Abstract

Penelitian ini membahas tentang masalah mengenai masyarakat hukum adat terutama hak mengusai terhadap tanah adat atau yang dikenal dengan sebutan Hak Ulayat. Hal tersebut bisa saja terjadi apabila negara dan masyarakat tidak selaras dalam memenuhi kewenangan dan kewajibannya dalam hak menguasai tanah yang berdampak pada pemanfaatan sumber dayanya. Penelitian ini difokuskan menganalisis Putusan MK bagi masyarakat hukum adat terhadap perubahan pada Undang-Undang Nomor 41 Tahun 1999. Metode penelitian yang penulis gunakan adalah Yuridis Normatif dan mempergunakan pendekatan perundang-undangan (statute approach). Selain itu juga digunakan pendekatan kasus yang digunakan untuk mengetahui ratio decidendi yang digunakan oleh Hakim Mahkamah Konstitusi dalam memutus perkara pengujian undang-undang yang terkait dengan masyarakat hukum adat. Hasil dari penelitian ini adalah menampilkan hasil kepastian hukum bagi   hak masyarakat hukum adat dalam menguasai wilayah ulayatnya dalam pengelolaan dan pemanfaatanya yang dikuasai oleh Negara dengan mengkaji Putusan Mahkamah Konstitusi atas perubahan Undang-Undang Kehutanan sehingga negara tidak ditempatkan sebagai pemilik tanah, melainkan hanya sebagai penguasa yang berwenang mengatur dan mengurus tanah dapat menjalankan kewenangannya terhadap masyarakat hukum adat di Indonesia.

Abstract

Penelitian ini bertujuan untuk menginvestigasi penggunaan hukum Tiongkok dalam penyelesaian sengketa bisnis internasional melalui studi kasus pada perjanjian kontrak antar-negara. Penulis melakukan analisis mendalam terhadap beberapa kasus di mana perusahaan asing mengalami sengketa hukum dengan perusahaan Tiongkok dalam konteks kontrak bisnis internasional. Penelitian ini mengeksplorasi bagaimana pengadilan Tiongkok dan arbitrasi internasional digunakan dalam penyelesaian sengketa, serta sejauh mana hukum Tiongkok diterapkan dalam proses tersebut. Penelitian ini berpotensi memberikan wawasan yang berharga kepada praktisi hukum bisnis internasional dan pengusaha yang terlibat dalam transaksi dengan perusahaan Tiongkok, serta bagi mereka yang tertarik pada perkembangan hukum Tiongkok dalam konteks global.

Abstract

The right holder of a trademark has full validity to use his own trademark or license it to other parties, including delisting of its own trademark. Delisting of a mark could be done by the owner of the relevant mark, based on initiative of the minister or third party’s interest. Hongyunhonghe Tobacco (Group) Co. Ltd. (Plaintiff) has filed a lawsuit for the delisting of registered WIN trademark owned by PT Sumatra Tobacco Trading Company (Defendant). The issues raised are how the legal arrangements for the delisting of trademarks by third party’s interested and the suitability of the application of the law in Decision Number 45/Pdt.Sus-HKI/Merek/2023/PN.Niaga.Jkt.Pstreviewed based on the applicable trademark rules. Normative juridical research type through a statutory study approach and literature study-based data collection. Qualitative data analysis with prescriptive nature. The provisions of Article 74 paragraph (1) jo. Article 85 of the Trademark Law regulates the delisting of registered trademarks filed third party’s interested in the form of a lawsuit to the Chairman of the Central Jakarta Commercial Court. The application of the law applied in the decision is erroneous and states the Plaintiff is not interested. Law enforcement is one of the factors that affect the effectiveness and utilities of the law for the community. Trademarks that have been obtained should be used as well as possible in accordance with the term of protection, so as not to cause a gap for other parties to conduct the delisting of registered trademarks.

Abstract

This study analyzes the impact of Government Regulation in Lieu of Law (Perppu) No. 2 Year 2022 on Job Creation, particularly in the plantation sector, on the rights of Masyarakat Hukum Adat (MHA). The initial purpose of this Perppu was to increase investment through simplification of regulations and acceleration of licensing, but the formulation of existing norms and regulations can threaten the existence of MHA. This research is a normative research and uses a legislative approach by analyzing primary and secondary legal materials, and using John Rawls' Theory of Justice and Mochtar Kusumaatmadja's Theory of Development Law. The results show that there are significant changes in the application of Perppu No. 2 Year 2022 on Job Creation compared to Law No. 34 Year 2014 on Plantations, including changes in land area limitations, elimination of environmental permits, and elimination of criminal sanctions related to permits and the environment. The implications of the implementation of this Perppu are that it exacerbates the marginalization of Indigenous Peoples, ignores customary rights, and causes overlapping land tenure, as well as ecosystem and environmental damage. This research suggests several strategic steps: accelerating the inventory of customary land and the granting of customary rights certificates, requiring MHA to be involved in every stage of decision-making through FPIC mechanisms, and passing a special law for MHA. Investment policies should also focus on sustainable development with stricter environmental standards than at present.

Abstract

In the process of forming a law or legislation, the DPD does not have the power to decide or play a role in the decision-making process at all. Even though there are support requirements to become a member of the DPR. This means that the quality of the legitimacy of DPD members is not at all balanced by the quality of their authority as representatives of the regional people. The aim of this research is to analyze the function and authority of the Regional Representative Council in the Structural Institution of the Republic of Indonesia State Legislative Institution and how to optimize the function and legislative authority of the Regional Representative Council. The type of research we use is normative legal research, namely research carried out by examining the body of literature or secondary data. Strengthening the authority of the DPD by consistently incorporating the Constitutional Court's decisions into statutory regulations and other regulations under it. This is being done pending the issuance of the fifth amendment to the 1945 Constitution. The current revision of the MD3 Law has not yet adopted the authority of the DPD in accordance with the Constitutional Court's decision. The need for the fifth amendment is to reorganize the function of legislation firmly and clearly in the 1945 Constitution, because by reorganizing the function of legislation it will touch all institutions, including the DPR, DPD, President and other institutions.

Abstract

The purpose of this study is to determine the best principles for children in determining child custody, as well as to determine the legal considerations decided by the judge in determining child custody. This study is motivated by the number of divorce cases in Indonesia and the many children who become victims of conflict or parents. This study focuses on examining the best interests of children and legal considerations for judges in determining child custody arrangements due to divorce. This study uses a normative legal method with a case approach (Case Approach) and a statutory approach (Statute Approach), as well as library research data collection techniques. Custody is in line with the basic principles in Indonesian state regulations, namely the principle of the best interests of children. The results of this study indicate the provisions of Article 105 and Article 156 of the Compilation of Islamic Law. Article 105 of the Compilation of Islamic Law, explains that the provisions of the law on child custody which automatically grant custody to the mother, must be interpreted contextually. The main parameter that must be used as a reference is the best interests of the child. If the best interests of the child are not realized, then Article 105 of the Compilation of Islamic Law must be set aside and the judge must be guided by the best interests of the child. Although Article 105 of the Compilation of Islamic Law grants custody to the mother, the panel of judges also considers the father's ability and readiness to care for the child. The panel of judges decided to divide custody proportionally. For younger children, who still need intensive attention, custody is given to the mother. However, for older children, who are more emotionally stable, custody is given to the father. The panel of judges considered that this was the best solution to ensure the welfare of both children.

Abstract

The "valid" requirement in making an agreement aims to have binding legal force and provide legal certainty for the parties. In accordance with Article 1457 of the Civil Code, a sale and purchase agreement is an agreement between a seller and a buyer. The seller is obliged to hand over the goods that are the object of the sale and purchase to the buyer, while the buyer is obliged to pay the price agreed upon by both parties. This agreement clearly regulates the rights and obligations of both parties. The purpose of this study is to determine the Legal Consequences Related to Buyers Who Do Not Complete the Land Sale and Purchase Deed Process (Case Study of Supreme Court Decision Number 120 K/Pdt/2016). The research method used is normative legal research. The conclusion of this study is that there are cases where buyers feel that they have transferred land rights in a sale and purchase transaction that is carried out only based on PPJB, as stated in the DecisionSupreme Court Number 120 K/Pdt/2016 in this case the buyer is not direct convert PPJB to AJB. This has been clearly regulated in Article 4 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration, which in essence explains: by registering land will provide legal certainty and legal protection to land rights holders. Furthermorein accordance with Article 19 paragraph 2 letter (c) of the Basic Agrarian Law, states that the certificate functions as a strong means of proof.

Abstract

Law No. 2 of 2012 concerning Land Acquisition for Public Interest is carried out with the aim of providing land for development for the public interest by terminating the legal relationship between land rights holders and their land rights by providing appropriate compensation. And its implementing regulations are regulated in Presidential Regulation Number 71 of 2012. In the implementation of the Land Acquisition process, there are often obstacles in the process or become legal and social conflicts between land owners and institutions that need land. On this basis, the study aims to determine the process of providing land compensation that meets the principles of the Land Acquisition Law and this study is expected to be able to be used as a reference if similar problems occur. The method used in this study is Normative Jurisprudence, with a Statute Approach that is relevant to the Land Acquisition Law.The results of the study indicate that land acquisition for public interest as regulated in the Land Acquisition Law aims to create justice between the rights of land owners and the needs of national development. This process involves providing fair compensation, including physical and non-physical compensation, while taking into account the socio-economic balance of land owners. However, in its implementation, conflicts often arise related to the legitimacy of ownership and community resistance. This study emphasizes the importance of deliberation and dignified compensation mechanisms to maintain socio-economic stability. The conclusion of the research isCompensation is carried out transparently and through deliberation, taking into account the balance between landowner rights and development needs. The form of compensation includes physical and non-physical, aiming to maintain the socio-economic stability of landowners while supporting national development and protecting the rights of all parties in need.

Abstract

This study focuses on the main issues including the proof of girik arrangement in land acquisition disputes. The purpose of this study is to determine how the judge's considerations regarding the status of girik arrangement on evidence of land ownership and the process of proving girik in land disputes in the Tangerang District Court Decision Number 907/Pdt. G/2018/PN Tng. The method used in this study uses a normative legal method with a case approach and a statue approach to analyze various appropriate problems. The findings state that the validity of the arrangement of girik C No. 157 plot 96D covering an area of 2980 m2 in the name of Margawi as proof of land ownership in the Tangerang District Court Decision Number 907/Pdt. G/2018/PN Tng is proven by the history of the land and must go through a land ownership verification process. Initially, girik land was ownership of customary land, so in carrying out girik proof, verification must be carried out by inspection by the local Land Office or the Village Head.

Abstract

Land is a vital natural resource for human life, necessitating adequate legal protection regarding land rights. One mechanism for transferring land rights is through the Sale and Purchase Binding Agreement (PPJB), often used in property transactions such as houses or other real estate. However, in practice, legal issues frequently arise regarding buyer protection, particularly in cases of default. This study aims to analyse the acquisition of ownership rights in house sale and purchase transactions, as exemplified by the Bekasi District Court Decision Number 124/Pdt.G/2020/Pn Bks. Using a normative juridical method with statute approach and case approach, this research examines relevant regulations and their application to the transfer of rights in property transactions. The findings reveal that the court's considerations in this case were inconsistent with Article 22L Paragraph (4) of Government Regulation No. 12 of 2021. Therefore, more equitable legal protection is necessary, referring to the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945), to ensure optimal protection for all parties involved in property sale and purchase transactions.
