Abstract

This research discusses the model of human rights-based communication tapping policy in law enforcement in Indonesia. The fragmentation of wiretapping regulations in various laws such as the Telecommunications Law, ITE Law, and KPK Law has created legal uncertainty and opened opportunities for violations of citizens' privacy rights. This study uses a literature review method to analyse norm conflicts in wiretapping regulations and formulate a policy model that meets accountability and privacy protection standards. The results show that wiretapping should be conducted based on court permission, with independent supervision, restrictions on scope and duration, and an effective complaint mechanism for victims of illegal wiretapping. Regulatory harmonisation is needed through the establishment of a special law on wiretapping that integrates international human rights principles and accountability, so that wiretapping can be an effective law enforcement instrument without compromising the fundamental rights of citizens.

Abstract

This research addresses the surveillance and implications of wiretapping in the perspective of international and national law through a comparative study of regulation and practice, with a focus on the cases of Indonesia and Australia. Wiretapping is an important instrument in law enforcement and state security, but at the same time has the potential to violate human rights, particularly the right to privacy. At the international level, wiretapping is regulated through various human rights instruments such as the UDHR, ICCPR, and the Vienna Convention, which emphasise the protection of privacy and the principle of non-intervention, while leaving room for exceptions for serious crimes. At the national level, Indonesia faces challenges of regulatory fragmentation, weak oversight, and the absence of a specific law that comprehensively regulates wiretapping. The case study of Australia's wiretapping of Indonesia shows that the practice of wiretapping without adequate oversight can damage diplomatic relations and reduce trust between countries. This research recommends harmonising national regulations with international standards, establishing a comprehensive wiretapping law, and strengthening independent oversight institutions to ensure lawful, proportionate and accountable wiretapping practices, while protecting human rights and maintaining stable international relations.

Abstract

Judicial oversight of wiretapping in the law enforcement process is an important aspect to maintain the integrity and credibility of the judiciary. This research aims to analyse the effectiveness of the Judicial Commission (KY) in carrying out its supervisory function through wiretapping actions against judges suspected of violating the code of ethics and conduct. The research method used is normative juridical with a qualitative approach, examining legislation, legal doctrine, and the results of previous research. The results showed that the effectiveness of judicial oversight of wiretapping is still not optimal, mainly due to KY's dependence on other law enforcement officials, the resistance of the Supreme Court, and limited regulations and resources. In addition, overlapping authorities and lack of synergy between institutions also hinder the effective implementation of wiretapping. This research recommends the need to strengthen KY's authority, revise regulations, and increase inter-agency collaboration to strengthen judicial oversight and maintain judicial integrity.

Abstract

The development of digital technology has brought convenience in information exchange, but also increased the risk of wiretapping and violation of personal data in Indonesia. This research aims to examine the challenges of monitoring wiretapping practices in the context of personal data protection in Indonesia through a literature study of relevant regulations, cases, and literature. The results of the study show that regulatory fragmentation, the absence of independent oversight institutions, weak oversight mechanisms, and low public digital literacy are the main obstacles in protecting personal data from the threat of wiretapping. In addition, the rapid development of technology and cross-border jurisdictional issues complicate monitoring efforts. Regulatory harmonisation, the establishment of effective supervisory institutions, and multi-sector collaboration are needed to strengthen personal data protection in the digital era. This research recommends surveillance system reform, public education, and technical capacity building as strategic steps to create a safe and trusted digital ecosystem in Indonesia.

Abstract

Communication plays a central role in the legal protection of patients in health services in Indonesia. Through effective communication, patients' rights such as the right to medical information, informed consent, and confidentiality of health data can be fulfilled optimally. Clear and transparent communication not only strengthens the patient's legal position, but also minimises potential disputes between patients and health workers. However, the implementation of ideal communication still faces various obstacles, such as time constraints, low health literacy, and the challenge of adapting digital technology in health services. This literature review confirms the importance of strengthening the communication capacity of health workers, educating patients, and updating regulations so that patient legal protection through communication can be realised effectively and evenly throughout Indonesia.

Abstract

This study explores the evolution of the mudarabah contract from a historical perspective to its prospects for application in the modern banking system. Using a literature review method, with a research focus on the evolution of the mudarabah contract over time and its prospects for application in the modern banking system. Historical analysis shows how mudarabah has adapted to the changing socioeconomic and financial regulatory challenges over time, as well as the evolution of its practice based on the principle of profit sharing and Islamic commercial ethics. The results of the study show that innovation and adaptation in Islamic financial products, including mudarabah contracts, have strengthened their relevance in the modern era, indicating significant growth in global Islamic banking. This article closes by discussing the prospects of mudarabah contracts as ethical and sustainable financial instruments in the modern banking ecosystem, given the increasing demand for responsible and fair financial alternatives, as well as the important role of financial technology in expanding the reach and efficiency of sharia financial transactions.

Abstract

This study analyzes the Highest Retail Price (HET) policy for palm cooking oil. of palm cooking oil implemented by the Indonesian government through MOT Regulation of the Minister of Trade (Permendag) Number 1 of 2022 as revoked based on Permendag Number 6 of 2022 concerning the Determination of HET of Palm Cooking Oil, and its implications for business competition based on Law No. 5 of 1999 on the Prohibition of Monopolistic Practices. based on Law No.5/1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition. and Unfair Business Competition. The price ceiling policy aims to protect consumers from uncontrolled price increases, especially for low-income households. low-income communities. Producers filed an objection, and the Central Jakarta Commercial Court ruled that the scarcity of cooking oil was the impact of the single price ceiling policy, and therefore the KPPU's decision was canceled. Abstract

Taxation contributes to national development, and Indonesia has responded to global dynamics by introducing Indonesia Core Tax, a digital system designed to improve tax transparency and compliance. Although Indonesia has adopted various digital systems such as e-Faktur and e-Invoicing, it still faces implementation challenges, while Malaysia is more advanced with its integrated and phased API-based e-Invois system. This study examines taxation policy within the framework of Indonesia Core Tax, focusing on the legal aspects of e-Invoicing implementation as part of the digital transformation of tax administration. The analysis covers the hierarchy and functions of legislation, from laws and regulations to Minister of Finance regulations (PMK) and technical regulations of the Directorate General of Taxes (DJP). This study uses a normative legal research method with a legislative approach and a comparative approach to compare Indonesia's digital taxation system with Malaysia's, covering legal structure, legal substance, and legal culture. The results of the study show that although Indonesia has a fairly complete digital legal framework, the implementation of the e-Invoicing system still faces challenges in terms of regulatory consistency and technological readiness. In contrast, Malaysia has already implemented a mandatory and centralized API-based e-Invoice system through a clearance model approach. This study recommends harmonizing digitalization policies in taxation and strengthening the legal system as strategic steps toward more effective and adaptive tax administration.

Abstract

Restorative approaches in public health conflict offer solutions that focus on restoring social relations and peacefully resolving conflict through inclusive dialogue. This method provides space for all parties involved to actively participate, identify root causes, and seek solutions together to minimise the negative impact of conflict on the public health system. Compared to traditional retributive approaches, restorative approaches emphasise social justice, open communication and collective healing, making them more effective in building trust and improving responsiveness to community health needs. The implementation of this approach not only resolves the conflict, but also helps to create a more resilient and sustainable public health system.

Abstract

This study critically examines legal regulations related to the protection of medical personnel and patients in Indonesia, focusing on landmark cases that reflect legal challenges in the healthcare sector. The study found that although legal protections for medical personnel and patients are set out in legislation, implementation is often hampered, particularly in the context of medical decision-making, malpractice risks and lawsuits. Lack of legal certainty for medical personnel can hamper their professionalism, while for patients, unclear rights to quality services can reduce trust in the health system. Through the analysis of various cases in the literature review, this study identifies the need for legal reforms that focus on balancing the rights and obligations of both parties, namely medical personnel and patients, along with applicable legal education. With regulatory reform and more transparent law enforcement, the results are expected to improve the quality of health services, protect medical personnel in carrying out their duties, and strengthen public confidence in the legal system in the health sector. This research contributes to thinking about the importance of coordination between legal institutions, medical practitioners, and the community in building a fairer system in the health care sector.
