Abstract

This research explores the application of the receptie a contrario theory in its implementation in the inheritance law of the Minangkabau customary society. This research is a normative juridical research with conceptual and philosophical approaches. Data source analysis is conducted on primary legal materials in the form of expert interviews and laws and regulations, and secondary legal materials in the form of research results on Islamic law and customary law. Based on the research results, it can be concluded that the theory of receptie a contrario still applies to inheritance issues in Minangkabau. Although the Minangkabau people are famous for their adherence to customs, they consider breaking customs shameful. However, the Minangkabau community has explicitly stated that their customary inheritance law refers to Islamic inheritance law by recognizing that children and wives are heirs of their parents/husbands. In contrast, previously, the customary heirs recognized were nieces (kemenakan). This research confirms that the application of the receptie a contrario theory still applies to inheritance issues in Minangkabau. In addition, it also contributes to explaining to the broader community that inheritance in Minangkabau, although it adheres to matrilineal kinship lines, has implemented Islamic law.

Abstract

Child marriages are common throughout Indonesia. This is due to a strong influence of Indonesian customs and religion that strongly influence the lives of its people. It is worth pointing that marriage age arrangements in Indonesian Marriage Law reinforces that legal age for men is 19 years and 16 years for women. The 2012 statistics show that Indonesia is the 37th highest in the world in child marriage, while at the Southeast Asian level, this country ranks second after Cambodia. The ranking went up dramatically since in 2016, based on UNICEF, Indonesia ranked the 7th in child marriage worldwide. This means that the practice of child marriage in Indonesia happens, especially to women at the age of 18 years, and there is no discrimination related to the age of marriage. Against this matter, there has been a file for judicial review that demands marriage age for men and women to be pegged at the age of 18 years. However, the Judge of the Constitutional Court, through Decision Number 30-74/PUU-XII/2014, states that age of marriage remains valid for the 19-year-old for man and 16-year-old for women. The struggle does not stop there because at this time, there a national movement of STOP CHILD MARRIAGE formed by civil organisations in cooperation with the Commission of Child Protection and Ministry of Woman Empowerment and Child Protection. This movement sees that the practice of child marriage is a national emergency problem that must be addressed seriously. Further, this movement demands immediate enactment of government regulation in favour of the law which must promptly revise the Marriage Law, especially related to the marriage age.

Abstract

Empowerment of women and girls is to be realized through sustainable development. Sustainable development depends on an equitable distribution of resources and it cannot be achieved without gender equality (Pathania, 2017). This research aims to analyze the implementation of the Sustainable Development Goals Program in the elimination of child marriage practices in Indonesia and to discover efforts to implement the Sustainable Development Goals Program by government officials in the elimination of child marriages in Pesisir Selatan District, West Sumatra Province. This research used the Sustainable Development Goals approach. To obtain the data, the researchers used primary and secondary data. Based on the result, it can be concluded that implementation of achievement of the Sustainable Development Goals is not only carried out centrally by the central government, but the central government also submits this to the regional government.

Abstract

Changes in the legal construction begin with a paradigmatic shift in the relationship between the consumer and businesses, as reflected in the preference of let the producer aware principle in favor of letting the buyer aware principle. This study aims to find out the implication of the let the producer aware principle for goods and services, and its development in consumer protection law in Indonesia and to find out the legal system of Indonesia adopts the let the producer aware principle in order to protect Indonesian consumers. The research method applied in this study is normative juridical approach. The data obtained from the study of literature which is used as secondary data. Furthermore, interviews were conducted to obtain primary data, and then the data were analyzed by juridical qualitative method. As a result of analysis, it shows that firstly: the implementation of let the producer aware principle in Indonesia has not been properly conducted because of the common perception that consumers’ opinion is less valuable than producers’. Secondly, the adoption of the let the producer aware principle for consumer protection by Indonesian Legal policy is shown by Law Number 8 Year 1999 about Consumer Protection (Indonesian Consumer Protection Act), which is based on the principle of fault liability, utilizing reversed burden of proof. This way, both parties are protected, because it proportionally distributes the liability to each party. In conclusion, both producers and consumers are equally protected on condition that they can provide evidence of the losses obtained.

Abstract

In debt and credit problems, bankruptcy is often the last solution to resolve the problem. State-Owned Enterprises or SOEs are also not immune from debt and credit problems that lead to bankruptcy. The regulation regarding the bankruptcy of SOEs itself is regulated in Article 2 Paragraph (5) of the Bankruptcy Law and its explanation. However, problems then arise when the subsidiaries of SOEs become bankruptcy respondents. There is no legislation that specifically regulates the bankruptcy of SOEs Subsidiaries, so this has led to confusion and debate in the community regarding the status of SOEs Subsidiaries in terms of bankruptcy. The ambiguity and debate can be seen in the implications of the bankruptcy petition case filed by the Kinarya Liman Margaseta Consortium against PT Indonesia Power, which is a Subsidiary of SOEs, namely PT PLN. This research aims to find out how the position of a SOEs Subsidiary in terms of bankruptcy is reviewed from the Bankruptcy Law and SOEs Law. The type of research used in this research is normative legal research. The research specifications used in this research are descriptive analysis. The approach used in this research is a statutory approach and case approach. Based on the results of this case study, it can be seen that when viewed from the Bankruptcy Law and the SOEs Law, basically the subsidiaries of SOEs and SOEs cannot be equated in status and position. This is supported by several theories and strengthened by the Constitutional Court Decision and the Supreme Court Decision. Thus, PT Indonesia Power's bankruptcy petition should be filed by its creditors in addition to the Minister of Finance.

Abstract

This research examines the regulation of remuneration for Foundation executives in Indonesia, focusing on legal aspects and its implementation. As Foundations evolve to support social, religious, and humanitarian objectives, cases of misappropriation of Foundation funds have emerged, highlighting the need for tighter oversight. Through a normative juridical approach and descriptive analysis, this study details the issues surrounding remuneration regulations, emphasizes instances of financial misconduct, and discusses the importance of establishing an external supervisory body or regulatory changes. The implementation of Good Corporate Governance and Good Cooperative Governance principles within the Foundation context is also explored. This research responds to the need for integrity, transparency, and accountability in Foundation management to achieve the humanitarian goals they undertake. The conclusion underscores the necessity for further action, including the establishment of an external supervisory body or regulatory strengthening.

Abstract

Indonesia’s prohibition of cannabis originates from its adherence to international narcotics conventions, which historically denied recognition of cannabis’s medical value. However, the reclassification of cannabis by the Commission on Narcotic Drugs (CND) in 2020 marked a significant shift in the global legal paradigm by acknowledging its therapeutic potential. This study examines the problem of legal inconsistency between Indonesia’s strict prohibition policy and the development of international standards regarding medical cannabis. This research employs a conceptual legal approach to analyze developments in international narcotics policy and their relevance to Indonesia’s narcotics law. The findings demonstrate that Indonesia’s current legal framework, particularly Law Number 35 of 2009 and Minister of Health Regulation Number 30 of 2023, creates legal disharmony with international developments and restricts the fulfillment of the right to health. From a humanistic perspective, this condition also affects patients who require alternative medical treatment, thereby raising concerns regarding equitable access to healthcare services. This study concludes that Indonesia should adjust its legal framework by permitting the limited use of cannabis for medical purposes under strict regulation. Such reform is consistent with the mandate of Constitutional Court Decision Number 106/PUU-XVIII/2020, which emphasizes the importance of opening legal space for research on medical cannabis.

Abstract

Perkembangan teknologi digital mendorong peningkatan penggunaan layanan daring, namun juga menimbulkan risiko penyalahgunaan data pribadi konsumen oleh perusahaan. Penelitian ini bertujuan untuk mengkaji aspek yuridis perlindungan data pribadi konsumen berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi, serta membandingkannya dengan regulasi global seperti GDPR di Uni Eropa dan CCPA di Amerika Serikat. Metode yang digunakan adalah yuridis normatif dengan pendekatan kualitatif berbasis studi literatur hukum dan studi kasus. Hasil penelitian menunjukkan bahwa meskipun telah terdapat kerangka hukum di Indonesia, implementasi perlindungan data pribadi masih menghadapi tantangan serius, seperti lemahnya penegakan hukum, rendahnya literasi data konsumen, belum terbentuknya lembaga pengawas independen, serta minimnya kepatuhan pelaku usaha. Perbandingan dengan negara maju menunjukkan perlunya percepatan pembentukan perangkat pelaksana, mekanisme pelaporan publik yang terintegrasi, dan kewajiban penunjukan petugas perlindungan data (DPO) secara profesional. Penelitian ini memberikan implikasi penting dalam penguatan regulasi dan kebijakan perlindungan data pribadi konsumen, serta menjadi dasar bagi penelitian selanjutnya dalam menilai kesiapan kelembagaan, efektivitas prinsip privacy by design, dan literasi digital masyarakat di Indonesia.
