Introduction: The government has made efforts to ensure that existing business competition legal regulations can accommodate the broad legal needs of society, but in reality, in everyday life, legal problems are still often encountered. One of the fundamental legal issues related to business competition in Indonesia is regarding government procurement of goods/services. There are many practices of bid rigging in the process of procuring government goods/services to determine the winner in a tender. Tender conspiracy cases often occur in Indonesia, therefore everything related to tender conspiracy must be carefully scrutinized. Purposes of the Research: The aim of this research is to analyze and discover the nature of the prohibition on bid rigging from a business competition law perspective.Methods of the Research: The research method used is normative juridical. Descriptive and argumentative techniques must be used in carrying out the analysis.Results of the Research: The essence of the prohibition on bid rigging from a business competition law perspective can actually be observed in Article 22 of Law no. 5/1999, Per. KPPU No. 2/2010, and Constitutional Court Decision Number 85/PUU-XIV/2016. This prohibition aims to not give rise to unhealthy business competition, so that the aim of holding tenders can be achieved properly to provide equal opportunities to business actors in offering competitive prices and quality, which in the end will result in the lowest price with the best quality.

With the rise in cases of sexual violence against children, including those involving perpetrators who are still children, it has been found that law enforcement against child perpetrators still faces challenges, including in implementing sanctions that provide a deterrent effect while fulfilling the principles of justice for victims. This research aims to examine the responsibility of perpetrators of criminal acts who are legally and convincingly proven to have committed deception to force sexual intercourse with a child, with a case study in Decision Number: 50/Pid.Sus-Anak/2024/PN.Tjk. This research is supported by an in-depth literature review regarding the meaning of children, criminal acts of sexual intercourse and regulations related to criminal acts of sexual intercourse with children. This research also examines the basis for the judge's consideration in deciding whether to punish a criminal who has been legally proven to have committed a deception to intentionally force sexual intercourse with a child in case decision Number: 50/Pid.sus¬Anak/2024/PN.Tjk. The research method used in this research is a normative and empirical juridical approach using secondary and primary data collected through literature and field studies. The results of the research showed that the perpetrators, who were still children, were sentenced to one year in prison at the Special Children's Development Institution and two months of work training. The Tanjungkarang District Court is advised to increase its capacity in handling cases of sexual violence against children through training and in-depth understanding of child protection issues, and the Bandar Lampung City Police are advised to create special training for investigators in handling sexual cases against children and tighten supervision. to the social environment.

Data on sexual violence cases in Indonesia has increased in recent years. Based on various reports in 2021, the National Commission on Violence Against Women recorded a spike in sexual violence during the COVID-19 pandemic. In that year, there were more than 8,234 cases, in 2022 it increased with around 4,371 reports of sexual violence and in 2023 there were 4,150 cases of violence. Sexual violence in Indonesia is regulated in Law Number 17 of 2016 concerning the Establishment of Government Regulations in Lieu of Law Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection. This article analyzes the criminal responsibility for perpetrators who deliberately induce children to have sexual intercourse and analyzes the factors that influence the perpetrator in committing this criminal act. Based on research results, the factors that influence the perpetrator are external and internal factors which encourage the perpetrator to commit the crime by deliberately persuading the child to have sexual intercourse. Based on this, in the trial the panel of judges stated that the perpetrator had been legally and convincingly proven guilty of committing a criminal act and was sentenced to imprisonment for 1 (one) year at LPKA Class II Bandar Lampung in Masgar Pesawaran and Job Training for 6 (six) months at LPKS (Social Welfare Development Institute)Key words: sexual intercourse, criminal act, criminal liability.

Kemajuan teknologi informasi yang begitu pesatnya membuat style hidup masyarakat yang instan untuk menikmati film tanpa harus ke bioskop yaitu dengan mudah mengakses web streaming film di web sah yang telah terdapat di internet seperti Netflix. Tetapi tidak menutup kemungkinan adanya pelanggaran seperti pembajakan karya cipta film maupun menjual akun Netflix secara illegal melalui Layanan Over The Top lainnya. Riset ini bermaksud untuk menganalisa perlindungan hukum dan upaya hukum terhadap pelanggaran karya cipta film pada aplikasi Netflix. Metode penelitian adalah normative dengan pendekatan perundang-undangan dan konseptual serta pengumpulan bahan hukum menggunakan kepustakaan. Hasil penelitian diperoleh bahwa perlindungan hukum terhadap karya cipta film pada aplikasi Netflix yaitu bentuk perlindungan hukum internal dan bentuk perlindungan hukum eksternal. Pada bentuk perlindungan hukum internal yaitu pihak Netflix dapat mengubah atau menghentikan izin layanan aplikasi kapan saja ketika adanya pelanggagaran kekayaan intelektual dan dapat mengisi kolom aduan klaim pelanggaran hak cipta pada laman resmi Netflix. Sedangkan bentuk perlindungan hukum eksternal yaitu melalui alternatif penyelesaian sengketa, arbitrase, atau pengadilan. Diperlukan perlindungan hukum oleh pemerintah atas ciptaan yang dipublikasikan secara digital melalui Undang-Undang hak cipta di Indonesia dengan memperbaharui undang-undang hak ciptanya untuk memberikan perlindungan hukum secara penuh atas hak cipta dalam media digital khususnya pada layanan Over The Top (OTT). This legal research seeks to ascertain the legal status of Child Social Welfare Institutions, the procedures for guardianship, and the legal obligations of these institutions regarding guardianship, in accordance with the Criminal Code, Law, and Permensos Number 30/HK/2011 pertaining to National Childcare Standards for Child Social Welfare Institutions in Indonesia. This legal research constitutes an empirical investigation on a descriptive Child Social Welfare Institution. The study methodology employs a legislative framework. The data comprises primary data derived from empirical study findings and secondary data sourced from library books pertinent to the issue or research subject. This research reveals that the process for appointing a special guardian for foster children is explicitly governed by Permensos Number 30 / Huk / 2011 about National Childcare Standards for Child Social Welfare Institutions, particularly by a court order. The transfer of custody from parents to the Orphanage occurs immediately upon the child's submission, regardless of whether it is initiated by the parents or the appropriate agencies. This is executed due to its perceived simplicity and minimal time and financial expenditure, ensuring rapid fulfillment of demands. The legal obligations of guardianship by the Child Welfare Institution include responsibility for the child's welfare, assets, and guardianship that lacks a valid legal basis

Introduction: One of the important principles regulated in the Bankruptcy Law and Postponement of Debt Payment Obligations is the Going Concern Principle, which can enable a business entity or individual to run again even though it has fallen into bankruptcy, in this case the assets belonging to the debtor can be managed by the curator to obtain income as an effort to fulfill the debtor's debts. gradually to creditors.Purposes of the Research: This research aims to analyze just legal protection for debtors who are respondents to bankruptcy in the Bankruptcy Law and Postponement of Debt Payment Obligations.Methods of the Research: The type of research used is normative juridical, examining positive legal norms with the concept of law as it is written in the book, namely by conducting studies of statutory regulations and literature studies.Results Main Findings of the Research: The application of the principle of business continuity in bankruptcy cases and postponing debt payment obligations is within the framework of legal protection for debtors and has a positive impact on increasing the company's economic value which in turn is used to pay debts to its creditors.

This study analyzes the urgency of regulating pets as a subject of legal protection in Indonesia. Although pets have the right to be treated humanely, regulations in Indonesia do not specifically recognize pets as legal subjects entitled to legal protection. This study uses a normative juridical approach with an analytical descriptive method to examine regulatory gaps related to pet protection. Data was obtained through literature studies on laws and regulations, legal doctrines, and cases of violence against pets. The results of the study show that existing regulations, such as Criminal Code Article 302 and Law No. 18 of 2009, still focus on the health aspect of livestock and have not accommodated the basic rights of pets. In addition, criminal sanctions for perpetrators of violence against pets are considered ineffective in providing a deterrent effect. This study recommends the establishment of a special law on the protection of pets, a revision of the Criminal Code Article 302, and public education programs to increase awareness about pet rights. The implementation of these regulations is expected to strengthen legal protection for pets and encourage a paradigm shift in society in treating pets as legal subjects who are entitled to protection.
