Abstract

The Build Operate Transfer (BOT) scheme has become the primary choice for governments in financing infrastructure due to its significant benefits for both the government and the private sector. However, there are often associated problems and risks, especially regarding unilateral contract cancellations. Hence, legal protection for the parties involved in BOT contracts is crucial due to the substantial investments in long-term infrastructure projects. The type of research used in this study is normative legal research. The author employs approaches including statutory and case law analysis. The author utilizes qualitative juridical data analysis techniques, involving the interpretation of legal materials as an initial step, typically conducted in normative legal research. The results of this study indicate that although BOT contract law in Indonesia has been regulated, there are still several issues in its implementation, often leading to disputes and unilateral contract cancellations. The government must ensure legal certainty for investors and other private sector entities so that the investment climate, including through BOT contracts, can thrive in Indonesia. This principle is then developed into regulations governing legal protection provisions for unilateral contract cancellations. Indonesia's legal framework for BOT contracts is detailed, but some additions are necessary to enhance its effectiveness. Therefore, future BOT legal frameworks are recommended to include general provisions related to BOT projects, tender offers and negotiations, agreement mechanisms, signing processes, and project monitoring.

Abstract

Tujuan studi ini untuk mengetahui status hukum penggunaan debt collector terhadap penarikan kendaraan yang telah dijaminkan dalam fidusia dan untuk mengetahui aturan yang seharusnya diterapkan terkait penggunaan debt collector dalam melaksanakan penarikan terhadap kendaraan yang dijaminkan fidusia. Studi ini mengadopsi metode penelitian hukum secara normatif berpendekatan perundangan. Temuan penelitian ini adalah sampai saat ini status hukum penggunaan debt collectorterhadap penarikan kendaraan yang telah dijaminkan dalam fidusia belum ditata secara tegas pada peraturan perundang-undangan. Aturan UU Jaminan Fidusia menjadi masalah tersendiri sebab undang-undang fidusia tidak mengatur ketentuan penggunaan debt collector dalam melaksanakan penarikan terhadap kendaraan yang dijaminkan fidusia. Adapun aturan penggunaan debt collector terhadap penarikan kendaraan yang telah dijaminkan dalam fidusia diatur melalui aturan perundang-undangan lain seperti: POJK 35/2018. Di satu sisi, undang-undang jaminan fidusia no.42/1999 telah mengatur terkait implementasi pengeksekusian fidusia diantaranya dalam pasal 15, pasal29, dan pasal 30. Sesuai keputusan MK 18/PUU-XVII/2019 adanya fidusia ini seharusnya mampu menjamin pemenuhan hak debitur saat tidak mampu membayar cicilan kreditnya, dilakukan dengan prosedur yang benar sesuai hukum bukan dengan penarikan kendaraan jaminan fidusia secara paksa. This study attempts to ascertain the legal status of the use of debt collectors to withdraw vehicles that have been pledged as fiduciaries and to find out the rules that should be applied regarding the use of debt collectors in carrying out withdrawals of vehicles secured as fiduciaries. This study adopts normative legal research methods with a statutory approach. The findings of this research are that until now the legal status of the use of debt collectors to withdraw vehicles that have been pledged as fiduciary has not been regulated in statutory regulations. The rules of the Fiduciary Guarantee Law are a problem in themselves because the fiduciary law does not regulate the provisions for the use of debt collectors in carrying out withdrawals on vehicles guaranteed by fiduciaries. The rules for using debt collectors for withdrawing vehicles that have been pledged as fiduciary are regulated through other statutory regulations such as POJK 35/2018. On the one hand, the Fiduciary Guarantee Act of 1999, number 42 regulates the implementation of fiduciary execution, including in Article 15, article 29, and Article 30. By constitutional judge number 18/PUU-XVII/2019's ruling, the existence of this fiduciary should be able to guarantee the fulfillment of the debtor's rights when he is unable to pay his credit installments, carried out using the correct procedures by the law, not by forcefully withdrawing the fiduciary collateral.

Abstract

Studi ini bertujuan guna menelusuri serta mengevaluasi perlindungan hukum dan usaha hukum yang dapat dilaksanakan bagi pemegang hak tanggungan atau kreditor bila terdapat kasus suatu tanah dijadikan jaminan oleh suatu pihak, dan kemudian hari tanah yang merupakan objek jaminan itu dinyatakan menjadi tanah terlantar oleh pihak berwenang yakni Badan Pertanahan Nasional (BPN) maka hal ini akan menimbulkan akibat pada pemegang Hak Tanggungan terhadap tanah itu yaitu kerugian dalam bentuk objek jaminan Hak Tanggungan yaitu tanah. Diteliti dengan metode penelitian hukum normatif dan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach) serta cara penghimpunan data memakai studi pustaka menggunakan sumber data sekunder dengan sumber hukum primer dan sekunder. Perolehan penelitian memperlihatkan bahwasanya perlindungan hukum untuk pemegang hak tanggungan pada kasus tanah terlantar adalah melalui perjanjian dan usaha yang bisa dilaksanakan pemegang hak tanggungan adalah mengakihiri perjanjian kredit dan melayangkan tuntutan pada debitor yang cedera janji. This research aims to investigate and evaluate legal protection and legal measures that can be taken by mortgagees or creditors in cases where a piece of land is used as collateral by a party, and then the land, which is the subject of the collateral, is declared as abandoned land by the competent authority, namely the National Land Agency (BPN). This will result in consequences for the mortgage holder regarding the land, which is a loss in the form of the collateral rights on the land. Researched with normative legal research methods and statutory approaches (statute approach) and case approaches (case approach) and how to collect data with literature studies using secondary data sources with primary and secondary legal sources. The research findings show that the legal protection for mortgagees in cases of abandoned land is through agreements and actions that mortgagees can take, including terminating the credit agreement and pursuing claims against the defaulting debtor.

Abstract

After the publication of PMK No. 18/PUU-XVII/2019, it essentially canceled the parate execution for the object of fiduciary guarantees over the debtor's control. However, until now, parate executions are still being carried out to resolve disputes between debtors and creditors. This research aims to examine the legal certainty of debtors and the legal consequences of PMK Decision No. 18/PUU-XVII/2019 in cases of partial execution of fiduciary collateral objects. This research method is normative law with a statutory approach, and the main data is secondary data. The results of this research: the legal protection given to debtors if the execution process continues after PMK No. 18/PUU-XVII/2019 can take legal action as an appeal as a stance to oppose the court's decision on a judge's decision which is deemed not to provide justice. The debtor can also take criminal legal action if the execution is still carried out using coercion because he has fulfilled the criminal offense. The impact of PMK Law No. 18/PUU-XVII/2019 on the legal certainty of debtors in cases of parate execution, the object of the fiduciary guarantee is to conditionally cancel the parate execution. However, many execution parate cases after the publication of PMK No. 18/PUU-XVII/2019 indicates that there is no legal protection for debtors as well as legal certainty regarding the application of the execution parate regulations. This further reduces the debtor's legal certainty because the judge's view of the two cases of execution parate for the object of fiduciary collateral did not consider execution parate as an unlawful act.

Abstract

Kepastian hukum merupakan salah satu syarat yang harus dipenuhi dalam penegakan hukum, yang berarti bahwa seseorang akan dapat memperoleh sesuatu yang diharapkan dalam keadaan tertentu. Dalam hal ini Undang-Undang Pokok Agraria meletakan dasar yang nantinya akan mewujudkan kepastian dan perlindungan hukum untuk warga negara Indonesia. Menurut Pasal 19 UUPA Nomor 5 Tahun 1960 yang menyatakan “Untuk menjamin kepastian hukum oleh Pemerintah diadakan pendaftaran tanah diseluruh wilayah Republik Indonesia menurut ketentuan-ketentuan yang diatur dengan Peraturan Pemerintah. Permasalahan terjadi pada Putusan Mahkamah Agung Nomor 3061 K/Pdt/2022. Dalam kasus ini, ada permasalahan terkait tumpang tindih sertifikat hak milik atas tanah. Hal ini mengakibatkan ketidakjelasan norma sehingga terjadi ketidakpastian hukum. Permasalahan yang akan dibahas adalah bagaimana pertimbangan hakim terkait dengan putusan Mahkamah Agung Nomor 3061 K/Pdt/2022. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Kesimpulan dalam tulisan ini adalah Pertimbangan hakim terkait dengan Putusan Mahkamah Agung Nomor 3061 K/Pdt/2022 memenuhi 3 (tiga) unsur, yakni kepastian hukum, keadilan dan kemanfaatan. Namun, pada putusan tersebut dalam mempertimbangkan keputusannya hakim condong pada kepastian hukum.

Abstract

Penelitian ini membahas tentang masalah mengenai masyarakat hukum adat terutama hak mengusai terhadap tanah adat atau yang dikenal dengan sebutan Hak Ulayat. Hal tersebut bisa saja terjadi apabila negara dan masyarakat tidak selaras dalam memenuhi kewenangan dan kewajibannya dalam hak menguasai tanah yang berdampak pada pemanfaatan sumber dayanya. Penelitian ini difokuskan menganalisis Putusan MK bagi masyarakat hukum adat terhadap perubahan pada Undang-Undang Nomor 41 Tahun 1999. Metode penelitian yang penulis gunakan adalah Yuridis Normatif dan mempergunakan pendekatan perundang-undangan (statute approach). Selain itu juga digunakan pendekatan kasus yang digunakan untuk mengetahui ratio decidendi yang digunakan oleh Hakim Mahkamah Konstitusi dalam memutus perkara pengujian undang-undang yang terkait dengan masyarakat hukum adat. Hasil dari penelitian ini adalah menampilkan hasil kepastian hukum bagi   hak masyarakat hukum adat dalam menguasai wilayah ulayatnya dalam pengelolaan dan pemanfaatanya yang dikuasai oleh Negara dengan mengkaji Putusan Mahkamah Konstitusi atas perubahan Undang-Undang Kehutanan sehingga negara tidak ditempatkan sebagai pemilik tanah, melainkan hanya sebagai penguasa yang berwenang mengatur dan mengurus tanah dapat menjalankan kewenangannya terhadap masyarakat hukum adat di Indonesia.

Abstract

Penelitian ini bertujuan untuk menginvestigasi penggunaan hukum Tiongkok dalam penyelesaian sengketa bisnis internasional melalui studi kasus pada perjanjian kontrak antar-negara. Penulis melakukan analisis mendalam terhadap beberapa kasus di mana perusahaan asing mengalami sengketa hukum dengan perusahaan Tiongkok dalam konteks kontrak bisnis internasional. Penelitian ini mengeksplorasi bagaimana pengadilan Tiongkok dan arbitrasi internasional digunakan dalam penyelesaian sengketa, serta sejauh mana hukum Tiongkok diterapkan dalam proses tersebut. Penelitian ini berpotensi memberikan wawasan yang berharga kepada praktisi hukum bisnis internasional dan pengusaha yang terlibat dalam transaksi dengan perusahaan Tiongkok, serta bagi mereka yang tertarik pada perkembangan hukum Tiongkok dalam konteks global.

Abstract

The right holder of a trademark has full validity to use his own trademark or license it to other parties, including delisting of its own trademark. Delisting of a mark could be done by the owner of the relevant mark, based on initiative of the minister or third party’s interest. Hongyunhonghe Tobacco (Group) Co. Ltd. (Plaintiff) has filed a lawsuit for the delisting of registered WIN trademark owned by PT Sumatra Tobacco Trading Company (Defendant). The issues raised are how the legal arrangements for the delisting of trademarks by third party’s interested and the suitability of the application of the law in Decision Number 45/Pdt.Sus-HKI/Merek/2023/PN.Niaga.Jkt.Pstreviewed based on the applicable trademark rules. Normative juridical research type through a statutory study approach and literature study-based data collection. Qualitative data analysis with prescriptive nature. The provisions of Article 74 paragraph (1) jo. Article 85 of the Trademark Law regulates the delisting of registered trademarks filed third party’s interested in the form of a lawsuit to the Chairman of the Central Jakarta Commercial Court. The application of the law applied in the decision is erroneous and states the Plaintiff is not interested. Law enforcement is one of the factors that affect the effectiveness and utilities of the law for the community. Trademarks that have been obtained should be used as well as possible in accordance with the term of protection, so as not to cause a gap for other parties to conduct the delisting of registered trademarks.

Abstract

This study analyzes the impact of Government Regulation in Lieu of Law (Perppu) No. 2 Year 2022 on Job Creation, particularly in the plantation sector, on the rights of Masyarakat Hukum Adat (MHA). The initial purpose of this Perppu was to increase investment through simplification of regulations and acceleration of licensing, but the formulation of existing norms and regulations can threaten the existence of MHA. This research is a normative research and uses a legislative approach by analyzing primary and secondary legal materials, and using John Rawls' Theory of Justice and Mochtar Kusumaatmadja's Theory of Development Law. The results show that there are significant changes in the application of Perppu No. 2 Year 2022 on Job Creation compared to Law No. 34 Year 2014 on Plantations, including changes in land area limitations, elimination of environmental permits, and elimination of criminal sanctions related to permits and the environment. The implications of the implementation of this Perppu are that it exacerbates the marginalization of Indigenous Peoples, ignores customary rights, and causes overlapping land tenure, as well as ecosystem and environmental damage. This research suggests several strategic steps: accelerating the inventory of customary land and the granting of customary rights certificates, requiring MHA to be involved in every stage of decision-making through FPIC mechanisms, and passing a special law for MHA. Investment policies should also focus on sustainable development with stricter environmental standards than at present.

Abstract

In the process of forming a law or legislation, the DPD does not have the power to decide or play a role in the decision-making process at all. Even though there are support requirements to become a member of the DPR. This means that the quality of the legitimacy of DPD members is not at all balanced by the quality of their authority as representatives of the regional people. The aim of this research is to analyze the function and authority of the Regional Representative Council in the Structural Institution of the Republic of Indonesia State Legislative Institution and how to optimize the function and legislative authority of the Regional Representative Council. The type of research we use is normative legal research, namely research carried out by examining the body of literature or secondary data. Strengthening the authority of the DPD by consistently incorporating the Constitutional Court's decisions into statutory regulations and other regulations under it. This is being done pending the issuance of the fifth amendment to the 1945 Constitution. The current revision of the MD3 Law has not yet adopted the authority of the DPD in accordance with the Constitutional Court's decision. The need for the fifth amendment is to reorganize the function of legislation firmly and clearly in the 1945 Constitution, because by reorganizing the function of legislation it will touch all institutions, including the DPR, DPD, President and other institutions.
