Abstract

To understand and analyze the legality concerning the use of artificial intelligence in commercial activities. To explore and analyze the legal certainty of advertising generated by artificial intelligence. This research also helps the author gain insight and firsthand knowledge on how AI-generated advertising is regulated under Indonesian law. Through this normative legal method, results will be obtained that align with practical applications. This will make the research more concrete and accountable for its authenticity and validity. Artificial intelligence technology is fundamentally developed by generating results through the input of big data or pre-existing data, which is then trained to produce the desired outcomes. Although the technology is created to ease human life, its development has led to complexities, particularly in relation to the law. One current debate centers on the copyright of works created by artificial intelligence (AI). This has become a polemic due to the illegal use of data for training purposes

Abstract

This research analyzes the legal development of Islamic banking in Indonesia and Malaysia through a comparative law approach. Islamic banking has become an important component of the global financial system, yet its growth varies across countries. Indonesia's Islamic banking industry, while experiencing significant progress in recent years, still faces regulatory and institutional challenges. In contrast, Malaysia has emerged as a global hub for Islamic finance due to its integrated regulatory framework, strong government support, centralized Shariah compliance system, and established human resource development. This study employs normative legal research using primary and secondary legal sources, and applies comparative legal theory. The findings highlight the importance of legal harmonization, centralization of fatwa authorities, active government involvement, and comprehensive infrastructure development in supporting the growth of Islamic banking. Lessons from Malaysia's experience can serve as valuable references for Indonesia to enhance its Islamic banking industry and improve its competitiveness in the global market.

Abstract

This study discusses the comparison of green economic policies implemented between Indonesia and Malaysia in supporting inclusive sustainable national development, which is examined normatively through a comparative study approach. Indonesia, through Law No. 30 of 2007 on Energy, Law No. 21 of 2014 on Geothermal Energy, and other regulations, has established a national green program encompassing environmental quality improvement, disaster resilience and climate change mitigation, low-carbon development, and renewable energy development as pillars of national development. Meanwhile, Malaysia's National Energy Policy 2022-2040 and other regulations stipulate that a green economy can be achieved through economic development, the utilization of sustainable energy resources, and environmental quality. Research findings indicate that Indonesia has not maximized the implementation of a green economy due to the ease of business permits granted to investors and limited regulations within specific scopes, while Malaysia has established more complex regulations regarding green investments, ensuring that permits are not issued arbitrarily.

Abstract

As an agricultural country, farmers in Indonesia have a crucial role, their existence must be safeguarded within the agricultural sector. Encouraging farmers to engage in breeding or develop new superior plant varieties is essential for fostering independent and advanced Indonesian farmers. These breeding activities are governed by Law Number 22 of 2019 on Sustainable Agricultural Cultivation System, and Law Number 29 of 2000 Plant Variety Protection. However, these laws have led to challenges for farmers involved in breeding, as the Plant Variety Protection Law adopts liberal approach that prioritizes individual economic benefits and specifically protects breeders who have registered their new varieties. As a result, farmers who use traditional knowledge in their breeding practices are vulnerable to criminalization due to the registration system. This paper will examine the rights of farmers in breeding activities under Indonesian law and compare with regulations in Malaysia, which shares geographical proximity, customs, and membership in the World Trade Organization. The research method is normative legal research, utilizing both conceptual and comparative approach. The objective to explore the legal protection of farmers’ rights in breeding activities in both Indonesia and Malaysia, and provide recommendations for improving the protection of farmers' rights in the future.

Abstract

Phishing is a digital crime that targets victims’ sensitive information or data via email, social media posts, or text messages. This research on phishing focuses on the criminal law policies regulated in Indonesia and Malaysia as a preventive effort against phishing. In order to examine these issues, this study employs a normative research method with a statute-based approach, a conceptual approach, and a comparative approach. The legal comparison is conducted on personal data protection regulations applicable in Indonesia and Malaysia, namely Indonesia’s Law No. 27 of 2022 on Personal Data Protection (UU PDP) and Malaysia’s Personal Data Protection Act (PDPA) 2010 (Act 709) as amended by the Personal Data Protection (Amendment) Act 2024 (Act A1727). The objectives of this study are to analyze the criminal policies of Indonesia and Malaysia in addressing phishing crimes and to identify gaps in existing regulations. The findings indicate that criminal sanctions under personal data protection law in Indonesia are more severe than in Malaysia. Violations of the Indonesian PDP Law carry a maximum prison sentence of 4 to 6 years and a fine between IDR 4,000,000,000 and IDR 6,000,000,000. In contrast, Malaysia stipulates lighter criminal sanctions, with a maximum prison term of 1 to 3 years, and the 2024 amendments to the PDPA (Act A1727) impose a maximum fine of RM 1 million. Moving forward, policy responses to address phishing crimes must emphasize three key aspects: first, institutional strengthening of the body responsible for enforcing personal data protection in Indonesia; second, enhanced international cooperation in law enforcement; and third, the establishment of victim protection mechanisms through compensation frameworks. Abstrak: Phishing adalah kejahatan digital yang menargetkan informasi atau data sensitif korban melalui email, unggahan media sosial, atau pesan teks. Penelitian tentang phising ini difokuskan pada kebijakan hukum pidana yang diatur di Indonesia dan Malaysia sebagai upaya pencegahan phising. Dalam rangka mengkaji mengenai hal tersebut penelitian ini menggunakan metode penelitian normatif dengan pendekatan perundang- undangan (statute approach), pendekatan konsep (conseptual approach), dan pendekatan perbandingan. Perbandingan hukum dilakukan pada regulasi perlindungan data pribadi yang berlaku di Indonesia dan Malaysia yaitu dalam UU Undang-Undang No. 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP) dan Personal Data Protection Act (PDPA) 2010 (Act 709) serta Akta A1727 Akta Perlindungan Data Peribadi (Pindaan) 2024. Tujuan dari penelitan ini untuk menganalisis kebijakan kriminal Indonesia dan Malaysia dalam menanggulangi tindak pidana phising. Selain itu, untuk mengidentifikasi kesenjangan dalam regulasi yang ada. Hasil penelitian menemukan sanksi pidana dalam undang-undang perlindungan pribadi di Indonesia lebih tinggi daripada di Malaysia. Sanksi pidana terhadap pelanggaran UU PDP adalah penjara maksimum 4 s.d.6 tahun dan denda maksimum antara Rp4.000.000.000,-s.d. Rp6.000.000.000,-. Malaysia mengatur sanksi pidana yang lebih rendah yaitu maksimum 1 s.d. 3 tahun, sedangkan berdasarkan Amandemen Personal Data Protection Act (PDPA) 2010 (Act 709) tahun 2024 yang tercantum Akta A1727 Akta Perlindungan Data Peribadi (Pindaan) 2024 pidana denda menjadi RM 1 Juta. Kebijakan dalam penanggulangan tindak pidana phishing pada masa yang akan datang perlu menekankan pada tiga aspek yaitu, kelembagaan yang bertanggung jawab dalam pelaksanaan perlindungan data pribadi di Indonesia, kerjasama Internasional dalam penegakkan hukum, dan mekanisme perlindungan korban melalui ganti rugi. Abstract

This research aims to analyze the optimization of legal protection and risk mitigation for PT ASDP Indonesia Ferry (Persero) as the lender in a Shareholder Loan (SHL) Agreement with PT Indonesia Ferry Properti, and to examine the legal implications of the PT ASDP directors' liability in the SHL decision-making process. The research method employed is normative juridical with a literature study approach. The findings indicate that although the SHL execution has procedurally met legal principles and Good Corporate Governance (GCG), the optimization of legal protection for PT ASDP requires the enhancement of more proactive post-disbursement fund supervision clauses and, crucially, the implementation of specific collateral to mitigate credit risk, considering the current agreement is still reactive and lacks specific collateral. Furthermore, the directors of PT ASDP bear responsibilities under Article 97 of the Company Law and the principle of fiduciary duty. The Business Judgment Rule (BJR) doctrine can shield directors from personal liability if decisions are made in good faith, with due care, without conflicts of interest, and accompanied by risk mitigation efforts, wherein the implementation of GCG principles is fundamental. Violations may lead to civil, criminal, or administrative liability. This research concludes the importance of contractual strengthening of the SHL and strict adherence to GCG to protect company assets and directors.

Abstract

The development of the global financial system has encouraged various countries to adopt bullion banks as an alternative to the gold-based financial system. However, in Indonesia, the concept of bullion banks is still relatively new and does not yet have a clear legal framework. This study aims to examine the need for bullion bank regulation in Indonesia and to assess the suitability of the national legal framework with international practices. The method used is normative juridical with a statutory approach and comparative studies. The results of the study show that Indonesia does not yet have specific regulations regarding bullion banks, which has the potential to cause legal uncertainty for business actors and investors. Therefore, it is necessary to formulate comprehensive regulations to regulate bullion bank activities specifically to support the stability of the national financial system. This study recommends that policy makers immediately formulate regulations related to bullion banks by referring to best practices in other countries.

Abstract

Agrarian conflicts in Indonesia are structural issues rooted in the unequal distribution and ownership of land. This study examines the dynamics of agrarian conflict in Central Kalimantan, particularly related to the expansion of oil palm plantations and its impact on local land ownership structures. Using a juridical-sociological approach and a case study method, the research finds that the implementation of the Basic Agrarian Law (UUPA) has not yet fully realized the principles of social justice in agrarian resource management. The disparity in land ownership between corporations and indigenous communities is identified as a major trigger for prolonged conflict. This study recommends the enforcement of the core principles of the UUPA and the strengthening of indigenous land rights within national agrarian policy.

Abstract

This study explores establishing a legal entity as a representative body for participants in Islamic insurance, in light of current Indonesian regulations and the fatwas and guidelines issued by the National Sharia Board of the Indonesian Council of Ulama (DSN-MUI). Using a normative juridical method with statutory, comparative, and conceptual approaches, this research draws on primary legal materials—including statutory laws and DSN-MUI fatwas—and secondary sources such as scholarly literature and credible legal documents. The proposed legal entity aims to represent the collective ownership of Islamic insurance participants. It suggests forming an internal body comprised of participant representatives from various regions, modeled after the Badan Perwakilan Anggota (Member Representative Body) in mutual insurance. This initiative is intended to enhance participant rights and address conflicts of interest arising from Islamic insurance companies' dual role as both fund managers and supervisors. Despite its potential, forming such an internal legal body faces practical and legal obstacles, including financing issues, representative selection criteria, operational efficiency, and the absence of specific regulatory support. Furthermore, the existing authority of the Sharia Supervisory Board (DPS) is limited to Sharia compliance oversight. As a viable alternative, appointing an Independent Commissioner to represent participants is recommended. This solution is grounded in existing laws, such as the Company Law, Insurance Law, UUP2SK, and relevant OJK regulations. It can be enhanced by establishing a Dana Tabarru’ Funds committee under Article 121(1) of the Company Law to ensure stronger accountability and protection of participants’ interests.

Abstract

This research aims to determine whether the budget formulation of the Merah Putih Village Cooperative is in accordance with the norms and statutory regulations as stipulated in Law Number 25 of 1992 concerning Cooperatives, particularly in relation to Article 33 paragraph (4) of the 1945 Constitution, which emphasizes the principle of independence in the national economy. The results of this study focus on optimizing the establishment of the Merah Putih Village Cooperative to support the formation of national-scale cooperatives that function not only as savings and loan institutions driving the economy, but also address the challenges and risks that may arise from the establishment of the Merah Putih Cooperative. First, the issue of economic scale is crucial. Operations at the village level are often limited by available resources and market reach. Second, human resource capacity is a determining factor. The management of funds amounting to IDR 3–5 billion requires financial, business, operational, and marketing management skills that are not always present in every village. Experience with Village-Owned Enterprises (BUMDes) shows that one of their main challenges is finding local residents who are truly skilled managers. Third, elite capture or control by local elites can become a bottleneck. In villages with weak governance, influential figures may abuse their authority to control the cooperative for personal gain. Similar occurrences are often found in grant programs from Ministries/Agencies or the private sector, where key individuals dominate and exploit these resources for their own interests. Fourth, the risk of fraud.
