Abstract

Transformasi digital telah membuka peluang baru dalam praktik filantropi Islam, termasuk sedekah. Artikel ini mengkaji implementasi sedekah berbasis teknologi digital dalam pemberdayaan ekonomi modern, dengan telaah terhadap QS. Al-Baqarah ayat 271 sebagai dasar normatif. Latar belakang dari penelitian ini adalah meningkatnya kebutuhan akan sistem distribusi sedekah yang lebih transparan, efisien, dan adaptif terhadap perkembangan teknologi. Tujuan penelitian ini adalah untuk menganalisis bagaimana digitalisasi sedekah dapat memperkuat peranannya dalam pemberdayaan ekonomi masyarakat secara berkelanjutan. Metodologi yang digunakan adalah kualitatif deskriptif dengan pendekatan studi kepustakaan (library research), analisis tafsir tematik terhadap ayat Al-Qur’an, serta studi kasus beberapa platform digital yang telah mengaplikasikan sedekah secara daring. Hasil penelitian menunjukkan bahwa implementasi teknologi digital dalam praktik sedekah meningkatkan partisipasi publik, akuntabilitas pengelolaan dana, dan efektivitas distribusi kepada penerima manfaat. Penelitian ini menawarkan kebaruan dalam mengintegrasikan nilai-nilai spiritual Islam dengan sistem ekonomi modern berbasis teknologi, serta berkontribusi terhadap pengembangan model ekonomi Islam yang inklusif dan adaptif. Kesimpulannya, digitalisasi sedekah bukan hanya sebagai inovasi teknis, tetapi sebagai strategi pemberdayaan ekonomi yang relevan dengan nilai-nilai Al-Qur’an dan kebutuhan zaman.

Abstract

In Indonesia, sharia economic law is implemented through Religious Courts which have an important role in resolving disputes involving sharia financial entities such as banks, microfinance institutions, and insurance. Law Number 3 of 2006 replaces Law Number 7 of 1989 which significantly expands the authority of the Religious Courts in supervising and enforcing sharia economic principles. Sharia economics, which is based on Islamic values ​​such as justice, honesty, and legal certainty, forms an economic and financial system that is different from conventional systems. Religious Court Judges strive to balance ethical and practical considerations in carrying out their judicial duties. This research examines how ethical perspectives and practical considerations contribute to achieving legal certainty and justice in resolving sharia economic disputes, especially in the Surabaya Religious Court. This research uses a normative juridical approach using legal utility theory to analyze the challenges faced and propose strategies to increase the effectiveness of implementing simple, efficient, and cost-effective principles in Sharia economic protection at the Surabaya High Religious Court. The research results consider the principles of maqasid al-syariah to simplify the process, lighten the burden on the parties involved, and uphold justice in every decision-making. This study emphasizes the need for better integration between Islamic Sharia principles and Sharia banking practices in Indonesia, as well as encouraging reforms to ensure that legal outcomes provide fair justice and maximum social benefits, in line with the ethical and utilitarian aims of the law.

Abstract

Progressive law is based on the emergence of a sense of dissatisfaction with the theory that has been developed and used as a guide in legal practice in Indonesia, legal theories that have been developed so far, are unable to respond to problems that occur in the reality of society. This has resulted in a sense of public dissatisfaction with the performance of the law and the courts. The value of justice is the main goal to be achieved in law enforcement efforts. Meanwhile, in the case of marriage annulment, there are parties who are dissatisfied with the decision of the first level judge, so they take legal action to a higher level court to answer their dissatisfaction. This research uses a qualitative method with an empirical juridical approach. Primary data obtained from marriage annulment decisions Number 185/Pdt.G/2023/PTA.Bdg, 84/Pdt.G/2023/PTA.Bdg and 106/Pdt.G/2023/PTA.bdg, secondary data obtained from laws, journals and other legal books that have the same relevance as this research. After the data is collected, data analysis is carried out to get answers to the problems raised. This research resulted in several findings. First, the application of progressive law in polygamy licensing cases uses the hermeneutic method, namely the school of philosophy that studies the nature of something to understand something into a clearer object of interpretation, in the case of forced marriage using the legal interpretation method, namely a conclusion in providing an explanation or understanding of a term that is unclear in meaning. Second, the door for judges to apply progressive law will never be closed, in fact it is a necessity by judges, legal problems will continue to exist and continue to develop.

Abstract

The purpose of this study is to reveal the sharia compliance of the halal tourism business in Bandung Regency, where halal tourism in its implementation must be carried out by prioritizing the principles of Islamic business ethics (Professional Ethics), meaning that the principles of Islamic business ethics in the context of halal tourism in Bandung Regency must submissive (obedient) in a syar'i, especially in promoting the principles of Islamic business ethics, namely by prioritizing Islamic services with the aim of providing comfort for Muslim tourists in particular. In addition, the principles of Islamic service are expected to be able to realize professional ethics in doing business in an Islamic way, especially in carrying out halal tourism activities, especially for tourism industry players in Bandung Regency. This literature review uses the theory of Islamic business ethics as coined by Hamid Salam and Abdalla Hanafi including: a) Ethics to always convey the truth; b) Ethics to be trusted; c) Ethics to do something sincerely; d) Brotherhood ethics; e) Mastery of science; f) Ethics of Justice. The findings of this study are the principles of Islamic business ethics (professional ethics) in the implementation of the halal tourism business in Bandung Regency referring to the Bandung Regency Regional Regulation (Perda) Number 6 of 2020 concerning Halal Tourism, where there are several principles that must be met in running tourism. Halal in Bandung district which includes: a). set as needed; b). facilitate; c). according to ability; d). gradually; e). priority scale; and f). Inclusive. In addition, there is the concept of the Code of Ethics for Tourism (GCET) or the Global Tourism Code of Ethics as a reference for sustainable tourism development in Bandung Regency which includes economic, social, cultural, and environmental components. This is because Indonesia is not an Islamic country but a country where the majority of the population is Muslim, so it is necessary to prioritize the values of Rahmatan lil 'Alamin in business (muamalah), especially in terms of additional service activities in halal tourism in Bandung Regency. In addition, indicators of sharia compliance in halal tourism in Bandung district are referring to 2 regulations, namely local regulations (perda) Bandung district number 6 of 2020 concerning halal tourism, and DSN-MUI fatwa No: 108/DSN-MUI/2016 concerning guidelines for tourism implementation. based on sharia principles.

Abstract

This research aims to explore the influence of community participation on the creation of local legal products in Indonesia, focusing on regions with special autonomy status like Banda Aceh, Aceh Besar Regency, Yogyakarta City, and Surakarta City, and comparing them with regions with ordinary autonomy status like Bandung Regency and Bandung City. Using a combined normative and empirical legal research approach, including public consultations and field surveys, the study delves into the origin of regional legal products, highlighting community participation, people's sovereignty, the rule of law, and public policy. It examines various factors affecting community involvement, such as social, political, cultural, and educational factors. The research findings underscore the importance of community participation in shaping the quality and compliance of local legal products. However, conventional patterns in facilitating community involvement often result in suboptimal participation, except for unique cases like Aceh, which demonstrates innovative approaches and impactful outcomes. The study concludes that enhancing community participation is crucial for improving the quality and effectiveness of local legal products, ensuring better compliance and implementation at the grassroots level.

Abstract

The development of Islamic law in Indonesia, particularly concerning apostasy as a cause of divorce, is significant in the evolution of Islamic law. The complexity of Indonesia's social and legal system poses challenges in integrating Islamic values with societal diversity. This research aims to understand the development of Islamic law in Indonesia regarding apostasy issues through the analysis of maqasid sharia. Using a descriptive-analytical approach, data from various sources are examined to understand the development of Islamic law in Indonesia, focusing on the implications of maqasid sharia regarding apostasy as a reason for divorce. Findings indicate that progressive Islamic law development in Indonesia emphasizes a balance between religion and individual justice, protecting individual rights in divorce and seeking fair solutions through legal reforms considering the principles of maqasid sharia.

Abstract

Penelitian ini bertujuan untuk mengkaji sejarah perkembangan golongan yang ingkar sunnah sampai dengan ajaran-ajaran yang dikembangkan dan didakwahkan kepada masyarakat serta konsikuensi penganut paham ingkar sunnah terkhususnya bagi muslim itu sendiri. Penelitian ini menggunakan pendekatan kualitatif deskriptif, dengan penelaahan dokumen. Penelitian ini menyimpulkan, bahwa ingkar sunnah merupakan bentuk kegagalan dalam memahami sunnah dan pemahaman ini juga sudah ada pada masa kenabian. Sehingga beberapa ulama menerangkan bahwa konsikuensi terhadap penganut paham ini dikategorikan kafir.

Abstract

This study discusses the ijtihad method used by the Hisbah Council of Islamic Unity (PERSIS), one of the major Islamic organizations in Indonesia known for its commitment to the purification (tajdīd) of Islamic teachings. This research is motivated by the importance of understanding how religious institutions respond to socio-religious dynamics through a distinctive ijtihad mechanism. The main purpose of this study is to analyze the methodological approach of the Hisbah Council in formulating fatwas of contemporary Islamic law. This research uses a qualitative approach with a descriptive-analytical method. Data collection was carried out through a literature study of the official fatwa documents of the Hisbah Council, minutes of deliberations, and supporting literature related to the methodology of ijtihad and Persis Islamic thought. The results of the study show that the ijtihad method of the Hisbah Council is textualist-scriptural with an emphasis on the postulates of the Qur'an, sahih hadith, and qiyās. They reject the blind form of taklid as well as the use of istihsān and maṣlaḥah mursalah methods which are considered loose or do not have a strong nash basis. This study shows that the Hisbah Council maintains epistemological consistency in maintaining the purity of Islamic legal sources, but still shows a selective attitude in responding to contemporary issues. This strengthens the position of the Hisbah Council as an influential ijtihad authority in shaping the direction of religious thought of the Islamic Union in the modern era.

Abstract

This study critically examines juristic disagreement (ikhtilaf) in waqf jurisprudence through an integrated epistemological, methodological, and contextual analysis, while exploring the pathways toward harmonizing classical doctrines with contemporary socio-economic demands. Using a qualitative, library-based research design, the study analyzes classical fiqh sources from the four Sunni schools, foundational works of uṣūl al-fiqh, contemporary academic discussions, and modern fatwas. The research scope encompasses the conceptual foundations of waqf, the validity of various asset types, istibdal, temporary waqf, and contemporary innovations, including cash waqf, waqf-linked sukuk, and digital waqf. The findings reveal that ikhtilaf is rooted in divergent epistemic commitments regarding textual authority, legal causation, and public interest, as well as methodological distinctions in legal reasoning and contextual influences across historical periods. Major challenges include the increasing complexity of financial instruments, fragmented regulatory frameworks, and limited capacity among waqf managers to operationalize maqasid-oriented governance. The study recommends strengthening collective ijtihad, developing maqasid-driven regulatory frameworks, and establishing measurable evaluative standards for modern waqf practices. Practical implications highlight the need to integrate classical fiqh reasoning with contemporary governance principles to ensure that waqf remains socially transformative and aligned with sustainable development objectives. This research formulates a normative–analytical model that synthesizes maqasid-oriented reasoning with juristic diversity, providing a conceptual platform for harmonizing waqf jurisprudence and enhancing the strategic relevance of waqf in the modern era.

Abstract

This article explores the evolving role of Bahtsul Masail, an Islamic legal forum under Nahdlatul Ulama (NU), in shaping contemporary Islamic jurisprudence in Indonesia. Bahtsul Masail has historically functioned as a platform for collective ijtihad, enabling scholars to address modern socio-religious issues using a structured legal reasoning method rooted in classical fiqh. The objective of this paper is to examine how Bahtsul Masail has transitioned from a textual and conservative framework toward a more dynamic, inclusive, and contextually responsive model of Islamic legal interpretation. Utilizing a qualitative-descriptive method, the research analyzes primary documents from NU congresses and scholarly literature. The findings reveal that Bahtsul Masail promotes a three-tiered methodological approach qauliy, ilhaqiy, and manhajiy allowing legal rulings to balance orthodoxy with socio-legal adaptability. This transformation not only strengthens the legitimacy of Islamic legal authority in Indonesia’s pluralistic society but also provides a model for legal innovation within traditional Islamic institutions.
