Abstract

The development of information technology has transformed the way people engage in economic activities, including the conduct of online arisan (rotating savings groups). Online arisan represents an electronic agreement between parties that does not require written documentation but still establishes legally binding rights and obligations. This study aims to analyze and compare the legal regulations governing online arisan agreements in Indonesia and Malaysia, using Decision No. 106/Pdt.G/2017/PN Palangka Raya as a case study. The research employs a normative legal method with statutory, case, and comparative approaches. The results show that in Indonesia, online arisan agreements are considered valid as long as they fulfill the requirements stipulated in Article 1320 of the Indonesian Civil Code and are carried out in accordance with the principles of freedom of contract, good faith, and pacta sunt servanda. Meanwhile, in Malaysia, online arisan activities, also known as kumpulan wang kutu, are regulated under several laws, including the Contracts Act 1950, the Electronic Commerce Act 2006, and the Kumpulan Wang Kutu (Prohibition) Act 1971. This study concludes that Indonesia emphasizes contractual freedom and legal validity, while Malaysia prioritizes consumer protection through strict prohibition, reflecting fundamentally different regulatory approaches to online collective financial arrangements.

Abstract

The rapid growth of the skincare industry in Indonesia has not always been accompanied by adequate compliance with consumer protection laws. One prominent issue is the case of White Tomato products marketed by Dr. Richard Lee, where discrepancies were found between the information on the label and the actual composition of the product, including allegations of relabeling practices that could potentially cause harm to consumers. This study aims to analyze the legal responsibility of business actors for losses arising from such actions and to examine the legal remedies available to consumers. Using a normative juridical method, this study applies a legislative approach and a case approach through a review of relevant regulations and administrative actions issued by the Indonesian Food and Drug Administration (BPOM). The results of the study show that these practices violate the provisions of Law Number 8 of 1999 concerning Consumer Protection, specifically Articles 4, 7, and 8, because they do not provide accurate and clear product information to consumers. Business operators may be held civilly liable under Article 19 of the Consumer Protection Law and Article 1365 of the Civil Code, and may be subject to administrative and criminal sanctions under Articles 61 and 62 of the Consumer Protection Law. Consumers can pursue legal remedies through civil litigation, administrative complaints to the BPOM, or alternative dispute resolution through the BPSK. This study highlights the importance of strict compliance with honest product information and emphasizes the need for stricter regulatory oversight to ensure consumer protection and legal certainty.

Abstract

This study focuses on the main issues including the proof of girik arrangement in land acquisition disputes. The purpose of this study is to determine how the judge's considerations regarding the status of girik arrangement on evidence of land ownership and the process of proving girik in land disputes in the Tangerang District Court Decision Number 907/Pdt. G/2018/PN Tng. The method used in this study uses a normative legal method with a case approach and a statue approach to analyze various appropriate problems. The findings state that the validity of the arrangement of girik C No. 157 plot 96D covering an area of 2980 m2 in the name of Margawi as proof of land ownership in the Tangerang District Court Decision Number 907/Pdt. G/2018/PN Tng is proven by the history of the land and must go through a land ownership verification process. Initially, girik land was ownership of customary land, so in carrying out girik proof, verification must be carried out by inspection by the local Land Office or the Village Head.

Abstract

Land is a vital natural resource for human life, necessitating adequate legal protection regarding land rights. One mechanism for transferring land rights is through the Sale and Purchase Binding Agreement (PPJB), often used in property transactions such as houses or other real estate. However, in practice, legal issues frequently arise regarding buyer protection, particularly in cases of default. This study aims to analyse the acquisition of ownership rights in house sale and purchase transactions, as exemplified by the Bekasi District Court Decision Number 124/Pdt.G/2020/Pn Bks. Using a normative juridical method with statute approach and case approach, this research examines relevant regulations and their application to the transfer of rights in property transactions. The findings reveal that the court's considerations in this case were inconsistent with Article 22L Paragraph (4) of Government Regulation No. 12 of 2021. Therefore, more equitable legal protection is necessary, referring to the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945), to ensure optimal protection for all parties involved in property sale and purchase transactions.

Abstract

Abuse of position through extortion constitutes a form of power misuse that significantly undermines public integrity and trust in government. This study aims to analyze the regulation of extortion in office within the legal systems of Indonesia and Singapore, and to compare the criminal policies of both countries. The research employs a normative legal approach with doctrinal and comparative methods, examining legislation, jurisprudence, and relevant legal literature. The findings indicate that Indonesia emphasizes the elements of abuse of power and coercion as a formal offense under Article 12 letter e of the Corruption Eradication Law (UU Tipikor), whereas Singapore focuses on corrupt intent and the receipt of gratification under the Prevention of Corruption Act (PCA) 1960, without requiring coercion. In terms of criminal policy, Indonesia predominantly applies a repressive penal approach, while Singapore implements an integrated penal and non-penal strategy, emphasizing prevention, integrity development, and transparency in public administration. These findings highlight the necessity for legal and criminal policy reform in Indonesia through the strengthening of non-penal mechanisms, regulatory harmonization, and enhanced anti-corruption institutions, so that criminal law can function as ultimum remedium in safeguarding the integrity of public office

Abstract

This research analyzes the legal policy and validity of appointing former directors of bankrupt companies to the boards of State-Owned Enterprises (SOEs) under the principles of Good Corporate Governance (GCG). Utilizing a normative legal research method with statutory and case study approaches, the study specifically examines the appointment of Sigit Winarto as Director of PT JIEP following the bankruptcy of PT Istaka Karya. The findings demonstrate that such an appointment explicitly violates Article 93 of the Company Law in conjunction with Article 15 of the SOE Law, as it transpired within the mandatory five-year prohibition period without valid judicial rehabilitation. Consequently, the appointment is void ab initio due to substantive legal defects and contravenes the GCG principles of responsibility and accountability. Therefore, rigorous enforcement of administrative sanctions against the appointing authorities is imperative to safeguard the integrity of state asset management and to ensure legal certainty and public trust in the professionalism of SOE governance in Indonesia.

Abstract

Pendidikan di Indonesia masih menghadapi ketimpangan yang signifikan, terutama dalam hal akses dan kualitas pendidikan di daerah terpencil dan bagi kelompok sosial-ekonomi rendah. Kebijakan “Merdeka Belajar” meskipun menawarkan fleksibilitas, belum mampu mengatasi ketidakadilan struktural yang mengakar dalam sistem pendidikan. Penelitian ini membahas dampak kebijakan “merdeka belajar” terhadap akses pendidikan dan ketimpangan sosial-ekonomi di indonesia serta peran kurikulum demokratis dalam membentuk individu kritis dan menantang hegemoni sistem pendidikan yang menindas. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis kualitatif terhadap kebijakan pendidikan dan penerapannya dalam konteks sosial. Hasil pembahasan menunjukkan bahwa kampus merdeka yang diciptakan kala pandemi masih menyisakan dampak ketimpangan sosial sekalipun pandemi telah selesai. Hal tersebut dikarenakan kurikulum yang ada saat ini cenderung terpusat dan kurang melibatkan partisipasi siswa, serta tidak cukup mendukung pengembangan pemikiran kritis untuk menanggapi ketidakadilan sosial. Selain itu, kebebasan akademik dan partisipasi kolektif dalam penyusunan kurikulum juga masih cenderung terbatas, meskipun diamanatkan oleh undang-undang. Kesimpulannya, sistem pendidikan Indonesia masih perlu diperbaiki untuk menciptakan pendidikan yang lebih demokratis dan inklusif. Saran yang diberikan adalah agar pemerintah dan institusi pendidikan lebih melibatkan semua aktor pendidikan dalam penyusunan kurikulum serta memastikan kebebasan akademik yang dijamin oleh hukum.
