Abstract

This study analyzes the problem of a prosecutor’s procrastination in executing a court judgment that delays the prisoners’ serving their sentences and causes some irregularities in the correctional facilities regarding the prisoners’ rights trade. The introduction of many prisons without a specific body to supervise the execution of the sentence, particularly the warded people’s freedom in Indonesia, appeared to have unfulfilled justice in the society. In this regard, this research aims to define the validity of the need to enhance the Supervision of prisoners’ rights protection in Central Java. It describes an optimal system relevant to such Supervision. The type of research that was utilized in this study is sociological juridical. Sociological juridical research serves to be the opposite of normative legal research. It is revealed that there have been ongoing infringements of prisoners’ rights, highlighting the further need to set a more comprehensive mechanism that would include the Police, the Prosecutors, the Courts, and the Correctional Institutions in the system of oversight and other management functions. Every level in the hierarchy system of the Criminal Justice System has its limit on including the human rights of prisoners containing adequate risks of intrusion, where checks and balances must be exercised. Formally and horizontally, these rights must be assured and upheld both legally and in their spirit by Justice and the Law. This study’s findings are that appropriate measures need to be applied to implement better Supervision policies aimed at safeguarding the human rights of prisoners and ensuring the justice system in Indonesia is not compromised.

Abstract

Petty theft is one of the most common forms of conventional crime occurring in society and can be committed by individuals from various backgrounds. This study aims to analyze the crime of petty theft using Edwin H. Sutherland’s Differential Association Theory, which emphasizes that criminal behavior is learned through social interaction with groups that support legal violations. The research method used is normative juridical with a criminological approach, based on literature review of legal regulations, doctrines, and previous studies. The findings reveal that petty theft is not solely driven by economic factors but also by the internalization of deviant values acquired from social environments such as peers, family, or specific communities. For example, theft committed by juveniles often stems from social influences that normalize unlawful behavior. These results highlight the need for socially based crime prevention strategies through legal education, family involvement, and community-based social control.

Abstract

This research explores the protective laws and enforcement of human rights in Indonesian correctional facilities, especially by observing systematic problems in exercising the ruling on prisoners' rights.  This study uses a juridical-empirical method based on analyzing legal sources with additional field research to cover what legal contents advocate for in what contexts more effectively. It analyzes primary legal materials,including relevant legislation and gathers empirical data throughinterviews and direct observations. This approach allows for an enhanced understanding of the interplay between legal theory and practice to evaluate the legal framework of prisoners' rights protection critically. The findings reveal significant legal gaps, particularly regarding the unclear constitutional arrangements regarding the separation of powers in the execution of sentences as well as the protection of prisoners' rights. These issue are notably prevalent in correctional institutions in Central Java, which has been the case that the enforcement mechanism has not been running optimally. The analysis identifies systematic violations of prisoners' rights stemming from structural weaknesses in the legal relationships between correctional institutions, courts, and other law enforcement entities. As outlined in the examination of statutory interpretation and legal principles throughout this study, legislative reform is also necessary to better protect prisoners' rights, particularly concerning clarification of institutional authority and improved oversight mechanisms. These findings highlight the necessity for legal harmonization between human rights standards and correctional practices to increase the integrity of the Indonesian criminal justice system.

Abstract

Mining in Indonesia is a vital sector that contributes significantly to the economy. However, current regulations still reveals a number of weaknesses that impact environmental sustainability and community welfare. These include weak law enforcement, lack of transparency and public participation at all stages of mining activities, inadequate mechanisms to ensure corporate social responsibility and environmental and post-mining reclamation, provisions that are not responsive to changing social and environmental conditions, further exacerbating the situation. This research uses a normative legal research method with an analytical approach to the provisions of laws and regulations based on facts obtained from secondary sources by paying attention to the credibility of these secondary sources. The main findings of the research reveal that environmental problems arise due to misalignment between mining laws and environmental laws. Environmental laws are not positioned as a command to mitigate the environmental impact of mining, and issues are further compounded by overlapping regulations on mining reclamation. The welfare of the community remains an unfulfilled promise, as environmental economic rights are increasingly eroded by the provisions in Article 162 of Law No. 3 of 2020. The rampant illegal mining activities further harm state finances, exacerbated by the absence of sophisticated infrastructure to monitor mining areas and potential sites in real time using satellite imagery. Additionally, inadequate distribution of corporate social responsibility (CSR) funds has left mining and affected areas without proper support, highlighting the urgent need for CSR regulations in the future be regulated at the legislative level. Furthermore, regulatory efforts to adopt green technology remain insufficient, with a lack of fiscal incentives and investment protection for companies committed to sustainable practices. The situation is further worsened by the lack of transparency in the mining sector, further exacerbates the situation as there is still no clear mechanism to ensure accountability or provide the public with access to crucial mining operation data. Based on the complex mining problems from multi-sectors, the regulatory reform framework must involve authorized government institutions and involve public participation in regulatory reform and the outcomes of the rules formed can accommodate the protection of public participation and protection of public rights in mining, respond to effective law enforcement and provide great contribution to the state, society, and global collaboration.

Abstract

The crime of sexual abuse against minors is a serious issue faced within the Indonesian legal system. This crime has long-term impacts on the victims and can potentially destroy the future of the child. This study aims to analyze the effectiveness of criminal law policies regarding sexual abuse of minors, as well as the underlying factors contributing to the occurrence of such crimes. This research uses a juridical-sociological approach by collecting secondary data through literature studies and legal documents, as well as primary data through interviews and questionnaires. The results show that although laws related to child protection are in place, the implementation of law enforcement still faces various challenges. Additionally, social and psychological factors influence the frequency of sexual abuse against children. This research recommends an increase in legal socialization and the strengthening of law enforcement to better protect children from sexual crimes.   Abstrak Kejahatan pencabulan terhadap anak di bawah umur merupakan masalah serius yang dihadapi dalam sistem hukum Indonesia. Kejahatan ini memiliki dampak jangka panjang terhadap korban dan dapat merusak masa depan anak. Penelitian ini bertujuan untuk menganalisis efektivitas kebijakan hukum pidana terkait pencabulan terhadap anak, serta faktor-faktor yang melatarbelakangi terjadinya kejahatan tersebut. Penelitian ini menggunakan pendekatan yuridis sosiologis dengan mengumpulkan data sekunder melalui studi pustaka dan dokumen hukum, serta data primer melalui wawancara dan kuesioner. Hasil penelitian menunjukkan bahwa meskipun peraturan yang berkaitan dengan perlindungan anak sudah ada, implementasi penegakan hukum masih menghadapi berbagai tantangan. Selain itu, faktor sosial dan psikologis juga memengaruhi frekuensi terjadinya pencabulan terhadap anak. Penelitian ini merekomendasikan peningkatan sosialisasi hukum dan penguatan penegakan hukum untuk melindungi anak-anak dari kejahatan seksual.

Abstract

The enactment of the Indonesian Criminal Code (KUHP) marks a significant reform in the country’s criminal law system. One of the most notable changes is the formal recognition of living law as a source of criminal law. This recognition provides space for the incorporation of local values and indigenous customary wisdom into the national legal system. However, this provision has sparked controversy, particularly due to its potential conflict with the principle of legality and the protection of human rights. In principle, modern criminal law requires that only acts explicitly regulated by legislation can be subject to punishment. Therefore, the application of unwritten norms as a basis for criminal liability poses serious challenges to legal certainty. This study aims to analyze the prospects of applying living law under the new KUHP by examining its formalization, limitations, and implications for the principle of legality and human rights. This research employs a normative juridical and comparative approach, analyzing statutory regulations, legal doctrines, and practices from several other countries. The findings indicate that the implementation of living law can only be carried out in a limited and conditional manner—through formalization via local regulations, judicial oversight, and assurance that customary norms do not contradict the Constitution. If formulated and applied correctly, the recognition of living law can improve access to social justice, strengthen the legitimacy of law, and contribute to building a peaceful and inclusive society within a sustainable legal development framework

Abstract

The research aims to explore the socio-political dimensions of gender justice and human rights, emphasizing women's political equality while ensuring appropriate support for family life. Using a combination of field research (non-doctrinal) and a literature review of primary sources, including those related to Boja Village, the paper analyzes legislative changes and economic initiatives that have enhanced women's status and family welfare. The study also examines global and national gender-equality indices, evaluating their progress through both quantitative indicators and qualitative policy assessments/public opinion. The discussion highlights the complex roles of governments, non-governmental organizations, and women’s activist groups in advocating for gender parity on a global scale. While many aspects of life have seen improvements, cultural and economic challenges, along with institutional remnants, continue to hinder equal opportunities for both men and women. The coordinated approach to women’s and family welfare emphasizes gender- and culture-sensitive empowerment of the individual. The chapter concludes with policy and practice recommendations aimed at fostering more gender-sensitive interventions, accelerating progress toward universal human rights, and advancing the sustainable development agenda.

Abstract

Judicial independence ensures that judges remain free from external influence and possess full discretion in determining the severity or leniency of a sentence. However, this independence can also result in sentencing disparity, particularly in corruption cases that involve state financial losses. Sentencing disparity refers to the inconsistent imposition of punishment for similar offenses under comparable circumstances, which undermines legal certainty and justice. In Indonesia, such disparity is often justified under the pretext of judicial independence, even though it contradicts the principle of equality before the law. The inconsistency in sentencing, especially for corruption cases under Law Number 31 of 1999 in conjunction with Law Number 20 of 2001, raises concern over the absence of clear sentencing guidelines. This research aims to examine the relationship between judicial independence and sentencing disparity in corruption cases, particularly focusing on the need for standardized sentencing mechanisms. Using normative legal research methods, this study analyzes primary, secondary, and tertiary legal materials through a literature review, supported by case decisions sourced from the Supreme Court’s database. The findings indicate that although judges are mandated to uphold justice, legal certainty, and utility, the lack of clear sentencing standards contributes to disparities in rulings. Therefore, the implementation of sentencing guidelines and reliance on jurisprudence are necessary to balance judicial independence with fairness and consistency in criminal sentencing, especially for corruption crimes.

Abstract

Cybercrime is escalating in Southeast Asia alongside rapid digital growth, yet the region still lacks a unified legal and victim-centered approach. While most studies focus on perpetrators and cybersecurity, this research addresses a critical gap by exploring Cyber Victimology as a framework to understand and strengthen victim protection in ASEAN countries. Using a normative legal method with comparative and conceptual approaches, this study examines legal disparities, weak law enforcement, limited victim support, and low digital literacy, particularly among children and the elderly. Findings show that ASEAN lacks harmonized regulations, adequate cyber policing, and psychological-legal support infrastructure. For instance, Singapore’s robust Personal Data Protection Act contrasts with minimal protection in Cambodia and Laos. The study proposes concrete policy responses, including regional legal harmonization modeled on the Budapest Convention and the GDPR, enhanced law enforcement capacity, national crisis centers, and targeted digital literacy programs. Integrating Cyber Victimology into policy will help ASEAN establish a more inclusive, victim-responsive digital governance system.

Abstract

Sexual violence is an increasingly prevalent crime in Indonesia. Article 16 of Law Number 12 of 2022 on Criminal Acts of Sexual Violence states that, in addition to imprisonment, fines, or other criminal penalties as outlined in the Law, the judge is required to determine the amount of restitution for criminal acts of sexual violence that carry a sentence of four years in prison or more. One form of compensation available to victims of the criminal acts of sexual violence is restitution payments made by the defendant. However, many Panels of Judges still deny cases of the criminal acts of sexual violence restitution, particularly in verdicts where the defendant faces a four-year sentence or more. Several reasons explain why judges do not determine restitution payments by the defendant to the victim: the first is bias regarding the amount of compensation for victims in the judge’s decision; the second is that the request for payment restitution must be formally submitted; and the third concerns how to reformulate the determination of restitution in sexual violence cases (a comparison of Indonesia and the Netherlands).
