Abstract

Penelitian ini bertujuan untuk melihat dan menganalisis peran penegakan hukum dalam menjaga wibawa peradilan, serta ingin melihat serta menganalisis urgensi konstruksi hukum pengaturan contempt of court dalam proses peradilan pidana. Adapun metode yang digunakan dalam penelitian ini adalah melalui metode pendekatan yuridis normatif. Dalam melakukan penelitian yuridis normatif penulis melakukan pengumpulan data melalui studi kepustakaan yang dilakukan dengan cara meneliti bahan pustaka berupa data sekunder. Hasil penelitian menunjukkan bahwa peran penegak hukum dalam menjaga wibawa peradilan sangat diperlukan sekali karena tindakan merendahkan peradilan mengancam pondasi keadilan dan kepercayaan publik terhadap sistem hukum. Karena itu, hakim, jaksa, advokat dan panitera memiliki tanggungjawab yang besar dalam menjaga integritas dan wibawa peradilan dengan cara menegakkan hukum dan keadilan. Setiap perkara diperiksa dan diputus dengan peradilan yang jujur serta tidak memihak dan yang lebih penting peradilan diselenggarakan dengan merdeka dan tidak dipengaruhi oleh kekuasaan manapun. Kemudian yang tidak kalah pentingnya perlu ada konstruksi hukum khusus yang diberlakukan dengan pasti sebagai bagian dari ikhtiar untuk menegakkan wibawa peradilan, seperti undang-undang khusus. Selama ini jika terjadi contempt of court, pelakunya dibiarkan saja tanpa ada sanksinya. Ini tidak boleh dibiarkan secara terus menerus, maka perlu ada aturan hukum yang mengatur sehingga dengan aturan hukum itu pelaku contempt of court dapat di proses dan dihukum.

Abstract

This study aims to determine and analyze the role of justice collaborators and whistleblowers in corruption in the procurement of goods and services carried out by state administrators and to determine the forms of corruption that occur in the procurement of goods/services. The research method used is normative legal research through a legislative approach and a conceptual approach. The results of this study found several problems, namely; There is a need for unification of perceptions and synchronization of regulations that apply to law enforcement officers in understanding aspects of witness protection related to legal collaborators and violation reporters. The most common forms of deviation in the government procurement of goods/services that can lead to corruption are: bribery, job combination, separation of duties, collusion between partners providing goods/services and procurement implementers, document falsification, waste of money. region/country, reducing the quantity and/or quality of coral/gauze, incorrectly determining the type of procurement contract for goods/services, contracts without available budget, setting their own estimated price that is too high.

Abstract

In Article 18B paragraph (2) of the Amendment to the 1945 Constitution, it is stated that "the State recognizes and respects customary law community units and their traditional rights as long as they are still alive and in accordance with the development of society and the principles of the Unitary State of the Republic of Indonesia, which are regulated in law." In 2018, West Sumatra Province established West Sumatra Province Regional Regulation Number 7 of 2018 concerning Nagari. Problem formulation: 1) What are the consequences of the authority of the Nagari Traditional Council (KAN) after the enactment of West Sumatra Province Regional Regulation Number 7 of 2018 concerning Nagari in West Sumatra Province? 2) What are the legal impacts of supervisory authority on the implementation of nagari customs and culture by the Nagari Traditional Council in West Sumatra Province? The type of research used is normative legal research, using secondary data sources consisting of Primary Legal Materials and Secondary Legal Materials, data collection techniques using document studies, the data is then analyzed using qualitative analysis. Research Results and discussion: 1) Based on the provisions in Article 5 of the West Sumatra Province Regional Regulation Number 7 of 2018 concerning Nagari, the Nagari Institution consists of: a. Nagari Traditional Density; b. Nagari Government; and c. The Nagari Customary Court, one of the authorities of the Nagari Customary Court is: Supervising the Implementation of Nagari Customs and Culture. 2) In the provisions of Article 17 of West Sumatra Province Regional Regulation Number 7 of 2018 concerning Nagari, it states that: The Governor carries out general guidance and supervision over Nagari in the administration of government based on Customary Law. Abstract

Medical confidentiality is a fundamental duty for physicians, and disclosing patient records is generally prohibited by law and professional ethics. However, life-threatening emergencies raise the question of whether such disclosure can be legally justified to protect a patient’s life. This study examines how Indonesian law addresses this dilemma and whether physicians have a defensible legal basis for disclosure in emergency situations. Using a normative juridical approach that reviews legislation, scholarly writings, and ethical guidelines, the research finds that Indonesian statutory law does not yet clearly regulate discretionary disclosure by physicians in conscious emergency refusal situations. As a result, physicians who disclose records to manage emergencies face uncertain legal protection. Nonetheless, interpretive principles such as lex specialis and the maxim salus populi suprema lex esto may justify limited disclosure when the goal is life preservation. Within this framework, disclosure may be considered lawful if proportional, narrowly confined to the emergency, and properly documented. The study concludes that clearer statutory provisions are needed to establish exceptions to confidentiality in emergencies. Such reforms would enhance legal certainty and strengthen protection for medical personnel who act in good faith, balancing ethical obligations with humanitarian imperatives.

Abstract

AbstractToday the Intellectual Property Rights or Intellectual Property Rights (IPR) plays an important role in aspects of life. This is because IPR is closely related to technology, economic, and cultural arts. Due to the importance of IPR in life, it is proper that IPR must be protected. One form of IPRs that should be protected is copyrighted, particularly musical works of acts of piracy. This is important, because the copyrighted has legislation to protect copyright. However, these laws have not been able to make the perpetrators of piracy deterrent. Piracy even tend increasingly widespread and alarming. Uncontrolled piracy in the community will clearly have a negative impact on Indonesia. Bad image by the international community and the threat of sanctions ensured gets accepted by the Indonesian state. In addition, uncontrolled piracy will also result in decreased creative spirit of the artist. Seeing the condition of uncontrolled piracy of copyrighted works of music in Indonesia and as the country’s signing of the TRIPS agreement would copyrighted musical works. If the piracy of copyrighted musical works continues, the creators will continue the protection of copyright works owned by the nation of acts of piracy. AbstrakDewasa ini Intellectual property Rights atau Hak Kekayaan Intelektual (HKI) memegang peran penting dalam aspek kehidupan. Hal ini dikarenakan HKI berkaitan erat dengan teknologi, ekonomi, maupun seni budaya. Begitu pentingnya HKI dalam kehidupan, selayaknyalah HKI tersebut dilindungi. Salah satu bentuk HKI yang harus dilindungi adalah hak cipta, khususnya karya musik dari tindakan pembajakan. Hal ini menjadi penting, karena karya cipta musik dihasilkan melalui pengorbanan pikiran, tenaga, waktu bahkan biaya. Indonesia memang sudah memiliki Undang-undang untuk melindungi hak cipta. Namun undang-undang tersebut belum mampu membuat para pelaku pembajakan jera. Pembajakan bahkan cenderung semakin marak dan memprihatinkan. Maraknya pembajakan di tengah masyarakat jelas akan berdampak negatif terhadap Indonesia. Citra buruk oleh dunia internasional dan ancaman mendapat sanksi dipastikan diterima oleh negara Indonesia. Disamping itu, maraknya aksi pembajakan juga akan berakibat menurunnya semangat berkreasi dari kalangan seniman. Melihat kondisi maraknya pembajakan karya cipta musik di Indonesia dan sebagai negara penandatanganan perjanjian TRIPs mau tidak mau Indonesia harus menegakkan hukum di bidang HKI, khususnya hak cipta. Lebih khusus lagi hak cipta karya musik. Jika pembajakan hasil karya cipta musik terus berlanjut, pencipta akan terus mengalami kerugian terutama dalam bidang ekonomi. Untuk itu, negara mempunyai tanggungjawab moril terhadap perlindungan karya cipta yang dimiliki anak bangsa dari tindakan pembajakan.
