Abstract

Learning concentration is a crucial aspect that determines students’ success in mastering lessons, particularly in Bahasa Indonesia which requires integrated skills of listening, reading, writing, and speaking. However, not all students are able to maintain consistent focus during classroom activities. This study aims to analyze the forms of learning concentration among fourth-grade students at SDN Semanan 09 Pagi, West Jakarta, and to identify the factors that influence it. A descriptive qualitative approach with a case study method was employed, using observation, interviews, and documentation with the classroom teacher and five students with diverse characteristics. The research instruments covered several concentration indicators, including visual focus, attention, verbal responses, answering ability, willingness to express opinions, and psychomotor responses. The findings reveal variations in students’ concentration levels. Some students demonstrated strong focus through active participation in discussions, asking questions, and showing discipline in taking notes and submitting assignments. In contrast, others were easily distracted, lacked confidence in expressing opinions, and tended to be active only when directed by the teacher. Both internal factors, such as motivation and interest, and external factors, including teaching strategies, learning media, and classroom conditions, were found to influence concentration quality. These findings highlight the importance of teacher creativity in designing interactive learning strategies to encourage students to stay focused, express their thoughts, and become more independent learners.

Abstract

Connectivity infrastructure is one of the crucial aspects in the development of a region. The Indonesian government has allocated a significant budget for connectivity infrastructure spending. The effectiveness of infrastructure spending reflects how much the connectivity infrastructure indicators have been achieved. The increase in connectivity infrastructure spending must be directly proportional to the rise in the quality and quantity of connectivity infrastructure. This study aims to analyze the correlation between connectivity infrastructure spending and the achievement of its indicators, especially in the Southern Sumatra region. The analysis method used is the Pearson Correlation analysis method, an approach to analyzing growth and the effectiveness of connectivity infrastructure spending. The results show that infrastructure spending and the achievement of its indicators have a relatively weak and negative correlation for roads and bridges. This study provides implications that the Southern Sumatra Region still needs improvement and evaluation between the distribution of government spending and program implementation for better regional development effectiveness.

Abstract

Jual beli biasanya dilakukan dengan perjanjian atau yang dikenal dengan perjanjian jual beli, berdasarkan hukum adat perjanjian jual beli merupakan perjanjian yang bersifat riil, maksudnya penyerahan barang yang diperjanjikan merupakan syarat yang mutlak dipenuhi untuk adanya sebuah perjanjian. Penelitian in bertujuan untuk mengetahui tentang pengaturan perjanjian jual beli hak atas tanah dan mengetahui akibat hukum perjanjian jual beli hak atas tanah apabila terjadi wanprestasi. Penelitian ini bertujuan untuk mengetahui proses pelaksanaan perjanjian jual beli tanah dan rumah, peraturan serta hak dan kewajiban antara penjual dengan pembeli, dan mengetahui tanggung jawab hukum apabila salah satu pihak melakukan kesalahan. Metode penelitian ini bersifat normatif karena dalam penelitian ini yang akan diteliti adalah kaidah-kaidah hukum, asas-asas hukum dan tanggung jawab hukum terhadap pelaksanaan perjanjian jual beli tanah dan rumah di kabupaten sukoharjo. Sifat penelitian ini adalah deskriptif yang dimana menggambarkan secara menyeluruh dan sistematis tentang perjanjian jual beli. Hasil penelitian menunjukkan proses perjanjian jual beli tanah harus memenuhi syarat materiil, formil, dan syarat hukum. Syarat materiil yaitu meliputi pembeli, penjual dan obyek tanah, kemudian syarat formil meliputi sertifikat tanah asli, bukti telah membayar PBB, surat setoran BPHTB, surat setoran PPh, dan data data penjual dan pembeli yang meliputi: KTP dan KK, dan syarat hukum pasal 1320 KUHPerdata. Setelah memenuhi syarat – syarat, maka kedua belah pihak harus melakukan perjanjian secara tertulis yang dibuat oleh pihak PPAT yang kemudian ditanda tangani oleh para pihak. Setelah penandatanganan akta perjanjian perjanjian tersebut kemudian timbulah kesepakatan. Setelah terjadi kesepakatan dan penandatanganan perjanjian, maka timbulah hak dan kewajiban bagi para pihak yang harus dilaksanakan .

Abstract

Penelitian ini mengeksplorasi cara untuk menjaga kebebasan anak dalam mengungkapkan pandangan mereka, khususnya terkait penangkapan ratusan anak yang terjadi saat demonstrasi menolak peningkatan tunjangan anggota DPR pada tanggal 25 hingga 29 Agustus 2025 di Jakarta. Selain itu, studi ini juga menilai dampak dari pelanggaran hak asasi manusia yang dialami oleh anak-anak tersebut. Latar belakang dari penelitian ini adalah meningkatnya peran anak dalam berpartisipasi dalam aksi protes, yang dianggap sebagai salah satu cara mereka untuk mengungkapkan pendapat. Namun, mereka seringkali menghadapi tindakan represif yang dapat berpengaruh buruk terhadap status mereka sebagai individu dan subjek hukum yang rentan. Metodologi yang diterapkan dalam penelitian ini adalah pendekatan normatif, dengan menggunakan studi kasus dan analisis hukum berdasarkan dokumen hukum serta laporan dari lapangan. Kerangka teoritis yang digunakan meliputi teori tentang hak asasi manusia dan perlindungan anak, dengan penekanan pada perspektif Konvensi Hak Anak dan Undang-Undang Perlindungan Anak Indonesia (UU No. 35 Tahun 2014). Dalam konteks normatif, penelitian merujuk kepada UUD 1945 Pasal 28 yang menjamin kebebasan berekspresi, UU No. 9 Tahun 1998 mengenai Kebebasan Menyampaikan Pendapat, UU No. 35 Tahun 2014 tentang Perlindungan Anak, serta UU No. 11 Tahun 2012 yang berkaitan dengan Sistem Peradilan Pidana Anak, yang menekankan perlakuan khusus bagi anak dengan pendekatan yang memperhatikan hak-hak mereka. Berdasarkan data yang tersedia, terdapat laporan dari Komisi Perlindungan Anak Indonesia (KPAI) dan lembaga advokasi lain yang mencatat adanya penangkapan dan penahanan ratusan anak di berbagai lokasi selama aksi demonstrasi pada Agustus 2025, termasuk tindakan represif yang berpotensi melanggar hak dasar anak. Penelitian ini menyimpulkan bahwa meskipun anak memiliki hak untuk mengekspresikan pendapat mereka, diharapkan pihak berwenang memperhatikan prinsip perlindungan anak serta hak asasi manusia agar tidak terjadi pelanggaran lebih jauh terhadap anak-anak yang terlibat dalam aksi tersebut.

Abstract

This study examines both the direct and mediated effects of education and training, organizational culture, and integrity on employee performance, with competence positioned as an intervening variable at the National Counterterrorism Agency. A quantitative research design was employed, involving 130 employees as research respondents. The data were analyzed using Structural Equation Modeling based on Partial Least Squares (SEM-PLS) with the support of SmartPLS version 4. The findings indicate that education and training, integrity, and competence have a positive and statistically significant direct effect on employee performance, whereas organizational culture does not demonstrate a significant direct influence. In addition, education and training, organizational culture, and integrity were found to significantly and positively affect employee competence. The mediation analysis further reveals that these three variables indirectly influence employee performance through competence. Competence fully mediates the relationship between education and training as well as integrity on employee performance, while partially mediating the relationship between organizational culture and employee performance.Overall, the results highlight that strengthening employee competence plays a critical role in enhancing the effectiveness of education and training, organizational culture, and integrity in improving employee performance within the National Counterterrorism Agency.

Abstract

This article examines the implementation of subrogation rights in marine cargo insurance contracts in Indonesia, with an emphasis on the balance of legal responsibilities in subrogation practices. Subrogation rights, which allow the insurer to assume the legal position of the insured after claim payment, often face issues of unequal legal protection, particularly in cases involving third parties. This study employs a normative juridical method, using a statutory approach and case study analysis of court decisions. Findings indicate a lack of clear regulations and mechanisms ensuring a balance in legal responsibilities related to subrogation rights. Therefore, a reconstruction of contractual norms and regulatory frameworks is needed to guarantee proportional legal protection for all parties involved. The state holds a crucial role that must be optimized through the formulation of legal norms and regulations to ensure subrogation rights are exercised proportionally

Abstract

The use of fiduciary guarantees in Sharia-based consumer financing raises legal issues concerning debtor protection, particularly regarding justice, legal certainty, and execution mechanisms. Juridically, fiduciary guarantees function as instruments for creditor protection; therefore, debtor protection does not arise from the guarantee itself but from legal regulations and limitations on its execution. This study aims to analyze debtor legal protection in Sharia-based consumer financing utilizing fiduciary guarantees from the perspective of Indonesian positive law and Islamic economic law. This research employs a normative legal research method with statutory and conceptual approaches. The findings indicate that the regulation of fiduciary guarantees has not fully ensured debtor protection, especially in execution practices. From the perspective of Islamic economic law, such practices potentially contradict the principles of justice, the prohibition of oppression (ẓulm), and the objectives of maqāṣid al-sharī‘ah, particularly the protection of property (ḥifẓ al-māl). Therefore, the application of fiduciary guarantees in Sharia financing must be harmonized with the principles of rahn, the nature of Sharia contracts, as well as DSN-MUI fatwas and Sharia financial regulations issued by the Financial Services Authority.

Abstract

Efforts to protect stakeholder interests in a Limited Liability Company, especially related to the opportunity for shareholders to take legal action, including influencing the company in such a way that it is contrary to the principles of propriety and justice and to provide legal support for the existence of the company's board of directors and board of commissioners in carrying out their respective duties, then a legal doctrine has developed in corporate law which is often called Piercing the Corporate Veil. Judging from the substance of the material and idealism contained in this corporate law doctrine, the intended doctrine is actually needed as part of controlling the morals of the individuals standing behind the company's organs in running their business so as not to commit reprehensible acts that can harm the sense of justice of the community. Therefore, these corporate law doctrines are very important. Business entities in the business world are known as both those that are already in the form of companies and those that are not yet in the form of companies. Based on their legal form, companies are divided into two, namely companies that have legal entity status and those that are not legal entities. As an independent legal entity, the liability of PT shareholders is only limited to the value of the shares owned in the company. The doctrine of piercing the corporate veil can be applied in a Limited Liability Company in the event of misleading facts, fraud and injustice and to protect minority shareholders, shareholders concerned either directly or indirectly in good faith who use the company solely for personal interests.

Abstract

This study aims to analyze the legal responsibilities of the parties in the partnership agreement between PT. Pertamina Patra Niaga and PT. Braja Slebah Energi (business partner) Pertashop. This study uses a normative legal method by reviewing laws and regulations, legal documents, and literature related to the substance of the Pertashop partnership agreement and fuel consumer protection. The results of the study indicate that PT Pertamina Patra Niaga plays a strategic role in the distribution and marketing of fuel throughout Indonesia through the Pertashop program as a partnership-based service innovation. The Pertashop partnership agreement is in the form of a standard written agreement prepared by PT. Pertamina Patra Niaga as the licensor and product owner with PT. Braja Slebah Energi as the operational manager of fuel distribution and sales. From the aspect of consumer protection, the implementation of fuel distribution through Pertashop has referred to Article 19 of the Consumer Protection Law which requires business actors to provide compensation for consumer losses. It can be concluded that the Pertashop program is an effective instrument in expanding the fuel distribution network in areas not yet served by gas stations through a partnership pattern. Although the cooperation agreement is standard and unilaterally drafted by Pertamina, it remains valid and binding on the parties, clearly defining roles and responsibilities. Furthermore, consumer protection in fuel distribution through Pertashop has a strong legal basis through the implementation of Article 19 of the Consumer Protection Law, which is outlined in the agreement, guaranteeing consumers' rights to compensation in the event of losses.
