Abstract

Ijma’ sebagai konsensus kolektif para ulama, memegang posisi sentral dalam hierarki sumber hukum Islam setelah Al-Qur’an dan Sunnah. Sebagai mekanisme otoritatif dalam menetapkan hukum pada persoalan yang tidak ditemukan secara eksplisit dalam nash. Ijma’ memiliki kekuatan legitimasi yang cukup kuat dalam menjaga kontinuitas, kesatuan, dan otentisitas hukum Islam. Penelitian ini bertujuan untuk mengeksplorasi secara komprehensif konsep, sejarah, dan fungsi ijma’ dalam pembentukan hukum Islam, khususnya dalam merespons tantangan zaman modern yang ditandai dengan perubahan sosial, kemajuan teknologi, dan interaksi budaya yang semakin kompleks. Dengan menggunakan pendekatan normatif-historis, penelitian ini menelaah bagaimana ijma’ dapat tetap berfungsi sebagai sumber hukum yang dinamis dan tidak statis, serta mengkaji tantangan-tantangan aktual seperti fragmentasi otoritas keilmuan, pluralitas pandangan mazhab, dan integrasi nilai-nilai global ke dalam sistem hukum Islam. Hasil penelitian menunjukkan bahwa praktik ijma’ pada masa klasik sangat efektif karena bersandar pada otoritas ulama yang terpusat, sedangkan di era modern, praktik ijma’ lebih efektif bila diformulasikan melalui lembaga-lembaga keagamaan resmi seperti Majelis Ulama Indonesia, dewan fatwa, dan forum ijtihad kolektif lintas mazhab. Kebaruan penelitian ini terlihat dari analisis konstruktif terhadap ijma’ sebagai instrumen hukum yang potensial untuk diperkuat kembali melalui pendekatan kelembagaan dan kolektif lintas disiplin agar mampu menghadirkan solusi hukum yang inklusif dan kontekstual. Penelitian ini menawarkan kerangka revitalisasi ijma’ dalam ranah hukum Islam kontemporer, sehingga dapat berfungsi tidak hanya sebagai konsensus keilmuan klasik, tetapi juga sebagai forum partisipatif umat dalam merumuskan hukum yang adil, adaptif, dan tetap berpijak pada maqashid al-shari’ah.

Abstract

The need for mediation is motivated by the accumulation of cases at the cassation level. Every year the cases that come to court are not decreasing, but are increasing. Meanwhile, the judge who has to resolve the case has limited capacity, so the cases that come in cannot be resolved quickly. This happened at the Religious Court in the Banjarmasin PTA area. Therefore, the concept of mediation is needed to reduce the problem of the accumulation of cases that occur at the religious court level, in terms of the benefit of children's growth and development. The research approach chosen uses an empirical juridical approach with a descriptive research method of analysis of theories of mediation and child protection and their implementation in judges' decisions regarding divorce in the Religious Courts in the Banjarmasin PTA area. Divorce has a negative impact on children's psychological development, because in general the psychological development of children whose parents are divorced is very disturbed, apart from that, the negative factor resulting from divorce is the lack of love and attention from both parents. Psychologically, parental divorce results in changes in behavior, responsibility and emotional stability.

Abstract

Urf or community customs have an important role in the development of Islamic law. As one of the sources of law, 'urf is recognized in fiqhiyah rules as long as it does not contradict the shar'i nash. This research aims to analyze the role and application of 'urf in Islamic law with a historical approach and examine the fiqhiyah rules related to its use. This research uses a qualitative approach with a literature study method. Data were collected from primary and secondary sources, such as classical fiqh books, academic journals, and Islamic legal literature. The analysis is done descriptively-critically to understand the historical development of 'urf and its relevance in fiqhiyah rules. The results show that 'urf has a significant role in the development of Islamic law, especially in the context of legal adaptation to social and cultural changes. Historically, 'urf has been used by scholars as a basis in determining laws that are relevant to the context of society, as long as they do not conflict with the principles of sharia. Fiqhiyah rules such as al-'ādah muhakkamah (customs can be made into law) and Al-maslahah al-mursalah (interests that are not mentioned by the nash) become the main basis for applying 'urf. This finding confirms that 'urf can be a valid source of Islamic law as long as it meets certain criteria, such as not contradicting shar'i arguments and being common in society. Understanding 'urf is also important in the context of fatwa and contemporary Islamic legal policy. 'Urf acts as a dynamic instrument in Islamic law that allows flexibility in the application of sharia in accordance with social reality. This study contributes to understanding how Islamic law can remain relevant by considering the customs of society that do not contradict the principles of sharia.

Abstract

This article explores the legal framework of al-rahn (Islamic pawn) by emphasizing the integration between state regulations and religious decrees in Indonesia. The analysis focuses on the relationship POJK as a source of formal legal authority and the fatwa DSN-MUI as a normative reference rooted in Islamic principles. A qualitative approach is employed through library research, examining official documents such as POJK No. 31/POJK.05/2014 on Sharia Financing Products and DSN-MUI Fatwa No. 25/DSN-MUI/III/2002 on Rahn. The findings reveal that POJK provides legal certainty and an operational framework for Islamic financial institutions, while the DSN-MUI fatwa establishes non-negotiable sharia boundaries. Both instruments work in a complementary manner to establish a credible, just, and socially responsive Islamic pawn system tailored to the needs of Indonesia’s Muslim community.

Abstract

Pembahasan mengenai saddudzari'ah terhadap praktik merugikan Deb Collector terhadap nasabah, menjadikan topik menarik untuk penulis telisik lebih mendalam penerapan yang bisa digunakan untuk menagih hutang-piutang. Pada dasarnya saddudzari'ah dalam hukum islam yang berarti “menutup jalan (menuju) sesuatu yang haram”. Dalam konteks ini dzari’ah berarti sarana atau perantara, sedangkan saddu berarti menutup atau mencegah. Maka saddudzari'ah adalah prinsip mencegah perbuatan yang tampaknya mubah (boleh) tetapi dapat menjadi kerusakan. Pada saat ini jumlah uang yang cukup dapat membeli semua yang kita butuhkan dan inginkan, itulah sebabnya setiap orang berusaha mendapatkan uang. Sistem pembayaran yang disebut kredit, yang memungkinkan kita untuk membeli barang tanpa harus membayar segera. Namun, kredit memungkinkan peminjam membayar utang mereka dengan bunga dalam jangka waktu tertentu. Akibatnya, kehadiran penagih hutang berkembang di luar sektor perbankan. Meskipun bisnis lain dengan tagihan seperti leasing memberikan kredit kepada pelanggan yang ingin membeli mobil atau kendaraan lainnya dengan kredit. Namun, dalam praktiknya, penagih hutang jarang melakukan pelanggaran hukum seperti intimidasi, ancaman, dan kekerasan fisik atau psikis. Praktik penagihan utang oleh debt collector sering kali menimbulkan masalah, terutama ketika dilakukan dengan cara-cara yang merugikan nasabah. Penarikan paksa di jalan raya, penggunaan kekerasan, dan penagihan yang tidak manusiawi adalah beberapa contoh praktik yang dapat menyebabkan kerusakan fisik, psikologis, dan sosial. Jurnal ini bertujuan untuk menganalisis penerapan prinsip saddudzari'ah dalam mencegah praktik-praktik merugikan tersebut. Metode penelitian yang digunakan adalah studi pustaka dengan pendekatan normatif-yuridis. Hasil penelitian menunjukkan bahwa prinsip saddudzari'ah relevan untuk diterapkan dalam konteks ini, dengan menekankan pentingnya mencegah kerusakan sebelum terjadi. Regulasi yang jelas dan pengawasan yang ketat dari pihak berwenang diperlukan untuk memastikan praktik penagihan utang dilakukan secara etis dan sesuai dengan hukum.

Abstract

Penelitian ini bertujuan untuk menganalisis tafsir Q.S. Al-Baqarah 271 dalam Tafsir Al-Misbah terkait fenomena sedekah di media sosial, dengan fokus pada keseimbangan antara keikhlasan dan eksistensi diri. Penelitian ini menggunakan metode deskriptif kualitatif dengan pendekatan studi literatur, mengkaji Tafsir Al-Misbah, hadis, serta fenomena sosial yang berkembang. Hasil penelitian menunjukkan bahwa media sosial dapat menjadi sarana meningkatkan kesadaran untuk bersedekah, namun juga berpotensi menimbulkan niat yang tidak murni. Tafsir Al-Misbah menegaskan bahwa publikasi sedekah diperbolehkan jika dilakukan dengan niat yang benar. Studi ini memberikan kontribusi terhadap kajian Islam kontemporer dengan menghubungkan tafsir klasik dan praktik digital modern serta menawarkan panduan praktis menjaga keikhlasan dalam aktivitas sedekah daring.

Abstract

Transformasi digital telah membuka peluang baru dalam praktik filantropi Islam, termasuk sedekah. Artikel ini mengkaji implementasi sedekah berbasis teknologi digital dalam pemberdayaan ekonomi modern, dengan telaah terhadap QS. Al-Baqarah ayat 271 sebagai dasar normatif. Latar belakang dari penelitian ini adalah meningkatnya kebutuhan akan sistem distribusi sedekah yang lebih transparan, efisien, dan adaptif terhadap perkembangan teknologi. Tujuan penelitian ini adalah untuk menganalisis bagaimana digitalisasi sedekah dapat memperkuat peranannya dalam pemberdayaan ekonomi masyarakat secara berkelanjutan. Metodologi yang digunakan adalah kualitatif deskriptif dengan pendekatan studi kepustakaan (library research), analisis tafsir tematik terhadap ayat Al-Qur’an, serta studi kasus beberapa platform digital yang telah mengaplikasikan sedekah secara daring. Hasil penelitian menunjukkan bahwa implementasi teknologi digital dalam praktik sedekah meningkatkan partisipasi publik, akuntabilitas pengelolaan dana, dan efektivitas distribusi kepada penerima manfaat. Penelitian ini menawarkan kebaruan dalam mengintegrasikan nilai-nilai spiritual Islam dengan sistem ekonomi modern berbasis teknologi, serta berkontribusi terhadap pengembangan model ekonomi Islam yang inklusif dan adaptif. Kesimpulannya, digitalisasi sedekah bukan hanya sebagai inovasi teknis, tetapi sebagai strategi pemberdayaan ekonomi yang relevan dengan nilai-nilai Al-Qur’an dan kebutuhan zaman.

Abstract

In Indonesia, sharia economic law is implemented through Religious Courts which have an important role in resolving disputes involving sharia financial entities such as banks, microfinance institutions, and insurance. Law Number 3 of 2006 replaces Law Number 7 of 1989 which significantly expands the authority of the Religious Courts in supervising and enforcing sharia economic principles. Sharia economics, which is based on Islamic values ​​such as justice, honesty, and legal certainty, forms an economic and financial system that is different from conventional systems. Religious Court Judges strive to balance ethical and practical considerations in carrying out their judicial duties. This research examines how ethical perspectives and practical considerations contribute to achieving legal certainty and justice in resolving sharia economic disputes, especially in the Surabaya Religious Court. This research uses a normative juridical approach using legal utility theory to analyze the challenges faced and propose strategies to increase the effectiveness of implementing simple, efficient, and cost-effective principles in Sharia economic protection at the Surabaya High Religious Court. The research results consider the principles of maqasid al-syariah to simplify the process, lighten the burden on the parties involved, and uphold justice in every decision-making. This study emphasizes the need for better integration between Islamic Sharia principles and Sharia banking practices in Indonesia, as well as encouraging reforms to ensure that legal outcomes provide fair justice and maximum social benefits, in line with the ethical and utilitarian aims of the law.

Abstract

Progressive law is based on the emergence of a sense of dissatisfaction with the theory that has been developed and used as a guide in legal practice in Indonesia, legal theories that have been developed so far, are unable to respond to problems that occur in the reality of society. This has resulted in a sense of public dissatisfaction with the performance of the law and the courts. The value of justice is the main goal to be achieved in law enforcement efforts. Meanwhile, in the case of marriage annulment, there are parties who are dissatisfied with the decision of the first level judge, so they take legal action to a higher level court to answer their dissatisfaction. This research uses a qualitative method with an empirical juridical approach. Primary data obtained from marriage annulment decisions Number 185/Pdt.G/2023/PTA.Bdg, 84/Pdt.G/2023/PTA.Bdg and 106/Pdt.G/2023/PTA.bdg, secondary data obtained from laws, journals and other legal books that have the same relevance as this research. After the data is collected, data analysis is carried out to get answers to the problems raised. This research resulted in several findings. First, the application of progressive law in polygamy licensing cases uses the hermeneutic method, namely the school of philosophy that studies the nature of something to understand something into a clearer object of interpretation, in the case of forced marriage using the legal interpretation method, namely a conclusion in providing an explanation or understanding of a term that is unclear in meaning. Second, the door for judges to apply progressive law will never be closed, in fact it is a necessity by judges, legal problems will continue to exist and continue to develop.

Abstract

The purpose of this study is to reveal the sharia compliance of the halal tourism business in Bandung Regency, where halal tourism in its implementation must be carried out by prioritizing the principles of Islamic business ethics (Professional Ethics), meaning that the principles of Islamic business ethics in the context of halal tourism in Bandung Regency must submissive (obedient) in a syar'i, especially in promoting the principles of Islamic business ethics, namely by prioritizing Islamic services with the aim of providing comfort for Muslim tourists in particular. In addition, the principles of Islamic service are expected to be able to realize professional ethics in doing business in an Islamic way, especially in carrying out halal tourism activities, especially for tourism industry players in Bandung Regency. This literature review uses the theory of Islamic business ethics as coined by Hamid Salam and Abdalla Hanafi including: a) Ethics to always convey the truth; b) Ethics to be trusted; c) Ethics to do something sincerely; d) Brotherhood ethics; e) Mastery of science; f) Ethics of Justice. The findings of this study are the principles of Islamic business ethics (professional ethics) in the implementation of the halal tourism business in Bandung Regency referring to the Bandung Regency Regional Regulation (Perda) Number 6 of 2020 concerning Halal Tourism, where there are several principles that must be met in running tourism. Halal in Bandung district which includes: a). set as needed; b). facilitate; c). according to ability; d). gradually; e). priority scale; and f). Inclusive. In addition, there is the concept of the Code of Ethics for Tourism (GCET) or the Global Tourism Code of Ethics as a reference for sustainable tourism development in Bandung Regency which includes economic, social, cultural, and environmental components. This is because Indonesia is not an Islamic country but a country where the majority of the population is Muslim, so it is necessary to prioritize the values of Rahmatan lil 'Alamin in business (muamalah), especially in terms of additional service activities in halal tourism in Bandung Regency. In addition, indicators of sharia compliance in halal tourism in Bandung district are referring to 2 regulations, namely local regulations (perda) Bandung district number 6 of 2020 concerning halal tourism, and DSN-MUI fatwa No: 108/DSN-MUI/2016 concerning guidelines for tourism implementation. based on sharia principles.
