Abstract

This research aims to determine the impact of lack of transparency in regional financial management on local development and community welfare and accountability will remain a topic of concern in society. The public does not want acts of corruption to occur in government, because acts of corruption will not only be detrimental to state finances, they will also have an impact on hampering state development and reducing the level of social welfare. This type of research is a literature study. Library study activities related to methods of collecting library data, reading and taking notes and processing research materials. The results of the research inform that the phenomenon of non-transparency in the areas of budgeting, personnel, procurement of goods and services is certainly a fact that must be revealed based on the facts that can be observed and witnessed in various implementation of the main duties and functions of government employees. The cause of non-transparency in the various fields mentioned above is because there are factors that hinder the realization of transparency in the implementation of clean, authoritative and responsible regional government. Abstract

Islamic law is one aspect of Islamic teachings which occupies a very crucial position in the view of Muslims, because it is the most concrete manifestation of Islamic law as a religion. Islamic law has a significant influence on Indonesian positive law, especially in several areas of law. Meanwhile, positive law is law in the form of laws that regulate relations between humans and humans, or with legal entities. Islamic law is generally defined as rules which are the result of understanding and deducing from the provisions revealed by Allah SWT to the Prophet Muhammad SAW. Therefore, the main sources of Islamic law are the Koran and Hadith. source of pure positive law from society. This is because the adoption or discovery of positive law uses an inductive method. Namely by observing the actions and attitudes of community members. From the results of these various observations, general regulations are then made that are binding on the entire community. In this article the author tries to explain further the analysis of the concepts and sources of these two laws, and their comparative analysis.

Abstract

In the context of civil law, Tort Law plays an important role in upholding the rights of loss victims. Tort law is rooted in the principle that every individual has the right to live without experiencing interference from the unlawful acts of others. The aim of this research is to find out how Tort Law works in the context of Civil Law: Enforcement of the Rights of Loss Victims. The method used in this research is qualitative research in the nature of library research which uses books and other literature as the main object. Data analysis in this research looks for sources of information regarding tort law in the context of civil law: Enforcement of the Rights of Loss Victims. Based on research results, Tort Law in the context of civil law discusses violations of civil law that cause harm to individuals or property. The principle is to provide compensation to victims who suffer as a result of unlawful actions.

Abstract

Islamic inheritance law is one of the rules that regulates humans and humans in matters of inheritance (inheritance). This law regulates the transfer of assets from deceased people to living people with detailed calculations and distribution. The aim of this research is to determine the legal consequences of buying and selling inherited land without the consent of the heirs. In this research the author uses Normative Law research, which is carried out by examining and analyzing legal regulations with legal issues in their consistency with existing principles. This type of research is a type of library research, which relies on the study and study of texts. The research results show that in Islamic law, land inheritance does not yet exist has been circulated and is prohibited from being sold because it still belongs to other heirs. If all heirs agree to the sale and purchase, it can be traded, if not it is considered illegal and revoked. Legal protection for buyers of inherited land that is not distributed is that they can file a civil lawsuit against the seller and the Notary/PPAT (official with the authority to make deeds) who has made the sales agreement.

Abstract

This research discusses how women's rights in the family are protected according to Islamic law in analyzing gender discrimination cases. This study was conducted to determine gender inequality in several aspects of life, such as inheritance and inheritance. It is hoped that this research can contribute to a better understanding regarding making an important contribution in expanding understanding of the Islamic legal perspective on gender equality, which can become a reference for policy makers in promoting gender equality in Muslim societies. The research method is to use a literature study research method which includes Islamic legal discrimination in various social and geographical contexts. Public education regarding women's rights in Islam is an important key to changing perceptions and reducing gender discrimination. Legal reforms that support gender equality need to continue to be developed to create more effective protection of women's rights.

Abstract

The war between Ukraine and Russia has had a big influence on the world, especially from a political perspective. Russia's invasion of Ukraine on Thursday, February 24 2022 stems from internal conflict between the two countries. Due to this incident, Russia received criticism from the international community, including Indonesia. The United States condemned the invasion and imposed economic sanctions on Russia. These sanctions take the form of stopping the operations of Russian-owned financial institutions in the United States, freezing all investment assets and property of individuals close to the Russian President, as well as restrictions on Russian debt transactions. After being hit by economic sanctions, Russia was also subject to a crude oil embargo by the European Union and the United States. The war that occurred influenced the increase in oil prices due to Russia's invasion of Ukraine, causing new challenges in the global economy. This research uses library research. Library research is research whose main object is literature (library) which utilizes sources from literature to obtain research data, so that library research limits its activities to literary materials related to the research object. The research results show that the war between Russia and Ukraine has had various negative impacts that threaten all sectors, especially the economy in terms of global trade. As is known, these two countries are the largest suppliers of various main commodities such as wheat, fertilizer, natural gas and oil. Where these commodities are really needed by international consumers. Russia and Ukraine have a significant market share of the supply of oil, gas and other commodities, so the invasion has increased the prices of these commodities. The direct impact of rising commodity prices affects economic growth in the countries involved. This means that the economy in Southeast Asia will be affected by the war that is taking place. Continued conflict could have drastic effects in Southeast Asia. The impact of the Russian and Ukrainian wars has an impact on the Southeast Asian economy and will be more detrimental than the impact of the COVID 19 pandemic. This is because it is related to the global economy in essential areas.

Abstract

The development of science and technology has positive and negative impacts on human life. Likewise with cyberspace, one of the advances in technology, of course it is a reality that is faced with a legal metanarrative. Overcoming the ineffectiveness of legal metanarratives in addressing cyber challenges requires an innovative and comprehensive approach. Currently the world is facing changes in the industrial world which can be called the Industrial Revolution 4.0 which has a major impact on industrial life, especially in the form of rapid technological developments. The rapid development of technology has given birth to a new concept of "creative industry" which utilizes human creativity and thinking abilities. Intellectual property rights play a very important role in the creative industry, and the state recognizes the efforts and perseverance of creators/inventors in producing new innovations and minimizing the occurrence of intellectual property rights. Therefore, intellectual property must be protected legally. Violation of rights. However, in reality there are several challenges and difficulties in implementing laws related to intellectual property rights in Indonesia. This journal uses normative research methods based on legal regulations and literature studies, and considers aspects of theoretical, structural and legal explanations. The main problem that occurs in Indonesia is the low level of public awareness and education regarding intellectual property, and this problem can give rise to other problems. Intellectual property protection in Indonesia not only provides peace of mind and legal certainty for creators/inventors, but also has a psychological impact that motivates creators/inventors to continue to innovate. Indonesia will be a country that has great potential to implement Industry 4.0 because of its large workforce. The digital information era not only brings progress to industry, but can also pose challenges to labor laws. The aim of this research is to analyze labor problems due to the absence of regulations that are appropriate to the situation in the Industrial Revolution 4.0 era.

Abstract

Online shopping transactions through e-commerce platforms such as Tokopedia have become increasingly popular. However, with the growing number of online transactions, there are risks and responsibilities that need to be addressed. This study aims to explore the implications of keperdataan (law relating to civil matters) on the risks and responsibilities in online shop agreements in Tokopedia. The research will focus on analyzing the legal framework that governs online transactions, particularly in terms of consumer protection, contractual obligations, and dispute resolution mechanisms. By examining relevant laws and regulations, as well as case studies of online shop agreements in Tokopedia, the study seeks to identify key legal issues that may arise in online transactions and provide recommendations for both consumers and online sellers.

Abstract

This research discusses legal protection for consumers in online buying and selling transactions using a normative juridical approach. Through analysis of legal sources, legislation, relevant literature, and transaction data from e-commerce platforms, this study highlights various issues faced by consumers in the e-commerce context, such as product discrepancies, fraud, dispute resolution difficulties, and data security issues. The research also explores the role of the Civil Code (KUH Perdata) and other relevant regulations in providing a framework to protect consumer rights. In the context of breach of contract, the study shows that consumers have rights guaranteed by law to receive compensation if they are affected by a seller's breach of contract. However, challenges such as difficulties in enforcing consumer rights across different jurisdictions remain an issue to be addressed. This research emphasizes the importance of solutions such as cross-border cooperation and online alternative dispute resolution systems in enhancing consumer protection. Abstract

This study aims to determine the effect of differentiated learning on student learning outcomes in Pancasila Education in grade VII at SMP Negeri 26 Medan. This study was conducted based on the low learning outcomes of students, as indicated by the large number of students who did not meet the minimum passing grade (KKM), as well as the learning process that was still dominated by conventional methods without considering differences in learning styles, interests, and readiness of students. This study used a quasi-experimental method with a Pre-test-Post-test Control Group Design, involving 64 students consisting of class VII-E as the experimental class and class VII-H as the control class. The experimental class was given treatment in the form of differentiated learning that accommodated the readiness, interests, and learning profiles of students, while the control class was taught using conventional learning. The research instrument was a learning outcome test administered before and after the treatment. The data were analyzed using normality, homogeneity, Paired Sample T-Test, and Independent Sample T-Test tests with the help of the SPSS 25 program. The results showed a significant increase in the learning outcomes of the experimental class, with the average score increasing from 70.72 to 84.91 after the implementation of differentiated learning. Meanwhile, the control class only experienced a small increase from 69.38 to 70.03, or 0.65 points. The Paired Sample T-Test results showed Sig. (2-tailed) = 0.000 < 0.05, indicating a significant difference between the pretest and posttest scores in the experimental class. The Independent Sample T-Test also produced a Sig. value of 0.000 < 0.05, with a posttest average difference of 14.88 points between the two classes, proving that differentiated learning has a significant effect on student learning outcomes. It can be concluded that the application of differentiated learning is ffective in improving Pancasila Education learning outcomes while creating an adaptive and student-centered learning process.
