Abstract

The enactment own specific criminal law product, Indonesia has its Penal Code Law Number 1, 2023, known as Nusantara Code. Pros and cons are both seen as to the authority and ratification of the Nusantara Criminal Code, For example, the one-time major crime of killing no longer exists and its current punishment requires a ten-year probation period Whereas the death penalty is concerned, this means surveillance licensee should payout each year to judge on a case by case basis with clear definite rules in place. The officers and conduct of death row inmates during the operational process of the death penalty are each specifically set up by law. In addition to the burden of hearing and adjudicating a case at the trial stage, the judges perform a second function; that is watching over a permanent decision of law, whether it is against convicts sentenced to death or not. For this reason, ln the Nusantara Criminal Code the Death Penalty is an especially set offence and surveillance observation must also be handled specially to make the judgment of it by Supervision and Observation Judge both accurate questions can be settled once and for all.

Abstract

Indecency includes all acts related to sexual life that violate morality (propriety), including intercourse outside of marriage. The Criminal Code classifies the crime of indecency as a crime against morality. Currently, there is a rise in the crime of indecency, with children often being the victims. Children are part of the younger generation and a potential human resource; therefore, perpetrators of sexual crimes against children must face appropriate punishment. The position of children as the younger generation who will carry forward the noble ideals of the nation requires that their rights and protection be upheld and respected. This research aims to assess the protection provided to child victims of sexual crimes in the city of Pekanbaru, as well as the forms of protection that have been established and implemented in the jurisdiction of the Pekanbaru Police Department (Polresta Pekanbaru). The research was conducted in Pekanbaru, particularly at Polresta Pekanbaru. In terms of data collection techniques, the author used a normative juridical approach, guided by legislation, legal books or literature, and other materials related to the issues and discussions in this thesis. In this context, the important role of parents and the community or the environment is emphasized to provide attention and supervision, ensuring that acts against children as victims of sexual crimes do not occur. Furthermore, in the implementation of legal protection for child victims of sexual crimes, the involved parties must actively and responsibly carry out their duties to ensure the legal protection of child victims of sexual crimes.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh variabel modal operasional, umur, jam kerja, dan lama usaha terhadap pendapatan pedagang kaki lima sektor informal, dengan studi kasus di alun-alun Kabupaten Gresik. Data yang digunakan adalah data primer. Teknik analisis yang digunakan adalah analisis regresi linier berganda. Penelitian ini  menggunakan perhitungan  melalui   SPSS  16.   Hasil   penelitian  ini   menunjukkan   bahwa  variabel  modal operasional,  lama  usaha jumlah, dan jam kerja  berpengaruh  positif dan signifikan terhadap pendapatan  pedagang  kaki  lima  sektor  informal  di  alun-alun Kabupaten  Gresik.  Sedangkan variabel umur   tidak berpengaruh secara signifikan terhadap pendapatan pedagang kaki lima sektor informal di alun-alun Kabupaten Gresik.Kata Kunci : Modal Operasional, Umur , Lama Usaha, Jam kerja, Pendapatan PKL

Abstract

Artikel ini mengkaji tentang isu penting terkait kebebasan pers dan perlindungan identitas anak korban asusila. Dalam konteks hukum pidana, pertanyaan mengenai tanggung jawab pidana bagi jurnalis atas pelanggaran privasi identitas anak korban asusila menjadi sangat relevan dalam era media modern. Penelitian ini bertujuan untuk melakukan perbandingan regulasi hukum di Indonesia dan Malaysia terkait pertanggungjawaban pidana jurnalis dalam kasus pemberitaan identitas anak korban asusila. Hasil dari penelitian ini menunjukkan bahwa meskipun Indonesia dan Malaysia memiliki peraturan hukum yang berbeda terkait pertanggungjawaban pidana bagi jurnalis, keduanya memiliki prinsip-prinsip yang serupa dalam perlindungan identitas anak korban asusila. Evaluasi mendalam terhadap kasus-kasus yang telah terjadi menunjukkan bahwa implementasi hukum terkait pelanggaran tersebut masih memiliki celah yang perlu diperbaiki. Diperlukan pendekatan yang lebih holistik dan komprehensif dalam menangani kasus-kasus sensasionalisme media yang merugikan anak korban asusila. Berdasarkan analisis ini, implementasi regulasi yang lebih ketat dan sanksi yang tegas terhadap pelanggaran hukum terkait pemberitaan identitas anak korban asusila akan menjadi langkah efektif dalam mencegah penyalahgunaan kebebasan pers demi kepentingan publik. Melalui pemahaman mendalam terkait perbandingan hukum antara Indonesia dan Malaysia dalam kasus pertanggungjawaban pidana bagi jurnalis atas pemberitaan identitas anak korban asusila, diharapkan dapat lebih meningkatkan kesadaran akan pentingnya perlindungan anak korban asusila dan mendorong perbaikan perundang-undangan guna mencapai keadilan yang lebih baik dalam konteks ini.

Abstract

Children are the buds of the nation's hope that have rights and protection as mandated by the Law of the Republic of Indonesia Number 23 of 2004 concerning the Elimination of Domestic Violence so that they are free from various threats or treatment that degrades human dignity. Other regulations that support child protection are regarding the age limit for marriage as stipulated in Article 7 of the Law of the Republic of Indonesia Number 16 of 2019 concerning Amendments to the Marriage Law No. 1 of 1974, which is 19 years old. However, the empirical reality shows that the target community, namely Fatayat, does not fully understand the urgency that the minimum age of marriage is 19 years. This research is a community service program funded by Semarang State University in Fatayar, South Semarang District, Semarang City. This paper aims to provide an increased understanding of the age of marriage in order to build family resilience in Fatayat, South Semarang District, Semarang City. The results of the study of 11 participants showed a tendency to increase understanding. This research includes several important stages, namely analysis of partner problems, science and technology needs for the community, coordination with partners, outreach and evaluation.

Abstract

This article provides a comprehensive analysis of a fundamental and universal principle in criminal law: the principle of ultimum remedium. This principle advocates for the use of criminal sanctions as a last resort, to be employed only when all other avenues have been exhausted. The primary focus of this study is to examine how the principle of ultimum remedium is articulated within the criminal codes of various countries. The countries selected for this analysis—Germany, Slovenia, Croatia, the Czech Republic, Kosovo, Montenegro, and Kyrgyzstan—were chosen randomly. By scrutinizing these formulations, the study aims to delineate an ideal framework for the application of the ultimum remedium principle. This research utilizes a doctrinal methodology, and through this lens, the article finds that legislators in numerous countries frequently integrate the principle of ultimum remedium implicitly within provisions that address basic principles and limitations of the use of criminal law, basic principles and limitations of criminal law enforcement, basic principles and limitations of criminal sanctions, and basics of criminal accountability. Nonetheless, some countries have explicitly codified the principle of ultimum remedium within provisions titled "The Principle of Subsidiarity of Criminal Repression." These articulated principles serve as crucial guidelines for legislators and law enforcement authorities.

Abstract

Corruption is one of Indonesia’s biggest problems. Various efforts have been made not only in enforcement of corruption cases, but also in various preventive efforts. Kebumen Regency is one of the poorest districts in Central Java with a high rate of corruption among other city districts in Central Java. Several large-scale corruption cases also involved the Kebumen district government. Various attempts have been made, but anti-corruption attitudes must be encouraged. One of them is through various educational networks. The anti-corruption character strengthening program for students is the basic provision for the nation's next generation to not only eradicate corruption collectively but also have high integrity. This program is carried out at SDN Tlogodepok, Kebumen Regency where through this program an anti-corruption character will be formed for students as an anti-corruption fortress from an early age. This program will be implemented in several methods: (1) lectures and outreach, (2) anti-corruption games, (3) anti-corruption learning assistance, (4) initiation of honesty stalls, (5) formation of anti-corruption student cadres, and (6) establishment of an integrity zone at SDN Tlogodepok

Abstract

The development of artificial intelligence (AI) technology has given rise to the phenomenon of deepfake, which is exploited for non-consensual pornography crimes, causing psychological and social harm to the victims. Although Indonesia has several regulations, such as the ITE Law, the Pornography Law, and the PDP Law, there is yet to be a specific regulation addressing deepfakes. The research uses a juridical-normative method with a statute approach, analyzing primary legal materials (ITE Law, Pornography Law, Criminal Code 2023, PDP Law), secondary materials (journals, books, expert opinions), and tertiary materials (legal dictionaries), which are collected through literature studies and analyzed deductively using the framework of legal birutoto justice and progressive law theories by Satjipto Rahardjo to produce a systematic argument. The research findings indicate that the lack of specific regulation on deepfakes in Indonesia creates legal uncertainty and barriers to enforcement, thus necessitating adaptive legal reforms, capacity-building of law enforcement officers, and a progressive approach to protect victims and ensure substantive justice.

Abstract

Penelitian ini dilatarbelakangi dengan adanya perubahan sistem pemidanaan pasca disahkannya KUHP Nasional. Transformasi dari Balai Pemasyarakatan dinilai penting untuk segera dilakukan guna menyongsong pemberlakuan pemidanaan baru di Indonesia. Penelitian ini menggunakan metode tinjauan yuridis normatif atau studi kepustakaan. Dari penelitian ditemukan masih banyaknya kendala yang dihadapi oleh Balai Pemasyarakatan dalam memberikan pelayanan bagi masyarakat. Transformasi guna menyokong pemberlakukan pidana pengawasan dan pidana kerja sosial dapat dilakukan dengan menghadirkan unit Balai Pemasyarakatan di setiap kabupaten/kota. Hal ini dapat dialternatifkan dengan membuat pos-pos BAPAS di setiap tempat rutan atau lapas. Selain itu, masih minimnya jumlah Pembimbing Kemasyarakatan harus segara disikapi dengan rekruitmen pegawai dalam jumlah yang besar. Dikarenakan adanya pemidanaan baru maka dibutuhkan pula aturan pelaksana dalam implementasiannya. Koordinasi antar lembaga juga harus ditingkatkan dalam proyeksi pelaksanaan dua model pemidanaan baru tersebut. kata kunci: Balai Pemasyarakatan, Pemidanaan, Hukum Pidana.

Abstract

This research examines the dynamics of the penitentiary system transparent, and accountable criminal case handling in criminal execution law in Southeast Asia, focusing on the convergence and divergence of international perspectives. These countries have diverse approaches to the penitentiary system and criminal law enforcement, including in terms of the implementation of the death penalty and the treatment of prisoners. Some countries, such as Singapore and Malaysia, maintain strict death penalty practices, which often contradict international human rights standards, while others such as the Philippines show inconsistencies in implementing criminal execution laws. This research also examines the three main stages in the enforcement of the penitentiary system, namely the formulation stage, the application stage and the execution stage, which vary across Southeast Asian countries. Historical, political and cultural factors contribute to these variations, affecting the conformity of national legal systems with transparent and accountable international criminal law. In addition, this study highlights the importance of transparency and accountability in criminal case handling, as well as the role of rehabilitation in the penitentiary system, as an effort to align with international standards, especially regarding the treatment of death row prisoners. Understanding these dynamics is expected to provide insight into the differences and similarities in criminal execution laws in Southeast Asia as well as efforts towards better integration with international perspectives on human rights and criminal executions.
