Abstract

This article copes with the issue of ‘azl from Islamic perspective. Generally, ‘azl is the prevention of pregnancy by releasing the sperm out of vagina. In modern context, this practise is analogous with the family planning. The only difference is that the modern family planning uses medicines. Islamic scholars, basing their respective arguments on some hadits of the prophet, have different opinion on the issue: some of them permit the practise of ‘azl, while some others prohibit it. This study reveals that the hadits used by Islamic scholars who forbid the practise of ‘azl is dha’if. Therefore, the practise of ‘azl is actually permitted, with the permission of wife, and without permission if applied to slave.

Abstract

This paper discusses the rights of living for women divorced by her husband such a case of Fatimah binti Qays, a companion of prophet who divorced by her husband and was not in place. The hadith stated the attitude of Abu Omar divorced his wife while he wasn’t there and sending a representative to meet Fatima bint Qais and bring her some foods. A representative’s visiting made Fatimah felt unsatisfactory because the food (nafkah) brought was not enough to supply her daily needs. This Hadith related to the issue both its sanad and matan are shahih (authentic quality). Although there is a valid hadith shows that there is no right of living for a husband to his divorced wife, but some scholars still disagree about it because of the texts of the Quran manage about the rights of living and housing.

Abstract

This article deals with wali nikah (relative legally responsible for a bride) as a requirement in a wedding process. Majority of Islamic scholars (fuqaha), and also Indonesian Islamic law, always refers to male relative when they talk about wali nikah. On the other hand, contemporary Islamic scholars even give a bride a freedom to get married without a wali nikah. While the first opinion may lead to gender inequality and injustice, the latter opinion is very dangerous. From historical approach, the opinion that wali nikah always refers to male relative can be traced from Islamic legislation prescribed in the Qur’an and hadits. Referring to some contemporary Islamic scholars and muhadditsin, the writer contends that wali nikah is not an obligatory rule (rukun) of a marriage, but only serves as a monitoring apparatus. Suppose wali nikah must exist, it does not necessarily come from a bride side, but may come from a bridegroom side. Moreover, the order of wali nikah may differ from what is compiled in Islamic legal thought (fiqh).

Abstract

Giving exclusive breastfeeding, in Islamic perspective, discusses about the milk (al-labn) coming out from the women breast, the status of giving exclusive breastfeeding to the children as a job, the children right to get the good milk, the responsibility of parent to take care, and the social implication of the exclusive breastfeeding. This is because that mother breastfeeding ¬-the same as blood- is the liquid in women body affecting the history of social human. If the blood can keep the brotherhood, the breastfeeding can keep the unity and the harmony of family. These, have the similarity implicative relation in descent rotation.

Abstract

Abstract

This article aims to outline some prophetic instructions regarding social interaction to avoid bullying behavior. This study uses a normative qualitative method, namely analyzing hadiths related to bullying with an ahkam hadith perspective.  This study concludes that bullying behavior from the perspective of hadith is: 1) The Hadith narrated by Ibn Majah generally explains how the Prophet's Hadith views bullying as leading to degrading behavior. This is obtained from the word ihtiqarwhich has a correlation in meaning with the orientation of bullying behavior itself, namely degrading. Then a complete reading of the hadith narrated by Imam Muslim adds an explanation of indications of bullying behavior such as envy, hatred, belittling and tyrannizing other people. These attitudes are the seeds of hostility and division between people; 2) The basic idea of Ibn Majah's hadith number 3203 is the value of humanism, namely the effort to maintain a humane attitude towards fellow humans in any situation and condition. In the previous comprehensive thematic study, it was also sufficient to contribute to the conclusion of the basic idea of the hadith studied, namely explaining the consequences for perpetrators of bullying both verbally and physically. This spirit is in line with the spirit of humanism which condemns all kinds of acts of harassment or degrading towards fellow human beings. Therefore, in the perspective of ahkam hadith there is a need for preventive measures in order to prevent or overcome this act of bullying; 3) The preventive measures offered by this hadith are: a) providing spiritual awareness of the importance of preventing bullying early, b) supporting cooperation and breaking the cycle of conflict, c) eliminating inferiority for victims of bullying and honing assertive skills.

Abstract

صار لفظ النشيد الإسلامي لغة العصر، فالناس يحبون ويتداولون الأغاني الدينية من كبار السن حتى الأطفال فمن الضروري في العصر الحاضر أن يكون مفهوم فن النشيد من منظور إسلامي، حيث يصبح العديد من الناس عبيدًا لحرية لا يمكن أن يسيطر عليها الوعي الذاتي للإنسان، ويبدو أن الناس مغمورون في عالم الترفيه المفرط ويخالفون الحدود التي حددتها الشريعة الإسلامية، فأراد الباحثون أن يبينوا مفهوم النشيد، وموقف الحديث النبوي من النشيد، والآثار الحكمية للنشيد في الحديث النبوي. والمنهج المتبع في هذا البحث هو المنهج الوصفي الاستقرائي، وذلك بجمع الأحاديث المتعلقة بالغناء والموسيقى وهما جزء من النشيد. والطريقة المستخدمة لتحليل البيانات هي دراسة مكتبية وطريقة تحليلها وصفية. ونتيجة البحث تشير إلى أن مفهوم النشيد وأحكامه واختلاف العلماء فيه قد ورد في الأحاديث النبوية بيانه. وهذا البحث له آثار لفهم القيم الحقيقية للفن الإسلامي وخاصة لجيل المسلم الذي يواجه مشاكل الحياة الحديثة المعقدة، حتى يصبح جيلا متحضرا ومتأدبا.الكلمات المفتاحية: النشيد، الغناء، الموسيقى ABSTRACTIslamic Nasyid is a contemporary issue. People are increasingly liking and enjoying religious songs, from parents to children. In the modern era, the concept of art in an Islamic perspective is needed, where many humans become slaves to freedom that a human's self-awareness cannot control. Humans seem to be immersed in the world of excessive entertainment and violate the boundaries that the Shari'a has determined. Therefore, the author wants to explain the essence of nasyid art, the view of the Prophet's hadith on nasyid and the legal consequences of nasyid in the Prophet's hadith. This study is a literature review, classical and contemporary. The method used is a qualitative method with a descriptive approach by collecting hadiths related to songs and music as part of nasyid. For data processing, the methods used are library research and descriptive analysis methods. The study results indicate that the understanding of nasyid, the law and the differences between the scholars in it has been explained in the hadith of the Prophet. Therefore, this paper has implications for understanding the actual values of art, especially for the millennial Muslim generation who face complex modern life problems to become a civilized Muslim generation.
