Abstract

Radikalisme dalam unjuk rasa buruh yang senter pada tahun ini diantaranya adalah menentang Peraturan Pemerintah (PP) Nomor 51 Tahun 2023 tentang Pengupahan dikarenakan isi dari peraturan tersebut dirasakan merugikan dan menurunkan tingkat kesejahteraan yag biasa di terima oleh para buruh pekerja sektor formal menurun. Penelitian dalam makalah ini adalah menganalisis latar belakang terjadinya aksi radikalisme yang dilakukan oleh para buruh pada saat aksi unjuk rasa, selanjutnya dampak yang dirasakan terhadap masyarakat wilayah sekitar dalam keseharian. Melalui pendekatan kualitatif dan studi literatur, makalah ini bertujuan untuk memberikan pemahaman yang lebih mendalam tentang akar permasalahan dan potensi, solusi penanganan aksi unjuk rasa tersebut dan cara dalam meminimalisir radikalisme dalam gerakan buruh.

Abstract

This study examines and compares the concepts and procedures of bankruptcy in Islamic economic law (At-Taflis wal Hajr) and Indonesian Bankruptcy Law (Law No. 37/2004 on Bankruptcy and Suspension of Debt Payment Obligations). Utilizing a normative legal research design with a qualitative, descriptive-analytical approach, this study relies on secondary data derived from Islamic legal sources (Qur’an, Hadith, classical fiqh literature, and scholarly fatwas) and Indonesian statutory regulations. The analysis applies a comparative legal method supported by content analysis to identify similarities, differences, strengths, and limitations within both legal systems. Findings reveal that while both frameworks share the fundamental aim of resolving debt disputes, protecting creditor rights, and distributing debtor assets equitably under judicial supervision, they differ significantly in their normative underpinnings. Islamic law embeds moral and social dimensions, treating bankruptcy as a remedial mechanism aligned with communal responsibility, whereas Indonesian positive law prioritizes procedural certainty and institutional enforcement to ensure legal and economic order. The study suggests harmonization through integrating procedural clarity with ethical and social responsibility measures from Islamic jurisprudence to strengthen bankruptcy governance in Indonesia.

Abstract

This research aims to evaluate the application of Islamic legal research methods, namely qiyas, al-maslahah al-mursalah, istihsan and al-'urf, in responding to contemporary legal issues in Indonesia. The research method used is a literature review by analysing classical and modern sources of Islamic law, including books, scholarly journals, and relevant fatwas and legal regulations. The results show that the four methods can be flexibly applied to resolve modern legal issues such as early marriage, the status of children in Siri marriages and domestic violence. The contribution of this research is to provide an integrative and dynamic approach to the development of Islamic law, so that it can provide relevant solutions to contemporary legal challenges and support the integration of Islamic law into the national legal system.

Abstract

The rapid development of the Islamic economy in Indonesia has given rise to various legal disputes that require special attention, particularly those related to the execution of mortgage rights in Islamic banking. These disputes are often complex, involving considerations of both Sharia principles and prevailing positive law. This research aims to analyze Decision No. 456/Pdt.G/2018/PA.Gtlo along with its related appeal and cassation decisions, to understand the dynamics and implications of such disputes. A case study approach is employed in this normative legal research methodology, with primary data in the form of court decisions were qualitatively analyzed. The research findings reveal a consistent pattern in court decisions, across the first instance, appeal, and cassation levels, rejecting the lawsuit for the annulment of mortgage execution. This rejection is based on several reasons, including formal defects in the filing of the lawsuit, the prohibition of retrying a case (ne bis in idem), and limitations on the scope of cassation review. These findings emphasize the importance of a deep understanding of the legal procedures applicable to disputes in Islamic economics, especially in the context of mortgage execution. Misunderstanding or negligence in fulfilling legal procedures can have serious consequences, such as the rejection of a lawsuit and losses for the disputing parties. Furthermore, this research highlights the importance of carefulness in filing lawsuits, particularly concerning formal and substantive aspects, to avoid unnecessary retrials.

Abstract

Transaksi ekonomi syariah meliputi bank, lembaga keuangan mikro, asuransi, reasuransi, dana investasi, obligasi, sekuritas, pinjaman, pegadaian, dana pensiun lembaga keuangan, dan sebagainya, sesuai dengan Pasal 49 UU No. 3 Tahun 2006. Terdiri dari beberapa industri dan perusahaan yang semuanya didasarkan pada hukum Syariah.Teknik penelitian hukum normatif digunakan dalam penelitian ini, yang juga menganalisis data sekunder dan sumber-sumber kepustakaan seperti buku, dan hasil penelitian berupa jurnal dan lainnya. Semua sumber primer, sekunder, dan tersier yang dikonsultasikan untuk penelitian ini termasuk dalam kategori ini. Melalui penelitian kepustakaan, serta data hukum sekunder yang dikumpulkan, Penilaian kualitatif digunakan untuk menyajikan temuan-temuan analisisSengketa ekonomi syariah dapat diajukan melalui gugatan acara biasa. Dalam situasi wanprestasi dan perbuatan melawan hukum (PMH), serta sengketa perdata tanpa ambang batas nilai uang, proses gugatan acara biasa berlaku. Dengan tenggang waktu maksimum lima bulan, upaya hukum di bawah proses standar dapat diajukan ke pengadilan tingkat pertama serta Pengadilan Tinggi Agama (banding) dan Mahkamah Agung (kasasi dan peninjauan kembali).Sengketa ekonomi syariah diatur dalam Perma No. 14 Tahun 2016. Perkara-perkara ini berkaitan dengan ekonomi syariah dan termasuk di dalamnya adalah perkara obligasi, kontrak berjangka, sekuritas, pembiayaan, pegadaian, dana pensiun, dan bisnis syariah, seperti wakaf, zakat, infak, dan shadaqah, yang bersifat komersil dan melibatkan bank, lembaga keuangan mikro, asuransi, reasuransi, dan reksa dana.

Abstract

Abstrak Wanprestasi dalam akad mudharabah merupakan isu yang signifikan dalam praktik ekonomi syariah, khususnya terkait pelaksanaan hak dan kewajiban para pihak. Penelitian ini bertujuan untuk menganalisis aspek hukum ekonomi syariah dalam perkara 220/Pdt.G/2024/PA.SMI, yang melibatkan sengketa wanprestasi pada akad mudharabah. Studi ini menggunakan metode yuridis normatif dengan pendekatan kasus untuk memahami penerapan prinsip syariah dalam penyelesaian sengketa tersebut. Hasil analisis menunjukkan bahwa terdakwa Ari Sudarjat Sofarulloh melakukan wanprestasi dengan tidak memenuhi kewajibannya sesuai dengan akad pembiayaan yang disepakati dengan mudharabah. Penggugat menggugat Tergugat karena tidak mengembalikan modal usaha beserta keuntungan yang dijanjikan dalam perjanjian dan addendum yang telah dibuat. Pada awalnya, Pengadilan Agama Sukabumi menolak gugatan secara verstek, namun putusan tersebut dibatalkan oleh Pengadilan Agama Bandung yang menerima permohonan kasasi penggugat. Dalam putusan banding, hakim memutuskan bahwa permohonan penggugat tidak dapat diterima secara verstek, tetapi juga memerintahkan tergugat untuk membayar biaya perkara. Sebagai kesimpulan, kasus ini menyoroti pentingnya Kejelasan dan konsistensi dalam pelaksanaan kontrak mudharabi dan penerapan prinsip-prinsip fiqih Islam dalam perselisihan tentang kewajiban dalam perjanjian Syariah. Kasus ini juga menegaskan bahwa para pihak dalam akad mudharab harus memastikan bahwa kewajiban mereka dipenuhi sesuai dengan ketentuan yang disepakati guna menjaga keadilan dan hubungan bisnis yang damai sesuai dengan hukum Syariah. Kata kunci : Akad Mudharabah, Analisis Perkara, Wanprestasi.   Abstract Default in mudharabah contracts is a significant issue in sharia economic practice, especially regarding the implementation of the rights and obligations of the parties. This research aims to analyze aspects of sharia economic law in case 220/Pdt.G/2024/PA.SMI, which involves a dispute over default in mudharabah contracts. This study uses a normative juridical method with a case approach to understand the application of sharia principles in resolving these disputes. The results of the analysis show that the defendant Ari Sudarjat Sofarulloh committed a breach of contract by not fulfilling his obligations in accordance with the financing agreement agreed with the mudharabah. The Plaintiff sued the Defendant for not returning the business capital along with the profits promised in the agreement and addendum that had been made. Initially, the Sukabumi Religious Court rejected the lawsuit in verstek, but the decision was overturned by the Bandung Religious Court which accepted the plaintiff's cassation request. In the appeal decision, the judge decided that the plaintiff's application could not be legally accepted, but also ordered the defendant to pay court costs. In conclusion, this case highlights the importance of clarity and consistency in the implementation of mudharabi contracts and the application of the principles of Islamic jurisprudence in disputes regarding obligations in Sharia agreements. This case also emphasizes that the parties to a mudharab contract must ensure that their obligations are fulfilled in accordance with the agreed terms in order to maintain fairness and peaceful business relations in accordance with Sharia law. Abstract

The establishment of Law Number 3 of 2006 concerning Religious Courts has increased the authority of religious courts, namely by resolving disputes from the sharia economy. Parties to the dispute can take a path that can be resolved, namely by litigation and non-litigation. There are several ways through non-litigation, such as mediation, negotiation, arbitration, and musharawah. However, the focus of this discussion is on mediation. Supreme Court Regulation Number 1 of 2016 concerning mediation procedures in court in article 1 point 1 states that mediation is one way to resolve disputes by negotiating to obtain agreement from two parties which will be assisted by a mediator. The necessity in conducting this mediation is a provision of article 10 of PERMA SES. This provision states that judges are required to seek peace first before hearing cases. Mediators in court have a vital role in the dispute resolution process from two parties Provide facilities for dialogue, neutrality, provide agreement facilities, encourage legal compliance, confidentiality, good communication skills, make agreements, stages of the mediation process, the first to fill out the form. Both parties may choose a mediator who is submitted to the judge. The initial stage in the mediation process is to provide a resume with a maximum of five days calculated to the mediator. Furthermore, the mediator mediates with negotiation material at an unlimited mediation meeting, both posita and petitum lawsuit, The mediation process takes place within thirty days calculated from the determination to carry out mediation, can be extended again for thirty days with the agreement of two parties. If within thirty days there is no sign of successful mediation, the process can be stopped immediately. If the mediation process has been carried out by the mediator and two parties, then the mediator will draw conclusions from mediation

Abstract

Interfaith marriage refers to a union between two individuals who adhere to different religions and remains a complex issue within the Indonesian legal system. Legally, Law No. 1 of 1974 on Marriage does not explicitly regulate interfaith unions. However, Article 2(1) of the law states that a marriage is valid if conducted by the religious laws and beliefs of the parties involved. This commonly means that interfaith marriages lack legal recognition in Indonesia. This interpretation is further reinforced by the issuance of Supreme Court Circular Letter (SEMA) No. 2 of 2023. This study adopts a normative juridical method with a descriptive qualitative approach. Primary data were obtained from the Marriage Law, the Compilation of Islamic Law, fatwas issued by the Indonesian Ulema Council (MUI), Muhammadiyah, Nahdlatul Ulama (NU), and SEMA No. 2 of 2023. Secondary data were gathered from legal literature, court decisions, and scholarly articles. The findings indicate that, under Article 2(1) of the Marriage Law, interfaith marriages are deemed invalid under Indonesian national law. However, from a human rights perspective—as stipulated in Article 16 of the Universal Declaration of Human Rights (UDHR) and Article 28B(1) of the 1945 Constitution—every individual has the right to marry regardless of religious affiliation. This study also outlines several legal alternatives available to interfaith couples seeking to formalize their marriage, including filing a court petition, temporarily adhering to one partner’s religious law, or marrying abroad. The legal implications of interfaith marriage include issues related to its validity, administrative registration, children's legal status, and both spouses' civil rights.

Abstract

Tulisan ini bertujuan untuk mengeksplorasi Kepastian dan keadilan hukum dalam penyeleaian sengketa harta bersama. Tema ini diangkat mengingat merupan tema yang menarik untuk diteliti. Pembahasan mengenai hal tersebut dapat disorot dari aspek teori maupun dari sisi penerapannya. Tulisan ini ingin mengeksplorasi perihal kepastian dan keadilan hukum dalam penyelesaian sengketa harta bersama. Bagaimana konsep kepastian dan keadilan hukum dalam penyelesaian sengketa harta bersama, menjadi hal yang menarik untuk ditelaah mengingat akan sangat bermanfaat dalam proses terapannya. Data penelitian ini diperoleh melalui penelitian pustaka (library research). Setelah konsep kepastian dan keadilan hukum dalam penyelesaian sengketa harta bersama, data kemudian dianalisa secara komprehensif untuk menemukan karakteristik dan pola pada tataran penerapannya karena terbuka dualism antara kepastian dan keadilan hukum dalam satu putusan pengadilan. Penelitian ini menemukan simpulan akan pentingnya kedudukan kepastian dan keadilan hukum dalam sengketa harta bersama diungkap dan diterapkan dalam putusan yang telah dijatuhkan oleh pengadilan.

Abstract

This article aims to analyze the role of hermeneutics in the interpretation of customary law and its implications for Sharia economic law in the era of globalization. This research contributes to revealing how hermeneutics can serve as an adaptive interpretative method to align customary law with the principles of Sharia economic law, ensuring its relevance in modern economic dynamics. This study is categorized as library research with a qualitative approach. The methodology used is a normative-juridical study. Hermeneutics in the interpretation of customary law functions as an interpretative method that ensures customary law remains relevant to social and economic developments without losing its identity. In the context of Sharia economic law in the era of globalization, hermeneutics enables the reinterpretation of customary law to align with Islamic economic principles, allowing it to adapt to the increasingly complex challenges of the global economic system.
