Abstract

Weapons that resemble sharp objects including knives, sickles, axes, machetes, etc. are referred to as sharp weapons. Considerable losses to society will arise due to the increase in crime due to the possession of sharp weapons without a license. The author examines the legal consequences for the owner of sharp weapons in the event of a criminal offense, along with the laws and regulations governing the possession of sharp weapons without a license. Normative legal research is the type of research used. The conclusion of the study shows that unlawful possession of sharp weapons can cause insignificant losses, endanger public safety and order, and disrupt community life. Sharp weapons are not always prohibited from use or possession; examples are domestic sharp weapons, agricultural weapons, heirloom weapons, and antiques. Those caught in possession of bladed weapons without a license are liable to ten months' imprisonment. To hold criminals accountable for their activities, there are penalties for those who violate criminal provisions. In this case, police officers must conduct raids with strict supervision if carrying sharp weapons without a license.

Abstract

Traffic is everything related to travel from one place to another, bound by the provisions of Law Number 22 of 2009 concerning Road Traffic and Transportation. As time goes by, tourism in Bali begins to reach its peak, resulting in more and more foreigners or foreign nationals visiting Bali for their own needs, many also rent motorbikes to get around Bali, but cases of foreigners riding motorbikes are increasing. . increase. careless. The formulation of the problem in this research is: 1) What factors cause foreigners to ride motorbikes recklessly on the highway? 2) What are the obstacles to law enforcement for foreigners who ride motorbikes carelessly on the highway? This research has general and specific objectives, and is equipped with research uses seen from theoretical and practical uses. This research uses empirical legal research methods. Based on the research results, it can be concluded that the factors causing reckless foreigners are: human factors, road facility factors, vehicle factors and natural condition factors. Then the obstacles to law enforcement for foreigners driving reckless motorbikes on the highway are internal enforcement from the police and external obstacles from the community.

Abstract

Standard insurance agreements are used by insurance companies that do not involve customers in making policies. This agreement causes conflict in the community because the position of the parties is not balanced. Two problems are formulated: how is the legal regulation of standard agreements in the insurance service business for customers and legal protection for customers in standard agreements? The research method used is normative legal. In the insurance agreement in accordance with Insurance Law Number 40 of 2014, applying an efficient method of providing agreement documents between customers and insurance regarding the object of coverage. This causes customers to be in a weak position because they are not in a good bargaining position and only have two choices, namely accepting or rejecting it (take it or leave it). Standard agreements in insurance services are still dominant in explaining the benefits, so there are many cases of failed claims due to the information described is not comprehensive in the contents of the policy. In order for the customer's rights to be protected, all information in the policy must be explained to the customer as proof of a written agreement made by the insurance company.

Abstract

The rapid advancement of technology does not only bring positive impacts to society but also brings negative impacts such as infidelity through social media. Chat evidence is one of the important factors in uncovering adultery crimes. The position of chat evidence in criminal procedure law is still unclear. The formulation of the problems raised is 1) what is the validity of chat evidence through social media in the examination of the crime of adultery? and 2) what is the strength of the evidence of chat through social media in the criminal process of adultery? The research method uses normative legal methods by analyzing literature materials and focusing on laws and regulations. The results of the discussion show that the validity of chat evidence in the examination of adultery crimes must meet formal and material requirements, with the important role of digital forensic experts. The stages of evidence management involve identification, collection, confiscation, examination and reporting. The authenticity and relevance of forensic results is the main key, with reports and certification of forensic digital experts as the basis for proof in court. Chats can now be used as electronic evidence thanks to Law Number 11 of 2008 concerning Information and Electronic Transactions. They no longer only have evidentiary power, but also letter evidence and clues.

Abstract

The presence of a child is happiness and prosperity for a family. However, the birth of a child from a woman who is not married or called a child outside of marriage causes many conflicts between families and communities regarding the status of the rights and responsibilities of children. This study aims to understand the role of unmarried children in the inheritance system and solutions to solve the problem of distributing inheritance of unmarried children in accordance with Balinese customary law. The normative legal approach is the methodology used in this study. Based on research and discussion, Balinese customary law culture recognizes that children born out of wedlock have the same status as legitimate children. Children out of wedlock have no legal relationship with their biological father, which leads to them having a lower status and fewer legal rights under customary law. They can still receive inheritances and gifts from their biological mother and father, but they also have responsibilities as heirs.

Abstract

Legal development in Indonesia focuses on regulation for the economy, particularly in e-commercee. While e-commerce facilitates transactions and affects the economy, cybercrime and personal data protection are threats. The problems are:  1. How is the regulation of consumer personal data on the purchase of goods in the marketplace? and 2. How is the legal protection of consumer personal data on the purchase of goods in the marketplace? This research uses normative research methods. The purpose of this study is to analyze the law in assisting legal protection of consumer personal data on the purchase of goods in the marketplace and analyze the challenges and obstacles faced by the law in handling cases of legal protection of consumer personal data on the purchase of goods in the marketplace. Privacy protection is regulated in the ITE Law and PP PSTE. Online legal remedies can be accessed to protect the privacy rights of ecommerce and Online marketplaces, following international legal mechanisms. Consumer rights in the Marketplace are regulated by Law No. 8 Year 1999 on Consumer Protection. MOCI Regulation No. 20/2016 supports consumer rights related to data protection and complaints. Electronic system operators, including marketplace companies, are required to establish internal rules, including privacy policies, to safeguard personal data.

Abstract

Advances in Information and communication technology have transformed the world into one borderless sphere. Online health platform is one form of change in the health sector that utilizes technology to provide health services by doctors to patients online. The problem in this study is (1) How the regulation of online health service platforms in accordance with the Ministry of Health? And (2) How  sanctions for medical personnel who do not meet the standards of the Ministry of Health?. The research method used includes normative legal research through statutory and conceptual approaches. The legal regulation of online health services is regulated in Law 36 of 2009 concerning Health as part of the provision of health services, ITE Law Number 11 of 2008 which regulates the operation of electronic systems and Permenkes Number 20 of 2019 which further regulates the implementation of telemedicine. Patients who are harmed can file for liability by submitting a complaint to the Indonesian Medical Discipline Honor Council. The decision (MKDKI) can be binding on doctors, dentists, and KKI who can hand out not guilty decisions or give punishments following the provisions in Article 69 of the Medical Practice Act.

Abstract

The lack of job opportunities in Indonesia, along with the increasing needs, has led many Indonesians to choose to seek employment abroad. TKI (Indonesian Migrant Workers) are those who travel abroad to work in order to earn a wage. Individuals who are very enthusiastic about working abroad can create various problems as a result, one of which is the illegal placement of TKI by individuals who send TKI without following the existing regulations. Prospective migrant workers certainly suffer losses due to this situation. Regarding this, (1) What are the legal guidelines for sending Indonesian Migrant Workers (TKI) abroad? What are the legal sanctions for those involved in the illegal trade of Indonesian migrant workers abroad? In this study, a legislative and regulatory approach is combined with a normative legal methodology. Based on the examination, it was found that there may be administrative and criminal sanctions for those who violate the law. However, Law of the Republic of Indonesia Number 18 of 2017 on the Protection of Indonesian Migrant Workers temporarily regulates these sanctions.

Abstract

Several issues affecting road traffic safety are traffic accidents. The high number of accidents in Indonesia is one of the consequences of the low awareness of road users and transportation service providers regarding compliance with traffic regulations and road safety. Two legal questions arise: (1) What regulations apply to public transport drivers regarding negligence that causes accidents? (2) What are the penalties for public vehicle drivers who are negligent and cause traffic accidents? This study uses a normative legal research method. Regulations on public transportation drivers related to training. Training will be conducted more frequently on the highways or while public transportation is in motion, so that drivers better understand field conditions. Criminal sanctions imposed on public transportation drivers for their negligence are regulated in CHAPTER XX which governs the criminal provisions of Law of the Republic of Indonesia Number 22 of 2009 concerning Traffic and Road Transportation. However, many drivers still ignore this, leading to accidents. Therefore, training and education for public transportation drivers, as well as adjustments to the Investigators of Civil Service (PPNS) are needed to apply the law correctly.

Abstract

The title of this research is Legal Protection of Whistleblower Witnesses in Corruption Crimes Cases in Indonesia. The problems are (1) How is the legal regulation of whistleblower witnesses in corruption cases in Indonesia? (2) How is the legal protection of whistleblower witnesses in corruption cases in Indonesia? This research conducts a normative legal study using statutory and conceptual techniques. Primary, secondary, and tertiary online documents are the legal resources used. Descriptive-analytical techniques are used to evaluate legal materials. Legislation No. 31/2014 regulates the prerequisites for parties seeking LPSK protection, including provisions regarding research-based reporting. In Indonesia, individuals who disclose corruption cases as witnesses or "whistleblowers" and provide clear information regarding illicit activities, particularly those related to organized crime, may be granted legal protection. The aforementioned safeguards can be inferred from the Witness and Victim Protection Law Number 31 of 2014. The group passed Law No. 31 of 2014 which regulates the legal framework and reporting procedures for those with knowledge of corruption crimes in Indonesia, as well as the protection of witnesses and victims, after much deliberation.
