Abstract

A foundation as a non-profit legal entity has a vital role in organising social, religious, and humanitarian activities. However, in practice, many foundations are involved in business activities directly and commercially, thus giving rise to legal issues related to violations of the non-profit principle, which is the basis for establishing the foundation. This study aims to analyse the limitations of business activities permitted for foundations according to Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations, and to explain the legal implications for foundations that exceed these provisions. This study uses a qualitative approach with a normative legal research type. The methods used include a statute and conceptual approach, with data sources from laws and regulations, scientific literature, legal documents, and related jurisprudence. The study results indicate that business activities can only be carried out by foundations through capital participation in business entities that are under the intent and purpose of the foundation. Foundations are prohibited from running a business directly and distributing profits to patrons, administrators, and supervisors. Violating these provisions can have legal implications in the form of administrative sanctions up to the foundation's dissolution. Therefore, compliance with legal restrictions is crucial in maintaining the legitimacy and sustainability of the foundation's social function.Keywords: Foundation; Business Activities; Limitations

Abstract

Penelitian ini bertujuan untuk mengembangkan modul pembelajaran IPA berbasis Project Based Learning (PjBL) yang terfokus pada peningkatan kemampuan kolaborasi siswa kelas 5. Menggunakan metode pengembangan model 4D (Define, Design, Develop, Disseminate). Penelitian ini melibatkan siswa kelas 5 sebagai subjek penelitian. Penelitian ini bertujuan : 1) Untuk mengetahui prosedur pengembangan modul pembelajaran IPA berbasis PjBL 2) Untuk mendeskripsikan kelayakan modul pembelajaran IPA berbasis PjBL, 3) Untuk mendeskripsi-kan efektivitas modul pembelajaran IPA berbasis PjBL terhadap peningkatan kemampuan ko-laborasi siswa. Instrumen penelitian yang digunakan melalui observasi kelas, penilaian kinerja siswa dalam kegiatan proyek, dan kuesioner untuk mengumpulkan umpan balik siswa terkait pengalamannya menggunakan modul. Hasil penelitian dapat disimpulkan bahwa modul pem-belajaran IPA berbasis PjBL layak digunakan dan dapat meningkatkan kemampuan ko-laborasi siswa kelas 5. Dibuktikan dengan persentase aspek materi dengan kategori valid, aspek bahasa dengan kategori sangat valid dan aspek media dengan kategori valid. Modul pembelajaran ini juga dapat meningkatkan keterampilan kolaborasi siswa, karena adanya pen-ingkatan keterampilan kolaborasi siswa pada kelas kontrol dan kelas eksperimen. Dilihat dengan adanya perbedaan hasil rata-rata nilai pada observasi akhir pada kelas eksperimen dan kelas kontrol. Maka dapat disimpulkan bahwa modul pembelajaran IPA berbasis PjBL untuk meningkatkan keterampilan kolaborasi layak digunakan.

Abstract

This study aims to analyse the legal status of foundations by Law No. 28 of 2004 and to examine the legal implications of the misuse of foundation functions between social and business interests. Foundations, as non-profit legal entities, play a strategic role in social and educational activities; however, in practice, there is a potential for the misuse of their functions for business activities that conflict with their social goals. This study employs a qualitative method, combining a literature and legislative approach, which analyses various legal sources and related provisions to explore the legal regulations surrounding foundations, their role in social and business activities, and the legal implications of a foundation deviating from its social goals. The results of the study indicate that although Law No. 28 of 2004 provides a clear legal basis for foundations, the practice of misusing foundation functions for business activities can still occur. Therefore, strict government supervision and adherence to the principles of transparency and accountability are necessary to ensure that foundations continue to operate in accordance with the social goals mandated by law.Keywords: Foundation; legal entity; Law No. 28 of 2004; social activities; business activities; legal implications

Abstract

Marriage is a strong contract or mitsaqan ghalizhan to obey Allah's commands with the aim of realizing a harmonious and loving household (sakinah, mawaddah wa rahmah). If the purpose of marriage is not achieved, then divorce is an act to break the marital relationship. The burden of living is part of the consequences of divorce which often causes irregularities when it occurs in divorce cases. In the decision on the divorce case number 1128/Pdt.G/2021/Pa.Bgr, the judge charged a living that was not in accordance with article 149 of the Compilation of Islamic Law. Therefore, this study was conducted to analyze the legal basis and considerations of the Bogor Religious Court Judges in deciding the burden of living and determining the amount. This research is qualitative research using normative-empirical legal research methods, through a case study approach. Based on the results of the study, the legal basis for the Panel of Judges in deciding the burden of past expenses refers to Article 80 of the Compilation of Islamic Law paragraph 4, regarding iddah and mut'ah living refers to the Indonesian Ministerial Regulation Number 3 of 2017 concerning guidelines for adjudicating women's cases in conflict with the law and the results of the meeting formulation. The Chamber of Religion as outlined in the Circular Letter of the Supreme Court of the Republic of Indonesia Number 3 of 2018 A. Regarding child support, it refers to Article 105 letter c of the Compilation of Islamic Law. Meanwhile, in determining the number of expenses for living expenses, the Judge considers two things, namely the husband's income and the needs of each party which are adjusted to the ability, fairness, and justice as well as the ability of the Defendant.

Abstract

Penelitan ini diawali dengan adanya kasus –kasus bullying yang tejadi dilingkungan pendidikan. Karena jaman sekarang banyak kekerasan yang terjadi di sekolah baik sekolah dasar (SD), sekolah menengah pertama (SMP), sekolah menengah atas (SMA)bahkan di pesantren-pesantren yang ada di indonesia. Mengingat anak seharusnya mendapatkan keamanan dan kenyamanan dilingkungan belajar dan bermainnya. Oleh karena itu penulis tertarik untuk melakukan penelitian tentang dampak bullying terhadap kesehatan mental siswa dipondok pesantren darul muttaqien. Tujuan penelitian ini adalah untuk mengetahui apa faktor yang menyebabkan adanya kasus Bullying di pondok Pesantren Darul Muttaqien, untuk mengetahui bagaimana bentuk-bentuk Bullying yang terjadi, dan untuk mengetahui bagaimana dampak Bullying terhadap kesehatan mental siswa dipondok pesantren Darul Muttaqien. Metode penelitian yang digunakan dalam penelitian ini adalah metode atau pendekatan kualitatif. Instrumen penelitian yang digunakan dalam penelitian ini yaitu pedoman wawancara, pedoman kuesioner, observasi, dan dokumentasi. Sampel yang digunakan dalam penelitian ini yaitu dengan menyebar angket kepada santri laki-laki kelas 1, 2, dan 3 MTs darul muttaqien sebanyak 50 santri. Hasil yang didapatkan dari penelitian ini yaitu, bullying dapat mengganggu kesehatan mental siswa. seperti gangguan stres bahkan trauma atas kekerasan tersebut.

Abstract

Tujuan penelitian ini adalah untuk mengetahui “Apakah terdapat Korelasi antara Pembelajaran Online terhadap Hasil Belajar Akidah Akhlak kelas VII MTs Darul Muttaqien”. Untuk mengetahui hubungan pembelajaran online terhadap hasil belajar Akidah Akhlak kelas VII Mts Darul Muttaqien. Penelitian ini merupakan penelitian kuantitatif. Teknik pengumpulan data meliputi angket dan dokumentasi. Digunakan untuk memperoleh data tentang pembelajaran online siswa MTs Darul Muttaqien yang digunakan sebagai sampel penelitian. Sedangkan teknik dokumentasi digunakan untuk memperoleh data mengenai hasil pembelajar Akidah Akhlak, serta jumlah populasi. Hasil penelitian mengenai korelasi Pembelajaran Online terhadap Hasil Belajar Akidah Akhlak MTs Darul Muttaqien, menunjukan bahwa tidak terdapat hubungan antara pembelajaran online terhadap hasil belajar Akidah Akhlak siswa dengan nilai 0,257 yang terletak antara interval 0,20 – 0,40 yang termasuk korelasi kurang. Kemudian dengan melihat para “r” dengan nilai signifikasinya di peroleh “r” tabel sebesar 0,361. Dengan demikian para taraf signifikasi 5% “r” hitung = 0,257 < dari “r” tabel = 0,361 berarti hipotesis alternatif (Ha) ditolak.

Abstract

Pendidikan Agama Islam khususnya materi pembelajaran fiqih merupakan usaha yang cukup mapan terarah, untuk menciptakan manusia secara fisik dan psikis yang taat kepada aturan beribadah seorang muslim. Materi pembelajaran fiqih mempunyai peran penting dalam memperbaiki ibadah anak-anak dan mengangkat derajat mereka yang lebih tinggi, serta berbahagia dalam hidup dan kehidupannya, oleh karena itu pendidikan agama harus diberikan mulai sejak dini kepada anak-anak. Tujuan penelitian ini untuk mengetahui pemahaman dan pengamalan Mata Pelajaran Fiqih tentang shalat berjamaah dan untuk mengetahui adanya Hubungan antara pemahaman materi pembelajaran fiqih dengan pengamalan ibadah sholat wajib di Mts Nurul Ihya kota Bogor. Penelitian ini menggunakan metode kuantitatif. Dari hasil penelitian ditemukan bahwa Hubungan Materi pembelajaran Fiqih dengan Praktek Ibadah Shalat (Dzuhur) siswa, diperoleh besarnya rxy 0.56 jika dilihat dari tabel interpretasi maka indeks korelasi yang diperoleh yaitu 0.56 yang terletak antara 0.40-0.70, dilihat dari tabel interpretasi data yang termasuk korelasi sedang atau cukup. Kemudian dengan melihat tabel nilai “r” product moment ternyata dengan df 18, maka dari taraf signifikan 5% diperoleh r tabel 0.3783. Dengan demikian pada taraf signifikan 5% rxy = 0,56 > r tabel 0,3783, berarti hipotesis alternatif (Ha) diterima, yang berarti terdapat hubungan yang signifikan antara Materi Pembelajaran Fiqih dengan pengamalan Ibadah Shalat Siswa di MTs. Nurul Ihya Kota Bogor.

Abstract

The demonstration method is a learning method that uses demonstrations to clarify a concept or to show the whole class about a process or instructions for doing something. Implementation of the Demonstration Method to increase student activity, so that they can interact more easily with teachers or classmates and can make it easier to understand the material presented by the teacher. This study aims to determine the implementation of the demonstration method in Fiqh learning at MAN 1 Bogor City, and its impact on student activity. The demonstration method was chosen because it can increase student interaction with teachers and friends, and make it easier to understand the material. The study used a qualitative approach through observation, interviews, documentation, and questionnaires, with data analysis in the form of reduction, presentation, and drawing conclusions. The results of the paired sample t-test showed an increase in student activity by 29.27% ​​after the implementation of the demonstration method. The supporting factors for the success of this method are student enthusiasm and the relevance of the material, while the inhibiting factors include limited time and facilities.

Abstract

Alternative Dispute Resolution (ADR) is a way to resolve disputes that is humane and fair. Humane because the decision (peace agreement) is the authority of the disputing parties and maintains good relations. Fair because each party negotiates a solution to the problem and the results are satisfactory, based on PERMA (Supreme Court Regulation) no. 1 of 2016 every divorce or dispute problem registered in court must follow the procedure that the parties to the case or the attorney must go through a mediation process first before proceeding to the next trial stage, but in reality the increase in divorce cases continues to increase every year, because public understanding of the law increases and there are many other factors, a mediator makes his position as a neutral party to the decisions of the parties, This study uses a qualitative research method, namely field research with observation, interview and documentation techniques, The purpose of this study is first, To explain the mediation process carried out by the Judge in resolving divorce cases. Second, To explain the Mediator Judge's Strategy in mediating Divorce cases. Third, To find out the role of the Judge in mediating the case resolution process at the Cibinong Religious Court. The results of this study indicate that in its role, the mediator judge ensures that the mediation process runs according to the law, provides understanding, and provides advice based on religion, personal experience, and successful mediation cases. In this case, it is done with the aim that the parties in the case at the Cibinong Religious Court are expected to make whatever the decision in court or the results of the mediation process as a valuable lesson in living together in the future.

Abstract

The low learning outcomes of students in the Fiqh subject at MTs Negeri Kota Bogor, particularly in the topic of halal and haram food and beverages, highlight the need to improve the quality of learning. This study aims to enhance students’ learning outcomes and active participation through the application of the Mind Mapping method. The research employed a Classroom Action Research (CAR) approach using the Kemmis and McTaggart model, which consists of four stages: planning, action, observation, and reflection. The study was conducted in two cycles involving 32 students of class VIII-B and one Fiqh subject teacher. Data were collected through observation sheets and achievement tests. The findings revealed a significant increase in student performance. In the pre-cycle stage, only 12.5% of students achieved the minimum passing grade. After implementing the Mind Mapping method, this figure rose to 68.75% in the first cycle and 96.8% in the second cycle. The average score also increased from 63 to 89. The results conclude that the Mind Mapping method is effective in improving students’ understanding and learning outcomes, as well as promoting greater engagement in Fiqh learning. Abstrak Rendahnya hasil belajar siswa pada mata pelajaran Fikih di MTs Negeri Kota Bogor, khususnya pada materi makanan dan minuman halal dan haram, menjadi perhatian penting dalam peningkatan kualitas pembelajaran. Penelitian ini bertujuan untuk meningkatkan hasil belajar dan partisipasi aktif siswa melalui penerapan metode Mind Mapping. Metode yang digunakan adalah Penelitian Tindakan Kelas (PTK) model Kemmis dan Mc. Taggart yang dilaksanakan dalam dua siklus. Subjek penelitian adalah 32 siswa kelas VIII-B dan satu orang guru mata pelajaran Fikih. Instrumen pengumpulan data meliputi observasi dan tes hasil belajar. Hasil penelitian menunjukkan peningkatan signifikan pada capaian belajar siswa. Pada pra-siklus, hanya 12,5% siswa yang mencapai ketuntasan. Setelah penerapan metode Mind Mapping, ketuntasan meningkat menjadi 68,75% pada siklus I dan mencapai 96,8% pada siklus II. Rata-rata nilai siswa juga meningkat dari 63 menjadi 89. Simpulan dari penelitian ini adalah bahwa metode Mind Mapping terbukti efektif dalam meningkatkan hasil belajar siswa serta mendorong keterlibatan aktif mereka dalam proses pembelajaran Fikih.
