Abstract

This journal aims to analyze the intervention process in dispute resolution in the Administrative Court. This study identifies two main problems: first, the mechanism for third-party entry into the dispute resolution process in the Administrative Court, and second, the legal consequences of third-party intervention in the case under study. The results of the study show that based on Article 83 of Law Number 5 of 1986 concerning Administrative Courts, third parties can enter the trial process during the examination, either on their own initiative, at the request of one of the parties, or at the initiative of the judge. The legal consequence of the entry of this third party is that they obtain the status of the Second Defendant of Intervention, which gives them the right to defend their interests in the trial process. This study emphasizes the importance of the presence of third parties in maintaining justice and legal certainty in state administrative disputes. The conclusion of this paper is that although intervention provides an opportunity for interested parties to participate in the legal process, there is a need for renewal and codification of the code of procedure in the Administrative Court to be more responsive to the dynamics of existing dispute resolution.

Abstract

The regulation of forced money (dwangsom) within the State Administrative Court is an important instrument to ensure compliance of state administrative officials with court decisions that have permanent legal force. However, until now the regulations governing the mechanism for the implementation of forced money in the PTUN are still unclear, so it often causes obstacles in the practice of execution. This study aims to analyze the urgency of the regulation of forced money in the State Administrative Court by focusing on the implementation mechanism so that it can be implemented effectively. The research method used is a prescriptive method with a normative approach, namely examining applicable laws and regulations, legal doctrines, and relevant court decisions. The results of the study show that the absence of strict regulations regarding the implementation of forced money creates legal uncertainty and has the potential to weaken the function of the PTUN as judicial control over government administrative actions. Therefore, a more comprehensive regulation is needed regarding the mechanisms, procedures, and parameters of the implementation of forced money in order to provide legal certainty, ensure the effectiveness of the execution of decisions, and strengthen the principle of the rule of law in the administration of government.

Abstract

This study aims to analyze the practices and impact of a humanistic approach in learning to develop the potential of students at MI Nailul Huda, Jimbaran-Badung. The humanistic approach, which emphasizes respect for the individual, is considered relevant to the principles of Islamic education. This qualitative research utilized a Focus Group Discussion (FGD) method with five teachers from MI Nailul Huda serving as subjects. The data were analyzed thematically to identify the understanding, practices, and impact of this approach. The findings indicate that the implementation of the humanistic approach successfully created a positive learning environment, strengthened teacher-student interpersonal relationships, and significantly enhanced students' self-confidence, creativity, and empathy. The study found that this approach aligns with the concept of fitrah (human nature) in Islam and the educational vision proposed by al-Ghazali. However, challenges such as a dense curriculum and cognitive-oriented assessment remain major obstacles. The research recommends continuous training to strengthen the consistent implementation of this approach.

Abstract

This study examines the discrepancy between das sollen and das sein regarding the obligation to register a business license as mandated in Article 15(1) of Government Regulation Number 80 of 2019. Although the regulation requires all business actors to register their licenses with the Central Government, its implementation in Malang City remains ineffective. Of approximately 85,200 MSMEs, only about 22,000 had obtained official licenses by 2024. The study addresses two issues: (1) the factors contributing to the low compliance of micro-enterprise actors with licensing requirements, and (2) the legal implications for those operating without a business license. Using a socio-legal method with a juridical-sociological approach, the research relies on primary and secondary data collected through fieldwork and literature study. The sample consists of 13 respondents and 2 key informants, analyzed qualitatively. The findings reveal that the main cause of ineffective implementation is the low level of legal awareness and knowledge among micro-enterprise actors. Eight respondents were unaware of the obligation to register with the Disnaker PMPTSP of Malang City, while five respondents were aware but had not complied. This demonstrates that regulatory implementation has not been optimal. The legal implications for non-compliant business actors include the loss of legal validity of their operations and the potential imposition of administrative sanctions under applicable laws.

Abstract

Objective: This study aims to analyse the contemporary management model of zakat, infaq, sedekah, and waqf (ZISWAF) in the Al-Barokah Islamic boarding school in Simalungun, North Sumatra, from the perspective of muamalah jurisprudence. Theoretical framework: This study is based on the muamalah jurisprudence framework, especially the concept of ownership (al-milkiyyah), trust, benefit (maslahah), and justice ('adl) in the management of social funds. These principles are linked to modern institutional management theory that emphasises accountability, transparency, and efficiency. The integration of classical Islamic legal norms with contemporary management practices is the basis for assessing the effectiveness of the ZISWAF management model in the Islamic boarding school environment. Literature review: The literature review includes Islamic Muamalah Fiqh from an Economic perspective in Islam, Contemporary ZISWAF Management, and Islamic Boarding Schools in the Reality of Sharia Economic Implementation. Methods: This study uses a qualitative approach with a case study method. Data were obtained through interviews with the management of the Al-Barokah Islamic boarding school, documentation of the institution's financial reports, and observations of ZISWAF management practices. Data analysis was carried out through the stages of data condensation, data presentation, and conclusion, using muamalah jurisprudence as an interpretative framework. Results: The study indicates that the ZISWAF management model at the Al-Barokah Islamic boarding school applies a hybrid system that combines fundraising based on traditional religious values ​​with modern institutional management practices. The integration of digital recording systems, participatory decision-making, and empowerment-based fund distribution reflects the application of muamalah fiqh principles in the contemporary context. This model has succeeded in increasing financial transparency, educational independence, and the social welfare of the community around the Islamic boarding school. Implications: These findings indicate that Islamic boarding schools have the potential to become strategic centres of Islamic social finance by institutionalising accountable ZISWAF management in accordance with sharia principles. Novelty: This study introduces the Integrated ZISWAF Management Model (IZMM), which combines the principles of muamalah fiqh with modern management for the sustainable management of Islamic boarding school social funds.

Abstract

Hypertension is a condition in which a person's blood pressure is above 140/90 mmHg, increasing the risk of serious illnesses such as stroke, heart attack, and kidney failure. It is often associated with psychological problems such as anxiety. One non-pharmacological approach to managing anxiety in hypertensive patients is Asmaul Husna remembrance therapy. The purpose of this study was to assess the implementation of nursing care for hypertensive patients with anxiety problems in the Nakula Room of Jombang Regional General Hospital through Asmaul Husna remembrance therapy. This study used a case study approach with a nursing care approach, with two hypertensive patients with anxiety problems as subjects. The study was conducted for 3 days using data collection methods including assessment, diagnosis, intervention, implementation, and evaluation. The results of the study showed a decrease in anxiety in both patients on the third day. The first patient was able to sleep peacefully last night, while the second patient began to calm down and stop thinking about her illness. The conclusion from the results obtained regarding the application of Asmaul Husna dhikr therapy is proven effective in reducing anxiety levels in hypertension patients in the Nakula Ward of Jombang Regional Hospital. Further research can be conducted to assess the long-term effectiveness of dhikr therapy and explore the application of other spiritual therapies in addressing anxiety in hypertension.
