Abstract

ABSTRACT This research is motivated by the existence of an Application for Divorce Claims in Bogor Religious Court ruling as an Applicant filing for Claims Divorce and Child Custody. The Plaintiff as a mother filed a lawsuit to the Bogor Religious Court so that Child Custody fell on the Plaintiff. But the Defendant as the father is suing back, that the child custody holder is his father because his mother does not reflect as a good mother. Then the Board of Judges of the Bogor Religious Court rejected the Plaintiff's claim and granted the Defendant's claim to establish custody of the child at the Defendant until the child is 14 years old provided that the plaintiff is given access to meet the child. This study aims to determine the legal basis of the Panel of Judges, the method of finding the Panel of Judges in child custody cases. The results of this study are: 1. The consideration of the panel of judges granted the Defendant's lawsuit because he saw from the facts in the trial and based on the evidence submitted by the parties and looked at the benefit of the child. 2. Judges use the method of legal construction in legal discovery, namely the method of law enforcement (rechtsvervjnings). In this method, the judge can rule out articles that are deemed incompatible with the facts at this time.

Abstract

AbstractMediation is an alternative method of dispute resolution that can be used by the parties in litigation such as at religious courts and non-litigation at BPSK. The implementation of mediation is generally the same at both institutions. The purpose of this study was to determine the basis, implementation and effectiveness of mediation at the both. This type of research is empirical juridical approach. The sources used primary and secondary data from various related literatures and interviews with mediators.The results is: First, the legal basis for mediation in the Religious Courts is Perma Number 1 of 2016 and BPSK it refers to Perma Number 8 of 1999 which is then specifically regulated in Kepmenperindag Number 350/MPP/Kep/12/2001. Second, mediation in the Religious Courts is a procedure that must be passed before the trial. While in BPSK, mediation is the stage of the trial. Third, the effectiveness of mediation at the Bandung Religious Court is very low, based on data obtained from January to September 2020, only 14 cases successful mediation out of 410 cases. In BPSK, mediation can be said to be effective, from the data obtained from October 2019 to June 2020 there were 6 cases that completed mediation, 4 of which were successful and 2 reached deadlocks.Keywords: Meditation, Alternative Dispute Resolution, Religious Courts, BPSK. AbstrakMediasi ialah metode alternatif penyelesaian sengketa yang dapat digunakan para pihak secara litigasi seperti di Pengadilan agama dan non litigasi di BPSK. Pada kedua lembaga tersebut pelaksanaan mediasi pada umumnya sama. Tujuan penelitian ini untuk mengetahui landasan, pelaksanaan dan efektivitas mediasi pada kedua lembaga tersebut. Jenis penelitian ini kualitatif dengan pendekatan yuridis empiris. Sumber yang digunakan meliputi data primer dan sekunder dari berbagai literatur yang berhubungan dan hasil wawancara dari mediator.Hasil penelitian ini meliputi: Pertama, landasan hukum mediasi di Pengadilan Agama adalah Perma Nomor 1 Tahun 2016 dan di BPSK mengacu pada Undang-Undang Nomor 8 Tahun 1999 kemudian diatur secara khusus dalam Kepmenperindag Nomor 350/MPP/Kep/12/2001. Kedua, mediasi di Pengadilan Agama merupakan prosedur yang harus dilalui sebelum persidangan. Sedangkan di BPSK, mediasi merupakan tahap persidangan. Ketiga, efektivitas mediasi di Pengadilan Agama Bandung sangat rendah, berdasarkan perolehan data dari bulan Januari hingga September 2020, mediasi yang berhasil hanya 14 perkara dari 410 perkara. Sedangkan di BPSK mediasi dapat dikatakan efektif, dari data yang diperoleh rentang bulan Oktober 2019 hingga Juni 2020 ada 6 kasus yang menempuh mediasi, 4 di antaranya berhasil dan 2 menemui jalan buntu.Kata Kunci: Mediasi, Alternatif Penyelesaian Sengketa, Pengadilan Agama, BPSK.

Abstract

This research is motivated by the presence of an application in marriage data collection called the Marriage Management Information System or Simkah which has begun to be applied in various Religious Affairs Offices (KUA) in West Java, especially in KUA, Jatinangor District, Sumedang. Simkah is a policy program issued by the government to be applied to KUA in district which aims to facilitate the presentation of marriage data at the KUA. The purpose of this study was to describe the application of the Marriage Management Information System or Simkah in administrative services at KUA Jatinangor, Sumedang and its effectiveness. The method used in this research is descriptive method with a qualitative approach, namely research that seeks to reveal and interpret developing phenomena. In this case, the researcher went directly to the field, involving KUA Jatinangor, Sumedang Regency. The data found shows that Simkah at KUA Jatinangor, Sumedang Regency has been implemented but is still constrained, especially in terms of the readiness of the KUA's human resources. In some cases, it was found that it was difficult to use this application, including the complexity of inputting marriage data. Thus it can be concluded that the application of Simkah has helped facilitate data collection on marriages throughout Indonesia but it is still not effective in data entry at the local KUA.

Abstract

Permasalahan sampah merupakan hal yang tidak asing terutama di Indonesia, hal tersebut sejalan dengan pernyataan dari Kementrian Lingkungan Hidup dan Kehutanan di mana dalam waktu 1 tahun 100 toko di Indonesia dapat menghasilkan sampah sebanyak 10,95 juta kantong plastic. Melihat fenomena di atas, jika permasalahan tersebut tidak ditangani dengan baik serta pertambahan penduduk yang semakin banyak maka dapat membawa dampak buruk bagi lingkungan, dimana pelastik membutuhkan waktu puluhan bahkan ratusan tahun untuk dapat diurai oleh tanah. Penyadaran masyarakat akan pentingnya menjaga lingkungan harus senantiasa dilakukan guna menjaga keberlangsungan lingkungan terkhusus di Desa Indragiri.. Melalui rembuk warga maka diperoleh program penanggulangan sampah dengan terbentuknya kelompok kerja di masyarakat yang bersama-sama dengan mahasiswa. Meskipun sampah plastik mempunyai dampak negatif yang cukup besar tetapi di satu sisi penemuan plastik ini mempunyai dampak positif, hal tersebut dikarenakan sifat pelastik yang lentur dapat di bentuk kedalam bentuk apapun, adapun prinsip pengelolaan sampah yang terbaik dan yang selalu diupayakan dimana-mana adalah dengan Prinsip 3R (Reduce, Reuse, Recycle), Prinsip Reduce dilakukan dengan cara sebisa mungkin meminimalisir barang atau material yang digunaka memiliki bahan plastic. Dari pemaparan diketahui bahwa sampah plastik merupakan salah satu aspek dalam pencemaran lingkungan yang menjadi masalah di lingkungan dusun cilimus Desa Indragiri. Selain dengan me-Reduce sampah plastik, Ecobrick juga menjadi salah satu solusi yang dipilih sehingga dapat memberdayakan masyarakat.

Abstract

"Isbat nikah" is the verification of a marriage. Juridically, marriage verification is regulated under the laws such as Law No. 1 of 1974 on Marriage, Law Number 7 of 1989 on Religious Courts, and Law No. 3 of 2006 and Law Number 50 of 2009 on Changes in the Religious Courts Act. The regulations stipulate that marriage verification is allowed for marriage performed before the Law Number 1 of 1974. In practice, marriage verification submitted to the Religious Court is done after the enactment of Law Number 1 of 1974. The acceptance of "marriage verification" by the Religious Court for the marriage taken place after the 1974 Marriage Law was based on the Compilation of Islamic Law (KHI), whereas KHI's legal status is not included in the Indonesian legal order. The essence of marriage verification is a legal determination. This means that a verified marriage remains valid because the marriage that is verified is merely on administrative reason. The position of marriage verification is a part of giving legal protection and legal certainty. The position of the KHI, which regulates in more detail the marriage verification, functions regulatively in the midst of a vacuum of religious judicial law. In addition, the judge may decide whether to grant or deny the application of marriage verification. Thus, it can be concluded that the nature of marriage verification is a part of legal discretion.

Abstract

This study aims to describe the causes of high divorce rates in Muslim families in West Java based on the decisions of the Religious Courts, and this study also aims to formulate a strategy to prevent the increase in divorce rates. This study uses descriptive analysis method with interview techniques, study documents on the decisions of the Religious Courts and literature studies. The results of this study indicate that the highest cause of divorce in the mulism family in West Java is due to economic factors, there is no harmony and no responsibility. Prevention strategies for increasing divorce rates in West Java need to be done systemically from top to bottom, starting from family education before marriage and during conflicts between husband and wife. Thus, it can be concluded that the cause of the high divorce rate in Muslim families in West Java is due to a lack of commitment and knowledge of the essence of marriage, which makes the marital bond in a Muslim family fragile. The strategy to prevent increasing divorce rates is done systemically involving various elements, namely the government, community institutions, and the Religious Courts.

Abstract

The Marriage Law in Indonesia deals with the base age for marriage in article 7 of Law No. 1 of 1974, for men 19 years and women 16 years, which was overhauled through Law No. 16 of 2019 by raising quite far for women to 19 years, as a work to decrease the speed of youth marriage which is still exceptionally high in Indonesia. The motivation behind this paper is to take a gander at the viability of the marriage age limitation regulation and find the right answer for kid marriage that happens in Indonesia. The outcomes got those the base age limitations for marriage have not been compelling sufficient in diminishing the act of child marriage. The applications for marriage dispensation over the most recent two years in strict courts all through Indonesia that showed a high expansion in applications contrasted with the years prior to the change of article 7 of the marriage regulation. In addition, albeit the marriage regulation exists as a crisis response, there actually should be a base age limit in the application for the marriage agreement, with the goal that the age of the candidate underneath the cutoff can be dismissed.

Abstract

Perceraian adalah perbuatan yang mesti dijauhkan pada ikatan pernikahan, tapi bila terjadi masalah yang sudah berkepanjangan dan tidak bisa lagi disatukan kembali, jika dibiarkan akan mengakibatkan kemudaran bagi kedua belah pihak dan itu merupakan penyelsaian terakhir dari sengaketa keluarga dengan mengajukan permohona ke Pengadilan Agama. aktikel ini mengkaji Putusan Pengadilan Agman Kota Sungai Penuh Nomor 90/Pdt.G/2023/PA.Spn. tentang cerai talak, dengan menganalisis putusan pengadilan tersebut, melalui studi kepustakaan dengan pendekatan hukum normatif. Berdasarkan ketentuan Pasal 19 huruf f Peraturan Pemerintah Nomor 9 Tahun 1975 dan Pasal 116 huruf f Kompilasi Hukum Islam, yaitu adanya pertengkaran terus-menerus, tidak ada lagi harapan untuk bersatu lagi serta mereka telah berpisah tempat tinggal dalam waktu yang lama. Hakim mengabulkan permohonan cerai pemohon. Keputusan hakim telah selaras dengan hukum Islam karena perkawinan dimaksudkan untuk mewujudkan keluarga yang sakinah, mawaddah, dan rahmah. Bila sudah tidak ada keharmonisan dalam rumah tangga perceraian adalah hal yang dibolehkan.

Abstract

Aiming to legalize the practice of polygamy through the Raqan regulation, which is then outlined in the family Qanun, it needs to have restrictions on practicing polygamy, such as the concept of justice and sanctions for abuse committed by a husband. The purpose is to protect women as human beings whose rights must be protected along with the obligations and be executed. Then, the research aimed to analyze the construction of Islamic law reform in the family sector, especially in protecting the position of women and children in the context of the structure of the legal order and the occurrence of polygamy without the permission of the Mahkamah Syar’iyah in Nanggroe Aceh Darussalam. The research was qualitative using non-doctrinal juridical or sociological methods to reform the legal order of polygamy in Raqan using studies of legal order theory, al-hudud (legal boundaries), and al-maslahah, using a historical approach and a legal philosophy approach. The findings showed that the idea of ​​a legal order for polygamy in the family law community in Nanggroe Aceh Darussalam is the implementation of the idea of ​​legal governance between compliance with Sharia and state law perfectly through Raqan renewal. Legal reform is an illustration and parameter in implementing polygamy to realize benefits for individuals and society. And, protect the position of women and children who have not been accommodated in marriage law, so that they can live a harmonious life.

Abstract

Repositioning the ihdad of career women is a phenomenon that involves changing the role and position of women in a professional context. A multi-perspective approach is needed for a complete grasp of this phenomenon, including philosophical, historical, juridical, and sociological studies. The research method is the normative method with a literature review (library research) with a phenomenological approach, historical approach, philosophical or philosophical approach to Islamic law (ushul fiqh), juridical approach (regulations and fatwas), and sociological approach, then combined with retrospective methods and analyzed qualitatively. According to the results, a thorough comprehension of women’s shifting roles and positions in the workplace can be seen in the repositioning of ihdad from a philosophical, historical, legal, and sociological standpoint. From a philosophical perspective, career women’s ihdad repositioning involves considerations of gender equality, justice, and human dignity. From a historical perspective, career women’s ihdad repositioning reflects significant social changes in the role and position of women in the workplace. Historically, women were often restricted to domestic roles and deemed unsuitable for careers outside the home. From a juridical perspective, career women’s ihdad repositioning involves a legal analysis related to the protection and rights of women in the workplace. From a sociological perspective, career women’s ihdad repositioning involves an analysis of social structures and social interactions that affect women’s position in the world of work.
