Abstract

This research is research on custody rights or hadhanah for underage children, child custody or hadhanah is one of the problems that arises when a husband and wife divorce, especially those who already have one or more children. , hadhanah is the task of looking after or caring for babies/small children who are not yet able to look after and regulate themselves. Receiving care and education is the right of every child from both parents. The child's parents are the ones who are more important in carrying out this task, as long as both of them have the ability to do so. In terms of custody or hadhanah of children who are not yet 12 years old, it should be given to a mother in accordance with what is regulated in Article 105 of the Compilation of Islamic Law which states that custody or hadhanah of children who are not yet 12 years old is the right of a mother. This research uses research methods Normative juridical, normative juridical, namely legal research carried out by examining library materials and using research approach models in legal researchers including legal approaches - Islamic law. The data collection method used is library data obtained through library research sourced from Islamic law, books, official documents, publications and research results. The primary data source was obtained by reading literature related to the discussion of hadhanah. The results of this research. The fuqoha agreed that hadhanah started from the birth of the mahdhun until the mumayyiz of the mahdhun, however they differed in their opinions regarding when the hadhanah ended after mumayyiz.

Abstract

This research aims to analyze the reform of Islamic inheritance law in Indonesia, with a particular focus on government policies supporting this reform. The study examines legal doctrines in the Compilation of Islamic Law, jurisprudence, Supreme Court guidance letters for religious courts, and fatwas from the Indonesian Ulema Council. Employing a historical and Islamic legal political (fiqh siyasah) approach, it explores the background and dynamics of these reforms. The reform process involves updating legal concepts, norms, and techniques, driven primarily by the executive and judiciary, while legislative bodies are constrained by their inability to pass laws. Non-governmental institutions, particularly the Indonesian Ulema Council, also play a pivotal role. Scientifically grounded methods, such as ijtihad intiqa'i tarjihi and ibda'i insha'i, serve as the foundation for these reforms. The government’s strategies within the Islamic legal-political framework (fiqh siyasah) are (1) developing Islamic inheritance law in line with societal practices, (2) codifying it into legislative products, (3) compiling it into unified legal texts, (4) enacting legal products such as presidential instructions, fatwas, and jurisprudence, (5) involving scholars, officials, and judges in shaping reforms, (6) creating regulations for non-litigious inheritance distribution based on Islamic law, and (7) engaging the community in inheritance practices. This research’s novelty lies in its comprehensive analysis of both governmental and non-governmental roles in reforming Islamic inheritance law through integrative legal-political strategies. Additionally, it highlights the innovative application of ijtihad intiqa'i tarjihi and ibda'i insha'i, contributing to the modernization and contextualization of Islamic inheritance law in Indonesia. The contribution of this research is its exploration of the interplay between legal reform and societal practices, providing a new understanding of the mechanisms that shape Islamic law in contemporary Indonesia. Furthermore, it offers valuable insights into the role of both religious scholars and government authorities in the legal reform process, offering a model for integrating Islamic law with modern legal systems.

Abstract

This study aims to evaluate the effectiveness of requiring individuals to memorize the obligatory, impossible, and permissible attributes of Allah, along with the pillars of obligatory bathing, as a prerequisite for marriage registration in Teluk Pulai Dalam Village. Despite not being aligned with the provisions of Government Regulation No. 9 of 1975, this practice is widely implemented within the community. This research employs a qualitative subjective approach with an empirical juridical method. Field research was conducted to gather direct insights into the application and impact of memorizing theological and ritual requirements for marriage registration in Teluk Pulai Dalam Village, Kualuh Leidong Subdistrict. Findings indicate that the memorization requirement positively influences the local community. Although it does not comply with formal legal provisions, it enhances individuals’ understanding of Islamic theological principles and the correct procedures for obligatory bathing. As a result, worship practices within the community are perceived as more valid and spiritually meaningful. This study provides a unique perspective on the intersection of religious education and marriage registration practices outside formal state regulations. It highlights how local customs shape religious literacy and compliance with Islamic rituals. The research suggests that integrating religious education into marriage-related practices can strengthen community understanding of Islamic obligations. However, it also raises questions about the legal and administrative alignment of such practices with national regulations. Further studies may explore how similar initiatives can be harmonized with formal legal frameworks.

Abstract

One of the most common issues in marriage is the marriage contract, which might take days to finalize. It happens when a guardian refuses to marry off his daughter because he disapproves of the marriage. Therefore, Malojongkon Boru is frequently practiced to get the approval of the woman's guardian or father. The subject of discussion for this study is the transition of the nasab guardian to the judge guardian in the practice of Malojongkon Boru. The focus of the problem in this study is the perspective of Indonesian Ulema Council (MUI) and Traditional Leaders on the transition of nasab guardian to the judge guardian in Malojongkon Boru marriage practice. This study is a field research with a qualitative approach. The data sources are classified into field data as primary data, including interviews and documentation, and literature data as secondary data. The findings indicate that MUI and Traditional Leaders view the transition of marriage guardians in the practice of Malojongkon Boru marriage as conducted in conformity with Islamic law.

Abstract

Land or territory is the main element of a country. In the perspective of fiqh siyasah, which regulates politics and government in Islam, land dispute cases on Batahan Plasma land as occurred in the case at the Medan PTUN can be seen as part of the leader's responsibility in maintaining justice and preventing conflict in society. The purpose of the study was to find out how the Lawsuit Against the Regent of Mandailing Natal Over the Location Permit for Plasma Land from the Perspective of Fiqh Siyasah (Analysis Study of Ptun Decision Number 84/G/2018/Ptun.Mdn). Research method, Normative Law research. The results of the study, PTUN Decision Number 84/G/2018/PTUN.MDN which granted the lawsuit against the Regent of Mandailing Natal regarding the location permit for Batahan Plasma Land shows the importance of the principles of legality, justice, and public interest in government administrative actions. The Medan PTUN assessed that the permit issued by the Regent was unlawful, not through a legitimate procedure. In the perspective of fiqh siyasah, this decision reflects an effort to uphold justice, transparency, and accountability, which is in line with the principles of social justice and public responsibility. This emphasizes the role of the court in ensuring that public policies are carried out for the public interest, not for the interests of individuals or certain groups. Accurate data certainly leads to transparency and minimizes the potential for fraud in the 2024 elections

Abstract

: Provinces and regencies/cities are autonomous regions, namely a legal entity with clear territorial boundaries and have the rights, authority, and responsibility to regulate and manage their own government affairs. Village apparatus plays a role in supporting the village head to ensure the smooth administration of government, provide services needed by the community, and carry out village obligations, duties, and functions. The purpose of the research is to find out how the decision of the state administrative court Number 282/G/2019/PTUN.MDN concerns the dismissal of the head of the Sampali village hamlet from the perspective of fiqh siyasah. Research method, normative legal research. The results of the research, the dismissal of the Head of the Sampali Village Hamlet was carried out without deliberation, adequate notification, or consultation with the sub-district head, as a result of which it violated Law Number 3 of 2024 concerning Villages and Regulation of the Ministry of Home Affairs Number 67 of 2017, as a result the decision was declared null and void, and the defendant was ordered to revoke the decision, return the plaintiff to his original position, and pay court costs. According to the perspective of fiqh siyasah, this decision reflects the application of the principles of justice ('adl), deliberation (shura), and responsibility (mas'uliyyah) in governance. The act of dismissing the village head without going through a legitimate procedure not only violates state law, but also the ethics of Islamic leadership. This case is an important precedent for applying the values ??of fiqh siyasah in maintaining the welfare of the community and the integrity of the village government

Abstract

The purpose of this study is to explore and understand the various rules of Islamic jurisprudence related to divorce, and how to apply these rules in problems related to divorce. This study uses a library research approach. The results of the study indicate that divorce should be imposed based on valid reasons and lead to the need to separate. Imposing divorce without a clear reason can result in sin for the husband. In addition, the valid requirements for divorce are that the husband who makes it must be mature and of sound mind, so that he can be responsible for the decision. This study examines four main rules of Islamic jurisprudence related to the law of divorce in Islam, namely: first, divorce cannot be separated and falls according to the number mentioned, second, the place where the divorce falls is where the marriage bond occurs, third, the law of divorce follows the nature that is coupled with the number so that the number of divorces is in accordance with what is mentioned, and fourth, even though divorce is said to be related to the past, the law of its fall still applies when the words are pronounced as well as examples and exceptions. This study uses a literature study method with analysis of the Qur'an, Hadith, and the opinions of classical and contemporary scholars. The results of the study confirm that these rules are very important in determining the validity, time of divorce, and its legal implications, thus providing legal certainty for married couples in Islamic households. The purpose of this study is to explore and understand the various Islamic jurisprudence rules related to divorce, as well as how to apply these rules in problems related to divorce. This study also aims to analyze the relevance and legal implications of these rules in the practice of Islamic family law, in order to provide a comprehensive understanding and legal certainty for Muslims in living their household life.

Abstract

This study discusses the implementation of Qawā‘id Fiqhiyyah (Islamic legal maxims) in addressing and resolving increasingly complex contemporary issues in line with the advancement of time, particularly in the social, economic, and technological domains. Qawā‘id Fiqhiyyah serve as foundational principles in Islamic law that are universal and flexible, enabling them to be applied in response to new problems not explicitly regulated in the scriptural sources (nash). Maxims such as al-‘ādah muḥakkamah (custom is authoritative), al-maṣlaḥah al-mursalah (unrestricted public interest), al-ḍarar yuzāl (harm must be eliminated), and al-mashaqqah tajlib al-taysīr (hardship begets ease) form essential foundations for formulating contextual and beneficial Islamic legal solutions. This research is normative juridical in nature, using a statute approach. Data were obtained from primary legal sources such as the Qur’an, Hadith, and classical texts on uṣūl al-fiqh and qawā‘id fiqhiyyah, supported by secondary and tertiary legal materials. The data analysis technique used is qualitative, with a descriptive-analytical approach. The results of the study indicate that Qawā‘id Fiqhiyyah are capable of serving as adaptive guidelines in establishing Islamic legal rulings on modern phenomena such as digital transactions, sharia-compliant fintech, and contemporary social issues. Abstract

This study investigates the Islamic legal principles governing radha’ah (breastfeeding) and its implications in family law, particularly in defining mahram (non-marriageable kinship) relationships. Rooted in classical and contemporary Islamic jurisprudence, this qualitative, library-based research identifies the foundational legal maxims: “What is prohibited by lineage is also prohibited by breastfeeding,” “The husband’s milk is the cause of prohibition,” and “Nutrition is the legal cause (‘illah) of prohibition in breastfeeding.” The study emphasizes that radha’ah establishes a familial bond equivalent to nasab (bloodline) and is effective when a child under two years of age is breastfed at least five times. Using sources such as the Qur’an, Prophetic traditions, juristic consensus (ijma’), and classical texts from various madhahib (schools of thought), the research reveals that both the breastfeeding woman and her husband (as the source of the milk) establish mahram ties with the breastfed child. Furthermore, it underscores the biological basis of Islamic rulings by demonstrating that nutritional transmission through milk forms the basis for legal prohibition, reflecting the maqāṣid al-sharī‘ah (objectives of Islamic law). This work offers vital insight into the intersection of biological function, legal normativity, and socio-religious ethics in Islamic family jurisprudence.

Abstract

This study aims to examine the qawāʿid fiqhiyyah (Islamic legal maxims) related to two significant issues in Islamic family law: rujūʿ (reconciliation) and īlā’ (a husband’s oath of abstinence). Rujūʿ refers to the husband’s right to reconcile with his wife after pronouncing a revocable divorce (ṭalāq rajʿī) during the waiting period (ʿiddah), while īlā’ refers to a husband's oath to abstain from marital relations with his wife for a certain period, which may lead to divorce if it exceeds four months without fay’ (the act of breaking the oath). This research employs a normative legal approach using the statute method, analyzing legal provisions derived from the Qur’an, Hadith, and the views of classical Islamic jurists. The findings indicate that both rujūʿ and īlā’ are firmly rooted in Islamic primary sources and are systematically explained through Islamic legal maxims. The maxim related to rujūʿ asserts that reconciliation is a continuation of a valid marriage contract and does not require a new contract, provided it occurs within the prescribed ʿiddah period. Meanwhile, the maxim concerning īlā’ establishes that the oath of abstinence has a legal limit of four months and is nullified by the husband’s resumption of conjugal relations (fay’). Islam regulates both matters in a balanced manner to preserve marital harmony and protect the rights of women. With proper understanding of the relevant legal maxims, cases involving rujūʿ and īlā’ can be resolved justly, in line with the overarching objectives of Islamic law (maqāṣid al-sharīʿah).Keywords: Qawa’id Fiqhiyyah, Reconciliation, Oath of AbstinenceAbstrakPenelitian ini bertujuan untuk mengkaji kaidah-kaidah fiqhiyyah yang berkaitan dengan dua isu penting dalam hukum keluarga Islam, yaitu rujuk dan ila’. Rujuk merupakan hak suami untuk kembali kepada istrinya yang telah dijatuhi talak raj‘i selama masa iddah, sedangkan ila’ adalah sumpah suami untuk tidak menggauli istrinya dalam jangka waktu tertentu, yang dapat berujung pada perceraian jika melampaui empat bulan tanpa adanya tindakan fay’. Penelitian ini menggunakan pendekatan normatif dengan metode statute approach, yaitu mengkaji ketentuan hukum berdasarkan nash Al-Qur’an, hadis, dan pendapat para ulama fikih. Hasil penelitian menunjukkan bahwa kedua permasalahan ini memiliki dasar hukum yang kuat baik dari Al-Qur’an maupun hadis Nabi ﷺ, serta dijelaskan secara sistematis dalam kaidah-kaidah fiqhiyyah. Kaidah tentang rujuk menegaskan bahwa rujuk merupakan bentuk kelanjutan dari akad nikah yang sah dan tidak memerlukan akad baru, selama dilakukan dalam masa iddah. Sedangkan kaidah tentang ila’ menjelaskan bahwa sumpah untuk tidak menggauli istri memiliki batas maksimal empat bulan, dan dapat gugur dengan tindakan fay’. Islam mengatur keduanya secara proporsional demi menjaga keutuhan rumah tangga dan melindungi hak-hak perempuan. Dengan pemahaman kaidah yang tepat, penyelesaian perkara rujuk dan ila’ dapat diterapkan secara adil, sesuai dengan prinsip maqāṣid al-syarī‘ah.Kata Kunci: Qawāʿid Fiqhiyyah, Rujuk, Ila’
