Abstract

Introduction: Unauthorized transfer of trade secrets can harm the owner, cause financial loss, damage reputation and trigger legal action. In the era of globalization and technology, the transfer of trade secrets is increasingly urgent to be legally regulated. Legislation has been implemented in various countries to protect trade secrets, but the legal consequences vary. The repercussions involve financial loss, reputation, legal action and ethical business considerations.Purposes of the Research:  The purpose of this study is to investigate and analyze the process of identifying and handling the transfer of trade secrets under the hand in Indonesian legal practice. This study also aims to understand the legal consequences that apply to the perpetrators of private transfer of trade secrets in the Indonesian legal system. Methods of the Research: This research uses normative legal research methods to analyze statutory regulations, court decisions, and legal literature related to the private transfer of trade secrets. A statutory approach helps understand the applicable legal framework. Data sources include various legal documents and legal literature, with data collection techniques focusing on document analysis and literature study. Data analysis involves identifying trends and legal implications of cases related to private transfer of trade secrets in the Indonesian legal context.Results of the Research: The process of identifying and handling illegal transfers of trade secrets in Indonesia is an important step in protecting business and industry. It covers the steps from identification to prosecution, with reference to regulations such as the Trade Secret Act. Trade secrets must be confidential and have economic value. Prevention through internal security policies and employee training is also necessary. Perpetrators of the transfer of trade secrets may face civil, criminal and administrative actions in accordance with applicable law, with consequences including criminal sanctions, demands for compensation and confiscation of goods or documents. Protection is also given to whistleblowers in good faith. Internal policies, nondisclosure agreements, and consulting legal advisors are important for protecting trade secrets. All parties must understand and comply with the law to maintain business integrity in Indonesia.

Abstract

Tujuan penulisan ini adalah untuk menganalisa kewenangan dan akibat hukum yang timbul berdasarkan kewenangan PPAT dalam pendaftaran tanah. Negara menerbitkan pengaturan hukum yang dapat menjamin hak kepemilikan dengan memperoleh kepastian atas hak tanah, seperti memiliki surat tanda bukti. Di dalam pelaksanaan administrasi pertanahan dan pendaftaran tanah yang tercatat di Kantor Pertanahan harus selalu sesuai dengan keadaan atau status sebenarnya mengenai bidang tanah yang bersangkutan, baik yang menyangkut data fisik mengenai bidang tanah tersebut, maupun mengenai hubungan hukum yang menyangkut bidang tanah itu, atau data yuridis ini, khususnya pencatatan perubahan data yuridis yang sudah tercatat sebelumnya, peranan PPAT sangatlah penting. Tulisan ini berfokus pada pertama, bagaimana kewenangan PPAT dalam pendaftaran tanah, dan kedua, akibat hukum apa yang timbul berdasarkan kewenangan PPAT dalam pendaftaran tanah. Tulisan ini bersifat kepustakaan atau penelitian hukum normatif yang menggunakan data sekunder untuk menganalisa fokus kajian tulisan ini. Hasil pembahasan tersebut menyatakan bahwa kewenangan PPAT dalam hal pendaftaran tanah termasuk dalam kewenangan delegasi, yang mana PPAT membuat akta sebagai bukti dilakukannya perbuatan hukum tertentu mengenai hak atas tanah. Akibat hukum dari kewenangan PPAT tersebut, bisa pada ruang lingkup Tata Usaha Negara, perdata, maupun pidana.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk pertanggungjawaban ganti rugi terhadap perbuatan melawan hukum akibat penghinaan dan pertimbangan Hakim dalam menerapkan hukum pada kasus tersebut. Penelitian ini menggunakan metode penelitian hukum yuridis normatif yang dilakukan berdasarkan bahan sekunder. Berdasarkan hasil analisis didapatkan bahwa tuntutan perdata tentang hal penghinaan diajukan untuk memperoleh penggantian kerugian serta pemulihan kehormatan dan nama baik, sehingga kembali pada keadaan seperti seandainya tidak ada penghinaan yang sebagaimana diatur dalam Pasal 1372 sampai dengan Pasal 1380 KUH Perdata sebagai bentuk perbuatan melanggar hukum sebagaimana diatur dalam Pasal 1365 KUH Perdata. Dalam pengajuan gugatan terdapat batas waktu kadaluwarsa yaitu gugatan harus diajukan dalam waktu satu tahun sejak hari dilakukannya perbuatan dan diketahui oleh penggugat, sehingga tidak perlu menunggu putusan pidananya terlebih dahulu apabila ingin mengajukan gugatan perdata. Ganti rugi akibat penghinaan terdapat 2 (dua) bentuk ganti rugi yaitu ganti rugi materiil dan ganti rugi immateriil. Adapun untuk mengetahui besaran nominal ganti rugi immateriil diberikan dengan mengikuti persyaratan yuridis yaitu dengan memperhatikan berat ringannya penghinaan, pangkat, kedudukan, kondisi, dan kemampuan si terhina maupun penghina, pernyataan menyesal dan permintaan maaf di depan umum, adanya perdamaian di antara para pihak.

Abstract

Legal protection of intellectual property is an important element in supporting creativity and trade. Indonesia has ratified the Agreement and Trade Related Aspects of Intellectual Property Rights and has enacted Law number 30 of 2000 concerning Trade Secret. Legal protection of trade secrets aims to protect business actors in trade practices both regionally and internationally. In addition, protection of trade secrets can prevent unfair business competition. Thus, business people have wider opportunities to develop their creativity and business. This research method is a normative research with comparative research type. This study examines the comparison of intellectual property protection laws specifically regarding trade secrets with laws in United States. The purpose of this comparative normative study to examine the extent to which the Trade Secret Act can be effective in its application as can be applied in the Supreme Court Decision.

Abstract

This article was to determine the voice of the international community in responding to the challenges of school closure policies during the 2019 Covid-19 pandemic. Effort to break the chain transmission of Covid-19 was believed to be closely related to the closure of all business activities including schools around the world. In order to understand the impacts and challenges of school closure, a series of critical searches were undertaken on various online sources, for instance news updates publications, practitioners, and school reactions to unplanned global policies to obligate students learning from home. The collecting data was analyzed using a qualitative phenomenological approach and in-depth interpretation to at the collective voice fulfills the reliability and validity of the research problem. The findings indicated that 16 international voices from different perspectives show relatively deep concern about school closures. Voices from these discussions were matched with existing questions and knowledge about difficulties resulting from school closures. The findings of this study can be categorized into three votes; First are voices in support of the national school closure policy. Second, questioning national policies without prior data. Third, there is concern that families face serious challenges in supporting children learning from home with low facilities and the ability to handle student needs. Therefore, these voices would provide essential insights for further decision-making regarding community school participation in supporting of government in fighting the coronavirus epidemic. Hence, a similar study was needed as additional research evidence that helps the government anticipate the spread of this deadly virus, especially in countries and regions experiencing different impacts.
