Abstract

This research aims to outline things that are prohibited in business practices both in formal law and Islamic law. This research includes library research, which uses a form of descriptive analysis. The research results show that in the law the things that are not permitted are monopoly, monopsony, market control and conspiracy. In the Islamic economic system, the cause of a transaction being haram is due to three factors, namely haram substances / haram li-dzatihi (pork, khamr, carrion, blood); haram apart from the substance / haram li-ghairihi (tadlis, gharar, ikhtikar, bai'najasy, usury, maysir, risywah); and the contract is invalid/complete (the pillars and conditions are not fulfilled, ta'alluq occurs, two in one occurs)

Abstract

Crowdfunding model emerged as an alternative to collect ZIS funds in the digitalization era with technological developments and changes in donor behavior. This research aimed to explore the strategy of socializing the Crowdfunding model as an alternative for collecting ZIS funds in Dompet Dhuafa, South Sulawesi. This research used qualitative methods with a phenomenological approach to explore how individuals interpret the socialization strategy of the Crowdfunding model by Dompet Dhuafa South Sulawesi. Data collection methods included in-depth and structured interviews, observation, and documentation. The research results showed that Dompet Dhuafa South Sulawesi used three main methods in socializing the Crowdfunding model: placing advertisements and videos on Kitabisa.com platform, using social media such as Instagram and Facebook, and placing banners in strategic places. However, the research suggested the need to add other methods of outreach such as outreach in the community and seminars on universities, to expand the reach and effectiveness of Crowdfunding campaigns. It is hoped that the results of this research provided a practical contribution to Dompet Dhuafa South Sulawesi in optimizing the collection of ZIS funds through online platforms and provided academic insight into the study of Islamic economics, especially on ZIS management.

Abstract

This research aims to analyze the development of a creative economy based on the tepo seliro synergy in halal tourism in Petekeyan Village, Jepara. A phenomenological approach was used, with data collected through in-depth interviews with key informants selected via purposive sampling. The analysis focused on six indicators of creative economic development and their connection to the five values of tepo seliro, examining their role in the success of Petekeyan's halal tourism industry. The findings show that creative entrepreneurs in the region uphold the value of tepo seliro, including honesty, not engaging in illegal activities, offering equal job opportunities, helping others, and ensuring security. The synergy of tepo seliro has contributed to the success of halal tourism by fostering a welcoming, safe, and respectful environment for all visitorsPenelitian ini bertujuan untuk menganalisis pengembangan ekonomi kreatif berbasis sinergi tepo seliro dalam pariwisata halal di Desa Petekeyan, Jepara. Pendekatan fenomenologi digunakan, dengan data yang dikumpulkan melalui wawancara mendalam dengan informan kunci yang dipilih secara purposive sampling. Analisis difokuskan pada enam indikator pengembangan ekonomi kreatif dan hubungannya dengan lima nilai tepo seliro, untuk melihat perannya dalam keberhasilan industri pariwisata halal di Petekeyan. Temuan menunjukkan bahwa pengusaha kreatif di wilayah tersebut menjunjung tinggi nilai-nilai tepo seliro, termasuk kejujuran, tidak terlibat dalam kegiatan ilegal, menawarkan kesempatan kerja yang sama, membantu orang lain, dan memastikan keamanan. Sinergi tepo seliro telah berkontribusi pada keberhasilan pariwisata halal dengan menumbuhkan lingkungan yang ramah, aman, dan saling menghormati bagi semua pengunjung.

Abstract

Fenomena tanam benang pada wajah sebagai prosedur estetika non-bedah semakin populer di kalangan masyarakat urban, termasuk di Makassar. Penelitian ini bertujuan menilai kesesuaian praktik tersebut dengan prinsip maqasid al-syariah, yang menekankan perlindungan agama, jiwa, akal, keturunan, dan harta. Studi ini menggunakan metode penelitian lapangan dengan pendekatan teologis normatif, fenomenologi, dan studi kasus di Gloskin Aesthetic Clinic Makassar. Data diperoleh melalui observasi, wawancara, dan dokumentasi, kemudian dianalisis dengan triangulasi sumber, metode, dan waktu. Temuan menunjukkan bahwa mayoritas pasien menjalani tanam benang untuk mengatasi tanda penuaan, memperbaiki kontur wajah, dan meningkatkan rasa percaya diri. Dari perspektif maqasid al-syariah, prosedur ini dapat dibolehkan apabila bertujuan medis atau psikologis yang sah, tidak permanen, tidak menimbulkan mudarat, dilakukan oleh tenaga medis kompeten, serta tidak dimaksudkan untuk tabarruj atau mengubah ciptaan Allah. Namun, jika motivasinya semata-mata mengikuti tren kecantikan yang berlebihan atau demi penampilan yang bertentangan dengan nilai Islam, hukumnya menjadi terlarang. Studi ini menegaskan pentingnya parameter maqasid al-syariah sebagai panduan etis dalam prosedur estetika modern. Implikasi penelitian ini mencakup perlunya edukasi hukum dan moral bagi konsumen Muslim serta regulasi industri estetika yang sensitif terhadap nilai syariat.

Abstract

The development of digital technology has given rise to various new phenomena in the social, economic, and religious lives of Muslims. This condition calls for a methodological renewal in understanding Islamic law that is adaptive to changing times. This article discusses the reconstruction of digital fiqh as an effort to apply the principle of ta?b?q al-a?k?m ‘al? al-naw?zil (the application of legal rulings to new issues), grounded in naql? (textual) evidence, ‘aql? (rational) reasoning, and ijtih?diyyah legal maxims. The study finds that the conceptual foundation of digital fiqh encompasses the values of trustworthiness (am?nah), responsibility, and the prohibition of causing harm to others, as emphasized in the Qur’an and the Sunnah. The contextualization of digital fiqh is divided into four main areas: fiqh al-ma‘l?m?t (fiqh of information), fiqh al-mu‘?mal?t al-raqmiyyah (fiqh of digital transactions), fiqh al-da‘wah al-raqmiyyah (fiqh of digital da‘wah), and fiqh al-akhl?q al-raqmiyyah (fiqh of digital ethics). U??l? and maq??id? approaches are employed to ensure that the principles of ?if? al-d?n, al-‘aql, al-m?l, al-nafs, and al-‘ir? are preserved in cyberspace. The main challenges faced include epistemological, methodological, and practical issues in establishing new technology-based legal rulings. This article recommends integration between Islamic scholars, IT experts, and regulators; the development of a digital fiqh curriculum in Islamic educational institutions; and the formulation of a codified Digital Media Fiqh as a guide to cyber ethics for Muslims.

Abstract

The study of Islamic political jurisprudence (fiqh siyasah) has become increasingly relevant in addressing the dynamics of modern governance characterized by democratization, demands for justice, and the emergence of political change and revolutionary movements. This paper aims to analyze the concept of democratic governance and the ethics of revolution within the framework of Islamic political jurisprudence, emphasizing core Islamic principles such as shura (consultation), justice, public welfare (maslahah), and amar ma‘ruf nahi munkar (enjoining good and forbidding evil). This research employs a qualitative normative approach through a literature review of classical and contemporary sources in Islamic law. The findings indicate that fiqh siyasah functions as a normative instrument regulating the relationship between rulers and the people, emphasizing trust (amanah), justice, and moral responsibility in the exercise of power. Fiqh at-thawrah in Islam is not understood as an unconditional legitimation of rebellion, but rather as an ethical framework for socio-political change that must consider the objectives of Islamic law (maq??id al-shar?‘ah) and avoid greater harm (mafsadah). Democracy, from the perspective of Islamic political jurisprudence, is acceptable as an ijtih?d-based mechanism insofar as it serves as a means to realize justice, public participation, and accountability of authority, without negating the sovereignty of divine law. Meanwhile, the system of governance in Islam is flexible and contextual, provided that it remains grounded in the principles of shura, justice, and public welfare. Thus, Islamic political jurisprudence offers an ethical and normative paradigm for the development of just, democratic, and morally grounded governance in the modern era.

Abstract

This study examines the influence of the MUI Fatwa Number 83 of 2023 concerning the Legal Ruling on Supporting the Palestinian Struggle on the purchasing interest in Israeli products among the Muslim community in Makassar City, from the perspective of Islamic economic law. The main issue addressed is the low level of public awareness and understanding of the fatwa, amid challenges in identifying products affiliated with Israel and the dominance of global consumer culture. Using a quantitative method within the framework of Islamic economic law, this research involved 156 respondents selected through purposive sampling and analyzed using a Likert scale questionnaire, validation and reliability tests, and regression techniques. The findings indicate that the MUI Fatwa Number 83 of 2023 has a positive and significant effect on purchasing interest (p = 0.000); however, the positive direction of the effect reveals a contradiction between the substance of the fatwa which calls for a boycott and the community’s consumption behavior, which continues to maintain an interest in Israeli-affiliated products. This condition reflects a weak awareness of Islamic economic law among the Muslim community in Makassar City. These findings underscore the need to strengthen education, socialization, and the provision of Sharia-compliant product alternatives to enhance the fatwa’s implementation. Thus, the study concludes that the effectiveness of the fatwa in influencing consumer behavior remains suboptimal and requires ongoing strategic support so that the principles of maslahah, hisbah, and Islamic consumption ethics can be realized in community economic practices.

Abstract

Perkembangan kejahatan modern seperti kejahatan siber, terorisme, dan korupsi menuntut adanya reinterpretasi terhadap prinsip-prinsip fikih jinayah agar tetap relevan dengan dinamika sosial dan teknologi kontemporer. Penelitian ini bertujuan untuk menjelaskan bagaimana metode ijtihad dan maqāṣid al-syarī‘ah digunakan dalam merespons kasus-kasus pidana modern dengan tetap mempertahankan nilai-nilai keadilan dan kemaslahatan dalam hukum Islam. Melalui pendekatan normatif-teologis dan analisis komparatif terhadap literatur fikih klasik serta hukum pidana kontemporer, penelitian ini menemukan bahwa ijtihad kontekstual dan maqāṣid al-syarī‘ah berperan penting dalam mengadaptasi prinsip-prinsip fikih jinayah tanpa meninggalkan dasar syariatnya. Penerapan konsep ta‘zīr memungkinkan fleksibilitas hukum terhadap bentuk kejahatan baru, sementara maqāṣid al-syarī‘ah memastikan setiap sanksi diarahkan pada perlindungan agama, jiwa, akal, keturunan, dan harta. Dengan demikian, fikih jinayah tidak hanya relevan di masa lalu, tetapi juga menjadi solusi etis dan rasional bagi problem kejahatan modern.

Abstract

This article aims to analyze and compare the two forms of jihad in Islam with the principles of IHL, in order to assess their compatibility and potential disharmony. The concept of jihad in Islam is often misunderstood, especially when associated with armed conflict. In classical Islamic jurisprudence discourse, jihad is divided into two main forms: defensive jihad (difaa'i) and offensive jihad (tulubi). Meanwhile, international humanitarian law (IHL) regulates the legality and limitations in armed conflict, particularly regarding the protection of civilians and non-combatants. The primary data sources in this study are divided into primary data in Islamic studies such as verses of the Qur'an and the Hadith of the Prophet Muhammad regarding jihad and war, and primary data in International Humanitarian Law, namely the 1949 Geneva Conventions and their Additional Protocols. Meanwhile, secondary data was obtained from literature on Islamic studies and International Humanitarian Law, journals, and research related to Jihad and War. Using a normative-comparative approach to primary and secondary legal sources, it was found that defensive jihad is more compatible in principle with IHL, while offensive jihad has the potential to conflict with modern International Humanitarian Law in practice.

Abstract

This study aims to examine the urgency, principles, and application of fiqh al-aqalliyyāt (fiqh of Muslim minorities) within multicultural societies, particularly in maintaining harmonious interfaith relations. The research employs a qualitative library-based research design by analyzing classical and contemporary Islamic legal sources, scholarly opinions, fatwas, and relevant literature to understand how Islamic law responds to the challenges faced by Muslims living as minorities in non-Muslim-majority countries. Data were collected through systematic document analysis of fiqh texts, the maqāṣid al-sharīʿah framework, and contemporary fatwa institutions such as the European Council for Fatwa and Research. The findings indicate that fiqh al-aqalliyyāt functions as a contextual and adaptive legal framework that emphasizes the principles of facilitation (taysīr), removal of hardship (rafʿ al-ḥaraj), public interest (maṣlaḥah), and consideration of legal consequences (maʾālāt). This approach enables Muslim minorities to fulfill their religious obligations while engaging constructively within diverse social, cultural, political, and religious environments. The study further reveals that the novelty of fiqh al-aqalliyyāt lies in its integrative methodology, which combines classical juristic principles with contemporary social realities, thereby offering practical solutions to issues such as interfaith greetings, religious practices, economic transactions, and political participation. The implications of this research underscore the importance of fiqh al-aqalliyyāt as a reference for the development of Islamic law, the strengthening of interfaith harmony, and educational discourse on Islam in multicultural contexts, contributing to a more inclusive and context-sensitive understanding of Islam in the modern era.
