Abstract

Penelitian ini mencoba untuk mengembangkan modul pendidikan berorientasi pengakuan hukum untuk menghindari praktik pernikahan anak di bawah umur, terutama di Madura Sub-Budaya Masyarakat di daerah tapal kuda. Hasilnya adalah modul pendidikan yang terdiri atas tiga paket. Paket I berisi istilah perkawinan dan anak-anak di bawah usia sahnya dalam perspektif hukum Islam, hukum nasional dan hak asasi manusia internasional. Paket II resiko dan bahaya pernikahan anak di bawah umur, baik fisik, psikologis, medis dan seksual. Paket III berisi rencana kebijakan dan rencana aksi untuk pencegahan praktik pernikahan anak di bawah umur yang dirancang secara sinergis di segala bidang, baik hukum, politik, pendidikan, agama dan sosial-ekonomi. Bahan Modul dikembangkan berdasarkan pendekatan kompetensi. Seperti biasa bahan berbasis kompetensi, maka modul adalah hasil dari perkembangan ini akan terdiri dari: standar kompetensi, kompetensi dasar, indikator, tema, strategi, media, penilaian, dan alokasi waktuABSTRACT This research tried to develop educational module orientated in law recognition to avoid the practice of child marriage under age, especially in Madura Sub-Culture Community in Horseshoe Area. The result is an educational module which consist three packages. Package I contains the terms marriage and children under the age of legality in the perspective of Islamic jurisprudence, national laws and international human rights. Package II risks and dangers of the marriage of child marriage under age, whether physical, psychological, medical and sexual. Package III contains policy plan and action plan for the prevention of child marriage practices designed underage synergistically in all fields, whether legal, political, educational, religious and socio-economic. The materials module was developed based on the competency approach. As usual competency-based material, then the module is the result of this development will consist of: competency standards, competency base, indicators, themes, strategies, media, assessment, and time allocation

Abstract

Shariah is the heart of Islam because it handles the most fundamental aspects of the religion. Ironically however, Shari?ah is the most misunderstood dimension of Islam. What we currently believe as Shari?ah may not be Shari?ah. And the reverse may be true that what we consider as non-Shari'ah, may in fact be Shari'ah. It is here that reconstructing our understanding concerning the true meaning of Shari?ah becomes a matter of necessity. Having this in mind, we are interested in elaborating the critical views of al-Ashmawi on the notion of Shari?ah hoping that this will help us to discover the missing and yet the true- dimension of Shari'ah. Al-Ashmawi on the whole, is critical against the jargon that only associates the Shari?ah with its formalization and application.

Abstract

The kind of Islamic sciences being taught in many higher education institutes in Indonesia is that which tends to make students isolated from their world. These Islamic sciences in themselves are kind of separation from the religious and worldly, Islamic and secular. This dichotomous character had inflicted upon the students mentality, who in turn become equally dichotomous in their attitude, and way of thinking. This paper tries to explore this, and attempts to seek the best way in which the dichotomous curriculum can be replaced with the integrative one. It argues that, like the nature of Islam, religious sciences cannot be separated from the non-religious ones. The one must work hand in hand with the other so that. The paper addresses specifically the dilemmas intrinsic within the text book used by many higher religious institutes in the country called ?Reorientasi Pendidikan Islam: Menuju Pengembangan Kepribadian Insan Kamil?. The book?we argue?directs the students to adopt a single identity, disregarding therefore the multi and diverse racial, religious and even cultural background of the students. The paper is simply about a warning of the danger of the implication that the book can come up.

Abstract

Qur’anic texts and Prophetic sunnah are essentially zamâniy and makâniy in nature. According to historical records, Muhammad Shallallâhu ‘alaihi wa sallam was playing numerous roles. Therefore, every Moslem really needs to associate sunnah with the status of the Prophet at the time a sunnah was delivered when attempting to understand and practice it. This study aims to discuss the instruction by the Prophet Muhammad, peace and blessings of Allah be upon him, for a group of companions to drink camel urine when they complained of sickness from the perspectives of sunnah tasrî’iyyah and sunnah ghayr tasyrî’iyyah. This study is a literature study using content analysis techniques. The results identified that the hadîth above is categorized as sunnah ghayr tasyrî’iyyah. The advice of the Prophet in the hadîth above to drink camel urine as a medicine must be understood in the emergency context with no medicine other than camel urine available. This is the opinion of the majority of Moslem scholars that taking medication with something that is najis is not permissible, except in a compelling emergency. Under a normal condition and in the presence of halal medicines, taking medication with something that is najis – like camel urine – is harâm

Abstract

Learning motivation has been examined for its positive influence on learning outcomes. However, little attention has been addressed to the development of measuring instruments of learning motivation in the context of reading the Quran in Indonesian higher education. This study was designed to develop a Quran learning motivation questionnaire. The Self-Determination Theory (SDT) was applied as a theoretical framework to explore the type dan level of motivation. Participants involved in this study were 420 students. They were divided into subsample one for exploratory factor analysis (N = 200) and subsample two with confirmatory factor analysis (N = 220). The questionnaire was developed with 12 item-three factors using five points Likert scale that can measure the learning motivation in reading Quran. The results of the study show that the level of student motivation is relatively low (M= 3.12), and the intrinsic motivation type (M= 3.99) is more dominant than extrinsic motivation survival (M= 2.99) and approval (M= 2.38) with a p-value of 0.000. In addition, it was found that female students (M= 3.19) had significantly higher motivation than male students (M= 3.04), with a p-value of 0.017.

Abstract

One of the most significant issues in the Indonesian traditional markets is the reduction of dose (Mikyāl) and weight (Mīzān) done by sellers in traditional markets. As a solution to this corruptive reality, this paper offers an application called Syu'aib Controller (SC). This is a dose and weight frauds detector. With this application, consumers can control the process of selling and buying as it told in the story of the Madyans. Syu'aib Controller (SC) was developed on a digital basis based on the criteria of the Quranic values taught by the Prophet Syu'aib AS to the Madyans. These values include justice, accuracy, and satisfaction. This innovative device can be used in buying and selling activities in traditional markets. With this digital device, the buyers could know the real weight of the object, check and supervise the dose, and scale used in the traditional market. The Syu'aib Controller (SC) is expected to foster an anti-corruption mentality. Thus the fair and honest characters of the Nusantara merchants are formed.

Abstract

Begging behavior is a serious issue and happens on a wide scale, especially in urban areas. In Islamic normative point of view, the Quran has a distinctive perspective towards beggars. In Sura al-Mā‘ūn [107]: 3, Allah swt. encourages Moslem people to pay attention to poor beggars. In contrast, in other verses, al-Jāthiyah [45]: 7, al-Quran criticizes people who are lying for the sake of other’s mercy with a mode and guise of a falsehood. In fact, the begging behavior nowadays is not only caused by the economic problem, but beggars even make it as a preferable profession. The biggest problem in handling the beggar issues is the difficulty to differentiate between the genuine and the professional beggar. If we examine thoroughly using an analysis of the Quran verses, there is a distinctive characteristic of those beggars. These at least can be identified through the micro-expression, sound pressure, and eye tracking. The analysis of the human’s track and physical fact through al-Quran here is what the authors intend as Quran forensic. Based on the distinguishing indicators from the analysis of the Quran forensic, this article found a new model for solving beggar problems with a multidisciplinary approach.

Abstract

Todays health researchs prove that the breast milk contains a lot of content that is not found in milk formula, especially immunologic substances. Breast milk contains anti-infective agents that are clean and free of contamination. Immune substances that exist in immunoglobulins, secretory, and lactoferrin as well as the presence of factors that can stimulate Lactobacillus bifidus to protect baby’s digestive tract. Lately also known that breast milk can increase children’s intelligence. It could be due to nutritional milk, methods, or durations of breastfeeding. Research shows that a Taurine, Decosahexanoic acid (DHA) and Arachidonic acid (AA) exist in breast milk is very useful in the formation of the baby’s brain cells and accelerate the stimulus from the receptor organ to the brain, so that the response can be given in a fast time. Yet long before the WHO, researchers and human rights activists has been intensifying exclusive breastfeeding, the Koran was first called to breastfeed h}awlayn kâmilayn two full years. The Relevances between the activity of breastfeeding for two full years and the brain development of baby will be discussed in this paper.

Abstract

Muhammad b. ‘Alî Muhammad b. ‘Abd Allâh al-Shawkânî al-San‘ânî. He was born in the Hijrah in Shawkân village, Yemen on Monday 28 Dhû al-Qa‘dah 1172 H and died on Tuesday, 27 Jumâd al-Akhîr 1250 H at the age about 78 years. Al-Shawkânî grew up in the San‘a city, it is the capital of the republic of Yemen now. He study first time about religion from his father, then from renowed scholars in San‘a and its surrounding, he was known as a scolar who mastered the various branches of religious sciences. Such as tafsîr, h}adîth, fiqh, us}ûl al-fiqh, history, science of kalâm, philosophy, balâghah, mant}iq etc. the main issue in this article is how political thought in the book of tafsir Fath al-Qadîr is the work of Shawkânî. At the end of article, the authors found that the intended political thinking in the study of Fath al-Qadîr is about constitutional ideas. These ideas about the constitution is limited to the concept of leadership and deliberation, the concept of the right of citizen to obtain justice, and the concept pf the right of citizens to live association and assembly

Abstract

The Muslims’ responses toward and understanding about the texts of Qur’an and hadîts—usually named as living Qur’an/tafsîr and living hadîts/sunnah—are of the objects of Islamic studies. Such responses include the Muslims’ reception and their interpretations toward certain texts and exegete found in the Muslims’ daily life, such as traditionalizing of recitation of certain chapters and verses of Qur’an in some social religious ceremonies and celebration. The social reception of the interpretations take form of either small or large scale of institutionalization. The Muslims’ responses toward and understanding about the texts of Qur’an and hadîts and their receptions do not cause any problems until the emergence of authorities in the Muslims’ communities that accuse them as heresy (bid‘ah), apostasy (riddah), and infidelity (kufr). This becomes the starting point of perverting and excommunication phenomena in Islam. This article is aimed at elaborating that problem and analyzing the phenomena through Theo-social-analysis.
