Abstract

Violations of moral norms often have significant social impacts, one of which is marriage which is carried out as a form of resolving moral conflicts in society. This article aims to analyze marriage due to violations of moral norms in Pematang Siantar City based on the perspective of Islamic law and positive law in Indonesia. In Islamic law, marriage is often considered a solution to normalize social relations after the occurrence of a violation, although there are requirements and principles that must be met. Meanwhile, positive law in Indonesia emphasizes the formal legality aspect and does not explicitly regulate the obligation to marry in such situations. This study also discusses various social implications that arise as a result of this phenomenon, such as social pressure on the individuals involved, as well as its impact on household stability. Using a normative-juridical approach, this article reviews how the two legal systems view this phenomenon, as well as providing an overview of the integration efforts between religious, legal, and cultural values in resolving this problem. The results of the analysis show that a comprehensive approach is needed to handle marriage cases due to violations of moral norms, in order to ensure justice for all parties involved.

Abstract

Tulisan ini bertujuan untuk mengkaji praktik perkawinan sah sintua-tua pada masyarakat Muslim Karo di Desa Palding Jaya Sumbul, faktor-faktor yang melatarbelakangi keberlanjutannya, serta perspektif ulama Kabupaten Dairi terhadap praktik tersebut. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan sosiologi hukum. Data primer diperoleh melalui wawancara dengan masyarakat Muslim Karo, pelaku perkawinan adat, dan ulama setempat, sedangkan data sekunder berasal dari peraturan perundang-undangan, Kompilasi Hukum Islam, dan literatur terkait. Analisis dilakukan secara kualitatif dengan menelaah fenomena sosial yang terjadi di lapangan. Hasil penelitian menunjukkan bahwa sebagian masyarakat Muslim Karo masih mempraktikkan perkawinan sah sintua-tua sebagai bagian dari tradisi adat. Praktik ini pada dasarnya diperbolehkan bila dilakukan antar sesama Muslim setelah akad nikah secara Islam, kemudian dilanjutkan prosesi adat. Dalam konteks ini, perkawinan adat dipandang sebagai ‘urf yang mubah, karena tidak bertentangan dengan prinsip syariat. Namun, permasalahan muncul ketika praktik tersebut dilakukan dengan pasangan berbeda agama. Masyarakat beranggapan bahwa adat tidak melarang pernikahan beda agama, sehingga tetap melaksanakannya meski bertentangan dengan hukum Islam. Faktor pendorongnya antara lain kehamilan di luar nikah, hubungan cinta beda agama, serta pernikahan di bawah umur. Menurut ulama Kabupaten Dairi, jika perkawinan sintua-tua melibatkan perbedaan agama, maka ia tergolong ‘urf fasid dan hukumnya haram. Selain itu, dari perspektif hukum positif, perkawinan adat ini tidak memiliki legalitas karena tidak tercatat di instansi berwenang. Dari sudut maqashid syari’ah, praktik ini bertentangan dengan hifz ad-din (menjaga agama) dan hifz al-nasl (menjaga keturunan), sehingga dinilai tidak efektif dan merugikan masyarakat Muslim Karo. This paper explores the practice of sah sintua-tua marriage within the Karo Muslim community in Palding Jaya Sumbul Village, the reasons for its persistence, and the perspectives of Islamic scholars in Dairi Regency. Using an empirical juridical method with a sociological approach to law, the study draws on primary data from interviews with community members, traditional marriage practitioners, and local religious scholars, while secondary data are obtained from legislation, the Compilation of Islamic Law, and relevant literature. Data analysis was conducted qualitatively by examining social phenomena in the community. The findings indicate that some Karo Muslims continue to practice sah sintua-tua marriage as part of their cultural identity. When conducted between fellow Muslims, after a valid Islamic marriage contract and followed by customary rituals, the practice is viewed as mubah ’urf because it does not conflict with Islamic law. Problems arise, however, when it involves interfaith couples. Many community members believe adat does not forbid such unions, leading them to disregard Islamic prohibitions. Factors sustaining this practice include premarital pregnancy, strong emotional attachment between partners of different faiths, and underage marriage. According to scholars in Dairi Regency, interfaith sintua-tua marriages are categorized as ’urf fasid (corrupt custom) and are therefore prohibited. From the perspective of positive law, these marriages lack legal validity since they are not officially registered. Within the framework of maqashid al-shari‘ah, interfaith sintua-tua marriages undermine hifz al-din (protection of religion) and hifz al-nasl (protection of lineage), making them both socially and religiously detrimental.

Abstract

Khulūʿ, as a divorce mechanism initiated by the wife through the payment of iwāḍ (compensation) to the husband, is a legal institution deeply rooted in classical Islamic jurisprudence, yet it has undergone significant transformation when adopted into modern legal systems, including that of Indonesia. This study reassesses the concept of khulūʿ across the four Sunni schools of law and compares these doctrinal formulations with its judicial implementation within the Indonesian legal system, particularly through the Kompilasi Hukum Islam (KHI) and the practices of the Religious Courts. Employing a qualitative, library-based research approach combined with doctrinal and comparative legal analysis, this research finds that although the fundamental elements of khulūʿ—such as the requirement of iwāḍ, the absence of the husband’s right to revoke the divorce, the prescribed ʿiddah, and the centrality of mutual consent—are maintained, the Indonesian legal system has formally institutionalized khulūʿ by mandating judicial proceedings, requiring specific grounds for divorce, authorizing judicial intervention in determining iwāḍ when no agreement is reached, and introducing administrative procedures absent from classical fiqh discourse. The study concludes that the Indonesian model of khulūʿ reflects a process of Islamic legal adaptation shaped by the demands of modernity, the administrative needs of the state, and the imperative of protecting women, thereby producing a dialectical relationship between fiqh orthodoxy and contemporary family law regulation.

Abstract

Walīmat al-ʿurs constitutes an important socio-religious practice in Islamic marriage, particularly within Muslim societies that adhere to the Shāfiʿī school of law. This article examines the legal reasoning (istinbāṭ) employed by Shāfiʿī jurists in determining the legal status of walīmat al-ʿurs and analyzes its relevance to Indonesia’s Compilation of Islamic Law (Kompilasi Hukum Islam/KHI). Employing a normative legal research method with conceptual and comparative approaches, this study analyzes classical Shāfiʿī legal texts alongside statutory Islamic family law in Indonesia. The findings demonstrate that Shāfiʿī jurists derive the ruling of walīmat al-ʿurs through an integrative mode of legal reasoning that combines textual commands of the Prophet, contextual indicators (qarāʾin), and functional considerations of marriage publicity (iʿlān al-nikāḥ), resulting in its classification as sunnah muʾakkadah. Meanwhile, the absence of explicit regulation on walīmat al-ʿurs in the KHI reflects a legislative choice to prioritize administrative and juridical aspects of marriage over ritual-social practices. This study argues that walīmat al-ʿurs remains epistemologically, normatively, and functionally relevant to the KHI as a form of living Islamic law that complements codified legal norms. The article contributes to Islamic legal scholarship by highlighting the continued relevance of classical Shāfiʿī legal reasoning in understanding and evaluating contemporary Islamic family law in Indonesia.

Abstract

This study aims to analyze public perceptions of zihar, examine its practice in domestic life, and explain its legal and social implications from the perspective of fiqh munakahat. The study employed a qualitative approach with field research conducted in Simangambat Village, North Padang Lawas Regency. Data were obtained through in-depth interviews with religious leaders, community leaders, village officials, and married couples. Data were analyzed thematically by comparing social practices and normative provisions of Islamic law. The results reveal a clear gap between the norms of fiqh munakahat and social reality, where zihar is perceived as an emotional expression or a joke without legal consequences. This finding indicates a weak internalization of Islamic family law and the potential for injustice in marital relations. This study emphasizes the importance of strengthening contextual and sustainable fiqh munakahat education at the community level.

Abstract

The phenomenon of reluctance or fear of marriage (marriage phobia) among Generation Z men in Indonesia is increasingly on the rise. One of the main determining factors is psychological pressure due to the high financial standards set by prospective female partners or their families. This often clashes with the economic reality of Gen Z, who are at the early stages of their careers, causing anxiety about their inability to meet material expectations. This study uses a qualitative method with a library research approach. Analysis was conducted using interpretative and thematic methods on Q.S. An-Nur verse 32 as an analytical tool to address the issue of financial anxiety. Data were collected from classical and contemporary exegesis literature, as well as sociology journals related to Gen Z marriage behavior. This study aims to reconstruct understanding regarding Allah's assurance for those who intend to marry in order to protect their personal dignity. The analysis results show that Q.S. An-Nur verse 32 conveys an optimistic message that marriage is a gateway to sustenance, not a burden that must wait for absolute financial stability. This verse emphasizes that poverty is not a barrier to the legitimacy of marriage, but rather an encouragement for society to help facilitate the process. This interpretation offers a theological solution for Gen Z men to shift their focus from financial fears to mental preparedness and measured efforts, while also serving as a critique of the shift in marriage values that tend to be materialistic in the modern era.

Abstract

The weton tradition is part of the local wisdom of Javanese society and continues to influence social practices, including determining marital compatibility. In practice, determining the birth date of a prospective partner through weton calculations is often used as a basis for proceeding with or canceling marriage plans. This phenomenon creates an anomaly when the weton tradition clashes with the principles of Islamic family law, which emphasize the pillars and requirements of marriage derived from the Quran and Hadith. This article aims to analyze the role of the weton tradition in marriage from the perspective of Islamic family law and examine the limits of tolerance between custom and sharia. The research method used is qualitative research with a normative-juridical and sociological approach. The results of the study indicate that the weton tradition is acceptable as long as it does not conflict with the principles of faith and is not used as a determining factor in determining the validity of a marriage.

Abstract

This article examines the concept of wali adhol (reluctant or refusing guardian) within Islamic family law and analyzes its relevance and institutionalization in Indonesian marriage law. A wali adhol refers to a marriage guardian who unjustifiably refuses to solemnize the marriage of a woman under his guardianship despite the fulfillment of Islamic legal requirements. Employing a normative juridical method with conceptual and comparative approaches, this study analyzes classical fiqh doctrines, statutory regulations, and judicial practices in Indonesia. The findings demonstrate that the doctrine of wali adhol has been systematically incorporated into Indonesian positive law through Article 23 of the Compilation of Islamic Law (KHI) and relevant regulations of the Ministry of Religious Affairs. The Religious Courts are vested with the authority to determine the status of wali adhol and to appoint a wali hakim (judicial guardian) as a substitute, thereby safeguarding women’s rights to marriage. This study argues that the regulation of wali adhol reflects a substantive harmonization between Islamic law and national law, grounded in principles of justice, legal certainty, and the protection of human rights.

Abstract

Tawkil wali merupakan salah satu mekanisme penting dalam pelaksanaan akad nikah yang memungkinkan wali untuk mewakilkan kewenangannya kepada orang lain. Dalam konteks perkawinan kontemporer, praktik tawkil wali menghadapi berbagai problematika, baik dari aspek syar'i maupun hukum positif di Indonesia. Penelitian ini bertujuan menganalisis problematika tawkil wali dalam perkawinan kontemporer, kedudukan hukumnya dalam perspektif fiqh dan hukum positif Indonesia, serta solusi yang dapat ditawarkan. Metode penelitian yang digunakan adalah penelitian kepustakaan (library research) dengan pendekatan normatif-yuridis. Hasil penelitian menunjukkan bahwa problematika tawkil wali meliputi: ketidakpahaman masyarakat tentang syarat dan rukun tawkil, penyalahgunaan wewenang oleh wakil wali, ketidakjelasan status wali dalam kondisi tertentu, dan benturan antara hukum adat dengan hukum Islam. Solusi yang ditawarkan meliputi peningkatan edukasi hukum perkawinan Islam, penguatan peran KUA, dan harmonisasi hukum positif dengan syariat Islam.

Abstract

Mahar (ṣadāq) merupakan salah satu konsekuensi hukum yang melekat pada akad nikah dalam Islam dan berfungsi sebagai hak ekonomi istri yang wajib dipenuhi oleh suami. Dalam fikih mazhab Syafi‘i, mahar memiliki kedudukan strategis meskipun tidak termasuk rukun nikah. Artikel ini bertujuan untuk menganalisis konsep mahar dalam akad nikah menurut perspektif fikih Syafi‘iyyah dengan menelaah landasan normatif, kedudukan hukum, bentuk dan kadar mahar, serta implikasi hukumnya terhadap relasi suami istri. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan konseptual dan normatif-doktrinal. Sumber data diperoleh dari Al-Qur’an, hadis, serta kitab-kitab fikih mazhab Syafi‘i yang mu‘tabar, didukung oleh literatur hukum Islam berbahasa Indonesia. Hasil kajian menunjukkan bahwa mahar dalam fikih Syafi‘iyyah dipahami sebagai hak absolut istri yang lahir secara otomatis akibat akad nikah atau hubungan suami istri yang sah. Fleksibilitas penentuan mahar, pengaturan mahar mitsil, serta perlindungan hak istri dalam pelaksanaannya mencerminkan orientasi keadilan dan perlindungan perempuan dalam hukum keluarga Islam. Konsep mahar dalam mazhab Syafi‘i juga memiliki relevansi yang kuat dengan sistem hukum perkawinan Islam di Indonesia.
