Abstract

Changes to the authority of the Financial Services Authority, namely Law Number 21 of 2011 concerning the Financial Services Authority by Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector resulted in the existence of a single authority which directly resulted in impunity for the authority of the main organ in investigating crimes in the financial services sector. The purpose of this research is to identify the essence of the position of auxiliary state institutions in Indonesian statehood. This research uses the statute approach and conceptual approach. The results of this study show that the implementation of auxiliary state institutions in Indonesia is still not by the essence of its formation as a supporting institution.   Perubahan atas kewenangan Otoritas Jasa Keungan pada Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan oleh Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan mengakibatkan terdapatnya penunggalan kewenangan yang secara langsung berakibat pada impunitas kewenangan main organ dalam penyidikan terhadap kejahatan di sektor jasa keuangan. Tujuan penelitian ini tentu untuk mengidentifikasikan esensi kedudukan lembaga negara bantu pada kenegaraan Indonesia. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil dari penelitian ini menunjukan bahwa pengimplementasian mengenai lembaga negara bantu di Indonesia masih belum sesuia dengan esensi pembentukannya sebagai lembaga penunjang.

Abstract

The right to justice, and human rights more generally, requires the filing of a judicial review (PK) in Indonesia. A judicial review (PK) can be requested by an individual who believes that his rights have been infringed or that the court's judgment is incorrect. The cassation decision can be challenged in court by either the convicted person or the prosecution if they believe it violates basic principles of fairness and legal certainty. However, the Constitutional Court can in its decision revoke the prosecutor's authority to submit a judicial review (PK) because it is considered contrary to human rights, especially in terms of recognition, guarantees, protection and fair legal certainty and equal treatment before the law. This study used a qualitative research method with a statutory and literature approach. The results of the study stated that it was very important for the prosecutor to have the right to submit a judicial review (PK) on the cassation decision of the Supreme Court which was deemed not to have fulfilled legal certainty and justice for the victim and the state. If this is omitted, it will cripple law enforcement. The reason for submission, guarantee, protection and legal certainty for the convict cannot be fully recognized, because there are still rights to guarantee, protection and legal certainty for the victim and the people of Indonesia which must also be maintained and respected.

Abstract

Constitutional law is characterized in a broad sense as the legal laws controlling state structures, the interaction between vertical and horizontal state instruments, and the position of citizens and their human rights. Nevertheless, there are variations in the techniques and methods of applying the state system, in addition to the standard regulations that serve as the state's fundamental standards. This study employed a qualitative research strategy with a comparative study design. According to the findings of the study, the aims of the constitutional law systems of many nations are comparable. In contrast, Indonesia's legal system is founded on Pancasila and the Constitution of 1945 and seeks fairness for all its citizens. In Indonesia, the constitutional legal system recognizes legal plurality, Islamic law, and customary law. This is not found in other countries legal systems.Keywords: Legal System; State Administration; Legal Comparison Abstract:Hukum Tata Negara dalam pengertian umum diartikan sebagai sekumpulan peraturan hukum yang mengatur organisasi dari negara, hubungan antar alat perlengkapan negara dalam garis vertikal dan horizontal, serta kedudukan warga negara dan hak-hak asasinya. Namum dalam aplikasinya, terdapat perbedaan cara dan metode pelaksanaan sistem bernegara, selain terikat pada aturan baku yang menjadi landasan utama sebagai norma dasar suatu negara. Metode penelitian yang digunakan pada penelitian ini adalah metode penelitian kualitatif dengan pendekatan comparative studies. Hasil penelitian menyatakan bahwa ada kesamaan tujuan pada sistem hukum tata negara pada beberapa negara. Namun pada negara Indonesia, sistem hukumnya berdasarkan Pancasila dan UUD 1945 serta mencita-citakan keadilan bagi seluruh rakyatnya. Sistem hukum tata negara di Indonesia mengakui adanya pluralisme hukum, hukum Islam, dan hukum adat. Abstract

Eradicating the culture of Corruption in people's lives cannot only be done by enforcing the Law, but also by having strong laws and also the courage and willingness of the authorities to apply these laws fairly and firmly. This study also aims to evaluate the effectiveness of criminal Law in dealing with criminal acts of Corruption and provide recommendations to improve weaknesses in the Indonesian criminal law system related to handling criminal acts of Corruption. The method used is a qualitative research method with a literature approach and a statutory approach. The results of the study state that there are weaknesses and challenges in enforcing the Law on Corruption in Indonesia. Therefore there must be government efforts to handle and prevent this criminal act of Corruption. Apart from building anti-corruption awareness so that Corruption does not become a culture in society.Keywords: Corruption Culture; Legal Substance; Legislation Abstrak:Pemberantasan budaya korupsi di dalam kehidupan masyarakat tidak hanya dapat dilakukan dengan penegakan hukum saja, namun juga harus memiliki undang-undang yang kuat dan juga keberanian serta kemauan dari pihak-pihak yang berwenang untuk menerapkan hukum tersebut secara adil dan tegas. Penelitian ini juga bertujuan untuk mengevaluasi efektivitas hukum pidana dalam menangani tindak pidana korupsi dan memberikan rekomendasi untuk memperbaiki kelemahan yang ada dalam sistem hukum pidana Indonesia terkait penanganan tindak pidana korupsi. Metode yang digunakan adalah metode penelitian kualitatif dengan pendekatan literatur dan pendekatan peraturan perundang-undangan. Hasil penelitian menyatakan bahwa ada kelemahan dan tantangan dalam penegakan hukum tindak pidana korupsi di Indonesia. Oleh karena itu harus ada upaya dari pemerintah dalam melakukan penanganan dan pencegahan tindak pidana korupsi tersebut. Selain harus membangun kesadaran anti-korupsi agar korupsi tidak menjadi budaya di masyarakat.Kata Kunci: Budaya Korupsi; Substansi Hukum; Peraturan Perundang-undangan

Abstract

The Covid-19 pandemic has emerged as a worldwide public health emergency, impacting millions of individuals globally. Indonesia, being among the nations with the highest case count in Southeast Asia, is facing a substantial repercussion from this pandemic. The objective of this study is to examine the chronology of the Covid-19 epidemic in Indonesia, including its origins and subsequent transmission, while also identifying the obstacles encountered in mitigating its impact. This study employs a qualitative methodology, mostly relying on literature analysis. Information was acquired from several sources including scholarly journals, government reports, and pertinent news stories. According to the research findings, Covid-19 has rapidly disseminated across Indonesia since the initial case was identified in early March 2020. However, the obstacles to resolving these issues encompass a scarcity of healthcare resources, political and administrative instability, as well as deficiencies in infrastructure and accessibility. However, the government and many stakeholders' endeavors provide optimism that Indonesia can effectively combat this pandemic in the future.Keywords: Covid-19; History; Challenge; Mitigation Efforts

Abstract

This study examines the legal status of foundations, the legal implications of foundation management exceeding its authority or failing to fulfill its duties, and the obstacles to enforcing the law against foundations that deviate from their obligations. The background of this study is based on the importance of foundations as non-profit legal entities in social, religious, and humanitarian activities. However, there are often deviations in management that are detrimental to the community and undermine the foundation's goals. The study employs a qualitative method, combining a literature-based approach with a normative legal approach. Data were obtained from a comprehensive literature study, encompassing legal literature, scientific journals, laws and regulations, as well as the opinions of legal experts. Law No. 28 of 2004 was analysed in a normative legal manner, focusing on the legal status of foundations and their legal implications. The results of the study indicate that Law No. 28 of 2004 provides legal protection for foundation assets, ensuring that they are used exclusively for social, religious, and humanitarian purposes. However, foundation management can be held personally liable if they abuse their authority or are negligent in their duties. The study also identified obstacles to enforcing the law against foundations that deviate, including weak government supervision, unclear authority between agencies, and a complex bureaucracy. This study emphasises the importance of strengthening effective regulation and oversight so that foundations can carry out their functions by the objectives of their establishment, providing legal certainty and optimal protection for both the community and the foundation itself.Keywords: Foundation; Legal Entity; Legal Status

Abstract

This study examines the legal implications of changes to the status of foundations as outlined in Law No. 28 of 2004, specifically regarding their social and educational activities in Indonesia. The purpose of this study is to analyse how changes in the status of foundations as legal entities affect their management, and to identify solutions that can optimise the role of foundations in the social and educational fields. This study employs a qualitative research method, incorporating a literature-based approach and legal analysis. Data were obtained from various sources, including scientific journals, legal literature, and relevant laws and regulations, which were analysed using a normative legal approach. The results of the study indicate that the changes regulated in Law No. 28 of 2004 provide a more substantial legal basis for foundations to carry out social and educational activities more accountably and transparently. However, there are challenges related to the management and supervision of foundations that must be faced, including the potential for abuse of authority by foundation administrators. This study suggests the need for strengthening regulations, more effective supervision, and the application of sound corporate governance principles to ensure that foundations play a maximum role in social and educational activities.Keywords: Legal Implications; Foundations; Social and Educational Activities: Changes in the Status of Foundations

Abstract

This study aims to analyse the legal status of foundations by Law No. 28 of 2004 and to examine the legal implications of the misuse of foundation functions between social and business interests. Foundations, as non-profit legal entities, play a strategic role in social and educational activities; however, in practice, there is a potential for the misuse of their functions for business activities that conflict with their social goals. This study employs a qualitative method, combining a literature and legislative approach, which analyses various legal sources and related provisions to explore the legal regulations surrounding foundations, their role in social and business activities, and the legal implications of a foundation deviating from its social goals. The results of the study indicate that although Law No. 28 of 2004 provides a clear legal basis for foundations, the practice of misusing foundation functions for business activities can still occur. Therefore, strict government supervision and adherence to the principles of transparency and accountability are necessary to ensure that foundations continue to operate in accordance with the social goals mandated by law.Keywords: Foundation; legal entity; Law No. 28 of 2004; social activities; business activities; legal implications

Abstract

Foundations, as non-profit legal entities, play a crucial role in supporting social, educational, religious, and humanitarian activities in Indonesia. However, in practice, many foundations still fail to carry out their organisational functions in accordance with applicable legal provisions. This study aims to analyse in depth the roles and tasks of trustees, Management, and Supervisors of foundations, as regulated in Law No. 28 of 2004, an amendment to Law No. 16 of 2001. It seeks to identify the causes of deviations and structural dysfunction in the management of foundations. This study employs a qualitative, juridical-normative, and empirical approach, utilising data collection techniques that include literature reviews and interviews with representatives from several foundations in Indonesia. The study's results indicate that a gap remains between legal norms and their implementation in the field, particularly in areas such as abuse of authority, conflicts of interest, and inadequate internal supervision systems within foundations. This is due to a lack of understanding of the role of each organ and suboptimal supervision by the Trustees and Supervisors. Therefore, efforts are needed to strengthen institutional and regulatory capacity, as well as legal education for foundation actors, to improve the governance and accountability of foundations sustainably.Keywords: Foundation; Trustees; Management; Supervisor; Law No. 28 of 2004; Non-Profit; Governance

Abstract

This study aims to analyze the legal implications of changes to the foundation's articles of association, based on the provisions of Law No. 28 of 2004, which amends Law No. 16 of 2001 concerning Foundations. This study employs a qualitative method with a normative legal approach, grounded in a comprehensive examination of laws and regulations, jurisprudence, and relevant scientific literature. The study's results indicate that changes to the foundation's articles of association have a direct impact on the legality of the foundation's organs, the validity of legal relations with third parties, and the potential for legal sanctions if the specified procedures are not followed. The provisions of Law Number 28 of 2004 emphasise the importance of an accountable and transparent organisational structure through a change mechanism that must be legally registered and approved. Failure to comply with this procedure can result in the cancellation of legal actions, the invalidity of deeds, and weaken the foundation's social function in society. Therefore, understanding and socialising the law to foundation administrators is an important step to prevent violations, while ensuring the sustainability of the foundation as a non-profit institution that serves the public interest.Keywords: Foundation; Articles of Association; Changes; Legal Implications; Law Number 28 of 2004
