Abstract

This article examines an auxiliary state organ that has mixed functions in carrying out its duties, namely semi-legislative and regulatory, semi-administrative, and even semi-judicative. The KPK has a relationship with the legislature in terms of selecting its membership apparatus. This research analyzes the KPK authority in Indonesia after Law No. 19 of 2019 concerning the KPK and the constitutional implications of Law No. 19 of 2019 concerning the Corruption Eradication Committee. The Law No. 19 of 2019 concerning the Corruption Eradication Committee was used as the main source to answer the research questions. The results of this research explain that KPK is an auxiliary state organ whose position is under the independent executive family, free from any interference in carrying out its functions and authority. This is an implication of Constitutional Court Decision Number 36/PUU-XV/2017, which was then used as the basis for the creation of Law No. 19 of 2019 concerning the second amendment to Law No. 30 of 2002 concerning KPK, and the implication of changing the position of the KPK is that the functions and authorities of the KPK also change, thus eroding the functions and authorities of the KPK that existed before, coupled with the existence of a Supervisory Board, which is considered to further weaken its functions and authorities.

Abstract

The Constitutional Court’s Decision number 68/PUU-XX/2022 has sparked substantial debate among various societal factions. The controversy stems from the interpretation that the ruling potentially enables ministers to misuse their authority and exploit state resources for electoral advantages while running for President or Vice President, without necessitating resignation from their current position. This study seeks to discern the ramifications of the Constitutional Court's decision number 68/PUU-XX/2022 on the roles and authorities of ministers within a presidential government structure, and to scrutinize the decision from an Islamic law/siyasah perspective. This investigation adopts a descriptive qualitative approach, grounded in library research. The normative juridical methodology is employed, focusing on decision number 68/PUU-XX/2022. The study concludes that within the context of siyasah sharia, the decision could compel the nation’s leader (the President) to promulgate legal regulations that violate the principle of fairness between high-ranking and ordinary officials. However, the President risks being deemed unconstitutional if derivative regulations stemming from the decision are not enacted. Power abuse by state officials (ministers), partly driven by conflict of interest, is a critical concern. From the perspective of Islamic law/siyasah, the decision’s implications could potentially harm society and the government.

While partially the product quality and price variables also have a significant effect on purchasing decisions. It is known that the product quality variable has a value of Tcount = 3.052 > Ttable = 1.674 with a significance value of 0.04 ˂ 0.1 Then H1 is accepted and H0 is rejected, meaning that there is a partial influence between the product quality variable (X1) on the purchase decision variable (Y). while the price variable has a Tcount = 4,449 > Ttable 1.674 with a significance value (˂0.01) less than 0.1. So it can be concluded that H1 is accepted and H0 is rejected, meaning that there is a partial influence between the price variable (X2) on the purchase decision (Y).

Abstract

Women taking on leading roles is a common occurrence in many parts of the world today. So, we need to know the rules of a group or organization led by a woman, as well as the rules of a very big country. This paper mostly talks about three things. The first is about the verses in the Qur'an and the sayings of the Prophet that, when looked at lafadz, show that women can't be in charge. This will be described in more detail. In the second discussion, a verse is given that scholars use to say that a woman can lead a group, organization, or state. This is followed by the scholars' interpretations of these verses, which can be used as evidence that a woman can be a leader. Then, in the last discussion, stories were told about women in charge, because this isn't a new thing. It's been happening since ancient times, which makes us sure and think that a woman can be in charge of an organization.
