Abstract

This study aims to analyze human rights perspectives in resolving medical malpractice cases through penal mediation in Indonesia and the United States and find solutions to improve human rights protection in resolving such issues in Indonesia. The research was conducted by juridical normative research methods with a comparative approach, and the analysis was carried out by legal hermeneutics. The results showed that penal mediation in resolving medical malpractice cases needs to be improved in Indonesia to pay more attention to the human rights of victims and perpetrators, especially regarding equality and recognition of victims. In the United States, it is necessary to create consistent and detailed federal laws regarding penal mediation to resolve medical malpractice cases. The legal concept/regulation of human rights protection in resolving medical malpractice cases through penal mediation in Indonesia must ensure that the human rights of victims and perpetrators are protected and that the solutions found meet the needs of both parties fairly and humanely.

Abstract

Penelitian ini membahas konsep Citizen Lawsuit terhadap pelanggaran aturan-aturan lingkungan hidup di Indonesia melalui tinjauan normatif dari dogmatik hukum. Penelitian ini merupakan kajian hukum normatif, yang artinya mengupayakan kaidah, prinsip, dan doktrin hukum untuk menyikapi permasalahan hukum yang sebenarnya. Penelitian ini menggunakan metode statuta (pendekatan undang-undang) dalam analisisnya terhadap teks hukum. Arti Kata "Gugatan" Citizen gugatan adalah alat yang dapat digunakan oleh anggota masyarakat umum dalam upaya melindungi diri mereka secara hukum dari akibat perbuatan melawan hukum yang dilakukan oleh pejabat pemerintah. Walaupun Kitab Undang-Undang Hukum Acara Perdata (HIR/RBg) tidak secara tegas mengatur jenis gugatan Citizen Lawsuit, penulis studi ini menemukan bahwa Hakim tetap menerima dan mengadilinya berdasarkan Undang-Undang Kekuasaan Kehakiman dan melalui terobosan hukum. Hal ini terjadi meskipun Kitab Undang-Undang Hukum Acara Perdata (HIR/RBg) tidak mengatur dengan jelas jenis gugatan Citizen Lawsuit. Namun pada kenyataannya, tidak semua perkara Citizen Lawsuit diterima oleh Hakim Pengadilan Negeri karena para hakim memiliki pendapat yang berbeda mengenai jenis gugatan tersebut. Hal ini dikarenakan adanya perbedaan pendapat mengenai bentuk gugatan ini. Oleh karena itu, penulis menyarankan agar proses Gugatan Citizen Lawsuit diakomodir ke dalam hukum acara Indonesia untuk mencapai tujuan mencapai kejelasan hukum dan memberikan perlindungan hukum yang adil bagi individu yang ingin mempertahankan hak konstitusionalnya.

Abstract

The ever-expanding Indonesian cyberspace has ushered in significant economic growth to the country’s online business and e-commerce. This is due to the country’s rising internet penetration rate of 73% of its total population, with about 204 million people connected to the internet. This high connectivity has brought about several positive socio-economic opportunities but with other thorny issues like cybercrime, misinformation, cyber-induced intolerance, disinformation, trolling and cyber warfare. Despite the Indonesian government’s intervention with measures to regulate cyber activities, some devious cyber practices undefined in legal literature continue to be practiced, even passed as legitimate, sometimes leading to negative consequences. These practices are often conducted as organized operations that target populations to create mistrust and polarize the targeted population. Some are crafted as cyber warfare declared by entities within a country or from a foreign country targeting another’s populace, which poses a threat to social order. This paper explores these devious cyber practices and their strategies and mitigation possibilities. A sociological research approach coupled with the use of law enforcement theory was applied to study and analyze Indonesia’s cyber security law enforcement policies, the Internet and Electronic Transaction (ITE) Law, the Criminal Prosecution Act, the Constitutional law, civil society actors and private sector actors on cyber security. Indonesian law and international law, coupled with available technology, were reviewed for readiness to address threats posed by these devious cyber issues to social order. Measures taken by the Indonesian government are in readiness to combat these cyberspace issues in its jurisdiction but also present more questions on the proposals for reviews to the legislation and introduction of content monitoring systems, which risk being inappropriately deployed in censorships or suppression of legitimate freedom of expression.

Abstract

The brand is the manufacturer's public persona, a barometer of the company's public standing, and a watershed moment in the company's overall business strategy. There's no getting around the fact that a product's brand serves as its identity; after all, it's what sets one firm apart from another. The protection of registered marks, however, is sometimes the source of intricate legal challenges that obscure the mark's true significance. The purpose of this research is to evaluate and analyze the legal protection of registered trademarks and to determine the reason of the termination of its protection using a normative juridical approach. The research uncovered a number of potential triggers for a brand's registration to be revoked, such as the end of the brand's validity period, a request for revocation by the brand's owner, ministerial initiative based on the recommendation of the brand appeal Commission, or a lawsuit filed by a third party. Once the trademark is registered, it is protected for a certain length of time that may be extended. Legal action, criminal prosecution, and administrative measures like trademark cancellation or registration rejection all serve as deterrents. Defending corporate identities through trademarks is crucial in today's period of intense global competition. This study delves deeply into the value of brands to manufacturers and the legal hurdles that must be overcome to ensure a brand's long-term viability in a competitive market. With this knowledge in hand, company stakeholders may take the necessary initiatives to establish a brand that will endure. Protecting your name and your ideas are essential.

Abstract

Konstruksi dan pembentukan suatu peraturan perundangan di pengaruhi oleh faktor politik didalamnya. Politik hukum yang tidak bisa dipisahkan keberadaannya membuat suatu aturan yang dihasilkan akan terasa tujuan pembuatnya, begitupula dengan pembentukan peraturan daerah. Peraturan Daerah yang dibentuk sebagai turunan dari aturan diatasnya diharapkan dapat menyentuh masyarakat secara langsung. Peraturan Perundangan dibuat agar masyarakat bisa menjadi sejahtera, terutama bagi perempuan dan anak yang dianggap sebagai masyarakat yang rentan. Penulisan tulisan ini menganalisis konstruksi politik hukum di wilayah daerah. Peraturan daerah yang dianalisis yaitu Peraturan Daerah di Wilayah CIAYUMAJAKUNING. Harapan penulisan ini adalah agar dilihat salah satu contoh di daerah terkait bagaimana konstruksi politik hukum peraturan daerah khususnya yang berkaitan dengan perempuan dan anak.

Abstract

Legal protection for song copyrights is needed in order to create a better climate and atmosphere for the growth and development of music in Indonesia. The problem is how is the form of legal protection for song copyright holders for unlawful acts committed by corporations? What are the considerations of legal reasons and legal philosophical considerations by the Panel of Judges regarding Tort Towards Song Copyright by Corporations in the Court Ruling of the Central Jakarta District Court Number 19/Pdt.Sus-HakCipta/2020/PN.Niaga.Jkt.Pst. and Court Ruling of the Surabaya District Court Number 4/Pdt.Sus-HKI/HakCipta/2020/PN.Niaga.Sby.? Normative juridical research methods. In conclusion, legal protection for Tort toward song copyright by corporations. If there is a song copyright dispute, the settlement can be carried out through alternative dispute resolution, arbitration, a court where the court is a commercial court. The decision on the lawsuit must be pronounced no later than 90 (ninety) days after the lawsuit is registered. Therefore, the task of the judge to try cannot be separated from legal discovery activities. In the court decision verdict number 4/Pdt.Sus-HKI/HakCipta/2020/PN.Niaga.Sby. November 12, 2020, which rejected the Plaintiff's lawsuit in its entirety, is inappropriate because the Panel of Judges should carry out legal discovery activities by looking at Government Regulation Number 20 of 2017 Concerning Import or Export Control of Goods Allegedly Consisting of or Originating from Intellectual Property Rights Violations.

Abstract

The efforts of the local government of East Kalimantan Province and Kutai Kartanegara Regency to increase local revenue by proactively taking part in receiving a 10% Participating Interest (PI) offer in the Mahakam Block working area have been successful based on Permen ESDM No. 37 of 2016. The ministerial regulation stipulates that the legal subject for managing the 10% PI has several alternative forms of business entity, namely the old BUMD, new BUMD, or Regional Public Company (Perseroda). Based on these administrative procedures, the legal subject deemed to fulfill the requirements as a legal subject for the 10% PI Manager at the Mahakam WK is PT MMPKM which was formed as a Perseroda business entity. However, this has implications for the emergence of new norms regarding the definition and composition of Perseroda share ownership, as well as the legal subject requirements for managing a 10% PI between the Permen ESDM No. 37 of 2016 and the Regional Government Law, PP BUMD, and PP No. 35 of 2004. Furthermore, because of the scope of state finances, the negative implication is that local governments do not get the maximum regional income from dividends from BUMD holding company PT MMPKM.

Abstract

At this time, in the contemporary and modernization era, it is easier for couples who want to get married, especially with economic conditions that have begun to recover from the influence of the pandemic, so this is very supportive of quickly achieving their desire to marry. For couples who have previously been married and want to remarry, of course there are other requirements that must be met. Thus, sometimes some couples take shortcuts in falsifying their identity, such as being a widow or a virgin, in order to achieve their desire to get married officially. This is not impossible, in fact, it often happens that prospective female partners deliberately fake their identities to be accepted by male partners who are still virgins. The main problem in this research is how to implement the husband's right to annul the marriage due to falsifying the identity of the prospective wife, as well as how the judge's legal considerations are in resolving this problem. This study uses qualitative research methods with a normative descriptive approach. Data sources are based on literature studies and court decisions which are then analyzed using the content analysis method. The research results prove that the husband's rights in cases of identity fraud by his future wife are protected by the state based on statutory regulations so that the husband can take legal action to defend his rights. The judge in this case has given appropriate legal considerations so that no party is harmed as a consequence of their respective actions.
