Abstract

In Indonesia, sharia economic law is implemented through Religious Courts which have an important role in resolving disputes involving sharia financial entities such as banks, microfinance institutions, and insurance. Law Number 3 of 2006 replaces Law Number 7 of 1989 which significantly expands the authority of the Religious Courts in supervising and enforcing sharia economic principles. Sharia economics, which is based on Islamic values ​​such as justice, honesty, and legal certainty, forms an economic and financial system that is different from conventional systems. Religious Court Judges strive to balance ethical and practical considerations in carrying out their judicial duties. This research examines how ethical perspectives and practical considerations contribute to achieving legal certainty and justice in resolving sharia economic disputes, especially in the Surabaya Religious Court. This research uses a normative juridical approach using legal utility theory to analyze the challenges faced and propose strategies to increase the effectiveness of implementing simple, efficient, and cost-effective principles in Sharia economic protection at the Surabaya High Religious Court. The research results consider the principles of maqasid al-syariah to simplify the process, lighten the burden on the parties involved, and uphold justice in every decision-making. This study emphasizes the need for better integration between Islamic Sharia principles and Sharia banking practices in Indonesia, as well as encouraging reforms to ensure that legal outcomes provide fair justice and maximum social benefits, in line with the ethical and utilitarian aims of the law.

Abstract

Purpose – This study investigates the integration of productive waqf into Sharia insurance in Indonesia and its contribution to investment benefits and life protection. It aims to explore how waqf can enhance the economic and social impacts of Sharia insurance products.Methodology – A qualitative approach was employed, involving a comprehensive review of the literature on waqf, Sharia insurance, and Islamic finance. Additionally, interviews were conducted with experts in Sharia insurance and waqf management to gather insights into the current practices and challenges.Findings – This study reveals that productive waqf initiatives within Sharia insurance have the potential to significantly improve investment returns and expand the scope of life protection benefits offered to participants. It identifies key areas in which waqf funds can be deployed effectively, such as long-term investment projects and social welfare programs.Implications – The findings have practical implications for policymakers, Sharia insurance providers, and waqf administrators in enhancing collaboration to maximize the socio-economic benefits of waqf. By integrating waqf into insurance products, stakeholders can foster sustainable development and financial inclusivity.Originality – This study contributes to the literature by offering insights into the innovative use of waqf within the dynamic context of Sharia insurance. It underscores the originality of leveraging waqf assets to address contemporary socioeconomic challenges and promote ethical finance principles.

Abstract

Abstract: The purpose of this study is to review the concept of ta’āwun taught by Rasulullah Shalallahu Alaihi Wassalam and the reality of ta’āwun practice in the Islamic insurance industry in Indonesia. This research is also intended as a critique and input on the current practice of implementing ta’āwun. In contrast to conventional insurance, which uses a sale and purchase contract in its transactions, Sharia insurance uses the concept of ta’āwun in its transaction contracts. Qs. Al-Maidah verse 2 is the legal basis of this ta’āwun concept. This research used qualitative methods, the descriptive approach, and library research. The results of this study conclude that the concept of ta’āwun used by Islamic insurance currently needs to fully reflect the concept of ta’āwun in Qs Al-Maidah verse 2,  which has been practised by Rasulullah Shalallahu Alaihi Wassalam and his friends. In practice, Sharia insurance companies set a maximum age limit for prospective participants, while the maximum age for participation is 65 years. This maximum age limit for participation means that not all prospective Sharia insurance participants can be accepted as customers. It is undoubtedly different from the practice of ta’āwun that existed at the time of Rasulullah Shalallahu Alaihi Wassalam, where the concept of ta’āwun was carried out without knowing the conditions. It is fitting for Sharia insurance to adhere to the principle of monotheism properly and rely on Allah Subhanallahu Wata'ala to carry out the wheels of its Sharia insurance business by not limiting participation age. Sharia insurance practitioners naturally adhere to the principles of ta’āwun and monotheism and believe with certainty that to worship Allah Subhanallahu wa Ta'ala, even though there is no age limit for participation, the company will still get the benefits expected in other ways.Abstrak: Tujuan dari penelitian ini adalah untuk mengulas konsep ta’āwun yang diajarkan oleh Rasulullah Shalallahu Alaihi Wassalam dan realita praktik ta’āwun di dunia industri asuransi syariah di Indonesia. Penelitian ini juga dimaksudkan sebagai kritik dan masukan terhadap praktik penerapan ta’āwun yang berlangsung saat ini. Berbeda dengan asuransi konvensial yang mempergunakan akad jual beli dalam transaksinya, asuransi Syariah menggunakan konsep ta’āwun dalam akad transaksi­nya. Qs. Al-Maidah ayat 2 adalah landasan hukum dari konsep ta’āwun ini. Metode penelitian yang digunakan dalam penulisan artikel ini adalah kualitatif, adapun pendekatan yang digunakan adalah desktiptif. Sedangkan jenis penelitian yang digunakan adalah Kepustakaan (Library Research). Hasil dari penelitian ini menyimpulkan bahwa konsep ta’āwun yang digunakan asuransi Syariah saat ini masih belum mencerminkan sepenuhnya konsep ta’āwun yang ada di dalam Qs. Al-Maidah ayat 2 yang sudah dipraktikan oleh Rasulullah Shalallahu Alaihi Wassalam dan para sahabatnya. Dalam praktiknya, perusahaan asuransi Syariah menetap­kan batas maksimal usia bagi calon peserta, adapaun maksimal usia kepersertaan adalah 65 tahun. Pembatasan maksimal usia kepersertaan ini  membuat tidak semua calon peserta asuransi Syariah dapat diterima menjadi nasabah. Hal ini tentu berbeda dengan praktik ta’āwun yang ada di jaman Rasulullah Shalallahu Alaihi Wassalam di mana konsep ta’āwun yang dilakukan tanpa mengenal syarat. Sudah sepatutnya asuransi Syariah memegang prinsip tauhid dengan benar serta bertawakal kepada Allah Subhanallahu Wata’ala dalam menjalankan roda bisnisnya dengan tidak membatasi usia kepersertaan. Para praktisi asuransi Syariah sudah sewajarnya meme­gang prinsip ta’āwun, tauhid dan yakin dengan seyakin-yakinnya bahwa dengan niat beribadah kepada Allah Subhanallahu wa Ta’ala, walaupun tidak ada pembatasan usia kepersertaan, tetap akan mendapatkan keuntungan sebagaimana yang diharapkan oleh perusahaan.

Abstract

Pangandaran Regency holds considerable potential to emerge as a prominent halal tourism destination, supported by places of worship, halal cuisine, Islamic boarding school-based creative economies and halal accommodations. Despite these assets, the absence of specific regulations governing halal tourism hinders full optimization. Presently, Pangandaran relies on broader frameworks like West Java Governor Regulation Number 1 of 2022 on Sharia Economy and Finance Development, along with the 2019 West Java Halal Tourism Guidelines. This study explores the application of Islamic service ethics as a tailored regulatory approach to foster halal tourism growth in Pangandaran. It also aims to identify implementation challenges and propose viable solutions. The research uses qualitative methods to draw from regulatory analysis, interviews, questionnaires, observations, and documentation. The theoretical framework incorporates contemporary maqashid Sharia, legal change theory, maslahah mursalah, and halal theory. Findings reveal that integrating Islamic service ethics can effectively serve as a specialized regulation to unlock Pangandaran's halal tourism potential. This approach enhances security, comfort, and appeal for Muslim tourists, aligning with their religious values. Furthermore, the study underscores the broader economic benefits of halal tourism, offering a scalable regulatory model applicable to other regions with similar potential. The implications of this research extend to Islamic economics by promoting Sharia principles within the tourism sector, driving economic growth, and positioning Pangandaran as a leading halal tourism hub. This initiative bolsters local development and contributes to the overarching vision of integrated halal tourism in Indonesia.

Abstract

Penelitian ini bertujuan untuk menganalisis tafsir Q.S. Al-Baqarah 271 dalam Tafsir Al-Misbah terkait fenomena sedekah di media sosial, dengan fokus pada keseimbangan antara keikhlasan dan eksistensi diri. Penelitian ini menggunakan metode deskriptif kualitatif dengan pendekatan studi literatur, mengkaji Tafsir Al-Misbah, hadis, serta fenomena sosial yang berkembang. Hasil penelitian menunjukkan bahwa media sosial dapat menjadi sarana meningkatkan kesadaran untuk bersedekah, namun juga berpotensi menimbulkan niat yang tidak murni. Tafsir Al-Misbah menegaskan bahwa publikasi sedekah diperbolehkan jika dilakukan dengan niat yang benar. Studi ini memberikan kontribusi terhadap kajian Islam kontemporer dengan menghubungkan tafsir klasik dan praktik digital modern serta menawarkan panduan praktis menjaga keikhlasan dalam aktivitas sedekah daring.

Abstract

Purpose – This study explores the transformation of zakat distribution principles as outlined in Nahdlatul Ulama’s Fatwa Bahtsul Masail and its implications for Indonesia's legal regulations. The goal is to understand how these principles can enhance zakat management by addressing social inequality and poverty alleviation.Methodology – A normative juridical approach was used, with a descriptive analytical study based on a literature review. The research focuses on four main aspects: analyzing zakat distribution principles in the context of Indonesian law, examining the legal reasoning (istinbath hukum) behind these principles, identifying factors driving and hindering the transformation, and assessing the significance of implementing these principles in Indonesian legal frameworks.Findings – This study identifies three main principles—justice, equality, and regionality—that should be integrated into regulatory frameworks. It also highlights challenges, including a lack of public participation in zakat distribution through official institutions, such as NU CARE-LAZISNU.Implications – The findings suggest the need for increased socialization of zakat management principles by the National Amil Zakat Agency (Badan Amil Zakat Nasional, BAZNAS), based on both Sharia and secure legal regulations, to enhance the effectiveness of zakat management in Indonesia.Originality – This research provides valuable insights into the evolving principles of zakat distribution and their integration into legal frameworks, contributing to the adaptation of zakat management practices to contemporary challenges in Indonesia.

Abstract

This study examines the practice of qardhul hasan funded by zakat through the perspective of maqasid sharia, focusing on case studies in Indonesia and Malaysia. Qardhul hasan, defined as an interest-free loan, presents a promising method for effectively utilizing zakat funds; however, its implementation within the framework of Islamic law remains a subject of ongoing debate. A qualitative approach was employed, including content analysis and semi-structured interviews with experts in zakat and Islamic law. The findings indicate that maqasid sharia provides a strong foundation for implementing qardhul hasan, particularly in supporting post-pandemic economic recovery. It is crucial to establish clear parameters and guidelines to ensure that qardhul hasan practices adhere to sharia principles and achieve the goal of social justice. This research advances the current understanding of qardhul hasan by highlighting its potential impact on zakat management and economic recovery. Additionally, it encourages zakat policymakers and practitioners to focus on developing effective systems aligned with maqasid sharia and emphasizes the need for ongoing evaluation and trials to enhance zakat's role in societal welfare.

Abstract

Transformasi digital telah membuka peluang baru dalam praktik filantropi Islam, termasuk sedekah. Artikel ini mengkaji implementasi sedekah berbasis teknologi digital dalam pemberdayaan ekonomi modern, dengan telaah terhadap QS. Al-Baqarah ayat 271 sebagai dasar normatif. Latar belakang dari penelitian ini adalah meningkatnya kebutuhan akan sistem distribusi sedekah yang lebih transparan, efisien, dan adaptif terhadap perkembangan teknologi. Tujuan penelitian ini adalah untuk menganalisis bagaimana digitalisasi sedekah dapat memperkuat peranannya dalam pemberdayaan ekonomi masyarakat secara berkelanjutan. Metodologi yang digunakan adalah kualitatif deskriptif dengan pendekatan studi kepustakaan (library research), analisis tafsir tematik terhadap ayat Al-Qur’an, serta studi kasus beberapa platform digital yang telah mengaplikasikan sedekah secara daring. Hasil penelitian menunjukkan bahwa implementasi teknologi digital dalam praktik sedekah meningkatkan partisipasi publik, akuntabilitas pengelolaan dana, dan efektivitas distribusi kepada penerima manfaat. Penelitian ini menawarkan kebaruan dalam mengintegrasikan nilai-nilai spiritual Islam dengan sistem ekonomi modern berbasis teknologi, serta berkontribusi terhadap pengembangan model ekonomi Islam yang inklusif dan adaptif. Kesimpulannya, digitalisasi sedekah bukan hanya sebagai inovasi teknis, tetapi sebagai strategi pemberdayaan ekonomi yang relevan dengan nilai-nilai Al-Qur’an dan kebutuhan zaman.

Abstract

Online gambling has become a rapidly growing issue, leading to financial losses and mental health challenges. In Malaysia, online gambling is regulated under progressive Islamic law which focuses on social justice, while Indonesia struggles with weak enforcement despite existing regulations. This study discusses three main parts: first, current online gambling regulation in Indonesia and Malaysia; second, Malaysia’s progressive legal experience as a blueprint for Indonesia; and third, social justice and SDGs-based online gambling regulation for Muslim-majority countries. A qualitative approach, including case studies, in-depth interviews with legal experts, and document analysis in both countries, was employed. The findings show that Malaysia’s implementation of progressive Islamic law has been effective in managing online gambling, promoting social justice, and reducing financial and mental health impacts. In contrast, weak law enforcement in Indonesia exacerbates the social issues related to online gambling. The research concludes that Malaysia’s approach has successfully regulated online gambling and supported SDG achievement. Therefore, Indonesia should consider adopting more progressive Islamic legal principles to enhance law enforcement and reduce the social harms of online gambling.
