Abstract

Bakti sosial merupakan bentuk dari tanggung jawab sosial masyarakat Indonesia, khususnya dalam mendukung dan melindungi kelompok rentan seperti anak-anak. Panti asuhan berperan sebagai tempat perlindungan bagi anak-anak yang kurang beruntung secara sosial dan ekonomi. Salah satu bentuk nyata dari perwujudan tanggung jawab tersebut dilaksanakan oleh mahasiswa Kelompok Ajaib 3 dari Universitas Internasional Batam melalui kegiatan bakti sosial dan pendirian pojok literasi di Panti Asuhan Betesda, Batam. Kegiatan ini menggunakan metode edukatif dan partisipatif yang bertujuan untuk meningkatkan minat membaca, rasa percaya diri, kemampuan berpikir kritis dan berkomunikasi anak-anak di panti asuhan. Kegiatan bakti sosial ini menjadi pengalaman berharga bagi mahasiswa kelompok ajaib 3 dalam memahami pentingnya empati dan pengabdian masyarakat. Sebelum kegiatan bakti sosial, panti asuhan batesda belum memiliki pojok literasi, namun setelah kegiatan yang dilaksanakan oleh ajaib 3, pojok literasi berhasil dibangun.

Abstract

Kegiatan Pengabdian kepada Masyarakat ini di Universitas Internasional Batan bertujuan untuk meningkatkan kesadaran dan literasi sosial mengenai bullying dan hate speech di kalangan muda. Permasalahan yang diangkat oleh kelompok kami adalah “Bullying dan Hate Speech di Kalangan Muda” dimana tingginya kasus kekerasan verbal dan psikologis, baik dalam lingkungan sekitar maupun di media sosial, yang sering kali berdampak negatif terhadap kondisi mental korban. Kegiatan ini dilaksanakan oleh Kelompok Bibit 1 di Universitas Internasional Batam dalam bentuk edukasi dan diskusi interaktif yang melibatkan mahasiswa dari universitas lain seperti Universitas Indonesia, Universitas Bina Nusantara, dan Universitas Katolik Parahyangan. Metode yang digunakan mencakup penyampaian materi visual, sesi tanya jawab, serta dialog reflektif yang mendorong partisipasi aktif dari para peserta. Hasil yang diperoleh meliputi peningkatan pemahaman peserta mengenai bentuk, dampak, serta solusi atas bullying. Selain itu, kegiatan ini memperkuat kolaborasi antar kampus dan memperluas perspektif sosial para peserta. Kegiatan ini memberikan kontribusi dalam membentuk agen perubahan sosial di kalangan mahasiswa. Rekomendasi dari kegiatan ini adalah memperluas cakupan partisipasi dan melibatkan komunitas masyarakat untuk dampak yang lebih luas.

Abstract

The rapid proliferation of online gambling in Indonesia has prompted the Ministry of Communication and Informatics to implement large-scale algorithmic blocking measures, creating a critical tension between cybersecurity enforcement and citizen data protection. This study investigates the unintended consequences of these automated blocking mechanisms on government digital infrastructure that hosts personal data. Using normative legal research methodology with a conceptual approach grounded in Gustav Radbruch's legal philosophy which emphasizes. The research analyzes primary legal materials, including the Electronic Information and Transactions Law and implementing regulations, supplemented by secondary data from policy documents and case studies of breached government websites. Results demonstrate that while algorithmic blocking has successfully reduced gambling site accessibility by over 80%, it has simultaneously compromised data security indiscriminately blocking compromised government portals without adequate due process mechanisms. The absence of transparent algorithmic criteria in the TRUST+Positif system and the lack of procedural safeguards have created legal uncertainty and disproportionate impacts on public service delivery. The study concludes that Indonesia's current approach prioritizes technical utility over justice and legal certainty, necessitating regulatory reforms that balance cybersecurity objectives with constitutional privacy protections through precision-based blocking, algorithmic transparency requirements, and independent oversight mechanisms to ensure digital governance that respects fundamental rights while effectively combating online gambling.

Abstract

Abstract The Public Housing Savings Program (Tapera) is a government instrument aimed to fulfill the right to adequate housing in Indonesia which is also aligned with the principle of sustainability in Sustainable Development Goal (SDG) 11. This research explores the prospects and challenges of Tapera in Batam City through a normative juridical methods with the combination of empirical data from interviews findings. The research analyzes the legal framework of Tapera as regulated in Peraturan Pemerintah Nomor 21 Tahun 2024 and its allignment with SDG 11's goal of creating sustainable cities. Findings revealed several implementation challenges such as public distrust due to corruption risks to financial burdens for participants. This research highlights the critical needs for policy transparency and enhanced community participation. A key contribution of this research lies in its integration of welfare state theory with SDG implementation, particularly in the context of urban housing policy in areas with high migration. The results of this research shows that the Tapera program offers innovative solutions through various payment schemes to help Low-Income Communities (MBR) to obtain decent housing trough Home Ownership Loan (KPR), Home Construction Loan (KBR), and Home Renovation Loan (KRR), but on the other hand the program it still faces significant obstacles such as mismatch between housing supply and demand, public skepticism, and inefficiencies in fund management. Interviews results also reflect a predominantly negative view of the program. From the perspective of welfare state theory, Tapera represents a manifestation of the government’s responsibility to ensure citizens' right to housing and improve social welfare. This research also provides suggestions regarding reassessment of the Tapera financing scheme, reconsideration of the program’s financial burden, rebuilding public trust, and simplifying fund disbursement procedures. Abstrak Program Tabungan Perumahan Rakyat (Tapera) merupakan instrumen pemerintah dalam memenuhi hak atas perumahan yang layak di Indonesia yang juga sesuai dengan prinsip keberlanjutan pembangunan Sustainable Development Goal (SDG) 11. Penelitian ini mengkaji mengenai prospek dan tantangan Tapera di Kota Batam dengan menggunakan metode yuridis normatif dengan kombinasi data empiris dari hasil wawancara. Penelitian menganalisis kerangka hukum Tapera berdasarkan Peraturan Pemerintah Nomor 21 Tahun 2024 dan kesesuaiannya dengan tujuan SDG 11 tentang kota berkelanjutan. Temuan mengungkap berbagai tantangan implementasi seperti ketidakpercayaan masyarakat akibat risiko korupsi hingga beban finansial bagi peserta. Penelitian ini kebutuhan kritis atas pentingnya transparansi kebijakan, dan penguatan partisipasi masyarakat. Penelitian memberikan kontribusi baru dengan menghubungkan teori negara kesejahteraan dengan implementasi SDGs melalui analisis kebijakan perumahan di kawasan urban dengan migrasi tinggi. Hasil penelitian ini menunjukkan bahwa program Tapera menawarkan solusi inovatif melalui berbagai skema pembayaran untuk membantu Masyarakat Berpenghasilan Rendah (MBR) memperoleh hunian yang layak dengan skema Kredit Pemilikan Rumah (KPR), Kredit Bangun Rumah (KBR), atau Kredit Renovasi Rumah (KRR), namun di sisi lain program ini juga menghadapi berbagai tantangan seperti kesenjangan antara ketersediaan dan permintahan perumahan, adanya resistensi masyarakat, beban bagi pemberi kerja, ketidakpercayaan masyarakat, dan juga sistem pengelolaan dana yang belum optimal. Hasil wawancara dengan responden menunjukkan pandangan negatif terhadap program ini. Berdasarkan analisa dengan menggunakan teori negara kesejahteraan, program ini adalah salah satu bentuk dari peran pemerintah dalam memenuhi hak atas perumahan rakyat untuk menyejahterakan rakyat. Penelitian ini memberikan saran terkait peninjauan kembali terhadap skema pembiayaan tapera, pertimbangan kembali untuk beban dari program, pembangunan kepercayaan masyarakat, dan penyerdehananaan proesdur pencairan dana.

Abstract

Despite the rapid expansion of electronic court systems in Indonesia, scholarly discussions have largely emphasized procedural efficiency and administrative outcomes, leaving a critical gap in assessing E-Litigation as an instrument for the fulfillment of human rights. In particular, there remains limited empirical analysis on how the implementation of E-Litigation affects the principles of equality before the law and the protection of privacy rights, especially within administrative courts serving archipelagic regions. This research aims to analyze the effectiveness of E-Litigation implementation at PTUN Tanjung Pinang in fulfilling human rights—specifically equality before the law and privacy rights—through a comprehensive effectiveness assessment. The study employs an empirical juridical research method, combining statutory and conceptual analysis with qualitative field data obtained through interviews, observations, and document review, interpreted using Soerjono Soekanto’s theory of legal effectiveness. The findings demonstrate that E-Litigation at PTUN Tanjung Pinang is normatively effective due to a clear, firm, and adaptive regulatory framework that legitimizes electronic judicial processes. However, empirical effectiveness remains partial. Among the five effectiveness factors, only the legal factor operates effectively, while law enforcement capacity, facilities and infrastructure, societal readiness, and legal culture continue to face significant challenges. Uneven digital literacy, unstable internet connectivity, limited technological transparency, and transitional legal culture create practical barriers that disproportionately affect certain groups, particularly users in remote island areas. These conditions undermine equal access to justice and raise concerns regarding the protection of personal data in electronic proceedings. Overall, the study concludes that E-Litigation at PTUN Tanjung Pinang has not yet fully functioned as a comprehensive human rights protection mechanism. Strengthening human resources, improving infrastructure, enhancing public digital literacy, and fostering an adaptive legal culture are essential to ensure that judicial digitalization advances not only efficiency, but also substantive justice and human rights protection.

Abstract

Introduction: This article examines the normative tension between state law and customary law in regulating child marriage practices within indigenous communities. In the Indonesian legal system, marriage is regulated through a formal legal framework emphasizing legal certainty and protection, while customary practices are rooted in communal values, traditions, and unwritten norms. Within the perspective of legal pluralism, the coexistence of these legal systems often creates challenges in terms of effectiveness, compliance, and social legitimacy. Purposes of the Research: The purpose of this research is to analyze the application of legal positivism and natural law theory in social engineering toward child marriage practices in indigenous communities, as well as to formulate an appropriate approach for addressing such practices within the framework of Indonesian law. Methods of the Research: This research employs a normative juridical method using statute and conceptual approaches. Legal materials consist of primary sources such as legislation and secondary sources including legal doctrines and scholarly writings related to customary law, marriage law, and legal theory. Results of the Research: The findings reveal that the persistence of child marriage in indigenous communities reflects a normative tension between the formal validity of state law and the moral legitimacy of customary law. Neither legal positivism nor natural law independently provides an adequate solution. Instead, an integrative approach based on Roscoe Pound's concept of law as social engineering, supported by legal positivism and natural law, offers a more effective framework for promoting legal reform while respecting indigenous cultural values. This study contributes to the literature by proposing an integrated analytical framework that bridges legal certainty, moral legitimacy, and participatory social transformation in legally pluralistic societies.

Abstract

The development of deepfake artificial intelligence technology poses new challenges for Indonesian criminal law because it can be used to digitally manipulate a person’s face, voice, and identity. This study aims to analyze the modus operandi of deepfake AI technology abuse as well as the legal liability of perpetrators in digital fraud crimes. This study employs a normative legal research method using a statutory approach, a case-based approach, and a conceptual approach. The results indicate that the modus operandi of deepfake misuse involves the dissemination of AI-generated manipulative videos featuring President Prabowo Subianto, purporting to offer financial assistance to the public, accompanied by a WhatsApp number to direct victims to communicate with the perpetrator and transfer funds. Legal liability in this case arises because the perpetrator’s actions satisfy the elements of a criminal offense: there is intent, the perpetrator possesses the capacity to be held accountable, and no justifying or exculpatory grounds are found. This criminal liability is based on Article 51(1) in conjunction with Article 35 of the ITE Law and Article 378 of the Criminal Code, while the PDP Law is used as a supporting normative instrument in addressing the misuse of digital identities in the form of faces and voices. This study underscores the importance of strengthening regulations, digital evidence, and harmonizing legal frameworks regarding the misuse of deepfake technology.
