Abstract

This article explores the shifting landscape of international arbitration, traditionally valued for its efficiency. Today, increased costs and prolonged dispute resolution processes change this perception. The article introduces the Calderbank offer, a strategic instrument from common law that promotes early settlement. By integrating civil law’s adversarial approach and practice to settle with settlement offer in common law, this concept aligns with peace theory and could enhance efficiency in BANI Arbitration Center. This instrument allows arbitral tribunals to impose cost penalties on parties who reject settlement offers and subsequently fail to achieve a more favorable award. In this research, the authors employ a normative juridical research method, utilizing literature review as the primary approach. This research indicates that adopting the Calderbank offer may encourage parties to objectively consider the settlement offer, potentially leading to a win-win solution. BANI Arbitration Center may adopt this instrument, as BANI Rules has included provisions on tribunal discretion in cost allocation.

Abstract

In the digital era, learning increasingly involves multimodal resources, yet explicit teaching of how images and texts contribute to meaning-making through digital storytelling remains underexplored. This study examines the integration of Systemic Functional Linguistics Genre-Based Pedagogy (SFL-GBA) into the teaching of multimodal narrative texts at a private senior high school. A case study was conducted with 28 tenth graders through a team-teaching approach involving an English teacher and a lecturer, with data collected from eight classroom observations. Findings reveal that SFL-GBA effectively supported multimodal learning: during the Building Knowledge of the Field (BKoF) and Modeling of the Text (MoT) stages, students analyzed Field, Tenor, and Mode across texts and images, while in the Joint and Independent Construction stages, they composed narrative texts and transformed them into digital storytelling projects. The study concludes that explicit scaffolding and culturally responsive teaching within SFL-GBA enhance students’ multimodal literacy and narrative competence through digital storytelling. These findings also have important pedagogical implications, indicating that SFL-GBA can guide teachers in designing multimodal instruction and inform future curriculum development for integrating digital storytelling.

Abstract

This study aims to identify waste in the 3 kg LPG delivery process at PT Nahatolu Miragas Prima and provide improvement proposals to improve distribution efficiency. The main problem is the delivery lead time that exceeds the estimated ideal time, causing delays to distribution partners. The method used is lean distribution with steps such as data collection of the distribution process, process flow mapping using Value Stream Mapping, and identification of waste based on 8 types of waste. Weighting was done through a questionnaire to determine the most dominant waste, followed by cause analysis using fishbone diagrams and formulation of improvement proposals using the 5W+1H approach. The results showed that the main wastes were in the waste activities of waiting, excess processing, and non-utilized talent. The application of future stream mapping shows the potential to significantly reduce distribution time by reducing the lead time of the distribution process from 732 minutes to 574 minutes. In conclusion, the lean distribution method is effectively used to identify and reduce waste in the LPG distribution flow by increasing the activity of the 3 Kg LPG distribution process by 21,5%.

Abstract

This study explores the violation of Grice’s Maxims in a sophomore online academic writing class and examines their implications for student–lecturer interaction dynamics. In the context of online learning, miscommunication is more likely due to the absence of physical cues and asynchronous communication patterns. Using a qualitative descriptive approach, data were collected through classroom observation and semi-structured interviews with one lecturer and three students selected via purposive sampling. Instances of maxim violations were identified and analyzed using thematic analysis based on Grice’s theoretical framework. The findings revealed that the most frequently violated maxims were Quantity and Manner, often due to vague, minimal, or hesitant student responses. Violations of Relevance and Quality also occurred, especially when responses were off-topic or lacked evidential support. Factors contributing to these violations included linguistic insecurity, abstract question formulation, technical disruptions, and limited non-verbal interaction. Interestingly, the lecturer sometimes intentionally flouted maxims to reduce student anxiety and facilitate participation. These findings highlight the complexity of digital communication and the importance of pragmatic awareness in virtual classrooms. The study underscores the need for adaptive pedagogical strategies that foster clarity, engagement, and mutual understanding. It also contributes to the broader discourse on online pragmatics by illustrating how maxim violations, while seemingly disruptive, can serve functional and pedagogical roles in shaping effective communication within digital academic environments.

Abstract

Purpose: This study aims to predict financial distress in transportation and logistics companies before, during, and after the Covid-19 pandemic. Research Methodology: A total of 23 transportation and logistics companies were selected as the research sample using purposive sampling method. Secondary data from audited financial statements for 2019–2023 were analyzed. Three financial ratios—Current Ratio (CR), Return on Assets (ROA), and Debt-to-Asset Ratio (DAR)—were used as input variables. An Artificial Neural Network (ANN) with a multilayer perceptron backpropagation algorithm was employed to train and test the prediction models. The best architecture was identified by comparing the model performance across variations in hidden neurons. Results: The results reveal that companies reported as financially distressed have lower average values for the three ratios than companies not experiencing financial distress, making them suitable input variables. The best artificial neural network architecture in this study included an input layer with 60 neurons, a hidden layer with 15 neurons, and an output layer with a single neuron. This architecture achieved a training performance mean square error (MSE) of 0.125004 and an R-value of 50.00%. The study's findings suggest that 12 companies are likely to experience financial distress. Conclusions: Financial ratios are effective indicators of distress, and ANN models can predict potential bankruptcy with a reasonable accuracy. Limitations: This study is limited to three financial ratios and a single sector, which may not fully capture the broader determinants of financial distress. Contribution: This study contributes to the financial distress prediction literature by applying ANN to transportation and logistics firms in Indonesia and offers practical tools for stakeholders to anticipate risks and design preventive strategies.
