Abstract

ABSTRACT This research is motivated by the existence of an Application for Divorce Claims in Bogor Religious Court ruling as an Applicant filing for Claims Divorce and Child Custody. The Plaintiff as a mother filed a lawsuit to the Bogor Religious Court so that Child Custody fell on the Plaintiff. But the Defendant as the father is suing back, that the child custody holder is his father because his mother does not reflect as a good mother. Then the Board of Judges of the Bogor Religious Court rejected the Plaintiff's claim and granted the Defendant's claim to establish custody of the child at the Defendant until the child is 14 years old provided that the plaintiff is given access to meet the child. This study aims to determine the legal basis of the Panel of Judges, the method of finding the Panel of Judges in child custody cases. The results of this study are: 1. The consideration of the panel of judges granted the Defendant's lawsuit because he saw from the facts in the trial and based on the evidence submitted by the parties and looked at the benefit of the child. 2. Judges use the method of legal construction in legal discovery, namely the method of law enforcement (rechtsvervjnings). In this method, the judge can rule out articles that are deemed incompatible with the facts at this time.

Abstract

This article aims to analyze the role of hermeneutics in the interpretation of customary law and its implications for Sharia economic law in the era of globalization. This research contributes to revealing how hermeneutics can serve as an adaptive interpretative method to align customary law with the principles of Sharia economic law, ensuring its relevance in modern economic dynamics. This study is categorized as library research with a qualitative approach. The methodology used is a normative-juridical study. Hermeneutics in the interpretation of customary law functions as an interpretative method that ensures customary law remains relevant to social and economic developments without losing its identity. In the context of Sharia economic law in the era of globalization, hermeneutics enables the reinterpretation of customary law to align with Islamic economic principles, allowing it to adapt to the increasingly complex challenges of the global economic system.

Abstract

This research analyzes the decision of the Sumber Religious Court of Cirebon Regency in the procedure for executing the confiscation of sharia mortgage rights in the murabahah case Number 2008/Pdt.G/2020/PA.Sbr. This research pays attention to the role and actions of religious courts in handling execution cases, assessing debt collateral, and protecting the rights of debtors and creditors in sharia economic cases. The author uses a qualitative method with a normative approach. The analyzes primary data such as the judge's decision and related documents and analyzes secondary data as a source of information which includes literature study. This execution process involves the State Property and Auction Services Office and may face challenges from debtors or third parties. The case study of case Number 2008/Pdt.G/2020/PA.Sbr shows that the execution mechanism for the auction of mortgage rights was carried out outside the Sumber Religious Court, Cirebon Regency, without a court execution order. The judge considers it according to the applicable legal basis. As a result, the Plaintiff's lawsuit was rejected because of the implementation of the auction by Bank BRI Syariah.Tbk Cirebon Branch Office was deemed to be in accordance with the law. Default by the Customer is the main reason for this decision.

Abstract

In the practice of contract law, the fulfillment of promises and compliance with agreements are fundamental aspects to ensure justice and legal certainty. The principle of pacta sunt servanda which emphasizes the obligation to honor agreements has relevance to Islamic rules which also require the fulfillment of promises. This research uses normative legal research methods with a comparative juridical approach. Primary data sources are obtained from laws, government regulations, court decisions, and other relevant legal documents. While secondary data is obtained from books, journals, scientific articles, and other literature that discusses the principle of pacta sunt servanda, Islamic rules on promises, and contract law. Data collection techniques use literature study and document analysis, while data analysis techniques use qualitative analysis using the inductive method, and comparative analysis to compare the principle of pacta sunt servanda with Islamic rules of promise. The findings show that pacta sunt servanda and Islamic rules of promise have similarities in emphasizing the importance of commitment to the contract. However, there are differences in the application of these two legal systems, especially regarding exceptions and certain conditions such as force majeure and the principle of benefit in Islam. The principle of pacta sunt servanda and the Islamic rule of promise can complement each other in the practice of contract law, especially in the context of countries that apply legal pluralism. The application of these two principles encourages trust and stability in business transactions. This research recommends strengthening the legal framework that accommodates elements of contract compliance while taking into account aspects of substantive justice and relevant special conditions.

Abstract

Abstract Joint property disputes in Indonesian society can be said to have never subsided and even tend to increase as the divorce rate continues to increase, the purpose of this research is to find out the pattern and form of settlement of joint property disputes.The development of the dynamics of law in Indonesia has experienced significant developments. This study discusses three things: the pattern of dispute resolution, the factors that lead to disputes, in the settlement of joint property disputes in Indonesia. This research is an analytical descriptive research which includes data collection methods, data compilation, and final data analysis. The findings of the study show that first, the meaning and limits of joint property as stated in Law no. 1 of 1974 and in the KHI can no longer be criminalized in the case of joint property itself. Settlement of joint property disputes in Indonesia through two settlement channels. Second, Law No. 1 of 1974 in principle has provided preventive measures so that there is no mixing of joint assets with innate assets. Third, the settlement of joint property disputes in Indonesia through two settlement channels, the first through litigation and the second through non-litigation. Fourth, the settlement of joint property disputes carried out in two ways, litigation and non-litigation, provides different dispute resolution models and different finding. Abstrak Sengketa harta bersama dalam masyarakat Indonesia dapat dikatakan tidak pernah surut bahkan cenderung meningkat seiring dengan angka perceraian yang terus meningkat, tujuan dari penelitian ini adalah untuk mengetahui pola dan bentuk penyelesaian sengketa harta bersama. Dinamika hukum di Indonesia telah mengalami perkembangan yang signifikan. Penelitian ini membahas tiga hal yaitu pola penyelesaian sengketa, faktor-faktor yang menimbulkan sengketa, dalam penyelesaian sengketa harta bersama di Indonesia. Penelitian ini merupakan penelitian deskriptif analitik yang meliputi metode pengumpulan data, penyusunan data, dan analisis data akhir. Hasil penelitian menunjukkan bahwa pertama, pengertian dan batasan harta bersama sebagaimana diatur dalam UU No. 1 Tahun 1974 dan dalam KHI tidak dapat lagi dipidana dalam perkara harta bersama itu sendiri. Penyelesaian sengketa harta bersama di Indonesia melalui dua jalur penyelesaian. Kedua, Undang-Undang Nomor 1 Tahun 1974 pada prinsipnya telah memberikan tindakan pencegahan agar tidak tercampurnya harta bersama dengan harta bawaan. Ketiga, penyelesaian sengketa harta bersama di Indonesia melalui dua jalur penyelesaian, yang pertama melalui jalur litigasi dan yang kedua melalui jalur nonlitigasi. Keempat, penyelesaian sengketa harta bersama yang dilakukan dengan dua cara, litigasi dan nonlitigasi, memberikan model penyelesaian sengketa yang berbeda dan temuan yang berbeda pula.

Abstract

The phenomenon of unregistered inter-citizen marriage has been rife in several places in Indonesia. As a result of such marriages, women often have no legal power and can not obtain legal identity rights such as marriage certificates, birth certificates for their children, including material rights such as joint property and property ownership. This study examines the process of informal marriages between citizens as well as examining the extent to which the state provides legal protection to women who engage in informal marriage. The method and approach taken are normative juridical by utilizing secondary data sources in the form of legislation, books, and scientific journals. The results show that the emergence of an unregistered inter-citizen marriage is mostly due to the incompleteness of the documents needed from the country of origin of the prospective husband. To overcome this problem, the state has protected women in the form of preventive and restitutive protection women involved in intermarriages can obtain a clear legal position and protection.

Abstract

This study aims to determine the settlement of family disputes through litigation. The method used in this study is qualitative with the type of library research and uses an empirical normative-juridical approach, where the study focuses on the reciprocal correlation between law and the phenomena that occur. The results of the study indicate that the settlement of family disputes through litigation is a dispute resolution method in which there is a process of mutually disabling opposing evidence (op tegenspraak) and producing a win-lose solution. In fact, the resolution of household problems outside the court, such as mediation which in traditional societies is often carried out at the village level or tahkim which is carried out in large families through negotiation and arbitration. However, in the modern era, people now prefer to resolve family disputes through litigation in court so that married couples are forced to choose a court decision which mostly ends in divorce.

Abstract

The The family dispute resolution system in Indonesia aims to resolve various issues within family relationships, such as divorce, child custody, and division of joint property. Dispute resolution can be conducted through two main channels: litigation (court proceedings) and non-litigation (mediation). The court plays an important role in enforcing the law and protecting the rights of the parties involved. This article aims to analyze the effectiveness of the family dispute resolution system in Indonesia and evaluate the challenges faced in its implementation. The discussion begins with an explanation of the dispute resolution system in court, mediation as an alternative dispute resolution method, and the challenges in resolving family disputes in Indonesia. Furthermore, the article examines the role of the court in supporting justice for the parties involved in family disputes and identifies factors that affect the success of mediation. This study is also necessary to explore the challenges and dynamics that arise in family dispute resolution, particularly regarding the duration of legal processes, high costs, and emotional tensions between the disputing parties. This research uses a qualitative method, referring to related sources such as previous studies on family dispute resolution. In conclusion, the family dispute resolution system in Indonesia requires improvements, including the optimization of mediation, simplification of legal procedures, and digitalization of legal services to achieve a more efficient and just process

Abstract

The need for mediation is motivated by the accumulation of cases at the cassation level. Every year the cases that come to court are not decreasing, but are increasing. Meanwhile, the judge who has to resolve the case has limited capacity, so the cases that come in cannot be resolved quickly. This happened at the Religious Court in the Banjarmasin PTA area. Therefore, the concept of mediation is needed to reduce the problem of the accumulation of cases that occur at the religious court level, in terms of the benefit of children's growth and development. The research approach chosen uses an empirical juridical approach with a descriptive research method of analysis of theories of mediation and child protection and their implementation in judges' decisions regarding divorce in the Religious Courts in the Banjarmasin PTA area. Divorce has a negative impact on children's psychological development, because in general the psychological development of children whose parents are divorced is very disturbed, apart from that, the negative factor resulting from divorce is the lack of love and attention from both parents. Psychologically, parental divorce results in changes in behavior, responsibility and emotional stability.

Abstract

Empowering the community is an endeavor to prepare society for achieving progress, independence, and well-being within a sustainable social justice environment. Effective community empowerment must be tailored to the specific conditions of the target. Correspondingly, the objective of this program was to construct and empower an educational ecotourism village by implementing a hybrid method combining Sisdamas (Community Empowerment System) and Asset-Based Community Development (ABCD). This hybrid approach was expected to facilitate the identification of existing community assets and enhance synergy among stakeholders in creating an educational ecotourism village. Moreover, integrating these two methods could result in an effective, efficient, and sustainable coaching process. Cigugurgirang village possesses several assets that can be developed into an agricultural educational tourism area, including orange gardens, grape vineyards, and ornamental plant areas. They serve as the initial foundation for asset identification. The evaluation of the coaching process incorporated the Social Return on Investment (SROI) framework analysis, yielding a value of 10.16:1. Thus, every investment of 1 million rupiahs would generate a social value of 10.16 million rupiahs. In summary, the present community empowerment program had a multi-faceted impact, encompassing economic, educational, and social benefits. Its primary focus was establishing a sustainable and socially just environment, utilizing a combination of methods to maximize effectiveness. Furthermore, SROI analysis underscored the significant social value generated by the program's investments.
