Abstract

Pendaftaran Koperasi merupakan salah satu hal yang penting dilakukan oleh pendiri Koperasi untuk memperoleh status badan hukum. Hal ini mengingat jika badan usaha tidak disahkan oleh pemerintah dan tidak didaftarkan maka berdasarkan undang-undang yang berlaku, kedudukan Koperasi tidak bisa melakukan perbuatan hukum karena Koperasi belum berbadan hukum. Hal ini juga berdampak pada tidak terlindunginya hak para anggotanya. Pada praktiknya, tidak semua Koperasi memiliki akta pendirian termasuk belum didaftarkan, salah satunya Koperasi ABYAKTA. Sementara, Koperasi ini sudah berdiri sejak 2021 dan telah memiliki 20 orang anggota, anggota telah membayar simpanan pokok dan simpanan wajib. Oleh karena itu, penyuluhan ini penting dilakukan untuk memberikan edukasi bagi para pengurus dan anggota mengenai pentingnya dilakukan pendaftaran dan segera membuat akta pendirian untuk mendapatkan pengesahan dari Negara. Kegiatan penyuluhan diselenggarakan dalam bentuk sosialisasi dan diskusi terkait UU No. 25 Tahun 1992 khususnya mengenai tata cara pendirian dan prosedur pendaftaran Koperasi. Pada saat diskusi dan tanya jawab, para peserta sangat antusias dan memperoeh feedback yang positif, hal ini ditandai dengan tercapainya kesadaran peserta mengenai perlunya penyusunan akta pendirian Koperasi berikut penyusunan anggaran dasarnya. Dari kegiatan ini, akan ditindaklanjuti dengan pendampingan lebih lanjut, khususnya memberikan konsultasi informal dalam rangka percepatan pembuatan akta pendirian sekaligus pendaftaran Koperasi ABYAKTA

Abstract

Penyuluhan ini lebih mefokuskan pada upaya peningkatan pengetahuan dan kesadaran tentang bahaya penyalahgunaan narkoba di kalangan remaja dan upaya pencegahannya. Dengan target sasaran peserta adalah para siswa/I Kls.12 SMA Bunda Kandung. Pendekatan yang digunakan dalam bentuk sosialisasi dan pengambilan kuesioner kepada para siswa/i SMA. Dari pelaksanaan penyuluhan ini diharapkan akan dapat membentuk peer grup yang akan mentransformasikan kembali pengetahuan yang te telah diperoleh peserta kepada teman sebaya lainnya sehingga ada keberlanjutan informasi. Manfaat yang diperoleh dari kegiatan ini adalah meningkatkan pemahaman siswa/i terkait bahaya narkoba dan membangun kesadaran siswa/i untuk mencegah penyalahgunaan narkoba serta cara mencegahnya.

Abstract

One of the special aspects of Intellectual Property (IP) is Economic Rights, namely the right to obtain economic benefits from intellectual property. The creation of economic value shows that IP is one of the objects of trade that plays an important role in the development of a nation. As part of Intellectual Property, Geographical Indications are a trading tool that can provide benefits for producers, consumers, and the community in identifying products and providing quality assurance, avoiding fraudulent practices, helping the development of local producers, and supporting the preservation of nature and traditional knowledge. To carry out optimal IPR protection, a comparison needs to be made with practices that have been running so far, in this case a comparison will be made with practices in Malaysia. This research method uses a descriptive qualitative approach by collecting data from various sources. This research will use a conceptual/theoretical approach and a comparative approach. This research will determine the country's strategy to protect intellectual property in Indonesia and Malaysia and determine an effective model in protecting Geographical Indications. Thus, this research produces a deep understanding of the protection of Geographical Indications, highlighting the successes and challenges in increasing success related to intellectual property.

Abstract

Bankruptcy petitions in Indonesia are regulated under Article 2 paragraph (1) of Law No. 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (PKPU), which stipulates that a debtor may be declared bankrupt if they have at least two debts, one of which is due and collectible. However, this provision does not specify a minimum debt threshold as a requirement for bankruptcy, thereby creating a legal loophole that creditors may exploit by using bankruptcy as a mere debt collection tool. This raises concerns regarding the legal protection of debtors. This study aims to compare the bankruptcy laws of Indonesia and Malaysia, particularly with regard to the minimum debt amount requirement, and to evaluate whether the conditions for bankruptcy under the Indonesian Bankruptcy Law and PKPU provide legal certainty and adequate protection for debtors. The research employs a normative juridical method using statutory, conceptual, and comparative approaches. The findings indicate that the current provisions in Indonesia are no longer aligned with present-day needs and are prone to abuse. Unlike Malaysia, which stipulates a minimum debt amount, Indonesia has yet to regulate this matter explicitly. Therefore, a reformulation of Indonesia's bankruptcy law is necessary to ensure fairness, prevent misuse, and provide balanced legal protection for all parties, especially debtors.

Abstract

Globalization has increased the interest of Foreign Nationals (WNA) in owning property in various countries, whether for residential purposes, holidays, or investment. Indonesia and Malaysia, as two Southeast Asian nations, have different regulatory approaches regarding property ownership by WNA. This research aims to analyze the legal provisions, identify similarities and differences in regulations, and evaluate their impact on the investment climate and legal protection for WNA in both countries. The research method used is comparative law, focusing on the legal basis, forms of ownership, limitations, and legal protection. The findings indicate that Indonesia tends to be protective of land ownership by foreign parties, strictly regulated through the Basic Agrarian Law (UUPA) No. 5 of 1960, which limits WNA to Right of Use (Hak Pakai) and Right to Build (Hak Guna Bangunan/HGB) with limited durations. In contrast, Malaysia adopts a more liberal and pro-investment approach, allowing WNA to own property as freehold or leasehold based on the National Land Code 1965 and the Malaysia My Second Home (MM2H) program. The implications of these differences are that Indonesia's restrictive policies may reduce the attractiveness of foreign investment due to legal ambiguity and limitations in secondary transactions. Meanwhile, Malaysia offers greater legal certainty and economic appeal through freehold ownership, despite social risks such as rising property prices. This study concludes that Malaysia has a more foreigner-friendly system for property ownership, while Indonesia maintains a cautious principle. It is suggested that Indonesia consider agrarian reforms that are more transparent and provide legal certainty that balances national interests with foreign investment attractiveness.

Abstract

As countries located in the Asian region, Malaysia and Indonesia each have their own investment appeal. Over time, many investors have shown a stronger preference for investing in Malaysia rather than Indonesia. This phenomenon is influenced by various factors, making it a compelling subject of study. This research aims to examine the distinguishing factors in the investment appeal of Malaysia and Indonesia, particularly from the perspective of the positive legal systems in both countries. The objective of this study is to understand the legal regulations governing investment in Indonesia and Malaysia and to determine which regulatory framework is more attractive to investors. The research employs a normative juridical method using a comparative law approach. Data were collected from primary legal materials such as legislation and secondary sources such as books, journals, and previous studies through a literature review. The data were then analyzed descriptively and comparatively. The research findings indicate that Malaysia's investment regulatory framework is more attractive to investors compared to that of Indonesia. This is primarily due to the greater stability of Malaysia’s investment regulations and their relatively infrequent sudden changes. Furthermore, Malaysia’s legal system, which is based on common law, offers greater flexibility to foreign investors. The ease and stability of regulations in Malaysia make it a more preferred investment destination. These findings offer valuable input for the Indonesian government to improve its investment regulatory framework.

Abstract

To understand and analyze the legality concerning the use of artificial intelligence in commercial activities. To explore and analyze the legal certainty of advertising generated by artificial intelligence. This research also helps the author gain insight and firsthand knowledge on how AI-generated advertising is regulated under Indonesian law. Through this normative legal method, results will be obtained that align with practical applications. This will make the research more concrete and accountable for its authenticity and validity. Artificial intelligence technology is fundamentally developed by generating results through the input of big data or pre-existing data, which is then trained to produce the desired outcomes. Although the technology is created to ease human life, its development has led to complexities, particularly in relation to the law. One current debate centers on the copyright of works created by artificial intelligence (AI). This has become a polemic due to the illegal use of data for training purposes

Abstract

This research analyzes the legal development of Islamic banking in Indonesia and Malaysia through a comparative law approach. Islamic banking has become an important component of the global financial system, yet its growth varies across countries. Indonesia's Islamic banking industry, while experiencing significant progress in recent years, still faces regulatory and institutional challenges. In contrast, Malaysia has emerged as a global hub for Islamic finance due to its integrated regulatory framework, strong government support, centralized Shariah compliance system, and established human resource development. This study employs normative legal research using primary and secondary legal sources, and applies comparative legal theory. The findings highlight the importance of legal harmonization, centralization of fatwa authorities, active government involvement, and comprehensive infrastructure development in supporting the growth of Islamic banking. Lessons from Malaysia's experience can serve as valuable references for Indonesia to enhance its Islamic banking industry and improve its competitiveness in the global market.

Abstract

This study discusses the comparison of green economic policies implemented between Indonesia and Malaysia in supporting inclusive sustainable national development, which is examined normatively through a comparative study approach. Indonesia, through Law No. 30 of 2007 on Energy, Law No. 21 of 2014 on Geothermal Energy, and other regulations, has established a national green program encompassing environmental quality improvement, disaster resilience and climate change mitigation, low-carbon development, and renewable energy development as pillars of national development. Meanwhile, Malaysia's National Energy Policy 2022-2040 and other regulations stipulate that a green economy can be achieved through economic development, the utilization of sustainable energy resources, and environmental quality. Research findings indicate that Indonesia has not maximized the implementation of a green economy due to the ease of business permits granted to investors and limited regulations within specific scopes, while Malaysia has established more complex regulations regarding green investments, ensuring that permits are not issued arbitrarily.

Abstract

As an agricultural country, farmers in Indonesia have a crucial role, their existence must be safeguarded within the agricultural sector. Encouraging farmers to engage in breeding or develop new superior plant varieties is essential for fostering independent and advanced Indonesian farmers. These breeding activities are governed by Law Number 22 of 2019 on Sustainable Agricultural Cultivation System, and Law Number 29 of 2000 Plant Variety Protection. However, these laws have led to challenges for farmers involved in breeding, as the Plant Variety Protection Law adopts liberal approach that prioritizes individual economic benefits and specifically protects breeders who have registered their new varieties. As a result, farmers who use traditional knowledge in their breeding practices are vulnerable to criminalization due to the registration system. This paper will examine the rights of farmers in breeding activities under Indonesian law and compare with regulations in Malaysia, which shares geographical proximity, customs, and membership in the World Trade Organization. The research method is normative legal research, utilizing both conceptual and comparative approach. The objective to explore the legal protection of farmers’ rights in breeding activities in both Indonesia and Malaysia, and provide recommendations for improving the protection of farmers' rights in the future.
