Abstract

West Kalimantan is a region rich in cultural diversity and traditions, including in terms of conflict resolution through local cultural approaches. One of these cultural treasures is the oral tradition, which serves as a medium for mitigating and resolving social conflicts that arise within the community. This study aims to examine the forms of conflict that occur in West Kalimantan, explore Islamic values regarding conflict resolution, and analyze the role of oral traditions as a means of conflict transformation from an Islamic legal perspective. This study uses a socio-legal approach with a descriptive qualitative method, where data is collected through literature review and interviews with traditional leaders, religious scholars, and local communities. The findings of this study indicate that conflicts in West Kalimantan are often related to social issues, cultural identity, and resource disputes, but they are successfully mitigated through oral traditions such as customary advice, pantun (traditional poetry), and customary deliberation, which are rich in values of justice, reconciliation, and brotherhood. These traditions align with the principles of Islamic law, which emphasize the importance of ishlah (peace), 'adalah (justice), and ta'ayush silmi (living together in peace). Thus, oral traditions not only function as cultural instruments but also as social legal mechanisms rooted in Islamic values in transforming conflicts into sustainable peace.

Abstract

The enforcement of illegal laws from a legal and justice perspective is the main focus of this study, particularly in the context of West Kalimantan Province. The enforcement of laws that do not comply with existing legal provisions can lead to systemic injustice. This study explores the dynamics of law and justice in the context of illegal law enforcement in West Kalimantan, highlighting the role of Islamic law in the process. Using a qualitative approach, data was collected from various sources, including interviews with policymakers, legal practitioners, and local communities. The findings highlight the complex challenges faced in illegal law enforcement, including issues of legality, culture, and society. This study also considers the impact and implications of illegal law enforcement on social justice and legal stability in West Kalimantan. The findings of this study are expected to provide deeper insights into the dynamics of law and justice in the context of illegal law enforcement in the region.

Abstract

Abstrak Artikel ini mengkaji penerapan hukuman mati dalam perspektif hukum Islam kontemporer dengan menggunakan pendekatan kualitatif-normatif. Data primer diperoleh dari Al‑Qur’an, Hadis, kitab ushul fiqh, serta peraturan perundang‑undangan nasional seperti KUHP dan UU pelaksanaan hukuman mati. Data sekunder terdiri dari literatur seperti jurnal, tesis, dan studi komparatif tentang hudud, qisas, ta‘zīr, serta teori maqāṣid al‑Sharī‘ah. Analisis menggunakan content analysis dengan metode deduktif‑induktif, dibingkai oleh pendekatan ushul fiqh dan maqāṣid al‑Sharī‘ah untuk menilai relevansi syariat dalam konteks modern. Hasilnya menunjukkan bahwa penerapan hukuman mati harus memenuhi prinsip keadilan, perlindungan maqāṣid, dan penghormatan hak asasi manusia. Kajian ini merekomendasikan kebutuhan terhadap ijtihād kontemporer dalam menjaga keseimbangan antara syariat, kemaslahatan sosial, dan norma internasional. Kata kunci: hukuman mati, hukum Islam kontemporer, maqāṣid al‑Sharī‘ah, hudud, qisas, ta‘zīr, ijtihād.   Abstract This article analyzes the implementation of the death penalty within a contemporary Islamic legal perspective using a qualitative-normative approach. Primary data are derived from the Qur’an, Hadith, ushul fiqh texts, and national legislation such as the Criminal Code and death penalty laws. Secondary data include literature reviews, theses, and comparative studies on hudud, qisas, ta‘zīr, and maqāṣid al‑Sharī‘ah theory. Analysis is conducted through content analysis with deductive-inductive methods, framed by ushul fiqh and maqāṣid al‑Sharī‘ah approaches to assess the relevance of Sharia in a modern context. The results indicate that the application of the death penalty must uphold principles of justice, maqāṣid protection, and respect for human rights. This study recommends the need for contemporary ijtihād to balance Sharia, social welfare, and international norms. Abstract

Abstrak Pernikahan wanita hamil di luar nikah merupakan isu multidimensional yang mencakup aspek sosial, moral, dan hukum dalam masyarakat Muslim kontemporer. Wacana ini telah lama menjadi perhatian dalam literatur fikih klasik, yang menunjukkan adanya perbedaan pandangan ulama mengenai kebolehan menikahi wanita yang tengah mengandung akibat hubungan nonmarital. Namun, perkembangan sosial dan transformasi nilai dalam masyarakat modern menuntut adanya pembacaan ulang terhadap konstruksi hukum Islam yang lebih kontekstual, inklusif, dan berorientasi pada kemaslahatan. Studi ini bertujuan untuk mengkaji respons hukum Islam kontemporer terhadap praktik pernikahan wanita hamil melalui pendekatan maqāṣid al-syarī‘ah, yaitu suatu kerangka normatif yang menekankan pada pemeliharaan tujuan-tujuan syariat sebagai fondasi pengambilan hukum. Penelitian ini menggunakan metode normatif-yuridis dengan cara menelaah sumber-sumber hukum Islam klasik dan kontemporer, termasuk pendapat ulama, fatwa institusional, serta regulasi hukum Islam di Indonesia seperti Kompilasi Hukum Islam (KHI). Studi ini menunjukkan bahwa pendekatan maqāṣid al-syarī‘ah, terutama dalam dimensi perlindungan terhadap nasab (hifẓ al-nasl), kehormatan (hifẓ al- ‘irḍ), jiwa (hifẓ al-nafs), dan agama (hifẓ al-dīn), memberikan justifikasi normatif atas kebolehan pernikahan wanita hamil dalam kondisi tertentu. Legalitas ini tetap mensyaratkan adanya pertobatan, kesediaan untuk bertanggung jawab dari pihak pria, serta komitmen memperbaiki kondisi sosial-hukum anak yang dikandung. Dengan demikian, aktualisasi maqāṣid menjadi strategi penting dalam merespons dinamika sosial umat Islam secara bijak dan solutif Kata Kunci: Pernikahan Wanita Hamil, Maqāṣid Al-Syarī‘Ah, Hukum Islam Kontemporer   Abstract The marriage of pregnant women outside of wedlock constitutes a multidimensional issue encompassing social, moral, and legal aspects within contemporary Muslim societies. This discourse has long been a subject of attention in classical Islamic jurisprudence, which reveals differing opinions among scholars regarding the permissibility of marrying a woman who is pregnant due to extramarital relations. However, ongoing social changes and value transformations in modern society demand a renewed interpretation of Islamic legal constructions that is more contextual, inclusive, and oriented toward public welfare (maṣlaḥah). This study aims to examine contemporary Islamic legal responses to the practice of marrying pregnant women through the lens of maqāṣid al-sharī‘ah, a normative framework that emphasizes the preservation of the objectives of Islamic law as the foundation for legal reasoning. This research employs a normative-juridical method by analyzing both classical and contemporary Islamic legal sources, including the opinions of scholars, institutional fatwas, and relevant legal regulations in Indonesia such as the Compilation of Islamic Law (KHI). The findings indicate that the maqāṣid al-sharī‘ah approach—particularly in relation to the protection of lineage (ḥifẓ al-nasl), honor (ḥifẓ al-‘irḍ), life (ḥifẓ al-nafs), and religion (ḥifẓ al-dīn)—provides normative justification for the permissibility of marrying pregnant women under specific conditions. This permissibility requires sincere repentance, willingness to assume responsibility by the male partner, and a commitment to improve the legal and social status of the unborn child. Therefore, the actualization of maqāṣid becomes a strategic tool in responding to contemporary social realities among Muslims with wisdom and solution-oriented insights. Abstract

Islamic finance is an alternative economic system that is growing rapidly in Indonesia, based on Islamic principles such as the prohibition of usury, fairness in transactions, transparency, and social responsibility. This paper examines the main principles of the Islamic financial system, including the prohibition of usury and gharar, as well as the application of ethical and moral values ​​in financial activities. In addition, this article also discusses various innovative Islamic financial products such as sukuk, microfinance, and Islamic insurance, which are designed to meet the needs of the community while still upholding Islamic principles. Despite significant growth, this industry still faces a number of challenges, including limited regulations that support innovation, low public literacy, tight competition with conventional systems, and a lack of competent human resources. Through a descriptive-analytical approach, this study shows that consistent application of Islamic principles, adaptive regulatory support, and increasing human resource capacity are the keys to strengthening and sustaining the Islamic financial system in Indonesia. This research is expected to be an academic contribution to the development of more inclusive and sustainable Islamic economic theory and practice.

Abstract

Abstrak Penelitian ini bertujuan menganalisis konsep pengelolaan zakat dalam hukum Islam klasik, mengevaluasi model kontemporer, serta mengkaji isu-isu hukum dan solusi syariah dalam konteks dinamika sosial-ekonomi modern. Penelitian kualitatif ini menggunakan pendekatan multidisipliner dengan analisis teks fiqh klasik, fatwa kontemporer, studi kasus lembaga zakat global, dan data empiris terkini. Pendekatan maqasid al-shariah dan teori taysir (kemudahan) menjadi kerangka analisis utama. penelitian ini menemukan bahwa, prinsip keadilan distributif (QS. At-Taubah: 60) dan sistem Baitul Mal tetap relevan, tetapi memerlukan reinterpretasi untuk menjawab kompleksitas modern, seperti perluasan objek zakat (aset digital, saham) dan redefinisi asnaf (pengungsi, urban poor). Sinergi tridaya (negara, swasta, komunitas) terbukti optimal: negara sebagai regulator, lembaga swasta sebagai inovator, dan komunitas sebagai jaring pengaman berbasis lokal. Prinsip amanah (QS. An-Nisa: 58) menuntut sistem pengawasan hybrid (syariah-audit keuangan) dan sanksi progresif (pidana hingga restorative justice). Dengan demikian, zakat berpotensi menjadi instrumen transformatif pengentasan kemiskinan global jika dikelola dengan integritas syar’i, adaptasi teknologi, dan kolaborasi antarlembaga. Rekomendasi kebijakan mencakup harmonisasi regulasi internasional, sertifikasi amil berbasis kompetensi, dan pemberdayaan berbasis data. Kata Kunci: Zakat, Hukum Islam, Kontemporer.   Abstract This study aims to analyze the concept of zakat management in classical Islamic law, evaluate contemporary models, and examine legal issues and sharia solutions in the context of modern socio-economic dynamics. This qualitative study uses a multidisciplinary approach with analysis of classical fiqh texts, contemporary fatwas, case studies of global zakat institutions, and current empirical data. The maqasid al-shariah approach and the theory of taysir (ease) are the main analytical frameworks. This study found that the principle of distributive justice (QS. At-Taubah: 60) and the Baitul Mal system remain relevant, but require reinterpretation to address modern complexities, such as the expansion of zakat objects (digital assets, stocks) and the redefinition of asnaf (refugees, urban poor). The synergy of tridaya (state, private sector, community) has proven optimal: the state as a regulator, private institutions as innovators, and the community as a locally-based safety net. The principle of amanah (QS. An-Nisa: 58) demands a hybrid supervision system (sharia-financial audit) and progressive sanctions (criminal to restorative justice). Thus, zakat has the potential to become a transformative instrument for global poverty alleviation if managed with sharia integrity, technological adaptation, and inter-institutional collaboration. Policy recommendations include harmonization of international regulations, competency-based amil certification, and data-based empowerment. Keywords: Zakat, Islamic Law, Contemporary.

Abstract

Abstrak Pernikahan beda agama merupakan isu krusial dalam wacana hukum Islam kontemporer, khususnya ketika dihadapkan pada prinsip-prinsip maqāṣid al-syarī‘ah. Artikel ini mengkaji problematika nikah beda agama dengan menitikberatkan pada prinsip ḥifẓ al-dīn (perlindungan terhadap agama) sebagai fondasi normatif utama dalam hukum keluarga Islam. Dalam konteks Indonesia, realitas sosial yang plural dan kompleks semakin memunculkan ketegangan antara norma keagamaan dan kebebasan individu, terlebih pasca diterbitkannya Surat Edaran Mahkamah Agung (SEMA) No. 2 Tahun 2023 yang secara eksplisit menolak legalitas pernikahan lintas agama. Dengan pendekatan yuridis-normatif berbasis maqāṣid, kajian ini menemukan bahwa pernikahan beda agama tidak hanya berpotensi melemahkan prinsip ḥifẓ al-dīn, tetapi juga menimbulkan implikasi negatif terhadap keturunan (ḥifẓ al-nasl), akal (ḥifẓ al-‘aql), dan harta (ḥifẓ al-māl). Oleh karena itu, diperlukan pendekatan hukum yang tidak sekadar legalistik, tetapi juga integratif dan solutif dalam menjawab ketegangan antara norma syar‘i dan realitas hukum nasional. Kata kunci: Nikah beda agama, maqāṣid al-syarī‘ah, ḥifẓ al-dīn, hukum keluarga Islam, SEMA No. 2 Tahun 2023   Abstract Interfaith marriage is a crucial issue in contemporary Islamic legal discourse, especially when faced with the principles of maqāṣid al-syarī‘ah. This article examines the problematic of interfaith marriage by emphasizing the principle of ḥifẓ al-dīn (protection of religion) as the main normative foundation in Islamic family law. In the Indonesian context, plural and complex social realities increasingly give rise to tensions between religious norms and individual freedom, especially after the issuance of the Supreme Court Circular (SEMA) No. 2 of 2023 which explicitly rejects the legality of interfaith marriage. With a juridical-normative approach based on maqāṣid, this study found that interfaith marriage not only has the potential to weaken the principle of ḥifẓ al-dīn, but also has negative implications for descendants (ḥifẓ al-nasl), reason (ḥifẓ al-‘aql), and property (ḥifẓ al-māl). Therefore, a legal approach is needed that is not merely legalistic, but also integrative and solution-oriented in responding to the tension between sharia norms and national legal realities. Abstract

This study discusses the adaptation strategies of non-Muslim MSMEs to halal certification regulations in Manado City from the perspective of Maqasid al-Syari'ah. This is a qualitative study. The research design is field research. The informants in this study consisted of MUI officials in North Sulawesi Province and non-Muslim MSME actors in Manado City. The results of this study indicate that: Non-Muslim SME actors have demonstrated a high level of adaptation to halal certification regulations through gradual and pragmatic strategies. They began by improving hygiene, recording raw materials, and participating in training and capacity-building programs. These strategies reflect that the actors do not reject the regulations but require an approach tailored to their capacities. In many cases, halal certification is even positioned as a branding tool and a means of market expansion, rather than merely legal compliance. This adaptation also reflects the success of a values-based approach rooted in the principles of maqasid, where regulations are accepted as meaningful and beneficial ethical business practices. Through a dialogic and contextual approach, non-Muslim SME operators have successfully transformed halal certification into an opportunity rather than a threat to their identity.

Abstract

Tujuan pokok penelitian adalah untuk menganalisis Dominasi Pendapatan Istri dalam Perspektif Hukum Islam (Analisis Relasi Suami dan Istri di Ulumanda, Kabupaten Majene), Tujuan khusus, yaitu: 1) Untuk mengetahui realitas sosial peran istri dan suami dalam mencari nafkah 2) Untuk mengetahui dampak dominasi pendapatan istri terhadap dinamika relasi suami dan istri 3) Untuk mengetahui Pandangan Maslahah mengenai dampak dominasi pendapatan istri dalam relasi suami dan istri. Jenis penelitian ini tergolong penelitian kualitatif (field research) dengan pendekatan yang digunakan adalah teologis-normatif syar’i dan yuridis empiris. metode pengumpulan data yang digunakan adalah observasi, wawancara, dokumentasi, dan penelusuran referensi. Teknik pengolahan data dan analisis data dilakukan dengan melalui tiga tahapan, yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian ini menunjukkan, 1) Realitas pendapatan istri dalam rumah tangga membawa berbagai konsekuensi sosial yang memengaruhi dinamika keluarga dan pandangan masyarakat. Realitas sosial yang sering muncul diantaranya adalah perubahan peran domestik dalam rumah tangga, 2) Dampak dominasi pendapatan istri dalam rumah tangga dapat menimbulkan dampak negatif dan positif. 3) Pandangan Maslahah Mursalah tentang relasi suami istri diatur dengan prinsip keadilan, tanggung jawab, dan saling melengkapi. Namun, dominasi pendapatan istri dalam keluarga dapat memengaruhi dinamika, terutama jika tidak ada pemahaman yang mendalam tentang hak dan kewajiban masing-masing pasangan.

Abstract

Consumer trust in Islamic banks is currently declining. Islamic banks are perceived to be the same as conventional banks due to various cases about Islamic banks reported by the mass media. The aim of this research is to analyze the influence of the credibility of online news, the quality of social media content, and the variety of print media on the level of trust of BSI customers. This study uses an associative quantitative approach with simple random sampling techniques. A total of 121 respondents were selected from a total population of 480 using Slovin's formula and analyzed with SEM-PLS. The research results show that the credibility of online news, the quality of social media content, and the variety of print media have a positive and significant impact on customer trust levels. The negative stigma of society is growing stronger due to online news that is reinforced by social media and print media. Practical implications include more effective marketing and communication strategies to maintain customer trust amidst the challenges of the digital era.
