Abstract

Artikel ini mengkaji tentang isu penting terkait kebebasan pers dan perlindungan identitas anak korban asusila. Dalam konteks hukum pidana, pertanyaan mengenai tanggung jawab pidana bagi jurnalis atas pelanggaran privasi identitas anak korban asusila menjadi sangat relevan dalam era media modern. Penelitian ini bertujuan untuk melakukan perbandingan regulasi hukum di Indonesia dan Malaysia terkait pertanggungjawaban pidana jurnalis dalam kasus pemberitaan identitas anak korban asusila. Hasil dari penelitian ini menunjukkan bahwa meskipun Indonesia dan Malaysia memiliki peraturan hukum yang berbeda terkait pertanggungjawaban pidana bagi jurnalis, keduanya memiliki prinsip-prinsip yang serupa dalam perlindungan identitas anak korban asusila. Evaluasi mendalam terhadap kasus-kasus yang telah terjadi menunjukkan bahwa implementasi hukum terkait pelanggaran tersebut masih memiliki celah yang perlu diperbaiki. Diperlukan pendekatan yang lebih holistik dan komprehensif dalam menangani kasus-kasus sensasionalisme media yang merugikan anak korban asusila. Berdasarkan analisis ini, implementasi regulasi yang lebih ketat dan sanksi yang tegas terhadap pelanggaran hukum terkait pemberitaan identitas anak korban asusila akan menjadi langkah efektif dalam mencegah penyalahgunaan kebebasan pers demi kepentingan publik. Melalui pemahaman mendalam terkait perbandingan hukum antara Indonesia dan Malaysia dalam kasus pertanggungjawaban pidana bagi jurnalis atas pemberitaan identitas anak korban asusila, diharapkan dapat lebih meningkatkan kesadaran akan pentingnya perlindungan anak korban asusila dan mendorong perbaikan perundang-undangan guna mencapai keadilan yang lebih baik dalam konteks ini.

Abstract

Sexual violence against minors in Indonesia remains a critical issue that reflects deep structural inequalities and limited protective mechanisms. This study applies a normative juridical approach, drawing on statutory law, ministerial regulations, case reports, and scholarly commentary to examine how legal and community-based strategies intersect in addressing the problem. The method relies on secondary data rather than field research, with analysis focused on interpreting how legal frameworks connect with peer education and adolescent mentoring initiatives. The results point to three central gaps: the lack of a comprehensive sexuality curriculum in schools, limited recognition of bodily autonomy, and weak integration of prevention programs into existing legal structures. These shortcomings create vulnerabilities that leave young people without adequate tools to protect themselves or seek help. The discussion highlights four interrelated strategies to strengthen adolescent resilience: preparing trained peer educators, establishing structured mentoring and counseling systems, involving families and community organizations, and implementing targeted public-awareness campaigns. Each element contributes to both community-level support and the realisation of statutory obligations to protect children from sexual violence. Although this research does not provide empirical measurements, its interpretive analysis outlines a framework that may guide future studies and inform policymakers. By connecting legal obligations with practical community efforts, the study underscores that peer education and mentoring are not peripheral solutions but integral components of a rights-based approach to safeguarding adolescents.

Abstract

Traffic accidents are a serious problem that not only impacts safety but also raises complex legal and social issues. Traffic accident cases in Indonesia have tended to be handled through formal criminal justice mechanisms that are oriented towards punishment, often failing to provide complete recovery for victims and the community. With the development of the concept of restorative justice, the Indonesian National Police (Polresta Ambon) has begun to implement this approach in case resolution, including at the Ambon Police Department. This study aims to analyze the application of restorative justice in handling traffic accidents by the Ambon Police Department Traffic Unit and identify the obstacles encountered in its implementation. The research method uses a normative-empirical juridical approach with qualitative analysis. Primary data were obtained through interviews with police officers, victims, and perpetrators of traffic accidents, while secondary data were obtained from literature, legal documents, annual reports of the Ambon Police Department, and statistical data from the Central Statistics Agency. The analysis was conducted by linking field findings with the theoretical framework of Restorative Justice (Howard Zehr and John Braithwaite), the theory of justice (Aristotle and John Rawls), and the theory of the Criminal Justice System by Lawrence M. Friedman. The results of the study indicate that the implementation of Restorative Justice in the Ambon Police is carried out through a mediation process involving victims, perpetrators, and community leaders, with a focus on reparation of losses and restoration of social relations. However, its implementation still faces obstacles, both from the aspect of legal substance in the form of a weak regulatory basis, the aspect of legal structure in the form of limited apparatus and infrastructure resources, and the aspect of legal culture in the form of the dominance of the retributive paradigm in society. This study concludes that Restorative Justice is a more humane and just mechanism, but requires strengthening regulations, increasing the capacity of officers, and socialization to the community so that it can be implemented consistently and effectively in Ambon City.

Abstract

Pembaharuan sistem pemidanaan merupakan suatu upaya transformatif dalam mewujudkan prinsip reintegratif, khususnya dalam konteks perlindungan hak-hak anak yang berkonflik dengan hukum. Penelitian ini bertujuan untuk mengkaji efektivitas implementasi kebijakan hukum pidana serta program rehabilitasi bagi anak di Lembaga Pemasyarakatan (Lapas) Kelas I Semarang. Metodologi penelitian yang digunakan bersifat normatif dengan teknik pengumpulan data melalui wawancara semi-terstruktur, dan analisis terhadap instrumen hukum serta kebijakan terkait. Subjek penelitian meliputi aparat penegak hukum, warga binaan pemasyarakatan, praktisi rehabilitasi, dan stakeholders dalam sistem peradilan anak. Temuan penelitian mengungkapkan bahwa meskipun kerangka hukum pidana Indonesia telah menginkorporasikan prinsip-prinsip perlindungan anak melalui Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA) beserta regulasi turunannya, implementasinya di Lapas Kelas I Semarang masih dihadapkan pada berbagai kendala struktural. Faktor-faktor seperti keterbatasan infrastruktur, defisit sumber daya manusia yang kompeten, serta dominannya pendekatan retributif mempengaruhi optimalisasi program rehabilitasi. Namun demikian, intervensi berbasis edukasi, pengembangan kapasitas vokasional, dan pendekatan psikososial telah menunjukkan dampak positif dalam proses reintegrasi anak, walaupun belum mencapai tingkat yang maksimal. Penelitian ini juga mengidentifikasi pentingnya kolaborasi multisektoral antara pemerintah, lembaga pemasyarakatan, komunitas, dan organisasi non-pemerintah untuk memperkuat proses reintegratif. Rekomendasi kebijakan yang dirumuskan meliputi penguatan kapabilitas aparat pemasyarakatan, optimalisasi sarana rehabilitasi, serta pengembangan program pascarehabilitasi untuk menjamin keberlangsungan reintegrasi sosial anak. Temuan ini memberikan kontribusi akademik dan praktis bagi pengembangan sistem pemidanaan yang lebih humanis dan efektif, khususnya dalam konteks perlindungan hak anak di Indonesia. Abstract

The prolonged social conflict in Afghanistan has caused its citizens to flee to various countries around the world. Asylum seekers from this country located in Central and South Asia often face challenges in legal protection, especially in asylum-receiving countries such as Indonesia. Although it does not have an official policy regarding refugees, Indonesia is one of the transit destinations for asylum seekers, including those who are refugees from the conflict in Afghanistan. The study aims to analyze the protection, challenges, and mechanisms of legal protection for asylum seekers from Afghanistan in Indonesia. A qualitative approach is used in the study that relies on literature reviews, such as books, scientific articles, institutional reports, and documents related to the protection of asylum seekers. Indonesia is a member of international legal instruments, such as the 1951 Refugee Convention, but does not yet have a clear national legal framework to protect the rights of asylum seekers. Abstract

Introduction to the Problem: The practice of criminal law in a country should evolve technologically, as in Indonesia, where electronic surveillance of prisoners has been adopted. Indonesia has correctional facilities that are experiencing tremendous overcrowding, and this trend not only hinders the effective rehabilitation of inmates but also burdens the state coffers. Countries with well-organised biobanks have used this surveillance technology to prevent this malfunction. Purpose/Study Objectives: This research aims to analyze whether there is a possibility of introducing electronic monitoring of prisoners in Indonesia as a possible amendment to the Criminal Sanctions Implementation Act by conducting an international review of the experience of similar practices in several countries with civil law (Latvia, Iceland, France, Norway, Croatia, Kosovo), common law (England and Wales), and mixed law (Thailand) systems. Design/Methodology/Approach: This research utilises qualitative approaches, especially normative legal analysis and comparison. The data was collected by way of thorough analysis of legal documents from different jurisdictions that have varying legal traditions, such as civil law countries like Latvia, Iceland, France, Norway, Croatia, and Kosovo, common law countries of England and Wales, and Thailand, which has a mixed legal system. The comparison of these legal systems assists in constructing possible integration of electronic surveillance systems in the criminal law system in Indonesia. Findings: Research shows that electronic monitoring of prisoners in Indonesia has potential despite the lack of legislation for such tracking due to the relevance of implementation, especially for low-risk prisoners and first-time offenders. Concerns are identified, such as inadequate infrastructure, lack of comprehensive legislation and resistance from various groups. However, the promising benefits outweigh those concerns, as well as features such as a 40% reduction in prison overcrowding and improvements in recidivism rates of inmate rehabilitation. Abstract

The increase in online defamation in Indonesia in line with the growing number of internet users, which is often responded to with prison sentences of up to 4 years based on the Electronic Information and Transactions Law, has raised a debate regarding the effectiveness and proportionality of such punishments. This article aims to compare the effectiveness of prison sanctions versus non-prison sanctions such as fines, community service, and their alignment with the principles of restorative justice and the 2023 Criminal Code. The research method uses a comparative-normative approach by analyzing the rulings on defamation cases via Facebook, the ITE Law, and regulatory changes in the Criminal Code (Law No. 1/2023). The study results show that the defendants were sentenced to prison (2–8 months), only 3 received probation, the 2023 Criminal Code (effective 2026) abolishes prison sentences for minor offenses, switching to fines (maximum Rp10 million) or community service, online defamation has now become a complaint-based crime following the changes to the ITE Law in 2016. In conclusion, short-term prison sentences are less effective because they have the potential to sacrifice freedom of expression and have minimal preventive impact, while non-custodial sentences are more suitable for minor cases in line with the adoption of restorative justice. Recommendations include amendments to the Electronic Information and Transactions Law (UU ITE) to integrate alternative sanctions of fines or community service, prioritizing mediation as a preliminary step, and socializing the limits of digital freedom.

Abstract

Refugees constitute a highly vulnerable population, frequently exposed to severe human rights violations or neglect. Refugees are often undergone variable restrictions like on speech, travel, education, and economic activities. Particularly at risk are their rights to decent work, livelihoods, and access to education for children. The inability to secure dignified work profoundly exacerbates the challenges in fulfilling educational rights within refugee communities. This article investigates the systemic vulnerabilities leading to the potential violation of these critical social rights for international refugees in Indonesia. As a nation that has not ratified the 1951 Convention on the Status of Refugees, Indonesia operates without a comprehensive domestic legal framework explicitly governing refugee social rights. Nevertheless, its responsibilities as a member of the global community, coupled with inherent humanitarian principles, morally and ethically obligate the protection of these fundamental rights. Drawing on comparative legal analysis and good practices from other nations, this paper aims to identify specific areas for legal and policy reform in Indonesia. These reforms are crucial for providing adequate protection for refugees’ rights to work and education, within the practical capabilities of the state, and without compromising the security and public order rights of its citizens. Ultimately, this research underscores the urgent need for domestic legal reform to enhance refugee welfare and ensure their human dignity in Indonesia.

Abstract

This study explores into exploring the execution of Equilibrium Theory-Based Gender Equality (ETBGE) in Boja Village to enhance family welfare, employing a non-doctrinal (empiric) approach through observation and surveys. Gender equality is crucial for holistic development, especially in rural areas, as it promotes socioeconomic progress. Drawing on Equilibrium Theory, which advocates for equal This study delves into how gender equality principles can be effectively applied at the community level to enhance access to resources and opportunities. Through systematic observation and comprehensive surveys in Boja Village, the study evaluates gender dynamics, resource allocation, decision-making processes, and overall family welfare. Analysis of empirical data, including demographic profiles, economic indicators, and social structures, aims to uncover existing disparities and challenges in achieving gender equality objectives. The findings offer insights into the effectiveness of ETBGE principles in Boja Village, identifying successful areas and those needing further intervention. The study concludes by proposing practical recommendations and strategies to empower Boja Village residents, particularly women, enabling them to participate in decision-making, access resources equitably, and enhance the welfare of their families and the community.
