Abstract

This study examines legal deviations in the implementation of the Suspension of Debt Payment Obligations (PKPU) mechanism, specifically regarding the approval of a peace settlement submitted for the second time after the debtor is declared bankrupt. The study highlights the Supreme Court Decision No. 648K/Pdt.Sus-Pailit/2021, which ratified the second peace settlement in the case of PT Prospek Duta Sukses. This decision is deemed contradictory to the principle of a single peace settlement, as stipulated in Articles 289 and 292 of Law No. 37 of 2004 on Bankruptcy and PKPU, and further reinforced by Supreme Court Circular Letter (SEMA) No. 5 of 2021, which states that a peace settlement in bankruptcy can only be conducted once. Using a normative juridical method, this research analyzes the legal reasoning used by the panel of judges in approving the second peace settlement and evaluates its impact on legal certainty and protection for creditors, who are the affected parties in the bankruptcy process. The approval of a second peace settlement after the debtor is declared bankrupt creates legal uncertainty, as the existing provisions do not provide for more than one peace settlement. Additionally, this decision potentially harms creditors by prolonging the settlement of debts, which should have been clear, thus allowing room for misuse of legal procedures. The findings of the study show that the approval of this second peace settlement not only contradicts the fundamental principles of law but also risks harming creditors, who should be protected by the bankruptcy system to ensure their rights are fairly met. Therefore, this research suggests that consistent application of the law, in line with existing provisions, is necessary to uphold the principles of justice, legal certainty, and the credibility of the national bankruptcy system. Furthermore, reforms in regulations or law enforcement are needed to ensure that legal practices operate in accordance with principles that are fair and transparent.

Abstract

The implementation of a recommendation feature in the courier service selection system on e-commerce platforms is a technological innovation aimed at improving logistics efficiency while providing a more optimal user experience. Through this feature, consumers can find alternative delivery services based on certain indicators, such as cost, estimated time, and service quality. However, in practice, the implementation of recommendation features has the potential to raise legal issues when platforms prioritize internal couriers or certain partners without transparency and clear objective indicators. This situation can lead to discriminatory treatment, limit market access for other businesses, and reduce consumer freedom in choosing services. This study aims to analyze the implementation of recommendation features by e-commerce platforms from a competition law perspective, specifically based on Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. The method used is normative juridical research with a descriptive-analytical approach, through the review of secondary data in the form of laws and regulations, literature, and the practice of implementing recommendation systems in the digital industry. The research results indicate that recommendation features that unilaterally prioritize internal couriers without objective basis and without information transparency have the potential to violate Article 19 letter d of Law Number 5 of 1999. This practice can hinder competition, close opportunities for other courier service providers, and create distortions in the digital logistics ecosystem. Therefore, this study recommends that recommendation features in e-commerce be designed in a neutral, transparent manner, and based on objective indicators, such as rates, estimated delivery times, and service performance. This will maintain healthy business competition and protect consumers' rights to obtain the best service options.

Abstract

With reference to the Civil Code and the type of legal protection available to holders of local e-wallets that store cryptocurrency, this paper examines the legality of trading transactions involving digital currency, in this case crypto coins, as a form of payment. The urgency of this study is the occurrence of a legal vacuum (rechtsvacuum) of the existence of crypto coins that creates legal uncertainty. Normative juridical is the research method used in this study. The conclusion that can be drawn from the results of the discussion is that trade transactions using crypto coins as a means of payment in terms of the Civil Code are not prohibited if they are related to Article 1320 jo 1541 of the Civil Code, payments using crypto coins can be equated with legal exchange relationships. This form of legal protection for crypto coin users can be preventive and repressive. Preventive is carried out through consistent regulation. Repressively, now BAPPEBTI as a supervisor can provide administrative sanctions, in the form of warnings to license revocation for companies that organize e-wallets. Penelitian ini bertujuan menganalisis keabsahan transaksi perdagangan menggunakan koin kripto sebagai alat pembayaran, ditinjau dari Kitab Undang-Undang Hukum Perdata dan bentuk perlindungan hukum terhadap pengguna koin kripto yang tersimpan dalam e-wallet lokal. Urgensi dari penelitian ini adalah terjadinya kekosongan hukum (rechtsvacuum) keberadaan koin kripto yang menimbulkan ketidakpastian hukum. Dalam penyusunan artikel ini digunakan metode penelitian hukum yuridis normatif yang dilakukan melalui penelaahan bahan pustaka sebagai bahan dasarnya. Dari hasil pembahasan dapat diambil kesimpulan bahwa Transaksi perdagangan yang menggunakan koin kripto sebagai alat pembayaran ditinjau dari Kitab Undang-Undang Hukum Perdata bukan sesuatu hal yang dilarang, jika dikaitkan dengan Pasal 1320 jo 1541 Kitab Undang-Undang Hukum Perdata, maka pembayaran melalui penggunaan koin kripto dapat dipersamakan dengan hubungan hukum tukar-menukar. Bentuk perlindungan hukum bagi pengguna koin kripto dapat  dilakukan secara preventif dan represif. Secara preventif dilakukan melalui regulasi yang konsisten. Secara represif, sekarang ini BAPPEBTI sebagai pengawas dapat memberikan sanksi administratif, berupa peringatan hingga pencabutan izin bagi perusahaan yang menyelenggarakan e-wallet.

Abstract

ABSTRAKArtikel ini mengkaji dampak putusan Mahkamah Konstitusi Nomor 83/PUU-XXII/2024 yang menghapus Pasal 251 KUHD terhadap praktik hukum dalam industri asuransi. Penghapusan pasal tersebut bertujuan untuk mencegah kerugian sepihak dan menciptakan kesetaraan hukum antara pihak tertanggung dan penanggung. Penelitian ini berfokus pada penegakan prinsip keadilan yang ada dalam asuransi untuk menilai perubahan perilaku masyarakat dan keadilan hukum pasca putusan tersebut ditetapkan. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode pengumpulan data secara deskriptif melalui studi literatur dari buku dan karya ilmiah relevan lainnya, yang kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa putusan Mahkamah Konstitusi tersebut membawa dampak positif terhadap industri asuransi, menciptakan iklim usaha yang lebih sehat, mendorong keuntungan yang adil bagi para pihak, serta mengurangi praktik pembatalan sepihak perjanjian oleh perusahaan asuransi. Kesimpulan yang didapat adalah dengan penegakan putusan ini, maka prinsip keadilan yang ada dalam asuransi dapat terlaksana dengan lebih bagus dan dapat dirasakan oleh kedua belah pihak.Kata Kunci: Asuransi, Pembatalan Sepihak Asuransi, Prinsip Keadilan

Abstract

A partnership agreement is a form of business collaboration, either directly or indirectly, that is established based on the principles of mutual need, mutual trust, mutual reinforcement, and mutual benefit. Such partnerships generally involve Micro, Small, and Medium Enterprises (MSMEs) working with larger businesses in order to create a fairer and more sustainable business relationship. However, in practice, the implementation of partnership agreements often does not reflect these fundamental principles. This is also evident in the nucleus-plasma scheme within the palm oil plantation sector, where the relationship between the nucleus companies and plasma farmers tends to show an imbalance of bargaining power. This study aims to examine the application of partnership principles in the implementation of nucleus-plasma agreements in palm oil plantations, viewed from the perspective of prevailing legislation, particularly the Law on Micro, Small, and Medium Enterprises (MSME Law). The findings indicate that the application of partnership principles has not yet been fully implemented consistently. The partnership relationship remains unequal and is largely dominated by the nucleus companies, creating a sense of injustice for plasma farmers. In terms of supervision, the Indonesian Business Competition Supervisory Commission (KPPU) plays a crucial role in ensuring that partnership agreements are carried out in line with these principles. One of the measures taken is monitoring the implementation of behavioral change commitments by business actors. KPPU ensures that nucleus companies do not abuse their dominant position and continue to provide fair opportunities for plasma farmers. Therefore, this study highlights the importance of strengthening oversight and enforcing regulations so that the objectives of nucleus-plasma partnerships in palm oil plantations can truly be realized in accordance with the principles mandated by law.

Abstract

The New The construction of the New Effluent Water Treatment Plant (EWTP) is a National Strategic Project aimed at managing crude oil industrial waste in accordance with prevailing regulations. However, the project failed at 98.84% completion due to a fire at the fuel tank prior to the handover phase. Legal issues subsequently arose, as the contractor neglected to renew the mandatory insurance coverage stipulated in the contract. This study aims to analyze the legal liability of the contractor for the uninsured project failure and to evaluate the legal consequences under Indonesia’s positive law, particularly Law No. 2 of 2017 on Construction Services and Law No. 1 of 2025 on State-Owned Enterprises (BUMN). The research employs a normative juridical approach, and the findings indicate that the contractor may be deemed in breach of contract (wanprestasi) under Article 1239 of the Indonesian Civil Code, leading to legal consequences including compensation for damages, delay penalties, and responsibility for project losses. The absence of insurance coverage invalidates any claim of force majeure and strengthens the contractor’s legal liability based on the pacta sunt servanda principle and risk management obligations within BUMN projects. This research underscores the critical importance of contractual compliance and risk mitigation through insurance protection as integral components in the execution of national infrastructure projects. Proyek pembangunan New Effluent Water Treatment Plant (EWTP) merupakan Proyek Strategis Nasional yang bertujuan mengelola limbah industri minyak mentah sesuai peraturan perundang-undangan. Namun, proyek mengalami kegagalan saat progres mencapai 98,84%, akibat kebakaran Tangki BBM sebelum serah terima. Permasalahan hukum pun muncul karena kontraktor lalai dalam memperpanjang jaminan asuransi yang secara kontraktual diwajibkan. Penelitian ini bertujuan untuk menganalisis bentuk tanggung jawab hukum kontraktor atas kegagalan proyek yang tidak diasuransikan serta mengevaluasi akibat hukumnya berdasarkan hukum positif Indonesia, khususnya UU No. 2 Tahun 2017 tentang Jasa Konstruksi dan UU No. 1 Tahun 2025 tentang BUMN. Metode yang digunakan adalah pendekatan yuridis-normatif dan hasil penelitian menunjukkan bahwa kontraktor dapat dikualifikasikan melakukan wanprestasi berdasarkan Pasal 1239 KUHPerdata, dengan konsekuensi hukum berupa kewajiban mengganti kerugian, membayar denda keterlambatan, serta tanggung jawab atas kerusakan proyek. Ketiadaan asuransi meniadakan pembelaan force majeure dan memperkuat tanggung jawab hukum kontraktor berdasarkan asas pacta sunt servanda serta prinsip pengelolaan risiko dalam proyek BUMN. Penelitian ini menegaskan pentingnya kepatuhan kontraktual dan manajemen risiko melalui perlindungan asuransi sebagai bagian integral dalam pelaksanaan proyek konstruksi nasional.

Abstract

One of the notary's authorities is to provide legal counseling, including in the context of the Extraordinary General Meeting of Shareholders (EGMS). This counseling is very important to ensure the legality of the legal process, especially in the preparation of deeds related to the transfer of shares and other important decisions. However, in practice, there are cases where notaries do not perform their duties independently, which ultimately leads to legal problems. As a country of law, Indonesia guarantees legal certainty and protection for every citizen. However, irregularities by less independent notaries, such as in the case of Notary Hartono in Gianyar Regency, highlight significant risks for the parties involved, including potential losses due to falsification of documents. This study aims to analyze the legal consequences of deeds produced by non-independent notaries. This study seeks to explore how non-compliance by notaries with this principle affects the validity of the deeds they produce. The method used in this study is a normative juridical approach that utilizes secondary data, with analysis carried out on relevant laws and regulations, documents, and literature related to the authority of notaries and the principle of justice. This research is descriptive-analytical, providing an overview of the consequences arising from the lack of independence in the duties of notaries, followed by analysis. The results of the study show that the lack of independence of notaries in providing legal counseling can cause legally defective deeds and potentially void them, resulting in losses for the affected parties. The case of Notary Hartono serves as a concrete example where violations of notary independence lead to forgery of deeds and significant legal repercussions. The principle of justice is not upheld if the notary does not act independently in carrying out his duties

Abstract

Cooperatives are business entities that carry out their activities by collecting and distributing funds. The legal basis for Cooperatives is regulated in the Constitutional Court Decision No. 28/PUU-IX/2013 concerning the cancellation of the entire Law No. 17 of 2012 concerning Cooperatives, then there was a shift in the regulations of the Law on Cooperatives, which temporarily returned its legal basis to Law Number 25 of 1992 concerning Cooperatives until the issuance of a new Law on Cooperatives. The method used in this study is descriptive analytical with a normative legal research approach method and a qualitative legal analysis method. This study is expected to provide an understanding of the role and responsibilities of Notaries related to the Deed of Establishment of Savings and Loan Cooperatives and the legal consequences for the establishment of Cooperatives that are not accompanied by a Notarial Deed. The role and responsibilities of Notaries related to the Deed of Establishment of Savings and Loan Cooperatives are to make authentic deeds that function as valid evidence of the implementation of a legal act related to the establishment, changes to the articles of association, and other deeds related to cooperative activities. The legal consequences for the establishment of a cooperative that is not accompanied by a notarial deed are contained in the Constitutional Court Decision Number 28/PUU-XI/2013 which reads as follows: Notaries are no longer permitted to prepare cooperative deed of establishment based on the procedures and methods regulated in Law Number 17 of 2012 concerning Cooperatives

Abstract

Hukum merupakan salah satu pilar utama dalam menjaga kestabilan kehidupan sosial baik pada tingkat individu maupun masyarakat. Sebagai pengatur, hukum memberikan kerangka yang jelas untuk mengelola interaksi sosial melalui aturan-aturan yang adil dan sistematis. Peran hukum sebagai pelindung juga sangat krusial untuk menjamin keadilan dan hak-hak setiap individu di tengah dinamika sosial yang kompleks. Artikel ini membahas bagaimana hukum berfungsi dalam dua aspek tersebut: sebagai pengatur yang menciptakan keteraturan sosial dan sebagai pelindung yang menjamin hak asasi manusia serta mencegah konflik. Ditekankan bahwa keberhasilan hukum sangat bergantung pada implementasi yang konsisten dan keadilan yang nyata di lapangan. Dengan menganalisis peran hukum dalam kehidupan sosial, artikel ini memberikan wawasan penting tentang bagaimana hukum dapat memperkuat kohesi sosial dan membangun masyarakat yang lebih harmonis.

Abstract

Penegakan hukum terhadap pelaksanaan putusan Komisi Pengawas Persaingan Usaha (KPPU) merupakan aspek penting dalam mewujudkan kepastian hukum di Indonesia. Permasalahan dalam penelitian ini apakah hambatan yuridis dalam penegakan hukum persaingan usaha terkait pelaksanaan putusan Komisi Pengawas Persaingan Usaha (KPPU) dalam rangka mewujudkan kepastian hukum. Meskipun KPPU memiliki kewenangan untuk menjatuhkan sanksi terhadap pelaku usaha yang melanggar prinsip persaingan sehat, implementasi putusannya masih menghadapi berbagai hambatan, baik dalam bentuk resistensi pelaku usaha maupun kendala yuridis dan institusional. Artikel ini menganalisis bagaimana mekanisme penegakan hukum atas putusan KPPU, tantangan yang dihadapi dalam pelaksanaannya, serta upaya yang dapat dilakukan untuk memperkuat efektivitas penegakan hukum tersebut dan bagaimana upaya mengatasi hambatan-hambatan tersebut. Metode yang digunakan adalah pendekatan yuridis normatif dengan studi kepustakaan dan analisis terhadap putusan KPPU yang telah inkracht. Hasil penelitian menunjukan bahwa KPPU tidak memiliki kewenangan penuh dalam melaksanakan tugasnya. Keputusan KPPU bukan keputusan yang mengikat dan bersifat final (final and biding) melainkan masih dapat diajukan upaya hukum keberatan melalui Pengadilan Negeri sampai dengan Kasasi ke Mahkamah Agung RI. Hambatan yuridis lainnya adalam dalam pelaksanaan putusan KPPU yakni Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat, KPPU tidak memiliki kewenangan eksekusi karena harus mendaftarkan putusannya kepada Pengadilan Negeri guna mendapatkan penetapan eksekusi. Kelemahan tersebut mengakibatkan putusan KPPU masih belum mewujudkan kepastian hukum. Selain itu, KPPU sebaiknya berkompeten dalam wewenang penyidikan, penggeledahan hingga penyitaan terhadap pemeriksaan perkara persaingan usaha. Hasil analisis menunjukkan perlunya penguatan regulasi dan sinergi antar lembaga penegak hukum dan pemerintah agar putusan KPPU dapat dieksekusi secara optimal demi tercapainya kepastian hukum serta perlu dibentuknya pengadilan khusus yang mengadili perkara persaingan usaha
