Abstract

Peraturan Desa ditetapkan oleh Kepala Desa setelah dibahas dan disepakati bersama BadanPermusyawaratan Desa merupakan kerangka hukum dan kebijakan dalam penyelenggaraanPemerintahan Desa dan Pembangunan Desa. Penetapan Peraturan Desa merupakanpenjabaran atas berbagai kewenangan yang dimiliki Desa mengacu pada ketentuan peraturanperundang-undangan yang lebih tinggi. Sehingga sebagai sebuah produk hukum, Peraturan62Desa tidak boleh bertentangan dengan peraturan yang lebih tinggi dan tidak boleh merugikankepentingan umum. Salah satu daru alasan di buatnya Undang-undang Nomor 6 Tahun 2014tentang Desa adalah pengakuan bahwa Desa memiliki hak asal usul dan hak tradisional dalammengatur dan mengurus kepentingan masyarakat setempat dan berperan mewujudkan citacita kemerdekaan berdasarkan Undang-Undang Dasar Negara Republik Indonesia Tahun1945 Hal ini disebabkan karena dengan diakuinya desa sebagai sebuah daerah otonommenjadikan desa memiliki peran utama dalam mengelola, memberdayakan dan memajukansumber daya yang tersedia, baik sumber daya alam maupun sumber daya manusia. Sehinggapada akhirnya mampu menggerakkan roda pembangunan yang harus diiringi kesadaran akanpemahaman spirit otonomi bagi seluruh penggerak warga desa dan kapasitas perangkat jugamasyarakat dalam memahami tata kelola pemerintahan. Kelembagaan Desa/Desa Adat, yaitulembaga Pemerintahan Desa/Desa Adat yang terdiri atas Pemerintah Desa/Desa Adat danBadan Permusyawaratan Desa/Desa Adat, Lembaga Kemasyarakatan Desa, dan lembagaadat. Kepala Desa/Desa Adat atau yang disebut dengan nama lain merupakan kepalaPemerintahan Desa/Desa Adat yang memimpin penyelenggaraan Pemerintahan Desa. KepalaDesa/Desa Adat atau yang disebut dengan nama lain mempunyai peran penting dalamkedudukannya sebagai kepanjangan tangan negara yang dekat dengan masyarakat dan sebagaipemimpin masyarakat. Tri Dharma Perguruan Tinggi merupakan visi dari seluruh perguruantinggi di Indonesia yang terdiri dari pendidikan dan pengajaran, penelitian danpengembangan, serta pengabdian kepada masyarakat. Abstract

The implementation of the coaching carried out by Prison for the inmates often becomes not optimal due to the complexity of the problems that occur within Prison. One of the root causes of issues at Prison is overcapacity. This paper then tries to see by analyzing the nature of narcotics crime as a particular crime and Indonesia's role in overcoming narcotics crime. Then also visit and explore the implications of overcapacity in Prison and concepts that can be applied to prevent overcapacity in Prison. The research method used in this paper is a normative juridical research method, with the data source used being secondary data obtained through library research. The study results indicate that narcotics crime as a particular crime is transnational and involves international crime organizations. Indonesia's role in overcoming narcotics crime can be seen from the regulation in Law Number 35 of 2009. In this regulation, sellers and dealers are given a high penalty, even death. Sentences should not be given to those who are called victims or addicts. The implications of overcapacity in Prison can result in non-optimal coaching due to the complexity of the problems that occur in Prison. Overcapacity is one of the root causes of issues at Prison. For this reason, it is necessary to apply a concept to prevent overcapacity from occurring in Prison by providing rehabilitation as a form of using restorative justice.

Abstract

Corruption remains a pervasive challenge in Indonesia, undermining governance, economic development, and social justice. The Draft Law on Asset Forfeiture in Indonesia is an effort in reform to restore state losses caused by the crime of corruption. This is a comparative legal research which aims to compare the Draft Asset Forfeiture Law with the United States Code as a reference to assess compatibility with human rights. The findings of this research indicate that despite the fact that there have been numerous previous efforts and procedures from law enforcement to return assets under the criminal procedure law and other regulations, the judicial system is still insufficient to effectively address potential state financial losses due to the rampant corruption crimes in Indonesia. The Asset Forfeiture system, which shares similarities with the Asset Forfeiture principle in the U.S.C., has the potential to be abused and violates human rights and the basic Criminal Law principle of presumption of innocence, both in Indonesia and the United States. Therefore, it is necessary to improve the Draft Law on Asset Forfeiture with due regard to Human Rights, by placing the perpetrators of corruption on the Principle of the Highest Balanced Probability, and still adhering to the principles of the criminal process in accordance with basic criminal law.

Abstract

Indonesia is the fourth largest country in the capacity of the population number in the world. As the country with the largest population, various problems often plague the nation of Indonesia. One such problem is the problem of law enforcement and narcotics and drugs cases. Up to now Indonesia is confronted with drug trafficking that is very alarming. Drug crimes are so uncontrolled in social life. It is undeniable that narcotics have been threatening the future of the nation. There have been already many victims even until some of them dies. Drug abuse has reached very dangerous phase. There is no other way, government and officials must immediately take a serious and earnest step. It is a pity that the nation's children must always be the victims of drug distribution by the syndicate. Laws must be enforced as fairly as possible. Because the law is the supreme commander that must not be defeated by anything.Keywords: role of the judge, crime, drugs

Abstract

Korupsi sudah menjadi penyakit parah di negeri ini dan sangat sulit untuk disembuhkan. Berbagai upaya dalam mencegah dan menghilangkan praktek korupsi sudah sangat sering dilakukan. Baik dengan pembentukan peraturan perundang-undangan maupun pembentukan komisi atau badan penanggulangan tindak pidana korupsi. Namun korupsi tidak pernah mau pergi dari bangsa Indonesia. Di lembaga eksekutif ada korupsi, begitu juga di legislatif dan yudikatif. Belum lagi di beberapa badan usaha milik negara maupun lembaga-lembaga negara non kementerian. Fenomena korupsi ini membuat masyarakat gerah dan marah. Sebab pelaku korupsi telah mengambil hak-hak rakyat secara paksa. Akan tetapi penegakan hukum atas pelakunya tidak berjalan dengan baik. Koruptor kebanyakan dihukum ringan. Padahal Undang-undang memberikan ancaman hukuman pidana mati kepada pelakunya. Masyarakat berharap agar pelaku korupsi dihukum dengan seberat-beratnya, sehingga keadilan dan kesejahteraan masyarakat bisa terpenuhi.

Abstract

Abstract This research is purposed to determine how corruption occurs and then what steps must be taken to eradicate corruption and also to determine the role of universities in reducing anti-corruption behavior. The research method used in writing this research is a normative legal research method by conducting studies through library research or document studies. The results showed that the ways in which corruption occurred were among others by embezzling the practice of making rules that benefited certain parties, marking up projects, reducing the volume of work both in quality and quantity. Subsequently also the way a person commits a crime of corruption can go through a process that was initially small-scale which continues until the person concerned holds a high position. The steps that must be taken in eradicating corruption are building the rule of law, creating tangible conditions in all regions, the existence of activists, creating anti-corruption education, building moral education as early as possible, providing intensive religious education. While the role of universities in reducing corrupt behavior is to make universities a driving force because higher education institutions have a very strategic position in instilling an anti-corruption mentality. Higher education has the power to fight for the values of honesty. "

Abstract

Masalah prostitusi, baik yang sembunyi-sembunyi maupun yang terang-terangan, merupakanmasalah klasik yang dihadapi negara-negara dibelahan dunia, termasuk Indonesia. Bahkan diIndonesia prostitusi merupakan salah satu profesi yang sedang marak berkembang danmenjadi trendi dalam masyarakat. Lihat saja, tidak perlu modal besar, hanya cukup denganmodal wajah cantik, kemolekan tubuh, siap dihubungi 24 jam, serta bersedia melayani siapasaja tanpa memandang umur, maka pekerjaan ini bisa dilakoni untuk mendapatkan pundipundi uang, terutama oleh para wanita muda yang memang rata-rata menjadi incaran paralelaki hidung belang. Pemerintah sudah mencoba mengatasi persoalan ini. Namun faktanya,prostitusi bukannya berkurang tetapi malah menjalar baik di tempat hiburan, karaoke, pantipijat, salon terselubung dan lokasi-lokasi lainnya. Yang tidak kalah penting, muncul fenomenaprostitusi online yang sempat menghebohkan masyarakat akhir-akhir ini, baik yang dilakukanmasyarakat biasa hingga kalangan artis papan atas. Prostitusi, apapun, dimanapun dansiapapun pelakunya, ia dianggap sebagai kejahatan terhadap moral dan kesusilaan yangbersifat ilegal serta melawan hukum, dan hak asasi manusia, untuk itu harus dihentikan.

Abstract

Law enforcement is a process of making efforts to reinforce the existing legal norms. One of the parties that plays a role in law enforcement is the judge. The role of judges in law enforcement, especially criminal law, is very urgent in the criminal justice system in Indonesia. This is because the judge is the one who decides a case through his decision which will always be the concern of justice seekers. Therefore, in handling cases, the judge is impartial and may not be influenced by any party, so that his decision can realize a sense of justice in society. The research method used in this writing is the normative legal research method using secondary data obtained through literature studies. The focus of this research is the role of judges in law enforcement, especially in handling criminal cases through their just decisions.

Abstract

One form of employment agreement in Indonesia is a fixed-term employment agreement, or what we usually hear as a contract employment agreement. Recently, more and more business actors or companies have used a contract work system for their workers. It is suspected that in the implementation of the contract work agreement, it is more profitable for entrepreneurs or companies by ignoring the rights of workers that should be obtained. To obtain data, the method used in this study is the library research method, which is a research method carried out in the library, where data is obtained by reading, studying books, laws and regulations, scientific works, papers, the internet and other documents related to this. This article discusses How Legal Protection for workers whose contracts are continuously extended without a clear status. With the ratification of Perpu Number 02 of 2022 which is a replacement for Law Number 11 of 2020 concerning Job Creation, it is hoped that it can help employees with Fixed-Term Employment Agreements (PKWT) to fulfill their rights at work, especially the payment of final PKWT compensation which should be paid when the Fixed-Term Employment Agreement (PKWT) ends.

Abstract

The pluralistic life of beliefs about spiritual matters in Indonesia is very thick and sensitive, especially the occurrence of criminal acts that are beyond common sense or cannot be proven by scientific criminal investigations, namely criminal acts of black magic perpetrators or victims of black magic which result in violations of human rights (HAM). Belief in religion which is a source of morality and spirituality which is considered as part of a tradition that has never been abandoned by Indonesian society with situations and conditions of high spiritual values makes Indonesian people's belief in God and spirits that live around humans or those that smell mystical or black magic not uncommon in every region with their respective cultural characteristics, for example human rights violations in Banyumas Regency, namely the massacre allegedly carried out by black magic perpetrators with 250 victims. With this belief, it is not uncommon for people in some areas to have or even have the ability to see supernatural things or study black magic, for their own interests. So the question arises as a problem identification, namely 1. How are efforts to prove the crime of black magic according to Law Number 1 of 2023 concerning the Criminal Code? 2. How can the elements of black magic be called a criminal act based on Law Number 1 of 2023 concerning the Criminal Code? The research method used by the author is the normative legal approach method. The normative legal approach is a legal research conducted by examining library materials or secondary data as a basis for research by tracing laws and regulations and literature related to the problems studied by the author.
