Abstract

Investment apps have become an important part of the investment culture throughout the world and have helped democratize investment opportunities for many people. The utilization of investment apps in Indonesia has opened many doors for Indonesians to invest their wealth and obtain many different kinds of assets, posing cybersecurity risks that threaten the interests of their users. This study aims to analyze and provide literature for possible future legislation that affects the utilization of investment apps. Using the normative legal research method, this study analyzes the intersection of investment law and consumer protection law in Indonesia in the context of the utilization of investment apps. Through the statutory approach, this study finds that the normative restrictions within the respective laws make it difficult to properly define legal liability for many kinds of problems that can arise from cybersecurity risks in the context of the utilization of investment apps. The findings of this article serve as a contribution to the constantly expanding literature for Indonesian legal development, specifically on the quest to adapt to the changes brought about by the latest technologies.Aplikasi investasi telah menjadi bagian penting dari budaya investasi di seluruh dunia dan telah membantu mendemokratisasi peluang investasi bagi banyak orang. Penggunaan aplikasi investasi di Indonesia telah membuka banyak pintu bagi masyarakat Indonesia untuk menginvestasikan kekayaan mereka dan mendapatkan berbagai jenis aset, yang menimbulkan risiko keamanan siber yang mengancam kepentingan penggunanya. Penelitian ini bertujuan untuk menganalisis dan menyediakan literatur untuk kemungkinan legislasi di masa depan yang mempengaruhi pemanfaatan aplikasi investasi. Dengan menggunakan metode penelitian hukum normatif, penelitian ini menganalisis persinggungan antara hukum investasi dan hukum perlindungan konsumen di Indonesia dalam konteks pemanfaatan aplikasi investasi. Melalui pendekatan perundang-undangan, penelitian ini menemukan bahwa pembatasan normatif dalam masing-masing undang-undang menyulitkan untuk mendefinisikan pertanggungjawaban hukum secara tepat untuk berbagai jenis masalah yang dapat timbul dari risiko keamanan siber dalam konteks penggunaan aplikasi investasi. Temuan dari artikel ini berfungsi sebagai kontribusi terhadap literatur yang terus berkembang untuk pengembangan hukum di Indonesia, khususnya dalam upaya untuk beradaptasi dengan perubahan yang dibawa oleh teknologi terbaru.

Abstract

The phenomenon of “no viral no justice” that emerged on social media reflects the pessimistic attitude of the Indonesian society towards law enforcement. People have found a new legal culture in law enforcement, particularly by using social media as a tool for social control (civil engagement). However, the participation of the public on social media has had negative impacts due to the lack of alignment between legal awareness and emotional reactions to the law. The excessive reliance on emotional reactions has created an unhealthy legal culture and can influence the law enforcement system. The urgency of this research is driven by the increasingly alarming condition of law enforcement in Indonesia, which has led to public participation (people power) that tends to influence and hinder the law enforcement process. The pressures imposed on law enforcement authorities create legal uncertainty and undermine justice itself. Therefore, the discussion on the role of social media as a tool for the public's pursuit of justice in law enforcement in Indonesia is important and relevant for further study. This research aims to examine the influence and relationship of democratic public participation through social media in realizing the three fundamental legal values: justice, certainty, and utility. The research methodology used in this study is socio-legal research. The findings demonstrate that public participation through social media in monitoring the law enforcement process is essential in achieving justice, certainty, and utility. To minimize the emergence of an unhealthy new legal culture (monitoring) in society, it is necessary to enhance legal awareness and conduct targeted monitoring based on thoughtful thinking, reasoning, and argumentation.

Abstract

Indonesia boasts abundant natural resources, yet its registered Geographical Indication products remain limited compared to India. Despite its strategic geographical location and diverse offerings, many Indonesian Geographical Indication products lack registration and protection. This research conducts a legal comparison of Geographical Indication product protection between Indonesia and India. Utilizing a normative juridical approach and qualitative analysis of secondary legal materials, the study examines Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Indonesia and The Geographical Indications of Goods (Registration and Protection) Act, 1999 in India. The findings reveal that Indonesia lacks a time limit for protection, unlike India, which grants ten renewable years of protection with more stringent sanctions. Considering India's approach, Indonesia should tailor its protection timeframe and penalties to its unique context for optimal results.

Abstract

The existence of violations of personal data remains a legal issue at present. The protection of personal data is of utmost importance, serving not only as a safeguard but also as the foundation for comprehensive regulations concerning personal data. This research aims to compare regulations on personal data protection between Indonesia and Thailand, with a particular emphasis on human rights aspects. The research methodology used is normative legal research. The findings of this study reveal that both Indonesia and Thailand recognize that personal data protection is an integral part of human rights. This acknowledgment is reflected in their respective constitutions and various applicable laws. Indonesia recently enacted specific legislation on personal data protection in 2022, but its implementation still faces various challenges. The results of this research indicate that while both countries recognize the significance of personal data protection as a component of human rights, there are significant differences in their approaches and implementations between Indonesia and Thailand.

Abstract

In 2020, Law Number 11 of 2020 concerning Job Creation has been enacted. With this, it also changes the legislation regarding employment, including Government Regulation Number 35 of 2021. The purpose of this research is to find out the implementation of Government Regulation Number 35 of 2021 concerning PKWT, Outsourcing, WKWI, and PHK after the Constitutional Court Decision on Providing Compensation for PKWT Workers and providing solutions in accordance with the laws and regulations and facts found in the field in order to overcome the obstacles that occur. This research uses the Empirical/Sociological type of legal research because the data to be used is mainly data obtained directly which is primary data. Compensation is the right of workers who are bound by a Fixed-Term Employment Agreement (PKWT), so employers are obliged to provide the rights of PKWT workers at the end of the working period in accordance with the employment agreement. If the employer does not pay compensation rights, administrative sanctions will be imposed in accordance with applicable regulations.

Abstract

Thorough COVID-19 pandemic considered done in Indonesia, In terms of surveillance and detection, countermeasures are carried out by examining COVID-19 specimens by the network of COVID-19 examination laboratories. The gold standard for COVID-19 examination is to carry out an RT-PCR (Real Time Polymerase Chain Reaction) test from samples taken with nasopharyngeal and oropharyngeal swabs. Batam City so far has had several laboratories for examining COVID-19 specimens that examined COVID-19 specimens with the RT-PCR test. The number of positive COVID-19 in Batam City until April 18, 2022 was 30,960 people obtained from the results of examinations by the COVID-19 examining laboratory. Arrangements are needed to ensure that all laboratories that carry out testing of COVID-19 specimens have standards and work in maximum capacity so that fast and valid COVID-19 specimen examination results are obtained. This study analyzes the effectiveness of the Decree of the Minister of Health (Kepmenkes) of the Republic of Indonesia Number HK.01.07/MENKES/4642/2021 concerning the Implementation of the Corona Virus Disease 2019 (COVID-19) Examination Laboratory in the development of the COVID-19 examination laboratory in Batam City. Laboratory development is carried out by the Environmental Health and Disease Control Engineering Center (BTKLPP) Class I Batam. This study uses an empirical juridical method with a qualitative approach using secondary data. From the results of the research carried out, it was found that to get fast and valid results, the laboratory for examining COVID-19 specimens must have a standard that is a reference which refers to the Decree of the Minister of Health (Kepmenkes) RI Number HK.01.07/MENKES/4642/2021 concerning Organizing the Corona Virus Disease 2019 (COVID-19) Examination Laboratory and supervisory laboratory in carrying out guidance and supervision of the implementation of the examination of COVID-19 specimens in each of the laboratories for examining COVID-19 specimens in Batam City.

Abstract

One of the impacts of the COVID-19 pandemic is the default of high-yield promissory notes issued by PT Indosterling Optima Investa. This default case has led to the criminal trial of the CEO of PT Indosterling Optima Investa, who was acquitted, and the PKPU (Postponement of Debt Payment Obligation) decision stipulating the restructuring of interest payments and principal debt to investors. This research aims to determine the form of responsibility of PT Indosterling Optima Investa as the issuer for the losses suffered by investors due to the default of high-yield promissory notes and what legal protections are available for investors against the default of high-yield promissory notes issued by PT Indosterling Optima Investa. The type of research used in this paper is empirical legal research, where law is conceptualized as a social institution that is realistically associated with other social variables.

Abstract

This research generally aims to determine the role of the Batam Concession Agency and the strategy of the Batam Concession Agency in managing land related to the existence of idle land. The research method used in this research is the normative juridical research method, namely a research method whose main data is obtained from statutory regulations. Based on the research results obtained and analyzed by land researchers in Batam City, it is regulated based on PERKA No. 3 of 2020 concerning the Implementation of Land Allocation, Land Rights in Batam City are divided into two, namely, HGB for 30 years and can be extended for 25 years, and Right to Use for 25 years and can be extended for 20 years, both rights can be renewed according to their interests . The position of the land agreement in Batam City is a product issued by BP Batam. The land agreement is made based on the request of the beneficiary of the Right to Get the approval from the head of BP Batam. Regarding idle land in the city of Batam, it is divided into two, land that has not yet completed administration and idle land that has completed administration but has not been utilized properly.

Abstract

The aim of this research is to conduct a comparative analysis of the regulation and implementation of e-commerce taxation rules in each country, as measured through their impact on the economies of these nations. This study employs a normative juridical approach. The findings indicate that Indonesia could benefit from learning from Singapore, one of the leading Asian countries in terms of economic growth derived from the e-commerce sector. This serves as evidence of the success of implementing taxation regulations and legal frameworks related to e-commerce in Singapore. Minister of Finance Regulation Number 60 of 2022 (PMK Number 60/2022) represents a strategic step in regulating e-commerce taxation in Indonesia, granting the government the authority to establish order, fairness, and sustainable economic growth in the digital era. In response to the challenges presented by e-commerce, Singapore has made adjustments to its taxation regulations, even though there are no specific provisions in place for the digital economy. The guidelines issued by the Inland Revenue Authority of Singapore (IRAS) serve as crucial reference points for determining tax obligations in e-commerce transactions, taking into account factors such as production location and website hosting

Abstract

The provisions pertaining to bankruptcy and summary proof in Law Number 37 of 2004 present various drawbacks in their application, particularly impacting debtors. Debtors can be declared bankrupt with relative ease, and the requirement for declaring bankruptcy does not directly indicate the debtor’s insolvency. This can present difficulties for other creditors, as the leniency in bankruptcy requirements for debtors is viewed as means to accelerate debt resolution, even though not all face the same circumstances. This research will focus on the issues regarding the urgency of revising Law Number 37 of 2004, specifically with regard to the conditions for bankruptcy and summary proof. The method used in this research is the doctrinal legal research method, which entails scrutinizing literary sources, legal theories or principles, research journals, and legislative regulations to analyze the subject of the research. Furthermore, a comparative approach is adopted to evaluate the development of Indonesian law by examining the bankruptcy legal frameworks in France and the Netherlands. The study concludes that the pressing need for amendments to the conditions for bankruptcy and summary proof in Law Number 37 of 2004 necessitates a responsive legal system. This can be achieved through a comprehensive review of problematic regulations. Therefore, the incorporation of additional measures, such as an insolvency test and a proactive approach by judges, establishes a regulatory mechanism that can be viewed as a responsive outcome in the future.
