Abstract

This essay discusses the significance of sovereignty in the context of the modern state, highlighting the transformation of the concept of sovereignty and the development of globalisation, technology, and international interdependence. Initially, sovereignty was understood as the absolute power of a state to regulate its domestic affairs. However, sovereignty must be adjusted to international norms and human rights in the global era. Globalisation and digital threats require states to balance domestic interests and global obligations. This essay also raises the dilemma of international intervention and the role of sovereignty in facing these challenges. Therefore, a more flexible, inclusive, and participatory sovereignty reinterpretation is needed, considering the state's responsibilities to its citizens and international cooperation. With this approach, state sovereignty can remain relevant and effective in responding to the challenges of the times, such as globalisation and climate change, while maintaining identity, security, and social welfare.

Abstract

Esai ini mengupas konsep kedaulatan Tuhan dalam konteks filsafat politik, menguraikan bagaimana gagasan ini membentuk teori pemerintahan dan memengaruhi kehidupan bernegara. Dalam pendahuluan, dibahas pandangan teokratis yang menempatkan Tuhan sebagai sumber utama legitimasi kekuasaan, di mana hukum dan kebijakan negara didasarkan pada ajaran agama. Esai ini mengeksplorasi bagaimana pemerintahan teokratis seperti Iran menjadikan hukum Tuhan sebagai landasan tertinggi, namun memunculkan dilema terkait kebebasan individu dan pluralisme agama. Melalui perspektif agama-agama samawi dan filsafat ketuhanan, kedaulatan Tuhan dipandang sebagai kekuasaan absolut yang mengatur hubungan manusia dengan Tuhan dan sesamanya. Namun, konflik antara kedaulatan Tuhan dan kebebasan individu muncul ketika hukum agama diterapkan secara ketat dalam negara modern yang heterogen. Hal ini memicu pertanyaan tentang sejauh mana negara dapat memaksakan hukum agama dalam masyarakat yang beragam keyakinan. Esai ini juga membahas peran kedaulatan Tuhan dalam pembentukan moralitas dan hukum negara serta relevansinya dalam negara sekuler dan religius. Dengan pendekatan filosofis dan pemikiran para ahli, esai ini mengajak pembaca merenungkan keseimbangan antara kedaulatan Tuhan, hak individu, dan prinsip negara modern dalam menghadapi dinamika global.

Abstract

This essay discusses the inherent relationship between sovereignty and the state and the state's role in realising and implementing sovereignty. Sovereignty, which refers to the highest power in a territory, cannot exist without the state as a legitimate political entity. The state is the foundation of sovereignty, acting as an institution that enforces the law, protects the rights of citizens, and maintains order and security. Through the social contract theory, the state emerges from social agreement to ensure security and justice. The state has the power to make laws, enforce rules, and resolve disputes, which reflects the operationalisation of sovereignty in the life of society. In the international context, sovereignty is recognised as the main attribute of a legitimate state, but it is not absolute because the state must comply with international norms. International recognition of the state is essential for the legitimacy of sovereignty, allowing states to interact at the global level. In conclusion, sovereignty can only exist effectively if a state exercises it, so the state acts as a pillar supporting sovereignty in the legal structure and international system.

Abstract

This study aims to analyse the legal status of foundations by Law No. 28 of 2004 and to examine the legal implications of the misuse of foundation functions between social and business interests. Foundations, as non-profit legal entities, play a strategic role in social and educational activities; however, in practice, there is a potential for the misuse of their functions for business activities that conflict with their social goals. This study employs a qualitative method, combining a literature and legislative approach, which analyses various legal sources and related provisions to explore the legal regulations surrounding foundations, their role in social and business activities, and the legal implications of a foundation deviating from its social goals. The results of the study indicate that although Law No. 28 of 2004 provides a clear legal basis for foundations, the practice of misusing foundation functions for business activities can still occur. Therefore, strict government supervision and adherence to the principles of transparency and accountability are necessary to ensure that foundations continue to operate in accordance with the social goals mandated by law.Keywords: Foundation; legal entity; Law No. 28 of 2004; social activities; business activities; legal implications

Abstract

This article discusses the dualism in developing the Tax Court in Indonesia, which involves the Supreme Court and the Ministry of Finance. The research background includes the complexity of the tax justice system and challenges in coordination between the two institutions. The aim of the research is to identify the benefits, weaknesses and potential risks of this dualism coaching system. The research method used is qualitative with a literature and legislation approach to analyze the legal framework and its practical implementation. The research results show that the dualism coaching system provides a variety of approaches, but also creates the potential for conflict, uncertainty and waste of resources. This article concludes by stating the importance of improving coordination between the Supreme Court and the Ministry of Finance in order to increase efficiency and effectiveness in developing the Tax Court and ensuring legal certainty in resolving tax disputes in Indonesia.

Abstract

The phenomenon of gangsterism in Indonesia has developed into a form of non-state violence that threatens social order and the sense of security of the community. Gangs are not only detrimental to individuals, but also create an atmosphere of fear and distrust of law enforcement officers. In this context, the state has a constitutional obligation to protect the fundamental rights of citizens, including the right to a sense of security as guaranteed in Article 28G paragraph (1) and Article 30 paragraph (4) of the 1945 Constitution. This study specifically aims to examine the extent to which the state carries out its constitutional responsibilities in ensuring the security of citizens from intimidatory actions by gangster groups. The research method used is qualitative, with literature study techniques and legal-political analysis. Data were obtained through a study of scientific journals, laws and regulations, and government policy documentation related to overcoming gangsterism. The study results show that although there is a relatively strong legal framework in overcoming gangsterism, its implementation still faces serious challenges. Weak law enforcement, the dominance of a repressive approach without structural solutions, and the lack of rights-based social protection cause the practice of gangsterism to continue. Therefore, this study recommends integrating a firm legal approach and inclusive social policies as an effective strategy to realize just citizen security. The state must act actively and reasonably in carrying out its constitutional mandate to ensure a sense of security for all its citizens.

Abstract

Mangrove forests in Aceh are significant because of their roles in ecological, socio-economic, and socio-cultural aspects. Mangrove restoration efforts must be based on adequate land assessment and regular evaluation of the viability of planted mangroves. Therefore, this study aimed to analyze the bio-ecological characteristics of mangrove planting locations and evaluate land suitability in the restoration areas in Aceh Besar (Layeun Village) and Aceh Jaya (Babah Ie, Ujong Sudeun and Keude Unga Villages). This study was conducted in the YAGASU restoration area in Aceh Besar and Aceh Jaya Regencies in September 2022. The primary data consisted of the physicochemical characteristics of the environment, biodiversity, land suitability index, and plant survival rates after 3- 6 months planted. Data were analyzed using correlation, principal component analysis (PCA), cluster analysis (CA), descriptive statistics, and land suitability index. The result showed that the physical-chemical parameters of the environment are suitable for supporting the growth of mangroves and the livelihoods of various communities. In the study areas, the communities include 8 mangroves, 15 fish, 19 benthic, 11 zooplankton, and 22 phytoplankton species. Layeun, Ujong Sudeun, and Keude Unga Villages were found to have better land suitability than Babah Ie Village. However, an evaluation of the results of planting monitoring showed that Layeun has the highest survival rate compared to the other three villages. The results showed that pests, including buffalo and crustaceans, as well as sea waves, and the duration of the tides inundating the water are the main factors causing mangrove mortality.Keywords:Mangrove restorationSuitabilityBio-ecological

Abstract

Learning strategies are very important for an educator to use when teaching. The use of learning strategies should be a part that must get the attention of educators / facilitators in every learning activity. Therefore, educators need to learn and even develop how to set learning strategies in order to effectively achieve learning objectives in the teaching and learning process in the classroom, one of which is the application of appropriate learning strategies. This study uses a qualitative method in the form of descriptive. Data collection methods include interview, observation and documentation methods. Researchers acting as participants and informants of this study were the Head of Curriculum, Al-Quran Hadith teacher, and several seventh grade students. For the sample technique using purposive sampling. The validity of the data is done by triangulation of sources. For data analysis using data reduction, data presentation, conclusion drawing/verification. Based on the results of interviews and observations that have been made by the researcher, it was found data stating that the application of the inquiry learning strategy includes lesson planning, implementation of learning strategies consisting of observation, formulating problems, analyzing hypotheses, analyzing data, and drawing conclusions. The last stage is the closing and evaluation stage. In addition, it was also found that there was a process of compiling problems using the question and answer method and when delivering conclusions using the lecture method.
