Abstract

The abstract here is a representation (not a summary) of the background, objectives, methods and conclusions. Abstract in English written in one paragraph consisting of 150- 200 words, using Times New Roman, font size 11, one space. Abstract serves to briefly present the contents of the journal. The position of consumers in general is still weak in the fields of economy, education and bargaining power, therefore it is very necessary to have laws that protect consumer interests. To be able to provide guarantees for the implementation of consumer protection, the government pours consumer protection into a legal product. This is important because only the law has the power to compel business actors to obey it, and also the law has strict sanctions. This research was conducted at the Consumer Dispute Settlement Agency domiciled in Karawang Regency using normative juridical types and approaches. The author reviews the legal literature on consumer dispute resolution and legal certainty over the Karawang Regency Consumer Dispute Settlement decision which is then collected and classified with detailed, systematic and directed records regarding documents/literature. Furthermore, the author conducts a descriptive data analysis, so that a comprehensive picture of the problems surrounding consumer dispute resolution and legal certainty is obtained for the Karawang Regency Consumer Dispute Settlement decision. The results of the research that the author conducted suggest that consumer settlement in accordance with Law No. 8 of 1999 concerning Consumer Protection can be pursued by 3 (three) methods / methods, namely, conciliation, mediation and arbitration on the basis of the choice and agreement of the parties to the dispute. The form of award by the method of conciliation and mediation shall be final and binding, without having to be asked for fiat execution to the local District Court, while the form of award taken by the method of arbitration must be requested by fiat execution to the local District Court so that the arbitral award has executory force.

Abstract

The development of technology in this case is something related to human life, where technology on the other hand provides convenience but also provides new problems that are accepted by humans. The internet is one form of technological development itself. The internet is an electronic media and information that is developing very fast. The internet is widely used in various trading activities, trading activities that utilize the internet are known as e-commerce, one of the internet trading activities is through the Instagram platform. Trading via Instagram social media itself raises many problems related to law with all the risks. Problems that can arise include default. The purpose of this article is to find out the rights and obligations of the parties in buying and selling transactions via Instagram and the legal consequences that arise if the seller in a buying and selling transaction via Instagram defaults. In this study the authors used empirical research methods. The data taken was in the form of secondary and primary data. Secondary data was obtained from interviews with informants who had cases related to purchases on Instagram social media. Primary data were obtained from Civil Law, literature studies and various articles related to the problems studied. The results obtained from this writing are that legal protection for consumers who feel harmed by irresponsible producers has been regulated in Law no. 8 of 1999. The research in this article concludes that: in buying and selling activities carried out on Instagram there are often deviations in rights and obligations that are no longer in accordance with the norms that exist in society and legal remedies that can be taken in the event of default from one of the parties, both sellers and buyers who make online transactions, can be sued in the general court environment or outside the court and can be fined directly for the party who commits the default.

Abstract

In this era, beauty products are important for building self-confidence for women and men. Beauty products must also contain ingredients that are safe for the skin so that the skin looks healthy. However, in reality, some beauty products contain dangerous ingredients that can cause side effects on the skin. These ingredients contain hydroquinone, mercury, paraben, formaldehyde, phthalates, and triclosan. If used for a long time, it can cause skin problems such as itchy skin, excessive acne, blisters on the skin, blackened areas of the skin (ochronosis), and pose various risks to body health. Meanwhile, it has been explained in RI POM Regulation No. 23 of 2019 regarding raw materials that may be used in beauty products, of course, they must contain safe, quality, and beneficial ingredients. This research discusses legal protection for consumers due to products that cause side effects on the skin. What is the legal protection for consumers who cause side effects on the skin? Consumers must be given special protection for the content information listed on beauty products or packaging. Resolving consumer protection regarding the consequences of beauty products containing side effects on the skin can be done through legal action. This legal effort can be made to make claim for compensation or report it tothe athorities or police.

Abstract

Online loans that make it easy to get funding turn out to have a negative effect. In some cases, it can be found that there are debtors who choose to end their lives because they are not mentally strong in facing the threat accompanied by the spread of personal data. Lack of caution in filling out the terms and conditions submitted makes the chances of personal data leakage even greater. For this reason, legal protection is needed for debtors in terms of personal data. The purpose of the research is to find out the implementation of personal data rules in online loan transactions linked to the UUPK, to know the legal protection of debtors against personal data that is leaked without the knowledge of the debtor and what legal remedies can be taken by debtors in the misuse of personal data. The method uses a normative juridical approach, with secondary data in the form of data obtained based on literature studies and supporting data. There are still collection actions carried out by one of the online loan application services by distributing the debtor's personal data to several contacts of fellow debtors either through SMS or email short messages. This is contrary to the UUPK and also POJK 22/2023 Article 62 paragraph (2) letter c which explains that collection officers are not allowed to collect from parties other than Consumers.

Abstract

The rise in child molestation cases has brought significant concern due to the severe psychological and physical trauma inflicted on victims, particularly children. Such trauma can hinder their future growth and development. This study investigates the legal framework governing child molestation crimes and examines the psychological impact on children when perpetrators are acquitted, particularly in relation to the Child Protection Law. The research employs a normative legal method to analyze relevant laws, including both the Criminal Code and the Child Protection Law, which impose varying penalties based on the nature of the crime and the relationship between the offender and the victim. The results indicate that acquittal in molestation cases leads to prolonged psychological harm, increases the risk of physical issues such as sexually transmitted diseases, and can result in social stigmatization and exclusion. The study concludes that robust legal protection is essential for child victims, emphasizing the importance of ensuring their rights and providing appropriate remedies. Law Number 35 of 2014 on Child Protection underscores the state’s obligation to protect children from all forms of violence, including sexual violence.

Abstract

Consumers are often confronted with business practices that tend to disadvantage them. One such practice is when the price displayed on a product's display box differs from the price at the store cashier. Given the uncertainty about the price of an item, this can negatively impact buyers. Regulations aimed at protecting consumers and providing legal clarity must exist. One such law, Consumer Protection Regulation Number 8 of 1999, describes how consumer rights are protected by the law and how this law is implemented in day-to-day social interactions. With a qualitative approach, the research methodology normative juridical approach. The findings of this journal highlight that permissible cover to consumers who endure losses because of price discrepancies involves various individuals or business entities, whether legal or not, established and operating subject to the legal domain of the Republic of Indonesia, either individually or collectively through business agreements in different market sectors. Additionally, the research notes that sanctions for businesses occur when consumers request a recalculation based on display prices, and Indomaret employees refuse. Consumers who feel aggrieved and wish to cancel their purchase and receive a refund are also denied, as transactions have been input into the cashier system. Such actions are inconsistent with regulations and disadvantage consumers.

Abstract

This study analyzes the implementation of additional sanctions for users of non-standard mufflers in accordance with Law Number 22 of 2009 concerning Traffic and Road Transportation. The use of noisy racing mufflers is considered a criminal offense, but the existing sanctions are deemed ineffective. The research adopts a normative juridical approach with a legislative perspective. The findings reveal that additional sanctions that can be imposed on users of noisy mufflers include bringing the muffler closer to the user's ears or engaging in specific sports activities. Factors influencing the effectiveness of law enforcement encompass regulations, law enforcement agencies, infrastructure, society, and culture.

Abstract

Purchasing and selling, giving, swapping, and other methods are some of the ways that land may be acquired. Buying and selling is a reciprocal arrangement wherein one party, the seller, agrees to transfer ownership rights to an object and the other, the buyer, agrees to pay a price that accounts for the difference between the two parties' respective ownership rights acquisition amounts. An official with the power to legitimately validate a sale and purchase, known as a Land Deed Making Officer (PPAT), must be present when the sale and purchase are finalized. The sale and purchase are legally binding acts, and the deed proves it. The validity of the land rights transfer depends on this. In judgment N0.58/Pdt.G/2020/PN Kwg, the judge considered a signature forgery in the sale and purchase deed. This study employs a descriptive analytical research type based on normative juridical research. In qualitative research, secondary data is gleaned via document studies. As a branch of the National Land Agency, PPAT has the status of a public official with the power to create genuine deeds pertaining to certain legal activities involving ownership rights to apartment buildings or land. that the land certificate's signature is a forger, which has legal ramifications since it falls short of the conditions for creating a Deed of Sale and Purchase and renders the document legally worthless.

Abstract

Perjanjian merupakan tindakan hukum yang terbentuk melalui kesepakatan, di mana beberapa pihak secara bebas menyatakan keinginan mereka. Terwujudnya kesepakatan ini tergantung pada pelaksanaan hukum sebagai kepentingan satu pihak terhadap pihak lain melalui pengaturan aturan yang ada. Dalam konteks perjanjian kerja, diperlukan kontrak yang mengikat kedua belah pihak, sehingga kewajiban mereka dapat dipenuhi. Pada bulan Februari 2020, rumah produksi film Falcon Picture mengajukan gugatan wanprestasi melalui nomor perkara 171/Pdt.G/2020/PN Jkt.Sel terhadap aktor Jefri Nichol, atas pelanggaran perjanjian kerja No. 130/F.05.01/IV/2018 yang disepakati pada tanggal 4 April 2018. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif, yaitu metode hukum yang menggunakan data sekunder atau bahan pustaka. Tujuan penelitian ini adalah untuk melihat akibat hukum dari pelanggaran perjanjian kerja dan upaya penyelesaiannya sebagai perlindungan bagi pihak yang terlibat. Berdasarkan pertimbangan hakim, Jefri Nichol dan ibunya terbukti melakukan wanprestasi dengan tidak memenuhi kewajibannya terhadap Falcon Picture dan melanggar Perjanjian Kerja yang telah disepakati. Upaya penyelesaian wanprestasi dilakukan melalui tuntutan ganti rugi Falcon Picture kepada Jefri Nichol melalui jalur litigasi atau pengadilan. Jefri Nichol dan ibunya mencoba mengajukan eksepsi sebagai bentuk perlindungan, namun majelis hakim menolaknya karena bertentangan dengan perjanjian kerja yang telah disepakati.

Abstract

Perlindungan konsumen merupakan isu masyarakat yang mendapat perhatian di seluruh dunia, dengan fokus antara lain pada layanan pinjaman uang dari bank dan peran debt collector sebagai pihak ketiga yang melakukan penarikan barang jaminan. Otoritas Jasa Keuangan (OJK) diidentifikasi sebagai lembaga pengawas dan regulator yang bertanggung jawab melalui pembuatan peraturan keuangan. Penelitian ini bertujuan untuk mengevaluasi perlindungan hukum bagi nasabah terkait layanan pinjaman uang dari bank, khususnya yang terkait dengan Peraturan OJK Nomor 1/POJK.07/2013 tentang Perlindungan Konsumen Sektor Jasa Keuangan. Metode penelitian yang digunakan adalah yuridis empiris dengan wawancara dan analisis data dari literatur sebagai pendukung. Hasil penelitian menunjukkan bahwa perlindungan nasabah sangat penting karena masih ada pihak bank yang menggunakan jasa debt collector tanpa mematuhi peraturan yang berlaku, terutama dalam penagihan tunggakan kartu kredit. Proses penyelesaian sengketa antara nasabah dan debt collector dapat dilakukan di luar pengadilan atau melalui jalur pengadilan, dengan opsi damai sebagai upaya perundingan antar pihak yang berkaitan. Perlindungan hukum ini diperlukan agar hak-hak nasabah terlindungi dan untuk memberikan keamanan dari gangguan pihak-pihak tertentu.
