Abstract

The Constitutional Court (Mahkamah Konstitusi) plays a crucial role in safeguarding the constitution and upholding the principles of constitutional democracy in Indonesia. However, its credibility and integrity have been seriously questioned following the issuance of Constitutional Court Decision No. 90/PUU-XXI/2023, which addresses the minimum age requirement for presidential and vice-presidential candidates. This ruling sparked widespread controversy due to its perceived political interests and alleged violations of judicial ethics by several justices, particularly Chief Justice Anwar Usman, who was found by the Constitutional Court’s Honorary Council (MKMK) to have breached impartiality due to a family conflict of interest involving one of the candidates favored by the decision. This study employs a normative legal research method using both statutory and conceptual approaches to critically analyze the role of judicial ethics in maintaining the independence of the Constitutional Court, and to evaluate the legal and sociological implications of ethical violations on the legitimacy and validity of the Court's decision. The analysis shows that while the ruling remains legally valid and binding in accordance with Article 24C of the 1945 Constitution and the Constitutional Court Law (UU MK), which affirms the final and binding nature of Constitutional Court decisions, its moral and social legitimacy is significantly undermined due to unethical practices that contradict the principles of integrity, transparency, and accountability. Ethical violations in the decision-making process not only tarnish the personal reputation of the justices involved but also erode public trust in the institutional independence of the Constitutional Court. In modern constitutional legal systems, procedural legality cannot be separated from constitutional morality. The continued function of the Constitutional Court as the protector of citizens' constitutional rights and the guardian of constitutional supremacy is heavily dependent on the legitimacy derived from public trust. Abstract

The legal profession of advocacy plays a crucial role within Indonesia’s legal system as a guardian of justice and protector of human rights. However, ethical violations, particularly document forgery, pose significant challenges that threaten the integrity of the profession. This study aims to analyze the regulation of the Advocate’s code of ethics concerning document forgery, the applicable sanctions, and the impact on the judicial system and public trust. Using a normative juridical approach, this research examines provisions from the Advocate Law, the Indonesian Advocate Code of Ethics (KEAI), and the Indonesian Criminal Code (KUHP). The findings reveal that advocates involved in document forgery may face criminal, ethical, and administrative sanctions. Such violations not only harm clients but also establish a negative precedent for the rule of law. Therefore, stricter oversight, consistent enforcement of sanctions, and the enhancement of ethical awareness among advocates are essential to maintain the profession’s integrity. Preventing and addressing ethical violations are critical steps in preserving public confidence in Indonesia’s legal system.

Abstract

Human rights are basic rights that every person is born with and cannot be revoked by anyone.  The case of Mario Dandy's severe persecution of David Ozora is a clear example of a violation of the right to life, the right to security, and the right to protection from violence guaranteed by the 1945 Constitution and Law No. 39/1999 on Human Rights.  To investigate the types of human rights violations that occurred and how the perspective of human rights law assesses these violations, this research uses a normative methodology, namely a literature study.  The results show that these acts not only violate national law but also violate international human rights.  The court's verdict against the perpetrators shows the importance of fair law enforcement and the equality of every citizen before the law.

Abstract

The rapid development of digital technology has had a significant impact on various sectors, including the legal world. The digital era has given rise to various new challenges for law enforcers, especially related to violations of the code of ethics and professional responsibility. This study aims to examine the ethical dilemma and responsibility of the legal profession in dealing with violations of the code of ethics by law enforcers in the digital era. This study uses a qualitative approach by analyzing various cases of violations of the code of ethics involving law enforcers, as well as their impact on the credibility and integrity of the legal profession in society. The results of the study indicate that the digital era exacerbates the spread of inaccurate information and often worsens the image of the legal profession. Enforcement of the code of ethics of the legal profession requires adaptation to technological developments and the implementation of stricter supervision. This study also highlights the importance of the role of supervisory institutions and professional education in strengthening commitment to the ethics of the legal profession in the digital era. It is hoped that the findings of this study can provide insight into the development of legal profession policies and practices that are more responsive to changes in the times.

Abstract

This article aims to examine the ethical and juridical aspects of the neutrality stance taken by the Vice Regent of Garut, Luthfianisa Putri Karlina, in response to the sweeping actions conducted by the Islamic Ummah Alliance (AUI) against eateries operating during the day in Ramadan 2025. The study analyzes the suitability of the Vice Regent's reprimand actions against the organization within the legal framework and principles of public official neutrality in Indonesia. Through a juridical-normative approach, the research identifies that despite the issuance of a Community Compliance Decree by Forkopimda and MUI of Garut Regency, the decree is merely advisory and lacks the binding legal force of a regional regulation. The findings show that the Vice Regent's actions in reprimanding the religious organization were carried out in accordance with the authority outlined in Garut Regent Regulation Number 202 A of 2009 and align with the principles of due process of law and interfaith tolerance values. The study highlights the importance of balancing the enforcement of religious norms and protecting citizens' rights to engage in economic activities, particularly in multicultural societies. This case underscores the dilemma faced by public officials in addressing demands from majority groups while upholding good governance principles. The research reveals that the Vice Regent's firmness in condemning intimidation strengthens the government's legitimacy as a protector of diversity and guarantor of social order and justice. The findings contribute to developing an ethical decision-making model for public officials facing socio-religious pressures in regional governance and enrich understanding of the boundaries of public officials' authority in maintaining neutrality, legal interests, and socio-religious dynamics.

Abstract

Human rights (HAM) guarantee protection and justice for every individual, including in organizing sporting events. Although regulated in national and international regulations, human rights violations still often occur, especially in excessive crowd control. The Kanjuruhan tragedy on October 1, 2022 is clear evidence of this negligence. The incident caused 135 fatalities and hundreds more were injured due to mass panic triggered by the use of tear gas in the stadium. This incident highlighted the weakness of the security system and the lack of protection for supporters. The actions of the authorities in the Kanjuruhan tragedy were considered excessive and violated FIFA regulations, especially the use of tear gas which actually worsened the situation. In response, the government formed an Independent Joint Fact-Finding Team (TGIPF) to investigate this incident and take action against those responsible. However, many consider that the verdict against the defendant does not reflect justice for the victims and their families. This tragedy is a bitter reminder of the weakness of security in stadiums, encouraging reform and improvement of regulations for the safety of spectators. This study emphasizes the importance of a more humane security policy, where security is not only effective but also respects human rights. Comprehensive reform and strong commitment to human rights protection are important steps to prevent similar incidents from happening again in the future.

Abstract

The Constitutional Court (MK) has an important role in maintaining the supremacy of the constitution and ensuring that policies and regulations are in accordance with constitutional principles. As an institution authorized to examine laws, decide disputes between state institutions, and resolve disputes over election results, the Constitutional Court is required to act independently and with integrity. Therefore, MK judges must uphold professional ethics and codes of conduct so that public trust in their decisions is maintained. However, there have been allegations of ethical violations by judges in several cases. The method used in the research is normative juridical with data sources derived from literature review, journals, and legal regulations. The approach applied includes a statutory approach and a case approach. Data collection techniques are carried out through primary data that refers to applicable positive laws, as well as secondary data obtained from journals and other sources. The results obtained in this study are that the supervision mechanism applied by MKMK is tiered and strict, starting from preliminary examination to in-depth investigation, while still upholding the principle of presumption of innocence. Then, the validity of the decision of the Constitutional Court (MK) legally remains valid even though there is a violation of the code of ethics by the judge, as seen in MK Decision Number 90/PUU-XXI/2023 concerning the age limit of presidential candidates.

Abstract

This study reviews the urgency of law enforcement and protection of human rights (HAM) for prisoners in correctional institutions, with a focus on the Class IIA Yogyakarta Narcotics Prison. Based on the 2022 Komnas HAM report, human rights violations were found in the form of torture and inhumane treatment of inmates. This study uses a normative legal approach by relying on secondary data from legal regulations, scientific literature, and investigative reports. The findings show that the correctional system still faces various serious problems related to human rights protection, such as a weak supervision system and the practice of abuse of power. This study recommends the implementation of the Optional Protocol to the Convention Against Torture (OPCAT), correctional policy reform, and officer training based on human rights values. This study is primarily intended to contribute to the development of a correctional institution that is safe, humane, and adheres to the principles of justice.

Abstract

The phenomenon of dynastic politics in Indonesia has become a major highlight in contemporary democratic discourse, especially when the involvement of families of public officials extends into the realm of judicial power. One case that has generated great controversy is the Constitutional Court Decision Number 90/PUU-XXI/2023, which paved the way for Gibran Rakabuming Raka the son of President Joko Widodo to run in a national political contest. The decision was colored by a conflict of interest following the involvement of the Chief Justice of the Constitutional Court, Anwar Usman, who has a direct kinship with the party benefiting from the decision. This situation raises serious questions about the integrity of the judiciary, the neutrality of judges, and the effectiveness of the legal profession's code of ethics in safeguarding democratic principles and the rule of law. Using a normative juridical approach and a case approach, this analysis focuses on relevant legislation and court decisions, to unravel the extent to which Indonesia's legal mechanisms are able to prevent and crack down on the practice of nepotism in constitutional institutions. Violation of the principle of nemo judex in causa sua (not to hear cases involving personal interests) is the main highlight in seeing the fragility of the pillars of democracy due to the dominance of family interests and patronage politics. In this context, strengthening the code of ethics, the role of the Honorary Council of the Constitutional Court, and revitalizing the basic principles of justice such as independence, impartiality and accountability are absolute prerequisites in maintaining public confidence in the constitutional justice system in Indonesia.
