim idzā ḍāqa al-amru ittasa‘a as a principle of flexibility in Islamic law, analyze the limits of its application in fiqh, and explain its implementation in the worship-related problems of modern workers. This study used a qualitative approach with a library research design through an examination of classical and contemporary fiqh literature and an analysis of various cases involving modern workers. The results show that this maxim provides legitimacy for various forms of rukhsah in worship that are relevant to the conditions of modern workers, such as the permissibility of combining prayers for medical personnel in emergency conditions, transportation workers with high mobility, rescue teams in disaster situations, and concessions in purification through tayamum when adequate facilities are unavailable. Under certain conditions, this maxim also allows adjustments in the performance of worship due to time and place constraints, such as for workers in dense work environments or in situations of extreme traffic congestion, while still observing sharia limits. However, the application of rukhsah is not absolute because it must be adjusted to the provisions and conditions formulated by scholars. The conclusion of this study affirms that Islamic law has a flexible yet measured character in providing ease for mukallaf according to the level of difficulty faced in modern life. The implications of this study contribute to the development of contemporary fiqh studies, particularly in formulating Islamic legal responses that are adaptive to the dynamics of modern work without disregarding the principles of prudence and sharia compliance.
